MEETING IS CALLED TO ORDER 2. PLEDGE OF ALLEGIANCE 3. ROLL CALL: Flaherty, Gunn, Meehlhause, Mueller NOT PRESENT: Hull. 4. APPROVAL OF AGENDA A. Monday, June 22, 2015, City Council Agenda. MOTION/SECOND: Mueller/Meehlhause. To Approve the Monday, June 22, 2015, agenda as presented. Ayes – 4 Nays – 0 Motion carried. 5. PUBLIC INPUT None. 6. SPECIAL ORDER OF BUSINESS A. Resolution 8419, Recognizing Eagle Scout Daniel Niedfeldt-Thomas Mayor Flaherty read a Resolution in full recognizing Eagle Scout Daniel Niedfeldt-Thomas for his hours of volunteer service to the City and for building an outdoor seating area at a local church. A round of applause was offered by all in attendance. MOTION/SECOND: Gunn/Mueller. To Waive the Reading and Adopt Resolution 8419, Recognizing Eagle Scout Daniel Niedfeldt-Thomas. Ayes – 4 Nays – 0 Motion carried. B. Annual Storm Water Public Information Meeting Mounds View City Council June 22, 2015 Regular Meeting Page 2 Public Works Director Erickson provided the Council with a presentation on the City’s Storm Water Pollution Prevention Plan. He indicated the goals of the meeting were to inform interested citizens, solicit public comment and to comply with State permit requirements. He provided comment on the progress that was made addressing the City’s six minimum control measures. He then discussed the goals for the City’s storm sewer system going forward. Mayor Flaherty understood that Silver View Pond was 38% full. He questioned how this would be managed in the future. Public Works Director Erickson reported that the pond would have to be dredged at some point to remove the sediment from the pond. He explained that this work was typically done in the winter months. Council Member Mueller asked if the sediment within Silver View Pond had been rated. Public Works Director Erickson commented that he would have to investigate this matter further and would report back to the Council. Mayor Flaherty thanked staff for the thorough report on the City’s Storm Water Pollution Prevention Plan. 7. COUNCIL BUSINESS A. 7:00 p.m. Public Hearing, Second Reading and Adoption of Ordinance 903, an Ordinance Amending Chapter 701 of the Mounds View Municipal Code to Allow for the Keeping and Raising of Chickens and/or Ducks. (ROLL CALL VOTE) City Administrator Ericson stated this was the Second Reading of Ordinance 903, which would allow for the keeping and raising of chickens and/or ducks. He noted the First Reading of this Ordinance was held on June 8 th . Staff reviewed the language changes that were made to the Ordinance per Council’s direction and recommended adoption of Ordinance 903. Mayor Flaherty opened the public hearing at 7:28 p.m. Mike Read, 2208 Lois Drive, asked if the birds had to be vet checked yearly. He feared that bird flu could impact the community. City Administrator Ericson commented that based on research he has conducted, that the contraction of the bird flu to humans has not happened. Mayor Flaherty appreciated this comment. Bro Jones, 2500 Woodcrest Drive, questioned how many properties in Mounds View currently had chickens. Mayor Flaherty was uncertain how many properties had chickens as they were prohibited. Mr. Jones inquired why the City was not requiring neighbor approval. City Attorney Riggs did not advise the City Council delegate the approval of chickens and/or ducks to residents’ adjacent property owners. He recommended that this matter be handled through a permitting process. Mr. Jones reported he lived on Deb Nygaard’s block and indicated she has had her chickens Mounds View City Council June 22, 2015 Regular Meeting Page 3 illegally for quite some time. He believed that the City Ordinance should not be changed for one person. He recommended that the entire City be polled regarding this matter. Mayor Flaherty clarified that this was not the first meeting the City has had regarding chickens. He explained that a number of residents have come forward in support of chickens in Mounds View. He commented that the Council was making a Code amendment for all residents in the City. Mr. Jones believed that this Ordinance could adversely impact the City and housing property values. He explained that he has lived in Mounds View since 1962 and he did not want his neighbors to have chickens due to the smell and noise that would be created. Hearing no further public input, Mayor Flaherty closed the public hearing at 7:39 p.m. Council Member Mueller discussed a letter received from a landlord recommending that chickens not be allowed on rental properties. She reported that the proposed Code amendment would address this concern and rental properties would not be allowed to keep chickens. She reported that she supported the changing needs in the community and recommended that the Council adopt Ordinance 903. Council Member Gunn noted that several neighboring communities have already adopted urban farming Ordinances that allow for the keeping of chickens. She fully supported residents having chickens and/or ducks. Council Member Meehlhause supported chickens and/or ducks in the R-1 zoning district. He appreciated the control measures that were written into the proposed Ordinance. Mayor Flaherty stated that he originally was not in support of the keeping of chickens. However, after reviewing the proposed Ordinance he noted he would be supporting the matter. MOTION AMENDMENT: Flaherty. To Amend Ordinance 903, to Allow for the keeping of only Six Chickens and/or Ducks. The amendment failed for lack of a second. MOTION/SECOND: Gunn/Mueller. To Waive the Second Reading and Adopt Ordinance 903, an Ordinance Amending Chapter 701 of the Mounds View Municipal Code to Allow for the Keeping and Raising of Chickens and/or Ducks. Mayor Flaherty stated he was in