MEETING IS CALLED TO ORDER 2. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by Boy Scout Troop #93 member Jack Cibuzar. 3. ROLL CALL: Flaherty, Gunn, Hull, Meehlhause, Mueller NOT PRESENT: None. 4. APPROVAL OF AGENDA A. Monday, June 27, 2016, City Council Agenda. MOTION/SECOND: Mueller/Hull. To Approve the Monday, June 27, 2016, agenda as presented. Ayes – 5 Nays – 0 Motion carried. 5. PUBLIC INPUT Mike Read, 2208 Lois Drive, thanked the Mounds View Police Department for their fantastic work. He discussed an incident that occurred in his neighborhood and he was amazed by the work conducted by the Police Officers and for the safety they provided to the City’s residents. Mayor Flaherty thanked Mr. Read for contacting the Police Department with his concerns. He explained he would pass along this gratitude to the Police Department. Tom Winiecki, 2748 Sherwood Road, expressed concern with the traffic at the intersection of Sherwood Road and Red Oak. He feared traffic was moving altogether too fast and was failing to stop at the stop signs altogether. Mayor Flaherty understood these concerns and reported this concern would be brought to the Police Department. Mounds View City Council June 27, 2016 Regular Meeting Page 2 6. SPECIAL ORDER OF BUSINESS A. Annual Stormwater Public Information Meeting. Public Works Director Erickson explained the City was required to hold an annual public stormwater meeting for its MS4 permit. He stated this meeting was also required by the National Pollution Discharge Elimination System and the Clean Water Act. He indicated the goal of the meeting was to inform the public on the City’s stormwater pollution prevention plan. He reviewed the stormwater achievements over the past year in detail, along with the six minimum control measures. The goals for the coming year were then discussed and staff asked for question or comments. Council Member Mueller asked if the final report would be completed by the end of the week. Public Works Director Erickson explained this would be done and a copy of the report would be forwarded to the City Council. He indicated the report would also be posted on the City’s website. Council Member Mueller questioned if the County and Met Council had their own inspectors for their projects. Public Works Director Erickson reported this was the case. Mayor Flaherty questioned why surface water management was so important. Public Works Director Erickson described the importance of surface water management noting the City was working to protect its local waterways and ground water systems. 7. COUNCIL BUSINESS A. 7:00 p.m. Public Hearing: Second Hearing and Adoption of Ordinance 920, an Ordinance Renaming Highway Avenue in the City of Mounds View to “County Road H” (ROLL CALL VOTE) City Administrator Ericson stated this item was first considered by the Council at their June 13th meeting. He explained the renaming originated with the jurisdictional transfer of Highway Avenue from MnDOT to the County in 2014. The City supported the transfer but at this time, the City would like to rename this portion of the roadway to County Road H. He noted only three properties would be impacted by the proposed name change. Mayor Flaherty opened the public hearing at 7:30 p.m. Hearing no public input, Mayor Flaherty closed the public hearing at 7:30 p.m. Council Member Meehlhause asked if the reference to County Road 10 within the Ordinance should be changed to Mounds View Boulevard. City Administrator Ericson recommended the language remain as is. MOTION/SECOND: Mueller/Meehlhause. To Waive the Second Reading and Adopt Ordinance 920, an Ordinance Renaming Highway Avenue in the City of Mounds View to “County Road H”. B. 7:00 p.m. Public Hearing: Resolution 8601, a Resolution to Approve a Temporary On-Sale 3.2 Malt Liquor License for the Mounds View Festival in the Park Committee to Allow Ole Piper Inn to Serve 3.2 Malt Liquor during the August 20, 2016, Mounds View Festival in the Park. Assistant City Administrator Crane requested the Council consider approving a temporary on- sale 3.2 Malt Liquor license for the Mounds View Festival in the Park. She explained Ole Piper Inn would be serving the 3.2 malt liquor in the beer garden on August 20th. She reported all application materials have been submitted and only the criminal background check remained. Staff recommended approval of the request contingent upon a satisfactory criminal background check. Mayor Flaherty opened the public hearing at 7:34 p.m. Hearing no public input, Mayor Flaherty closed the public hearing at 7:35 p.m. Mayor Flaherty asked if Mr. Spitzley had experience serving at these types of events. Paul Spitzley, Ole Piper Inn, reported he had experience serving 3.2 malt liquor at softball tournaments in the