The minimum land area required for a PUD is three (3) acres. The subject properties total approximately 2.3 acres. 4. The surrounding area located along Highway 10 between Groveland Road and Fairchild Avenue are also designated as PUD on the Future Land Use Map. Without the subject properties, the remaining area to the west and the area to the east would not consist of the minimum area required of three (3) acres for the PUD designation, thus preventing these areas from being rezoned to PUD in the future. NOW, THEREFORE, BE IT FURTHER RESOLVED, based upon the above findings of fact, the information and documents regarding the rezoning proposal, the report drafted by staff and the testimony of the applicant, the recommendation of the Planning Commission, and in consideration of the public testimony given at the public hearing, the City Council does hereby deny the rezoning request made by John Matthews.
