CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING A DEVELOPMENT REVIEW AND CONDITIONAL USE
PERMIT FOR MIDWEST MOTOR EXPRESS, 2169 MUSTANG DRIVE;
MOUNDS VIEW PLANNING CASES CU2006-005 AND DE2006-002
WHEREAS, The applicant, Midwest Motor Express, has applied for a development
review to construct a 10,500 square foot single story expansion; and,
WHEREAS, Midwest Motor Express is located at 2169 Mustang Drive, property zoned
Industrial; and,
WHEREAS, the subject parcel is legally described as:
ALL THAT PART OF LOT 3 BLOCK 1, MOUNDS VIEW INDUSTRIAL PARK, OVERLYING
THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF SECTION 17,
TOWNSHIP 30, RANGE 23, WHICH LIES EASTERLY OF A LINE DRAWN PARALLEL
WITH AND 113 FEET WESTERLY OF THE EAST LINE OF SAID SOUTHWEST QUARTER
OF THE NORTHEAST QUARTER; AND THAT PART OF LOT 3, BLOCK 1, MOUNDS VIEW
INDUSTRIAL PARK, LYING EAST OF THE WEST LINE OF THE SOUTHEAST QUARTER
OF THE NORTHEAST QUARTER OF SECTION 17, TOWNSHIP 30, RANGE 23, RAMSEY
COUNTY, MINNESOTA; and,
WHEREAS, Chapter 1006 of the Mounds View City Code requires all new commercial
and industrial development to be reviewed by the Planning Commission and City Council for
consistency with all codes, regulations and requirements; and,
WHEREAS, the Mounds View City Council has held a public hearing on June 26, 2006
and reviewed the following information:
1. Planning Application
2. Site Plan
3. Zoning Map
4. Comprehensive Plan Future Land Use Map
5. Aerial View
6. Photographic Documentation
. WHEREAS, in the course of reviewing the documents associated with this property, it
was determined that Midwest Motor Express was operating without a conditional use permit,
a requirement for motor freight terminals located in an industrial zoned district; and,
WHEREAS, the Mounds View Planning Commission held a public hearing on June 7,
2006 and approved Resolutions 837-06 and 838-06 which recommended approval of the
conditional use permit and development review subject to certain stipulations contained
therein; and,
NOW, THEREFORE, BE IT RESOLVED, as required by Section 1125.01 of the
Mounds View Zoning Code, the Mounds View City Council makes the following findings of
fact related to the development review and conditional use permit request:
1. The Midwest Motor Express property is zoned I-1, industrial, within which motor
freight terminals are conditionally allowed.
2. The request is consistent with the Mounds View Comprehensive Plan in that the
Comprehensive Plan encourages business to remain and grow in Mounds
View.
3. The applicant has sufficiently demonstrated that a need exists for the proposed
expansion.
• 4. Permitting the expansion would not depreciate the neighborhood nor will it
cause additional traffic or affect neighboring properties.
5. The setback and zoning requirements as indicated in Sections 1104.02 and
1106.04 of the Mounds View Zoning Code are satisfied with this expansion..
6. The parking requirements are adequately satisfied and no additional parking will
be required with the expansion.
NOW, THEREFORE, BE IT FINALLY RESOLVED, the Mounds View City Council,
has reviewed the request fora 10,500 square foot addition of dock and warehouse space to
the existing Midwest Motor Express building, and based upon the above-stated findings of
fact, does hereby approve the development review and conditional use permit requests for
Midwest Motor Express, located at 2169 Mustang Drive, subject to the following conditions:
1. All disturbed areas shall be restored with sod or asphalt no later than 60 days
beyond issuance of the Certificate of Occupancy, weather permitting.
2. The. applicant shall provide proof of obtaining a permit from Rice Creek
Watershed District if a permit is so required.
• 3. The development plans must be approved by the Public Works Director in
regards to stormwatei- drainage, prior to a building permit being issued.
