RESOLUTION NO. 5853 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A WETLAND BUFFER PERMIT TO CONSTRUCT A SINGLE FAMILY HOME AT 2824 WOODCREST DRIVE, REQUESTED BY PROPERTY OWNERS LORI FRASE AND KIMBERLY OLSON WHEREAS, Lori Frase and Kimberly Olson have requested approval ofa Wetland Buffer Penllit for property they own at 2824 Woodcrest Drive, property legally known as: Lot 106, Kllollwood Park, Ramsey COUllty, Millllesota WHEREAS, the 40,300 square foot lot is zoned R-1, Single Family Residential; and, WHEREAS, part of said property is located within one hundred feet of an identified wetland as shown on the attached Wetland Buffer Map labeled "Exhibit A"; and, WHEREAS, the City Council has found that wetlands within the City, as part of the ecosystem, are critical to the present and future health, safety and general welfare ofthe land, animals and people within the City, as well as within the Rice Creek Watershed District; and, WHEREAS, the City Council has in mind its statutory obligation to comply with Chapters 104, 105 and 112 of Minnesota State Law, the regulations of Rice Creek Watershed District, Regulations of the Department of Natural Resources, including provisions for protected waters, Public Law 92.500 (Federal Water Pollution Control Act), open space policies of the Metropolitan Council and its guidelines encouraging protection and enhancement of marshes, wetlands in the flood plain area and the public interest in preventing irreparable destruction or deterioration of valuable natural resources; and, WHEREAS, Section 1010.08 of the Municipal Code states that a Wetland Buffer Permit is required when any construction activities are planned within one-hundred feet of a wetland; and, WHEREAS, the applicants propose to construct a 2,410 square foot house and a connected 552 square foot two car garage on the site; and, WHEREAS, the proposed improvements, which total 2,962 square feet, fall completely within the wetland buffer; and, WHEREAS, no development activities or disturbances of any kind will occur within the wetland itself; and, WHEREAS, to approve a Wetland Bu1Ter Permit, the City Council shall find that the standards and requirements articulated in section 1010.08, Subdivision 4 of the City Code are satisfied. .~ tt . Resolution 5853 September 23, 2002 Page 2 NOW THEREFORE, BE IT RESOLVED, the Mounds View City Council makes the following findings of fact relating to this request: 1. The alteration within the buffer is the minimum necessary to allow for the replacement of the single-family home which was recently demolished to allow for the construction of a new house. 2. The flood storage capacity of the wetland would not be impacted by the reconstruction of a home and garage on this lot. 3. The proposed improvements would not reduce the existing water quality enhancement value ofthe wetland under conditions of ultimate development. 4. It is not anticipated that the improvements would reduce the existing wildlife habitat value of the wetland. 5. Very little vegetation would be disturbed by the construction of the improvements, as a home had been previously located at this same location. 6. The proposed improvements would not adversely affect the water flow characteristics of the wetland. 7. The stom1water runoff from the proposed improvements is anticipated to follow historic pattems, no changes are proposed. 8. While proposed stormwater runoff will exceed previous volumes, the increased volume would not pose an impact to the overall Spring Creek wetland basin. 9. The quality of the stormwater runoff generated by the improvements will remain unchanged from previous runoff. 10. No waste would be discharged into the runoff as a result of the proposed improvements. NOW, THEREFORE, BE IT FINALLY RESOLVED that the Mounds View City Council approves the Wetland Buffer Permit to construct a 2,410 square foot home and 552 square foot garage requested by Lori Frase and Kimberly Olson, contingent upon the following: 1. Only clean fill, free of chemical pollutants and contaminants, shall be brought onto the site. 2. No waste--solid, hazardous or otherwise--shall be allowed to enter directly or indirectly into the wetland. 3. Before a building permit can be issued, the builder/developer shall submit a detailed grading and site plan showing existing and proposed elevations of the site. 4. The minimum floor elevation of the home shall not be less than 889.4 feet. 5. Grading of the site shall not deviate from the approved plan without the express written consent of the Director of Public Works after review by the City Engineer. . . . Construction erosion control measures designed to limit soil loss from the development site (such as a silt fence) shall be installed and maintained during the duration of the construction, not to be removed until graded areas have been sodded or revegetated. 7. Before a building permit can be issued for this development, the builder or developer shall post a $1,000 letter of credit, bond or cash surety which would be forfeited in the event the builder/developer fails to conform to or comply with the provisions of this resolution of approval or development agreement.
