COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING THE MEDTRONIC CRM WETLAND ALTERATION PERMlT; PLANNING CASE WA2005-002 WHEREAS, Medtronic, Inc., has submitted an application for a Wetland Alteration Permit to fill approximately 2.37 acres of wetland on the former Bridges Golf Course site associated with their Cardiac Rhythm Management office campus Planned Unit Development; and, WHEREAS, the area proposed to be filled represents 1.54 acres of degraded, low quality wetland and 0.83 acres of abandoned ditch trenching as illustrated in the attached Exhibit A; and, WHEREAS, the proposed mitigation areas as illustrated in Exhibit B satisfy all City, watershed and state requirements regarding wetland replacement; and, WHEREAS, the City Council has reviewed Chapter 1010 of the Mounds View Municipal Code pertaining to Wetland Alterations. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council makes the following findings of fact related to the proposed wetland alteration: 1. The impacted wetland area is the minimum required to facilitate a reasonable redevelopment of this site. 2. The proposed alteration will not decrease the flood storage capacity of the site but will instead increase capacity by a four to one ratio. 3. The proposed alteration will. not reduce the existing wildlife habitat value. Because of the mitigation efforts and ditch realignment, wildlife habitat should be enhanced. 4. Water flow characteristics will not be impacted by the alteration. The realigned ditch will provide enhanced water quality and greater capacity but will not impact upstream or downstream volume, according to the Rice Creek Watershed District 5. All runoff from the development will be pretreated and directed to infiltration basins before flowing out to the wetlands or the judicial ditch. 6. The storm water runoff from the site complies with the City's local water management plan as well as with Rice Creek's rate control requirements for this area. 7. There will be no degradation of the quality of the wetlands, water table or aquifers as confirmed by the Rice Creek Watershed. District engineers. 8. This site and the proposed development will be served by the municipa{ sanitary sewer system. No waste-solid, hazardous or otherwise-will enter any wetland. Resolution 6632 Page 2 • NOW, THEREFORE, BE IT FURTHER RESOLVED that the Mounds View City Council approves the Medtronic CRM Wetland Alteration Permit subject to the following conditions: 1. Erosion control measures and retention facilities shall be designed to limit soil loss from the development site to not more than five (5) tons per acre per year. Plans and supporting documentation for such measures and facilities shalt be provided to the City prior to commencement of construction. 2. Medtronic shall demonstrate that, after the development is completed, the conditions on the site will be stabilized such that the yearly soil loss from the site will nat be greater than five-tenths (0.5) ton per acre per year. 3. Sediment and soil loss shall be determined utilizing the Universal Soil Loss Equation as defined by the U.S. Department of Agriculture Soil Conservation Service Technical Field Guide, as amended from time to time, as provided for Ramsey Soil and Water Conservation District. 4. Only fill substantially free of chemical pollutants and wastes, as determined by the City, may be used. 5. The minimum building elevation shall be no less than as defined in the Lacal Water Management Plan. 6. No alteration shall be allowed which will endanger the health, safety or welfare of persons or which may result in unusual road maintenance costs or utility line breakages due to soil limitations, including high frost action. 7. Work in the wetland will not be performed during the breeding season of water fowl or fish spawning season. 8. Wetland alteration shall not occur without required permits issued from the Rice Creek Watershed District and any other agencies having jurisdiction.
