RESOLUTION AMENDING AND RESTATING RESOLUTION 4532,
AN ENABLING RESOLUTION ESTABLISHING THE MOUNDS VIEW
ECONOMIC DEVELOPMENT AUTHORITY UNDER MINNESOTA
STATUTES, SECTIONS 469.090 THROUGH 469.108
WHEREAS, the City of Mounds View (the "City") is a municipal corporation,
organized and existing under the laws of Minnesota; and
WHEREAS, the Mounds View Economic Development Authority("EDA") is a public
body corporate and politic under the laws of Minnesota; and
WHEREAS, the EDA was established by the City in Resolution No. 4532, an
enabling resolution adopted on March 28, 1994 (the "Enabling Resolution"); and
WHEREAS, the EDA and City now desire to modify the Enabling Resolution
pursuant to Minnesota Statutes, Section 469.093, subdivision 2; and
WHEREAS, the EDA and the City desire to grant the EDA pursuant to Minnesota
Statutes, Section 469.091, subdivision 1, specific authority to exercise all powers granted
to a Housing and Redevelopment Authority under Minnesota Statutes, Sections 469.001 to
469.047; and
WHEREAS, the City has conducted a public hearing on this Resolution and has
provided written notice of the public hearing in a newspaper of general circulation within the
City once a week for two consecutive weeks prior to the public hearing, the first date of
which did not occur more than 30 days prior to the public hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council (the "Council") of the
City of Mounds View, Minnesota as follows:
1. Recitals. The City is authorized pursuant to Minnesota Statutes, Sections
469.090 through 469.108 (the "Economic Development Authority Act"), to establish an
economic development authority for the City, and the Council desires to do so in order to
promote the economic, commercial, housing and industrial development and
redevelopment of the City and in order to consolidate the activities heretofore undertaken
by or on behalf of the City in those areas. The City has caused notice of a public hearing
on the establishment by the City of an economic development authority to be published in
a newspaper of general circulation in the City once each week for two consecutive weeks,
and pursuant to such notice, a public hearing on said question has been held by the City
on the date hereof, at which hearing all persons desiring to present their oral or written
comments on this proposal were given an opportunity to do so.

2. Establishment of Economic Development Authority. Pursuant to the
Economic Development Authority Act, the Council hereby establishes an economic
development authority for the City, to be known as the Mounds View Economic
Development Authority (the "EDA"). The EDA shall be governed by a board of
commissioners thereof consisting of the five members of the Council, and the term of each
such commissioner of the EDA shall coincide with that commissioner's membership on the
City Council.
3. Powers. The EDA shall have all powers given to an economic development
authority pursuant to the Economic Development Authority Act, and pursuant to Minnesota
Statutes, Section 469.091, subdivision 1, the specific authority to exercise all the powers
contained in Minnesota Statutes, Sections 469.090 to 469.108 and all the powers granted
to a Housing and Redevelopment Authority pursuant to Minnesota Statutes, Sections
469.001 to 469.047 or other law, [and of a city under Minnesota Statutes, Sections 469.124
to 469.133 or other law], as the same may be amended or supplemented.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Mayor and City
Administrator are hereby authorized and directed to execute all appropriate documents to
effectuate the actions contemplated by this Resolution after review and approval by the
City Attorney.
NOW, THEREFORE, BE IT FINALLY RESOLVED that the Mayor and City
Administrator, staff and consultants are hereby authorized and directed to take any and all
additional steps and actions necessary or convenient in order to accomplish the intent of
this Resolution.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN, that the City Council of the City of Mounds View will meet on
Monday, November 23, 2015, at 7:00 p.m., or as soon as possible thereafter, in the Council
Chambers at City Hall,2401 County Road 10,Mounds View,Minnesota 55112,to conduct a public
hearing on the question of modifying the enabling resolution for the Mounds View Economic
Development Authority(EDA)pursuant to Minnesota Statutes, Chapter 469.
On March 28, 1994, the City Council adopted the enabling resolution, Resolution No. 4532,
establishing the EDA. The original purpose of the EDA was to coordinate certain economic
development activities for the City. The Council proposes to revise provisions in the enabling
resolution to grant the EDA,pursuant to Minnesota Statutes,Section 469.091,subdivision 1,specific
authority to exercise all powers granted to a housing and redevelopment authority under Minnesota
Statutes,Sections 469.001 to 469.047,or other law,and of a city under Minnesota Statutes,Sections
469.124 to 469.133, or other law.
Any person wishing to express a view regarding the modifications to the enabling resolution will be
heard orally or in writing at the public hearing. At the conclusion of the hearing,or any adjournment
thereof, the City Council will take whatever action it deems necessary with regard to the enabling
resolution. A copy of the full text of the modification of the enabling resolution is on file for public
inspection in the office of the City of Mounds View at City Hall during normal business hours.
