A RESOLUTION CREATING A SIX-MONTH MORATORIUM ON THE ISSUANCE
OF NEW OFF-SALE INTOXICATING LIQUOR LICENSES WITHIN THE CITY OF
MOUNDS VIEW AND DIRECTING THAT A STUDY BE CONDUCTED
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOUNDS VIEW AS
FOLLOWS:
Section 1. Background.
1.01. Chapters 501-502 of the City Code establishes licensing regulations related to
intoxicating liquors(the"Licensing Regulations"). The purposes of the Licensing Regulations are to:
(1) provide minimum guidelines for the issuance of off-sale liquor licenses; (2) minimize adverse
effects of off-sale liquor establishments; (3) avoid potential over filtration of off-sale liquor
establishments; and(4)maximize the use of remaining potential off-sale liquor licenses.
1.02.The City Council has approved licenses for several different off-sale liquor establishments
in the past, and many of those licensees are still operating pursuant to their license.
1.03. The City Council has determined that before any additional new off-sale liquor licenses
are approved,that a study is necessary to examine the code and determine if any adjustments should be
made to the code.
Section 2. Findings
2.01. The City Council finds that it is necessary to conduct a study to the off-sale liquor
regulations in the City Code and to make any adjustments that might be needed. The purpose of the
study will include,but is not limited to: (1)determining the number of off-sale liquor establishments
that may locate in the City; (2) analyzing the relationship between off-sale liquor stores and criminal
activity; (3) determining if any additional official controls should be used to regulate the sale of
intoxicating liquor; (4) determining whether there should be a minimum distance separation
requirement between off-sale liquor stores,and(5)determining in which zoning district such licensed
business may operate.
2.02. The City Council finds that there is a need to adopt a moratorium on the issuance of any
new off-sale liquor licenses while the study referenced in Section 2.01 of this Resolution is being
conducted.
Section 3. Off-Sale Liquor License Study; Moratorium
3.01.A study is authorized to be conducted by the City staff and the City Council in accordance
with Section 2.

3.02. Pending completion of the study and adoption of any amendments to the City's
Ordinances, a moratorium is established on the issuance of any new off-sale liquor licenses. The
moratorium established by this Resolution does not apply to:(1)any off-sale liquor license application
pending with the City as of the adoption date of this Resolution;or(2)the location of any existing off-
sale liquor establishment.
3.03. Except as otherwise provided for in this Resolution, during the period of the
moratorium,applications for any off-sale liquor license will not be accepted by the City nor shall the
City Council consider or grant approval of any such application.
3.04. The moratorium established by this Resolution shall not apply to any off-sale liquor
establishments that have obtained license approval by the City Council before the adoption of this
Resolution.
Section 4. Enforcement. The City may enforce this Resolution by mandamus, injunction or
other appropriate civil remedy in any court of competent jurisdiction.
Section 5. Term. Unless earlier repealed by the City Council,this Resolution shall remain in
effect for a period of Six Months,effective beginning May 15, 2016.
