HomeMy WebLinkAboutResolution 8777RESOLUTION 8777 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING THE PRELIMINARY PLAT OF `BOULEVARD", LOCATED AT THE NORTHWEST CORNER OF MOUNDS VIEW BOULEVARD AND GROVELAND ROAD; PLANNING CASE MU2017-001 WHEREAS, the City of Mounds View Municipal Code, Title 1200 provides requirements and procedures for the subdivision of plats, requiring a Major Subdivision of a parcel or parcels of property in which more than one additional parcel or lot is created or which is two (2) acres or larger in size; and, WHEREAS, MWF Properties, LLC representing Cynthia Johnson, owner of PID: 06-30- 23-31-0029 and PID: 06-30-23-31-0030; and representing the State of Minnesota, owner of PID: 06-30-23-31-0031 and PID: 06-30-23-31-0241, has applied for Preliminary Plat approval of a Major Subdivision of `Boulevard", consisting of 4.5 acres in size, located on land legally described as: Certificate of Title No. 582367 (PID 06-30-23-31-0031): Parcel 1: Lot 50, except that part which lies southwesterly of a line run parallel with and distant 100 feet Northeasterly of the Southwesterly boundary of said Lot 50, also except that part described as follows: Commencing at the Northwest corner of said Lot 50; thence East 7 feet along the North line of said Lot 50; thence Southerly 100 feet to a point of intersection on the West line of said Lot 50; thence North along said West line of said Lot 50 to the point of commencement; Auditor's Subdivision No. 89, Ramsey Co., Minn. the said excepted part of the above described property, the Southwesterly 100 feet has been taken by the State of Minnesota for public Highway purposes. Parcel 2: All that part of Lot 32, Auditor's Subdivision No. 89, Ramsey Co., Minn., described as follows, to -wit: Resolution 8777 Page 2 Commencing at a point on the West line of Lot 50, Auditor's Subdivision No. 89, which point is 100 feet South of the Northwest corner of said Lot 50; thence South to a line 100 feet Northeasterly from and parallel with the Southerly line of Lot 32; thence Northwesterly on said parallel line 32 feet; thence Northeasterly to the point of beginning. Certificate of Title No. 582368 (PID 06-30-23-31-0241): The South 135.00 feet, front and rear, of Lot 47, Auditor's Subdivision No. 89, lying westerly of the East 187.00 feet. Certificate of Title No. 616319 (PID 06-30-23-31-0030): Lot 49, Auditor's Subdivision No. 89, Ramsey County, Minnesota. Certificate of Title No. 593365 (PID 06-30-23-31-0029): That part of Lot 48, Auditor's Subdivision No. 89 lying South of the North 300 feet front and rear thereof, except that portion taken for the Highway right of way purposes. WHEREAS, the properties are zoned R-4 High Density Residential, and are within the County Road 10 Corridor Overlay District, and are guided for Mixed Use PUD within the Comprehensive Plan; and, WHEREAS, the applicant, MWF Properties, has submitted the following; 1. Title Commitment, dated March 6, 2017 2. Application (Major Subdivision), received June 13, 2017 3. Extension of 120 -day review (expiring December 12, 2017), received September 13, 2017. 4. Traffic Impact Study, dated June 29, 2017 5. Title Commitment, dated August 24, 2017 6. Plan set, titled `Boulevard Mounds View, Minnesota Issued for: City Resubmittal", dated December 1, 2017. The plan set is inclusive of the Preliminary Plat and Development Review. WHEREAS, Staff distributed the submitted materials to applicable departments and agencies for review, receiving comments as noted in the December 11, 2017 Staff Report; and, WHEREAS, in response to emailed comments made by Jim Tolass, Ramsey County Public Works Director, dated October 26, 2017, Ramsey County will allow a driveway access onto Mounds View Blvd at the mid -block contingent upon this driveway being a shared driveway via easement with any redevelopment of any property on the north side of Mounds View Blvd, between Groveland Rd and Spring Lake Rd, and that existing driveways be removed at the time Resolution 8777 Page 3 of redevelopment. This easement and the applicable properties are included in the Preliminary Plat. Further, the developer agrees to close, at the developer's