Mr. Wienke has served the City for 28 years. Mr. Wienke's last day was June 30, 2017. On June 12, 2017, the City Council approved advertising for the Public Works Maintenance Worker (Sanitary Sewer Division). Staff advertised the opening on the City's website and the League of Minnesota Cities website. Staff received six (6) applications, and interviewed three (3). Discussion: The interview panel consisted of Public Works Supervisor Don Peterson, Public Works Maintenance Worker Neil Hiatt and me. It was the consensus of Staff to recommend Benjamin Geisbauer to the position of Public Works Maintenance Worker (Sanitary Sewer Division). Mr. Geisbauer currently works as a seasonal employee for the City. Mr. Geisbauer holds a Class D Water Supply System Operator and a Class SD Wastewater Treatment Facility Operator License. Mr. Geisbauer holds a Class B Permit for his CDL license, and will be obtaining his CDL within 6 months (this is allowed under the job description). Mr. Geisbauer, if hired, would be a member of the Public Works Collective Bargaining Unit. Mr. Geisbauer would be subject to the established job classification system with regard to the pay scale. Based on the criteria set forth by the 2017 — 2019 Public Works Collective Bargaining Unit Labor Agreement, Mr. Geisbauerwould qualify for Level A pay scale, which is $25.46 per hour. Progressing to Level B, then C in the future will be based on Mr. Geisbauer's ability to meet the criteria established by the Labor Agreement. Also in accordance with the Public Works Collective Bargaining Unit Agreement, Mr. Geisbauer would be subject to a twelve (12) month probationary period. Recommendation: Staff recommends the City Council adopt Resolution 8795, a resolution approving the hire of Benjamin Geisbauer to the position of Public Works Maintenance Worker (Sanitary Sewer Division) in the Public Works Department, contingent on a satisfactory criminal background checks, satisfactory drug test, and satisfactory pre-employment exam. The public hearing, second reading, and adoption will be on Monday, August 28, 2017. Notice of the public hearing was published in the August 10, 2017 Sun Focus. This ordinance continues the agreement with Xcel Energy under which Xcel Energy will collect a franchise fee in the amount of 4% of Xcel's electric and natural gas gross operating revenues for services within the City of Mounds View during the year 2018. The proceeds are split between the General Fund and the Street Improvement Fund. Ordinances 875 and 876 passed on January 28, 2013 extended the original 20 year franchise agreement for another 20 years. It provides that the City may impose a franchise fee of not more than 4% of Xcel's gross operating revenues at any time during the 20 -year term of the franchise. The 20 -year term runs from January 2013 through January 28, 2034. The franchise fee was first collected in 1993. It has been the practice to include a sunset provision in the ordinance that requires it to be re-enacted each year. The ordinance will be brought back to the City Council for second reading and adoption at the August 28, 2017 meeting. It will then be published in the Sun Focus and take effect as provided in the ordinance. Staff would request that a summary ordinance be published with the complete ordinance available on-line and at City Hall. Respectfully Submitted, Mark Beer ORDINANCE NO. 935 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE CONTINUING A FRANCHISE FEE ON XCEL ENERGY ELECTRIC AND NATURAL GAS OPERATIONS WITHIN THE CITY OF MOUNDS VIEW THE CITY OF MOUNDS VIEW ORDAINS: SECTION 1. The City of Mounds View Municipal Code Appendix D is hereby amended to include reference to the following Special Ordinance. Subdivision 1. Purpose. The Mounds View City Council has determined that it is in the best interest of the City to impose a franchise fee on those public utility companies that provide natural gas and electric services within the City of Mounds View. a. Pursuant to City Ordinance No. 875 and Ordinance No. 876, which are the Franchise Agreements ("Franchise Agreements") between the City of Mounds View (the "City") and Northern States Power Company D/B/A Xcel Energy, its successors and assigns, a franchise fee of not more than four (4.0) percent of Xcel Energy's gross operating revenues may be imposed by the City at any time during the 20 year term of the Franchise. The franchise fee is paid as full compensation