CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION DENYING A REZONING OF THE PROPERTY LOCATED AT 2925
COUNTY HIGHWAY 10 FROM R-1, SINGLE FAMILY RESIDENTIAL, TO R-3,
MEDIUM DENSITY RESIDENTIAL AND THE PROPRTY LOCATED AT 2901
COUNTY HIGHWAY 10 FROM B-3, HIGHWAY BUSINESS DISTRICT, TO R-3,
MEDIUM DENSITY RESIDENTIAL; PLANNING CASE NO. ZC02-004.
WHEREAS, the applicant, John Matthews, has applied to rezone the properties
located at 2925 County Highway 10 and 2901 County Highway 10, with property
identification numbers as follows:

WHEREAS, the city Council has reviewed the following documents regarding this
proposal:
1 Zoning Map
2 Location Map
3 Future Land Use Map
4 Planning Commission Resolution 706-02
5 Staff Report
WHEREAS, the Planning Commission held a public hearing regarding this
request on Wednesday, August 21, 2002; and,
WHEREAS, the City Council held a public hearing regarding this request on
Monday, September 23, 2002; and,
WHEREAS, according to the City Code, the City Council is to consider the
possible adverse effects of the proposed rezoning and shall make a finding of fact
related to its review of the request; and,
NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council makes
the following findings regarding the possible adverse effects of this rezoning as required
by the Mounds View Zoning Code:
1. The Current zoning of the lots is R-1 , Single Family Residential and B-3,
Highway Business. The requested zoning of the lots is R-3, Medium Density
Residential.

2. According to the Comprehensive Plan, the parcels proposed to be rezoned are
designated Mixed-Use PUD on the Future Land Use map.
3. The minimum land area required for a PUD is three (3) acres. The subject
properties total approximately 2.3 acres.
4. The surrounding area located along Highway 10 between Groveland Road and
Fairchild Avenue are also designated as PUD on the Future Land Use Map.
Without the subject properties, the remaining area to the west and the area to
the east would not consist of the minimum area required of three (3) acres for
the PUD designation, thus preventing these areas from being rezoned to PUD in
the future.
NOW, THEREFORE, BE IT FURTHER RESOLVED, based upon the above
findings of fact, the information and documents regarding the rezoning proposal, the
report drafted by staff and the testimony of the applicant, the recommendation of the
Planning Commission, and in consideration of the public testimony given at the public
hearing, the City Council does hereby deny the rezoning request made by John
Matthews.
Adopted this 23rd day of September, 2002.
