CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
APPROVING AN AGREEMENT FOR MAINTENANCE AND EVP SYSTEM
AGREEMENT FOR THE TRAFFIC CONTROL SIGNALS AT COUNTY ROAD J
AND XYLITE STREET, AND COUNTY ROAD J AND CORAL SEA STREET
WHEREAS, as part of the County Road J Improvement Project,
two new traffic control signals will be added at the intersections of County Road J
and Xylite Street, and County Road J and Coral Sea Street; and
WHEREAS, with the installation of these signals, there will need to
be an agreement with Ramsey County, Anoka County, the City of Blaine, and the
City of Mounds View pertaining to the maintenance of these new signals; and
WHEREAS, Ramsey County has submitted two separate
agreements; Agreement No. PW2005-19 for the signal system located at County
Road J and Xylite Street, and Agreement No. PW2005-20 for the signal system
located at County Road J and Coral Sea Street; and
• WHEREAS, the language and assigned responsibilities contained.
within these agreement documents are consistent with other signal agreement
the City has executed with Ramsey County; and
WHEREAS, the City of Blaine and the City of Mounds View will
equally share costs and maintenance responsibilities that are typically assigned
to the City in which the signal is located; and
WHEREAS, the City's legal counsel has reviewed these draft
agreements and found them to be fairly straight forward regarding the provisions
relating to who is responsible #or the maintenance and cost of the light and EVP
system; and
WHEREAS, the City's legal counsel did have some issues and
questions pertaining the indemnification wording in the agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Mounds View, Ramsey County, Minnesota as follows:
1. Traffic Control Signal Maintenance Agreement and EVP System
Agreement No. PW2005-19 and Agreement No. PW2005-20 with
Ramsey County, Anoka County, and the City of Blaine are hereby
approved pending approval by the City's legal counsel.

2. The Mayor and City Administrator are hereby au#horized to execute
Agreement No. PW2005-19 and Agreement No. PW2005-20 with
Ramsey County, Anoka County, and the City of Blaine pending
approval by the City's legal counse{.
