CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR AN ASSISTED
LIVING SENIOR RESIDENTIAL FACILITY TO BE LOCATED AT 2670 COUNTY
ROAD I; PLANNING CASE NO. 559-99.
WHEREAS, MSP Real Estate has applied for a conditional use permit to allow for an
assisted living senior residential facility at 2670 County Road I; and,
WHEREAS, the subject property is zoned B-2, Limited Business Commercial and is
legally described as follows:

WHEREAS, the Mounds View City Council has reviewed the following documents
regarding this proposal:
a. Planning Application
b. Zoning Map
c. Location Map
d. Site Plan
e. Staff Report
f. Staff Parking Analysis Memo, dated 8/3/99
g. Letter from M & E Realty, Property Owner, dated 5/24/99
h. Comprehensive Plan Land Use Map

WHEREAS, such a facility is a permitted conditional use within the R-4, High Density
residential zoning district; and,
WHEREAS, the Mounds View City Council adopted Ordinance 631 on September 13,
1999, an ordinance which rezoned the subject property from B-2, Limited Business Commercial,
to R-4, High Density Residential; and,
WHEREAS, The Mounds View City Council has considered the specific criteria for assisted
living facilities as they appear in Section 1109.04, Subdivision 2 and find that they are met; and,
WHEREAS, the Mounds View City Council has considered the following provisions from
Section 1125.01 (l)e of the Zoning Code regarding possible adverse effects of the proposed use:
(1) Relationship to Municipal Comprchcnsive Plan.
(2) The gcographical area involved.
(3) Whethcr such use will tend to or actually depreciate thc area in which it is proposed.
(4) The charactcr ofthc surrounding area.
(5) The dcmonstrated necd for such use,
and makes the following findings concerning same:
The Comprehensive Plan designates this site as Mixed Use PUD, which would be consistent
with the proposed R-4 zoning of this site. Such a facility would help meet the housing needs
ofa particular segment of the community. The property is located between commercial sites
to the north and a high density residential development and park to the south. The proposed
use would act as a buffer between the existing land uses. The proposed style and architectural
design of the proposed facility would blend into and add character to this area.
WHEREAS, The Mounds View City Council makes the following findings that the general
criteria for CUP approval in Subdivision 1125.01 (2) have been met:
(1) The use will not crcatc an cxcessive burdcn on existing parks, schools, strccts and other public
facilities and utili tics which serve or are proposcd to serve the arca.
It is not expected that this use will have any impact OJl parks, schools, streets and other
public facilities and utilities lvhich serve or are proposed to serve the area.
(2) The use will be sufficicntly compatible or separated by distance or scrccning from adjacent
residentially zoned or used land so that cxisting homes will not bc depreciated in value and thcre will be
no deterrence to dcvelopmcnt of vacant land.
This development, while not ahutting any residential property, would he sufficiently
compatihle with the existing land uses and would not cause any foreseeable depreciation in
neighboring property values.

(3) The structure and site shall havc an appearance that will not have an adverse effect upon adjacent
residcntial properties.
The architectural renderings presented to the Planning Commission and public show a well
desiJ.,Tlled and aesthetically pleasing building.
(4) Thc usc, in the opinion of the City COlUlCil, is reasonably relatcd to the overall needs ofthc City and
to thc cxisting land usc.
The demand for assisted living facilities such as the one proposed is growing to
accommodate an aging population,
(5) The use is consistcnt with thc purposes of the Zoning Code and thc purposcs of the zoning district
in which the applicant intends to locatc thc proposed use.
The use would be consistent lvith the R-.:/ zoning district, which allows for assisted living
facilities with a conditional use permit.
(6) Thc usc is not in conflict with thc Comprehensivc Plan of the City.
The Comprehensive Plan designates this area of the City as Mixed Use Planned Unit
Development, which indicates WI anticipation for a variety of uses. An assisted living
facility would be consistent with this designation and would also address a goal to offer a
wide range of housing alternatives to a variety of population segments.
(7) The use \vill not cause traffic hazards or congestion.
It is not expected that this IIse would create or generate substantial levels of traffic. As sllch,
it would not be expected that this IIse .would cause traffic hazards or congestion.
(8) Adequate utilities, access roads, drainage and necessary facilities have been or will be
provided.

infi"astructure will he needed to accommodate thi.\' lIse.
NOW THEREFORE BE IT RESOLVED that the Mounds View City Council does
hereby approve a Conditional Use Permit for an assisted living senior residential facility at 2670
County Road I as requested by MSP Real Estate, with the following stipulations:
1.
The applicant shall record the conditional use permit with Ramsey County within 60
days of City Council approval and provide proof of such recordation to the City or
this permit shall become null and void.

2. The applicant shall apply for and receive approval of a development review for this
use, submitting the appropriate fee and submittal materials to the Director of
Community Development.
3. The use shall be allowed to display facility identification signage as reviewed by
the Planning Commission and approved by the City Council within the
development review process, in an amount not to exceed 32 square feet, not
including any incidental or directional signage as allowed by Code.
4. All State laws and statutes governing such uses shall be strictly adhered to and all
required permits for operation shall be obtained and maintained.
5. The facility shall be secured at all times to protect the health and safety of the
facility residents.
6. The use will be subject to parking requirements equivalent to one stall per every
three beds or fractions thereof and one stall per every employee on that shift having
the most personnel present.
Adopted this 13th day of September, 1999.