past. Council Member Mueller questioned what method would be used to ensure no minors were served at Festival in the Park. Mr. Spitzley stated wrist bands would be placed on individuals that have been carded and were of age. He indicated minors would be allowed in the beer garden and could be served water or soda. Council Member Mueller inquired what hours the beer garden would be open. Theresa Cermak, Festival in the Park Committee President, stated the beer garden would be open from 12:00 p.m. to 9:40 p.m. MOTION/SECOND: Mueller/Hull. To Waive the Reading and Adopt Resolution 8601, a Resolution to Approve a Temporary On-Sale 3.2 Malt Liquor License for the Mounds View Festival in the Park Committee to Allow Ole Piper Inn to Serve 3.2 Malt Liquor during the August 20, 2016, Mounds View Festival in the Park, contingent upon a satisfactory criminal background check. Ayes – 5 Nays – 0 Motion carried. C. Resolution 8600, Approve RCWD 2016 Urban Stormwater Remediation Cost-Share Agreement. Mounds View City Council June 27, 2016 Regular Meeting Page 4 Public Works Director Erickson requested the Council consider approving the RCWD 2016 Urban Stormwater Remediation Cost-Share Agreement. He indicated the City received $19,292 in a grant to assist with correcting a stormwater issue on Tom Field’s property. Council Member Mueller asked Director Erickson how Bolton & Menk was chosen to work on the grant application. Public Works Director Erickson reported he completed the grant application and simply referred to Bolton & Menk for several questions that were of a time- sensitive nature. Council Member Mueller requested staff pass along her thanks to Bolton & Menk for their assistance in this grant. MOTION/SECOND: Meehlhause/Gunn. To Waive the Reading and Adopt Resolution 8600, Approve RCWD 2016 Urban Stormwater Remediation Cost-Share Agreement. Ayes – 5 Nays – 0 Motion carried. D. Second Reading and Adoption of Ordinance 919, an Ordinance Amending Chapter 1008 of the Mounds View Municipal Code Regarding Dynamic Display Signs (ROLL CALL VOTE). City Planner Sevald requested the Council approve the adoption of Ordinance 919, which would amend Chapter 1008 of the Mounds View Municipal Code regarding dynamic display signs. He noted dynamic display signs were permitted in the City’s business districts, but were restricted in the R-1 zoning district. He indicated the proposed amendment would permit full-color dynamic display signs at churches and institutional uses in the R-1 zoning district. Council Member Mueller reported the number of lumens would still be limited for the dynamic display signs. City Planner Sevald reported this was the case. MOTION/SECOND: Hull/Gunn. To Waive the Second Reading and Adopt Ordinance 919, an Ordinance Amending Chapter 1008 of the Mounds View Municipal Code Regarding Dynamic Display Signs. ROLL CALL: Gunn/Hull/Meehlhause/Mueller/ Flaherty. Ayes – 5 Nays – 0 Motion carried. E. Resolution 8602, Approving the Hire of Nathaniel Harder to the Position of Mounds View Police Chief. Assistant City Administrator Crane reported former Police Chief Kinney retired on April 29, 2016. She explained an interim police chief was appointed, which was Deputy Chief Steve Menard. She reviewed the recruitment and hiring process that was followed for the hiring of a new Police Chief. It was noted staff received 21 applications for the position and with the Mounds View City Council June 27, 2016 Regular Meeting Page 5 assistance of the Setter & Associates, the applications were whittled down to eight candidates and these individuals were given a written exam. After reviewing the written exams five candidates were interviewed by a panel of Mounds View city staff, Council members and New Brighton Public Safety Director Bob Jacobson. Second interviews were held with the two top candidates before the full City Council who recommended the hire of Nathaniel Harder to the position of Mounds View Police Chief. The Police Civil Service Commission then certified an eligibility list which placed the internal candidate at the top of the list, recommending that the Council promote from within. Council Member Hull asked who selected the two final candidates. Assistant City Administrator Crane reported this was the consensus of the interview panel. MOTION/SECOND: Mueller/Meehlhause. To Waive the Reading and Adopt Resolution 8602, Approving the Hire of Nathan Harder to the Position of Mounds View Police Chief. Council Member Meehlhause thanked staff for allowing the entire Council to be involved in the second interview process. Mayor Flaherty discussed the lengthy hiring process that was followed and believed Mr. Harder would serve the City well as the next Police Chief. Council Member Mueller thanked Deputy Chief Menard for his dedicated service to the community. Ayes – 5 Nays – 0 Motion carried. 