favor of reducing the number of chickens and/or ducks from eight to six. He believed that eight was too large a number for single-family lots in Mounds View. For this reason, he would not be able to support the Ordinance as proposed. ROLL CALL: Gunn/Meehlhause/Mueller/ Flaherty. Ayes – 3 Nays – 1 (Flaherty) Motion carried. Mounds View City Council June 22, 2015 Regular Meeting Page 4 MOTION/SECOND: Mueller/Meehlhause. To Approve the Chicken/Duck Permit Fee of $100 and the Yearly Permit Renewal Fee of $30. Ayes – 4 Nays – 0 Motion carried. B. Resolution 8430, Approving the 2015 Festival in the Park of Mounds View Contract. Assistant City Administrator Crane requested the Council approve the 2015 Festival in the Park of Mounds View contract. She discussed the budget and expenses for the Festival and noted the City would be donating $5,000 for fireworks. MOTION/SECOND: Mueller/Gunn. To Waive the Reading and Adopt Resolution 8430, Approving the 2015 Festival in the Park of Mounds View Contract. Ayes – 4 Nays – 0 Motion carried. C. Introduction and First Reading of Ordinance 904 to Amend Chapter 1106 of the Mounds View Zoning Code to Allow Additional Types of Exterior Materials on Columbaria. Planning Associate Heller reported the Council recently approved an Ordinance that would allow columbaria in the City of Mounds View at religious institutions. She explained that a local church has approached the City requesting columbaria to be constructed of brick and bronze, which would not be allowed under the previously approved Ordinance. She requested that the Council introduce an Ordinance that would amend Chapter 1106 of the Mounds View Zoning Code which would allow for brick and bronze columbaria. Council Member Mueller thanked staff for completing the additional research on this matter. She supported the proposed code amendment. MOTION/SECOND: Mueller/Meehlhause. To Waive the First Reading and Introduce Ordinance 904 Amending Chapter 1106 of the Mounds View Zoning Code to Allow Additional Types of Exterior Materials on Columbaria. Council Member Mueller requested that the proposed code amendments within this Ordinance be posted to the City’s website. Ayes – 4 Nays – 0 Motion carried. D. Resolution 8431, Approving an Engineering Services Agreement with Braun Intertec for Construction Materials Testing and Special Inspection Services Related to Mustang Drive. Public Works Director Erickson requested the Council approve an engineering services Mounds View City Council June 22, 2015 Regular Meeting Page 5 agreement with Braun Intertec for construction materials testing and special inspection services on Mustang Drive. He explained that the services would allow for geotechnical and asphalt testing to be completed. He recommended that the Council approve a 15% contingency for the project. City Attorney Riggs noted a change to Item 2 within the Resolution. MOTION/SECOND: Gunn/Meehlhause. To Waive the Reading and Adopt Resolution 8431, Approving an Engineering Services Agreement with Braun Intertec for Construction Materials Testing and Special Inspection Services Related to Mustang Drive, as amended. Council Member Meehlhause thanked staff for providing the overall project cost information to the Council. Ayes – 4 Nays – 0 Motion carried. 8. CONSENT AGENDA A. Set a Public Hearing for Monday, July 13, 2015, at 7:00 p.m., for the Second Reading and Adoption of Ordinance 904, Amending the Mounds View Zoning Code to Allow Additional Types of Exterior Materials on Columbaria. B. Set a Public Hearing for Monday, July 13, 2015, at 7:00 p.m., to Consider a Residential Kennel License located at 2280 Pinewood Drive. C. Set a Public Hearing for Monday, July 13, 2015, at 7:00 p.m., to Consider a Residential Kennel License located at 5414 Jackson Drive. D. Set a Public Hearing for Monday, August 10, 2015, at 7:00 p.m., to Approve Additions and Revisions to the 2015 Fee Schedule. MOTION/SECOND: Mueller/Meehlhause. To Approve the Consent Agenda as presented. Ayes – 4 Nays – 0 Motion carried. 9. JUST AND CORRECT CLAIMS Finance Director Beer answered the Council's questions related to claims. MOTION/SECOND: Gunn/Meehlhause. To Approve the Just and Correct Claims as presented. Ayes – 4 Nays – 0 Motion carried. 10. APPROVAL OF MINUTES A. May 11, 2015, City Council Meeting Minutes. MOTION/SECOND: Meehlhause/Mueller. To Approve the May 11, 2015, City Council meeting minutes as presented. REPORTS A. Reports of Mayor and Council. Council Member Mueller reported the League of Minnesota Cities Conference would be held in Duluth, Minnesota from June 24-26, 2015. She noted she would be serving on the Nominations Committee for the Board of Directors and interviews would be held on Wednesday, June 24 th . She reported that the new Executive Director would be introduced at the conference. She discussed the sessions planned for the conference and looked forward to taking part in this wonderful event. Council Member Meehlhause commented he would be attending the League of Minnesota Cities Conference in Duluth, Minnesota this week. Council Member Gunn indicated she would also be attending the League of Minnesota Cities Conference in Duluth, Minnesota this week. Mayor Flaherty provided comment on the 50 th Anniversary of the Mounds View Tornado event. He stated last Thursday he attended both the Music in the Park and Movie in the Park event. He stated the next Music in the Park event would be held on Thursday, July 16, 2015 at 6:30 p.m. at Silver View Park and would feature the Teddy Bear Band. B. Reports of Staff. City Administrator Ericson indicated the Council would be attending a bus tour of metro developments on Monday, June 29 th . C. Reports of City Attorney. City Attorney Riggs had nothing additional to report. 12.
