RESOLUTION OF THE CITY COUNCIL TO DENY THE REQUEST TO REZONE 2617
COUNTY ROAD I FROM R-1,SINGLE-FAMILY RESIDENTIAL, TO R-2, SINGLE &
TWO FAMILY RESIDENTIAL; PLANNING CASE NO. ZC05-002
WHEREAS, the applicant, JoAnn Colleen, has applied to rezone her property
located at 2617 County Road I, said lot being legally described as follows:
SPRING LAKE PARK HILL VIEW PART OF LOT 48 LYING WESTERLYOFA LINE
RUN NORTHERLYFROMA POINT ON SOUTH LINE OF SAID LOT 48 DISTANT 107 FT
EASTERLY OF SOUTHWEST CORNER TO A POINT ON NORTH LINE OF SAID LDT 48
DISTANT 107 FT EASTERLY OF NORTHWEST CORNER OF SAID LOT 48
WHEREAS, the City Council has reviewed the following documents regarding this
proposal
1. Staff Report
2. Planning Application
3. Location Map
4. Zoning Map
5. Aerial View Map
6. Comprehensive Plan, Future Land Use Map
7. Photographic Documentation
8. Email from resident
9. Planning Commission Resolution 819-05
WHEREAS, the City Council held a public hearing regarding this request on
Monday, December 12, 2005; and,
WHEREAS, according to Section 1125.01 of the Mounds View Zoning Code, the
City Council is to consider the possible adverse effects of the proposed rezoning and shall
make a finding of fact related to its review of the request.

• NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council makes the
following findings regarding the possible adverse effects of this rezoning as required by the
Mounds View Zoning Code:
1. The Current zoning of the lots is R-1, Single Family Residential. The requested
zoning of the lot is R-2, Single & Two Family Residential.

2. According to the Comprehensive Plan, the parcel proposed to be rezoned is
currently designated Single Family Detached (SFD). The request to change the
property to Single Family Attached (SFA) would not be consistent with the
Comprehensive Plan. The City Council believes that the lot should continue to be
zoned R-1.
3. The area north of County Road I is dominated by single family dwellings; the
introduction of a twin home into this area would exacerbate traffic and congestion
issues.
NOW, THEREFORE, BE IT FINALLY RESOLVED, based upon the above findings
of fact, the information and documents regarding the rezoning proposal, the report drafted
by staff, and the testimony of the applicant provided at the public hearing, the Mounds
View City Council does hereby deny the rezoning request made by JoAnn Colleen.
