RESOLUTION NO. 5863
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING A DEVELOPMENT AGREEMENT WITH
MOUNDSVIEW BUSINESS PROPERTIES, LLC, FOR A COMMERCIAL
DEVELOPMENT AT 2214 COUNTY HIGHWAY 10
WHEREAS, the City Council approved Resolution 5847 on September 23,2002,
approving a Development Review for Moundsview Business Properties, LLC, for a
proposed commercial development located at 2214 County Highway 10; and,
WHEREAS, the development property is zoned B-3, Highway Business, and is
legally described as follows:
Herbst Enterprises
Lot 1, Block 1
Ramsey County, Minnesota
hereinafter referred to as the "Property;" and,
WHEREAS, Resolution 5847 stipulates that Moundsview Business Properties,
LLC enter into a Development Agreement with the City to ensure the orderly
development of the Property;
WHEREAS, the approved development will not involve the construction of any
public utilities or public improvements; and,
WHEREAS, the Development Agreement, attached as Exhibit A, in addition to
ensuring for the orderly development of the Property, requires that the Developer
consent to a trailway easement across the southerly ten feet of the property; and,
WHEREAS, the Development Agreement also requires that the Developer
reimburse the City for all third-party expenses incurred by the City in the processing of
the Development Review and Development Agreement.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council
approves the attached Development Agreement and authorizes the Mayor and the City
Administrator to sign the Agreement on the City's behalf.
