RESOLUTION NO. 6893 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION DENYING A VARIANCE FORA 45-FOOT TALL BILLBOARD AT <br />2200 COUNTY ROAD 10, PLANNING CASE VR2006-004 <br />WHEREAS, Clear Channel Outdoor has requested approval of a variance to exceed <br />the maximum sign height by ten feet for a billboard to be located at 2200 County Road 10, <br />the site of the Mermaid Entertainment Center and Americlnn Hotel; and, <br />WHEREAS, the Mermaid site is zoned Planned Unit Development (PUD) and is <br />legally described as follows: <br />WHEREAS, The City of Mounds View has adopted Ordinance 769 which amended <br />the City Code to permit billboards as an interim use on properties adjacent to the south <br />side of County Road 10 south of its intersection with Woodale Drive; and, <br />WHEREAS, the Mounds View City Council held aduly-noticed public hearing on <br />July 24, 2006; and, <br />WHEREAS, the Chapter 1125 of the Zoning Code establishes the review criteria <br />against which all variance applications shall be judged and satisfied for a variance to be <br />granted; and, <br />WHEREAS, the Mounds View Planning Commission, after a duly noticed public <br />hearing, denied the requested variance due to the lack of demonstrated hardship <br />associated with the request; and, <br />WHEREAS, Clear Channel Outdoor has appealed the Planning Commission's <br />denial of the requested variance to the City Council for reconsideration. <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council makes <br />the following findings of fact relating to the Clear Channel Outdoor application for a <br />variance to exceed by ten feet the maximum established height provision for a billboard on <br />County Road 10: <br />1. Exceptional or extraordinary circumstances do not apply to this property which <br />would warrant approval of the requested variance. There are .other potential <br />locations within the County Road 10 corridor at which a billboard could <br />potentially be sited without the need for a height variance. <br />• 2. The literal interpretation of the provisions of the Zoning Code would not deprive <br />the Applicant the ability to site a billboard within the County Road 10 corridor. <br />
