HomeMy WebLinkAboutResolution 6758RESOLUTION 6758 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA APPROVING CONTRACT AWARD REGARDING EASEMENT CLEARING FOR EDGEWOOD DRIVE AND BONA ROAD WHEREAS, the City annually budgets for repair of drainage issues throughout the City; and WHEREAS, the Public Works Department solicited quotes from several companies; and WHEREAS, a total of three (3) quotes have been received; and WHEREAS, the low bidder was Mattco Excavation, Inc. in the estimated amount of $15,230.00; and WHEREAS, the 2006 adopted budget has $50,000.00 in funds allocated for the repair of drainage issued throughout the City (account 245-4415-5150). . NOW, THEREFORE BE IT RESOLVED, THAT the Mounds View City Council does hereby approve a contract award with Mattco Excavation, Inc. in the estimated amount of $15,230.00 for the repair of the drainage swale located immediately north of County Rd H in between the roads of Edgewood and Bona to be funded from Storm Water -System Maintenance, 245-4415-5150. '~.rl:~ f s ~ _ :- _ • Attachment D • EASEMENT USE AND RESTORATION POLICY Purpose In order to maintain the City facilities, it is important that that the City is consistent in how it uses and restores the easement areas once maintenance activities have been completed The purpose of this policy is to define consistent restoration action in cases where the City must utilize its easement rights to maintain its infrastructure. Policy The City and/or its authorized agents will use City-owned easements to maintain City-owned infrastructure and facilities. The City and/or its authorized agents will make every effort to contact and notify the affected property owner a minimum of thirty (30) days prior to the City utilizing easements to maintain City-owned infrastructure. It must be noted that is the targeted and preferred time period; there will be occasions .when this is not possible due to emergencies or circumstances beyond the City's control. The City and/or its authorized agents will remove any and all obstacles to allow . proper access and maintenance activities. These items will be removed with reasonable care and NOT REPLACED. Examples include, but are not limited to: trees, shrubs, landscaping, sheds, fences, playground equipment, and gardens. If the property owner wishes to retain possession of these items, they will be removed from the easement area and placed at the easement boundary. The City and/or its authorized agents will re-vegetate disturbed areas. In areas where maintained, cultured sod exists, the City will re-sod those areas. In areas that lack maintained cultured sod, the City will seed those areas with an appropriate seed mixture. The City will be responsible for the viability of the sodded areas for a period of thirty (30) days from installation; after that it will be the property owner's responsibility. For seeded areas, the City will be responsible until which time the area has been re-vegetated. As this is a policy, the City Council reserves the right to deviate from this policy if it is in the best interest of the City. City Administrator Revision Date: Date Effective Date:. June 13, 2005 r1 U • Attachment E August 22, 2005 «Title» «Address1» Mounds View, MN 55112 RE: Drainage Easement located in the back of your property Dear «Title»: ~t u ~ n~~ b GL~~Y~r; •A v. ^~Brpjt , P:irtneRti.QS Located in the back of your property is a storm sewer drainage easement- This easement was created to allow rain-water, melted snow, etc, in the area between Bona Road and Edgewood Drive to flow to a storm sewer located on County Road H. Unfortunately due to improper grading, settling and obstructions, this drainage easement is not functioning properly; it is not draining as intended. The City of Mounds View will eventually be conducting maintenance on the easement, located on your property, to restore its function to ensure proper drainage. All easement activities will take place in the back yards of the properties that have the said easement. (See copy of map) • The City Council recently adopted an "Easement Use and Restoration Policy"; please see the enclosed copy. The "Easement Use and Restoration Policy" allows the City to remove any obstacles within that easement area. This includes, but is not limited to, fences, playgrounds, pools, and gardens. If your property contains items that require removal, these items will not be replaced. Due to the nature and the function of any drainage easement, items should not be placed or constructed in an easement area. Also, it should be noted that for any future maintenance activities, any item in a drainage easement will be required to be removed. IMPORTANT The City is having the properties surveyed on Friday, August 26, 2005. Please do not remove the survey stakes from the property until grading is complete. At this time, the City is in the preliminary stages of the drainage easement cleaning and we do not have a timeline for the actual maintenance work. A neighborhood meeting will be conducted to inform all of the property owners on when the maintenance is scheduled to begin. (This meeting will be at least 30 days before any work will begin on site.) All items, within the area that is staked, will be removed and not replaced. When the easement cleaning has been completed, the area will be re-sodded. As explained in the previous letter, a neighborhood informational meeting would be scheduled before any work would commence. Please note that a neighborhood meeting is scheduled for September 27, 2005 at 7pm at the Mounds View City Hall, 2401 Highway 10, in the Council Chambers. It is strongly encouraged that all affected residents attend. The City will require information on what you would like to have done with items on the easement (fences, sheds, landscaping, etc) that are not removed before the project begins. • If you have any questions or concerns, make note of them for the neighborhood meeting and they will be addressed then.