expense, the median crossover on Mounds View Blvd in front of the former SBM Fire Station (1810 Highway 10 NE Spring Lake Park, MN); and, WHEREAS, Staff recommends approval of the Preliminary Plat; and, WHEREAS, the Planning Commission reviewed the request on July 19, 2017, recommending approval of the Preliminary Plat (Resolution 1075-17); and, WHEREAS, the City Council conducted a Public Hearing on July 24, 2017, continuing it on August 14, 2017; and, WHEREAS, the City Council considered oral comments made by the public during public meetings and included in meeting minutes, and written comments included in Staff Reports, dated July 24, 2017, August 14, 2017, and December 11, 2017; and, WHEREAS, the City of Mounds View Municipal Code, Section 1204.02, Subd 4 (Dedication Amount), allows for the dedication by the subdivider to the City, up to ten percent (10%) of the buildable land, or cash equivalent. Buildable land is the gross acreage minus right- of-way to be dedicated (Mounds View Blvd and Groveland Rd). This park dedication is estimated to be: PID Buildable Land EMV (2017) 06-30-23-31-0029 0.30 ac $ 43,140 X 10% _ $ 4,314 06-30-23-31-0030 1.22 ac $120,100 X 10% _ $12,010 06-30-23-31-0031 0.75 ac $171,700 X 10% _ $17,170 06-30-23-31-0241 0.84 ac $ 33,500 X 10% _ $ 3,350 $36;844 NOW, THEREFORE, BE IT RESOLVED, the City Council finds that the request is consistent with the City of Mounds View Municipal Code, Title 1000 (Building and Development Regulations), Title 1100 (Zoning Code), and Title 1200 (Land Subdivision), and the Comprehensive Plan; and, NOW, THEREFORE, BE IT FINALLY RESOLVED, based upon the above findings, the information and documents regarding the proposed Preliminary Plat, the Staff Report, the Planning Commission's recommendation, testimony of the applicant, and in consideration of public testimony, the City Council does hereby approve the Preliminary Plat of "Boulevard", with the following conditions: All utilities within the development shall be located underground. 2. The Developer agrees to construct at the Developer's expense, a public trail and trail lighting to city standards as shown on the Preliminary Plat and related drawings, dated December 1, 2017, or as amended and approved by City Staff and Ramsey County, These improvements shall be constructed at the time the building is constructed. Resolution 8777 Page 4 The Developer agrees to pay to the City, a Park Dedication Fee equivalent to 10% of the Estimated Market Value (EMV) of the buildable land. For the 2017 EMV, this fee equals $36,844. This fee shall be paid prior to the City signing the Final Plat mylars. The Developer shall satisfy all requirements of the City Engineer (Stantec), as stated in its review comments, dated Nov 27, 2017. 5. The Developer shall satisfy all Ramsey County requirements, including the removal of the CSAH 10 median crossover in front of 1810 Highway 10 NE, Spring Lake Park (former SBM Fire Station), and recording an ingress/egress easement benefiting the following properties (and their successors): PID: 06-30-23-31-0173 Address: 2925 Mounds View Blvd 06-30-23-31-0237 2935 Mounds View Blvd 06-30-23-31-0174 2949 Mounds View Blvd 06-30-23-32-0042 0 (Unassigned) 06-30-23-23-0044 0 (Unassigned) This easement shall be recorded concurrently with the recording of the Final Plat. 6. The Developer shall obtain applicable permits from the Rice Creek Watershed District (RCWD), and submit a signed/recorded copy of the Maintenance Agreement for storm water management facilities to RCWD. 7. The applicant shall execute a Developers Agreement with the City, intended to be completed as part of the Final Plat approval. The Developers Agreement will be inclusive of developer installed improvements, including a publicly owned pedestrian trail, privately owned fenced playground, landscaping and site improvements. 8. The Developer shall pay all of the City's costs in reviewing the application, including those of the City Attorney and consultants. 9. The Developer shall apply for Final Plat approval no later than six months after the date of approval of the Preliminary Plat, or the Preliminary Plat approval will become null and void.
