RESOLUTION AFFIRMING CHARGES ASSOCLATED WITH
ABATE117ENT OF VIOLATIONS AT 5300-02 RAYMOND AVENUE MOUNDS VIEW,

WHEREAS, on June 16, 2006, staff inspected the property located at 5300-02 Raymond
Avenue in response to a complaint regarding a large accumulation of garbage on the exterior of
the property
WHEREAS, on June 16, 2006 staff observed a large accumulation of household garbage,
rotting food, and other debris on the exterior or the property near the curbside.
WHEREAS, the accumulation of household garbage, rotting food, and other debris
constituted an immediate threat to the public health and safety.
WHEREAS, Mounds View code of ordinances Section 607.09 Subdivision 6 authorizes
for abating a public nuisance when there is an immediate threat to the public health or safety; and
WHEREAS, staff ordered an summary abatement at 5300-02 Raymond Avenue on June
• 16, 2006 and city staff removed said accumulations of household garbage, rotting food, and other
debris from the exterior of the premises and disposed of in an approved manner; and
WHEREAS, the City Council finds that the accumulation of 5300-02 Raymond Avenue
on June 16, 2006 constituted an immediate threat to the public health or safety; and
WHEREAS, on June 30, 2006 staff mailed a notice to the taxpayer of 5300-02 Raymond
Avenue with an invoice due payable within 30 days for the cost of said abatement.
WHEREAS, staff received a letter from the taxpayer of record, Mr. Anthony Osuji, indicating a
desire to appeal the charges of the summary abatement; and
WHEREAS, in a letter to Mr. Anthony Osuji and the new taxpayer of record, Irene
Wisseh, dated August 4, 2006, staff notified both parties of their opportunity to be heard before
the council on. August 28, 2006; and
WHEREAS, the City has complied with the notification requirement for abatement as
stated in Section 607.09, Subdivision 6d. of the Mounds View Municipal Code; and

I'JOW THEREFORE, BE IT RESOLVED THAT:
The City Council affirms the Summary Abatement cost of $435.16.
The current taxpayer of record of 5300-02 Raymond Avenue shall be personally liable to
the City for the costs of such abatement, including administrative costs pursuant to
Section 607.09 Subdivision 7 of the Mounds View Municipal Code.

2. If the taxpayer of record fails to pay the cost of the summary abatement of at 5300-02
Raymond Avenue within 30 days, the City shall, after duly notifying the taxpayer of
record, certify the unpaid costs against the property pursuant to Section 607.09,
Subdivision 8. of the Mounds View Municipal Code and Minnesota Statute 429.101.
