HomeMy WebLinkAboutResolution 8506 RESOLUTION NO. 8506 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION REAPPROVING A CONDITIONAL USE PERMIT FOR FAC HOLDINGS, LLC, TO CONSTRUCT A 150-FOOT TELECOMMUNICATIONS TOWER AT 4860 MUSTANG CIRCLE; PLANNING CASE NO. CU2014-001 WHEREAS, the property owner, FAC Holdings, LLC, has applied for a reapproval of a conditional use permit to construct a 150-foot telecommunications tower on its property; and, WHEREAS, the subject property, located at 4860 Mustang Circle, is zoned I-1, Industrial, and is legally described as follows: Lot 2 and Lot 3, Block 1, Mounds View Industrial Park No. 3, Ramsey County, Minnesota PIN: 17-30-23-13-0011 WHEREAS, the Mounds View Zoning Code conditionally allows telecommunication towers and antennae up to 150 feet in height in Industrial zoning districts; and, WHEREAS, the proposed telecommunications tower is not required to be registered with the Federal Communication Commission (FCC) or Federal Aviation Administration (FAA); and, WHEREAS, a duly-noted public hearing was held on Monday, February 8, 2016; and, WHEREAS, the City Council had previously approved the Conditional Use Permit for a 150-tall cell tower on the subject property on September 22, 2014; and, WHEREAS, due to circumstances beyond the applicant's control, the approved CUP had lapsed and applicant subsequently submitted a request dated January 12, 2016, requesting that the CUP be reapproved. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council has determined that the findings of fact articulated in Resolution 8304, the resolution which originally approved the CUP, remain applicable and shall be incorporated herein by reference. NOW, THEREFORE, BE IT FURTHER RESOLVED that the Mounds View City Council reapproves the conditional use permit for the telecommunications tower, with conditions as follows: Resolution 8506 Page 2 1. Access to the equipment shall be protected by a secure 8-foot chain link fence. 2. No advertising signage will be allowed attached to the pole or fencing. 3. The tower shall not exceed 150 feet in height or have any lighting. 4. The Conditional Use Permit(CUP) shall become null and void if the work for which the CUP was granted is not completed within one year from the date of reapproval unless a petition for extension of time in which to complete the work has been granted by the City Council. NOW THEREFORE, BE IT FINALLY RESOLVED that this Conditional Use Permit shall have no expiration date and shall remain in force so long as the conditions agreed upon herein are observed.
