RESOLUTION NO. 5825 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION APPROVING A DEVELOPMENT REVIEW FOR A PARKING LOT EXPANSION FOR THE JAKE'S SPORTS CAFE LOCATED AT 2400 COUNTY ROAD 10; PLANNING CASE DE02-005 WHEREAS, the applicants, Tony Jacob and Rob Jacob (the "Jacobs"), owners of Jake's Sports Cafe, located at 2400 County Road 10, have applied for a development review to expand their parking lot onto the adjacent undeveloped lot addressed 2404 County Road 10; and WHEREAS, The undeveloped parcel, formerly associated with the Theater PUD, is legally described as follows: Lot 2, Block I Anthony Propertie.\' Addition Ramsey County, Afinnesota WHEREAS, the Mounds View City Council has reviewed the following documents regarding this proposal: 1. Planning Application 2. Zoning Map 3. Location Map 4. Site Plan (datc stamped 8/14/02) 5. Staff Report WHEREAS, on July 22,2002 the City Council adopted Resolution 5802 which approved the removal of the subject parcel from the Theater Planned Unit Development, re-establishing the thirty-foot setback to County Road H2; and, WHEREAS, as a condition of approving Resolution 5802, the Council required that the Jacobs make application for a development review for the parking expansion in accordance with Section 1006.06, Subdivision 2 of the Mounds View Municipal Code; and, WHEREAS, before development may proceed, the Planning Commission and City Council is required to review and approve all applications for development; and, WHEREAS, the Planning Commission considered the development review request at their meeting on August 21, 2002 and recommended approval of the development review subject to conditions articulated herein. . . . Resolution 5825 August 26, 2002 Page 2 NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council, finding that the submitted site plan satisfies City Code, recommends approval of a development review subject to the following conditions: I. The Site Plan shall be revised as follows: a. One additional handicap accessible space shall be identified with one being marked "Van Accessible" unless the accessible spaces satisfy Universal Parking Space Design guidelines. b. Garbage dumpster construction details shall be added to the site plan. c. The crushed landscape rock shall be replaced with wood mulch or chips. d. The dimension for the curb cut width shall be indicated and shall not exceed 32'. c. A notation that indicates continuous B-612 perimeter curb around the parking lot shall be added. f. A notation shall be added that indicates the existing fence to be relocated or replaced with a fence to match the existing privacy fences in the development. g. A notation shall be added that the decorative wrought iron fence shall not exceed 4 feet in height. ') The lighting plan shall be revised to show fixture details and pole height from grade. 3. A drainage and utility plan shall be submitted to the Director of Public Works for his review and approval. 4. If necessary, the Jacobs shall execute an easement document which would allow the City to install and maintain a public trailway along the southern boundary of the Jacobs' property. 5. The Jacobs shall enter into a development agreement with the City that sets forth all of the terms, conditions, requirements, agreements, guarantees and plans for the orderly development of the property. 6. The City Forester shall review any proposed landscaping and make suggestions as to specific species to be utilized.
