HomeMy WebLinkAboutResolution 6733RESOLUTION N0.6733 • CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF NIINNESOTA ORDERING THE ABATEMENT OF NUISANCE CONDITIONS EXISTING AT 2408-10 COUNTY RD I, OPERATED AS SAMS FOOD MARKET AND SELF SERVE LAUNDRY, IN THE CITY OF MOUNDS VIEW WHEREAS, the Housing Inspector of the City of Mounds View has determined that conditions present at 2408-10 County Rd I in the City of Mounds View constitute a nuisance within the meaning of Minnesota Statutes, Section 561.01, 561.02, and Mounds View City Code Chapter 607. WHEREAS, based on the investigation of the Housing Inspector it is recommended that conditions described in a notice of violation dated December 28, 2005 are abated; and WHEREAS, in a letter to the responsible parties dated January 31, 2006 staff notified the responsible parties of its intent to appear before the Mounds View City Council to request authorization to abate nuisance conditions at 2408-10 County Road I; and WHEREAS, Minnesota Statutes, Section 561.03 and Mounds View City Code, Section • 607.09 Subdivision 5 authorize the City of Mounds View to correct said violations by abatement at the expense of the property owner, occupant, or other responsible party. WHEREAS, the City has complied with the notification requirement for nuisance abatement in Section 607.09, Subdivision Sb of the Mounds View Municipal Code; and WHEREAS, Sadiq Punjani, the listed taxpayer of 2408-10 County Rd I, will be liable to the City for the costs of such abatement, including administrative costs pursuant to Section 607.09, Subdivision 7 of the Mounds View Municipal Code; and NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View as follows: 1. The City of Mounds View finds that conditions existing at 2408-10 County Rd I, know and operated as Sam's Food Market and a Self Serve Laundry, constitute a nuisance within the meaning of Minnesota Statutes, Section 561.01, 561.02 and Mounds View City Code Chapter 607. 2. Graffiti shall be abated in the most practical manner 3. The City Attorney is authorized to take all necessary legal steps to abate said conditions. • 4. Any unpaid portion of the abatement costs after 30 days of the date on the invoice may be certified as special assessments against the property pursuant to Minnesota Statutes, Section 429.101 and Section 607.09, Subd. 7 of the Mounds View Municipal Code. • Dated this 13~` day of February 2006, by the City Council of the City of Mounds View. .,' Rob arty~,.M- a~yor ATTEST: ~---'~.
