RESOLUTION NO. 5775 CITY OF MOUNDS VIE\V COUNTY OF RAMSEY STATE OF MINNESOT A RESOLUTION REAPPROVING A PRELLVIINARY PLAT FOR THE MERMAID ADDITION MAJOR SUBDIVISION; MOUNDS VIEW PLANNING CASE NO. MA02-001 WHEREAS, Daniel Hall, President of The Mermaid. applied for approval of a preliminary plat to expand the existing Mermaid project area by adding the adjoining fonner Rent-All property, the south 361 feet of the Mounds View Business Park South property, and the fOffi1er Music Off T en property; and, WHEREAS. the properties included within this proposed plat are legally described in Exhibit A. herein attached; and. WHEREAS. the area of the proposed "MERMAID ADDITIO-';" is 9.36 acres; and, WHEREAS. on Novcmber 13.2000, the City Council originally approved the preliminary plat; and, WHEREAS. on May 13, 2001, the preliminary plat approval cxpired because the final plat was not submitted within the required six-month period after preliminary plat approval, in accordance with Section 1202.()7, Subd. 1; and, WHEREAS. on August 27, 2001, the City Council adopted Resolution 5607 which re- approved the preliminary plat; and, WHEREAS, on February 27,2002, the approval of the preliminary plat once again expired because the final plat was not submitted within the required six-month period; and, WH EREAS, on April 25, 2002, Mr. Hall reapplied for approval of the preliminary plat of the AIERAfAID ADDITION major subdivision, date-stamped May 14, 2002; and, WHEREAS, the City Council has rcviewed the following documents relative to this proposal: . . . Resolution 5775 Page 2 1. Planning Application Preliminary Plat. date-stamped May 14,2002 (separate attachment) 3. Staff Report. 4. Planning Commission Resolution 698-02 ., WHEREAS, the preliminary plat is consistent with the Mermaid Planned Unit Development plans and documents, which werc approved by thc City Council on Octobcr 10, 2000; and, WHEREAS, no additional park dcdication fees are required with this reapproval as applicant has fully satisfied this obligation as a result of the requirements contained in City Council Rcsolution 5607. NOW. THEREFORE BE IT RESOLVED, the Mounds View City Council does hereby reapprovc the preliminary plat for the Mermaid Addition major subdivision.
