RESOLlJTION NO. 5312 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR A 980 SQUARE- FOOT, OVERSIZED GARAGE AT 8100 LONG LAKE ROAD; MOUNDS VIEW PLANNING CASE NO. 546-99 Whereas, Richard Maki has applicd for a conditional use permit to cxpand an existing 400 square-foot garage by an additional 580 square feet on property located at 8100 Long Lake Road, zoned R- I, Single Family Residential. legally described as followed: The East 133 Feet of the South 162 Feet of the NE Quarter of Section 6, Township 30, Range 23 RAMSEY COUNTY, MINNESOTA WHEREAS, there is currently a 400 square-foot garagc and an 80 square-foot shed on this lot; and, WHEREAS, The Mounds View Zoning Code allows, with a conditional use permit, up to 1,400 square feet of garagc/accessory building on one lot; and WHEREAS, the Mounds View City Council has reviewed the following documents regarding this proposal: a. Planning Application b. Zoning Map c. Site Plan d. Arca Map with Building Footprints WHEREAS, the Mounds View City Council finds th2t the dimensional requirements as stated in Chapter 1104 the Zoning Code for this proposal have bcen met; and, WHEREAS, the Mounds Vicw City Council makes the following findings that possible advcrse effects havc been considered in its decision, as required by Section 1125.01 Subd. I.e.: 1. Relationship with the Comprehensive Plan. 171e Comprehensive Plan encourages the development and maintenance ~fresidential areas so as to improve the qualiZ}J. appearance and attractiveness ~f housing units and residential property in general. The Comprehensive Plan designates this property, 8100 Long Lake Road. as low-density residential. This proposal does not C01?/!ict with the Comprehensive Plan. 2,4. The Geographical Area Involvcd & the Character of the Surrounding Area. . . . Adost of the homes in the immediate area are of the same si=e and age. many of which having garages as large or larger than that of8100 Long Lake Road. Afore than half of the garages in the area are aI/ached to the principal structure. A larger garage on the subject property would not appear out (~fplace. 3. Whether such use \viII tend to or actually depreciate the area in which it is proposed. Increasing the size of the existing garage lvill have ([/1 immediate positive impact on the property value for the su~ject property, and m(~v actual(v increase the perceived values qf the homes surrounding 8100 Long Lake Road in that vehicles which were once parked or stored outside would be stored inside the garage addition. It is not conceivahle that this garage addition would depreciate the surrounding area in any wczv. 5. The demonstrated need for such a lIse. The existing garage is too smal/ fin' the need\' (?lthe proper~v O1l'ner. 717e applicant desires a large enough garage to park his vehicles il/side, protectedfi'om the elements and possible vandalism. WHEREAS, the Mounds View City Council makes the Following findings regarding the criteria for approval ofa conditional use permit, as required by Section 1125.0] Subd.3.b.: 1. The use will not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. The use will not cause traffic hazards or congestion. Adequatc utilities, access roads, drainage and necessary facilities have been or will be provided. 7. 8. Adding an addition to the garage, even one as large as is being requeste(1, would not create a greater impact on existing public./llcilities, parks. schools or services, 011 utilities or access road\', nor would it create an increase intrt(ffic on ac!jacent streets. 2. The use will be sufficiently compatible or scparated by distance or screening from adjaccnt residentially zoned or used land so that existing homes will not be depreciated in value and there will be no deterrence to development of"vacant land. 3. The structure and site shall have an appcarance that will not have an adverse effect upon adjacent residential properties. Because this is a small lot, the expanded garage would have little visual screening. In terms l?f its relationship with the two ac!joining properties, the garage is separatedfi'om the proper()' to the north by another garage, so the expansion would have little impact upon that property. The property to the west would l/ot be separated b.v II/Ucll distance or any ph~vsical screening. 4. The use, in the opinion of the City Council, is reasonably rclated to the overall needs of the City and to the existing land use. The use is consistent with the purposes of the Zoning Codc and the purposes of the zoning district in which the applicant intends to locate the proposed use. The use is not in conflict with the Comprehensive Plan ofthe City. 5. 6. . . . NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council approves the conditional use permit requested for a 980 square-foot accessory building with the following stipulations: 1. The conditional usc permit shall be recorded with Ramsey County within 60 days of City Council approval, and a reccipt of such recording shall be provided to the City of Mounds Vicw. 2. The garage shall not be used for living space or other uses not allowed by the Zoning Code. Should the use change for which the permit was granted, the conditional use permit shall become null and void. 3. The garage addition shall be designcd and maintained to provide a uniform building appearance with the house. 4. The driveway leading to the garage expansion shall be improved with a permanent surfacing material of either concrete or asphalt in conjunction with the construction of the garage. If occupancy of thc garage is to occur prior to the driveway's improvement, thc applicant shall submit a letter of credit or performance bond in an amount cquivalent to the valuation of the work yet to be completed, as estimated by the Community Dcvelopment Director. 5. All vehicles parked at the prope11y shall be parked either upon the driveway's improved surface or within the garagc. At no time shall a vehicle be allowcd to park upon the grass or off of the improved surface. 6. The existing shed on the lot shall bc movcd if necessary to maintain a minimum six-foot sctback from the garage. 7.