8. CONSENT AGENDA A. Set a Public Hearing for Monday, July 11, 2016, at 7:00 p.m., to Consider the Second Reading and Adoption of Ordinance 921, an Ordinance Opting Out of the Requirements of Minnesota State Statue §462.3593, which Defines and Regulates Temporary Family Health Care Dwellings. MOTION/SECOND: Flaherty/Hull. To Approve the Consent Agenda as presented. Ayes – 5 Nays – 0 Motion carried. 9. JUST AND CORRECT CLAIMS Finance Director Beer answered the Council's questions related to claims. MOTION/SECOND: Gunn/Meehlhause. To Approve the Just and Correct Claims as presented. Ayes – 5 Nays – 0 Motion carried. Mounds View City Council June 27, 2016 Regular Meeting Page 6 10. APPROVAL OF MINUTES None. 11. REPORTS A. Reports of Mayor and Council. Council Member Mueller stated she attended the League of Minnesota Cities Conference June 14th through June 17th. She discussed the seminars and events she attended at the conference. She was pleased to report she had completed her three-year term as a Director on the League of Minnesota Cities (LMC) Board. She indicated she would be moving to the Ambassador program at this point. She commended the City on becoming a GreenStep City. Council Member Mueller reported the Festival in the Park Committee met on June 21st and had several new volunteers attend. She indicated there were still spots open for the car show and for the craft fair. She explained the Festival in the Park Committee would meet again on Tuesday, July 19th at 7:00 p.m. at City Hall. Council Member Gunn believed the LMC Conference was excellent this year. She suggested the Council members share notes from the sessions they attended at the next work session meeting. Council Member Meehlhause agreed with this recommendation. He provided further comment on the sessions he attended at the LMC Conference. Council Member Meehlhause stated Twin Cities Gateway was considering hiring a Sports Management Position. This individual would work to identify ballfields for outside groups interested in hosting a tournament in order to better utilize the local facilities. Council Member Meehlhause explained he received a call from Bill Urbanski regarding the sound wall on US Highway 10. He confirmed that MnDOT would be building a sound wall on in conjunction with their 35W Managed Lane project. His concern was that MnDOT would be sending a letter to adjacent residents to vote on whether or not they want the sound wall, and residents may not realize the importance of this letter. Council Member Gunn reported a vote will been taken for all sound wall sections along 35W. Council Member Meehlhause wanted to make the residents of Mounds View aware that this letter would be coming and to encourage them to vote in support of the sound wall. Council Member Meehlhause provided an update on the NYFS meeting he attended last week. He explained he would be serving as the Chair of this group for the next year. Council Member Meehlhause stated he attended the Cable Commission meeting last week as well and an update was provided regarding the Comcast negotiations, which was very positive. Mounds View City Council June 27, 2016 Regular Meeting Page 7 Council Member Mueller commented the water pressure issue in her home and throughout her neighborhood was very low yesterday. She encouraged homeowners to contact Public Works if this were to occur in their home at some point in the future. Public Works Director Erickson discussed the notification process for water operation issues. He reviewed the problem that occurred with the SCADA system and noted the system had been flushed afterwards. Finance Director Beer stated the preliminary 2017 General Fund Budget will be reviewed by the City Council for the first time on Tuesday, July 5th. Public Works Director Erickson noted Phase I of the Area I project would be paved on Thursday or Friday of this week. He then updated the Council on the County and Met Council projects occurring in the City of Mounds View. Mayor Flaherty recommended that the light signals/posts on Mounds View Boulevard be looked at by staff as he knew many were in need of repainting. B. Reports of Staff. City Administrator Ericson asked if the Council wanted staff to send out a letter to residents informing them of the sound wall situation, in advance of the MnDOT letter. The Council was in support of this recommendation asking that letters be sent to all benefitting property owners, as identified by MnDOT. C. Reports of City Attorney. City Attorney Riggs was pleased to report the Silver View Trail easement situation was finally resolved. 12. Next Council Work Session: TUESDAY, July 5, 2016, at 7:00 p.m. Next Council Meeting: Monday, July 11, 2016, at 7:00 p.m. 13.
