RESOLUTION APPROVING A DEVELOPMENT REVIEW FOR AN 8,300 SQUARE FOOT
SINGLE STORY MULTI-TENANT OFFICE BUILDING
MOUNDS VIEW PLANNING CASE DE2005-003
WHEREAS, Dr. Greg Belting, owner of Silverview Chiropractic currently located at 2552
County Road 10, has an agreement to purchase the lot located at 2395 County Road 10 (the
vacant lot behind Walgreens) upon which he intends to construct an 8,300 square foot single
story multi-tenant office building; and,
WHEREAS, the lot in question is zoned PUD which was recently amended to include
"Office Uses" as those uses allowable on the subject parcel; and,
• WHEREAS, the subject parcel is legally described as Lot 2, Block 2; Mounds View City
Hall Addition; and,
WHEREAS, Chapter 1006 of the Mounds View City Code requires all new commercial
development to be reviewed by the Planning Commission for consistency will al! codes,
regulations and requirements; and,
WHEREAS, the Mounds View Planning Commission supported the request by adopting
Resolution 817-05 which recommends. approval of the development review.
WHEREAS, the City Council has reviewed the following documents relative to this
request:
1. Planning Application
2. Zoning Map
3. Walgreens PUD Document
4. Site, Grading, Drainage and Utility Plans
5. Building Elevations and Floor Plans
6. Lighting Plan
7. Staff Report
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council approves
the development review of 2395 County Road 10 subject to the following conditions:

1. The applicant shall execute a cross access, joint parking and maintenance agreement
with the owner of the Walgreens site and provide a copy of said document to the City for
its records.
2. Building design and construction shall be consistent with plans date-stamped October
10, 2005 with the front of the building 100 percent brick.
3. The applicant shall consent to the dedication of an easement over the proposed
retention /infiltration areas.
4. The applicant shall provide details for the proposed garbage enclose. The enclosure
shall be constructed with the materials used for the building to maintain a consistent
appearance.
5. The applicant shall execute a development agreement that specifies and articulates the
requirements, conditions and regulations pertaining to the development of the site.
