A RESOLUTION APPROVING A WETLAND ALTERATION PERMIT
TO CONDUCT TREE REMOVAL ACTIVITY ON LOT 4, BLOCK 1, MUELLER
ADDITION, REQUESTED BY EICHI, INC.;
PLANNING CASE NO. WA07-001.
WHEREAS, Martin Harstad, representing the owner EICHI, Inc., has requested a
w tland alteration permit to allow for the removal of trees from property legally described as
L t 4, Block 1, Mueller Addition, commonly referred to as the "Longview Estates" parcel;

WHEREAS, the Longview Estates tract of land is located within a wetland zoning
district and is subject to the provisions and regulations articulated in Chapter 1010 of the
Mounds View Municipal Code; and,
WHEREAS, tree removal activity is defined as "development" under Section 1010.05
of the Code and development within such districts is allowed by permit only; and,
. WHEREAS, the City Council has found that wetlands within the City, as part of the
ecosystem, are critical to the present and future health, safety and general welfare of the
land, animals and people within the City, as well as within the Rice Creek Watershed
District; and,
WHEREAS, the City Council has in mind its statutory obligation to comply with
Chapters 104, 105 and 112 of Minnesota State Law, the regulations of Rice Creek
Watershed District, Regulations of the Department of Natural Resources, including
provisions for protected waters, Public Law 92.500 (Federal Water Pollution Control Act),
open space policies of the Metropolitan Council and its guidelines encouraging protection
and enhancement of marshes, wetlands in the flood plain area and the public interest in
preventing irreparable destruction or deterioration of valuable natural resources; and,
WHEREAS, the City Council has reviewed the following documents regarding this
proposal:

WHEREAS, the proposal satisfies all of the wetland alteration permit approval
criteria enumerated in Section 1010.08, Subdivisions 4 and 5.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council
approves the Wetland Alteration Permit requested by Martin Harstad for removal of trees
from the Longview Estates parcel, contingent upon the following:
1. The permit shall apply ONLY to the removal of trees; no grading activity, alteration
or other development shall be allowed except by separate permit or amendment
hereto reviewed and approved by the Mounds View City Council.
2. No waste, construction or otherwise, shall be allowed to enter into the wetland or
any adjoining areas.
3. If deemed necessary by Rice Creek Watershed District, a silt fence or other
erosion control measure shall be installed.
4. The removal of trees shall not impede or otherwise restrict the natural flow of
surface water and stormwater runoff on the site.
5. Work in the wetland shall not be allowed during the breeding season of water fowl or
fish spawning season.