for the rights to transmit and furnish electric energy for light, heat, power and import, transport, sell and distribute natural gas for heating, illuminating and other purposes as outlined in Section 2.1 of Ordinance Nos. 875 and 876. Subd. 2. Franchise Fee Statement. A franchise fee is hereby imposed on Xcel Energy under its electric and natural gas Franchise Agreements in the amount of four percent (4%) of Xcel Energy's gross revenues, as defined in Section 9 of the Franchise Agreements, commencing with Xcel Energy's January 2018 billing month. Subd. 3. Payment. The said franchise fee shall be payable to the City in accordance with the terms set forth in Section 9 of the Franchise Agreements. Subd. 4. Surcharge. The City recognizes that the Minnesota Public Utilities Commission may allow each said utility company to add to its effective rates for the utility service on which the public utility gross earnings fee is imposed, a surcharge to reimburse such utility company for the cost of the fee. Subd. 5. Proof of Company Gross Revenues. Xcel Energy shall make each payment when due and shall monthly furnish a complete and correct statement of gross revenues for said month. Xcel Energy shall permit the City and its designated representative free access to the company's records for the purpose of verifying such statements. Subd. 6. Enforcement. Any dispute, including enforcement of a default regarding this ordinance will be resolved in accordance with the Franchise Agreements. Subd. 7. Effective Date of Franchise Fee. Notwithstanding the effective date of this ordinance and notwithstanding any contrary provisions in Section 9 of the Franchise Agreements, the effective date of the fee collected under Subdivision 9 of this ordinance is the later of ten (10) days after the publication and after the sending of written notice enclosing a copy of this adopted ordinance upon Xcel Energy by certified mail. Subd. 8. Sunset Clause. This ordinance shall automatically sunset on December 31. 2018. SECTION 2. This ordinance takes effect as provided herein. Franchise fees collected under this agreement are minimal due to Center Point Energy's small customer base within the City of Mounds View. Richie, Public Works Project Coordinator Item Title/Subject: Resolution 8803, Accepting Improvements and Approving Final Payment for Municipal Well No. 1 Rehabilitation Background: The Public Works Engineering Division prepared plans and specifications in-house and solicited quotes from seven (7) qualified well contractors, receiving five (5) quotes for rehabilitation of Municipal Well No. 1. The low quote was submitted by Thein Well Company, Inc. of Spicer, Minnesota. At the March 27, 2017 City Council Meeting, the Council approved the quotes received and awarded the well rehabilitation contract to Thein Well Company, Inc. (Resolution 8736). Discussion: Well rehabilitation of Municipal Well No. 1 was substantially completed on July 7, 2017. Thein Well Company, Inc. has completed all work related to the rehabilitation of Municipal Well No. 1 in a satisfactory manner in accordance with the contract documents, and submitted all required project documents. The final invoice amount is $37,848.00, which is approximately $6,300 more than the quoted amount, but still within the allotted contingency. The additional costs were associated with replacing additional sections of line shaft pipe than originally estimated. The additional pipe was needed due to the pipe already being turned once during the previous well rehabilitation and motor rehabilitation. Recommendation: Staff recommends that the City Council adopt the attached resolution to accept the work associated with rehabilitating Municipal Well No. 1 (City Project No. 2017-007) and release final payment of 37,848.00. Respectfully submitted, Don Peterson — Interim Public Works Director RESOLUTION 8803 CITY OF MOUNDS VIEW COUNTY OFRAMSEY STATE OF MINNESOTA ACCEPTING IMPROVEMENTS AND APPROVING FINAL PAYMENT FOR MUNICIPAL WELL NO. 1 REHABILITATION WHEREAS, the Public Works staff prepared bid documents in-house for the well rehabilitation of Municipal Well No. 1 in accordance with industry standards and the City solicited seven (7) and received five (5) quotes; and WHEREAS, Thein Well Company, Inc. of Spicer, Minnesota submitted the lowest quote in the amount of $31,557.00; and WHEREAS, the City Council approved the quotes received and awarded the well rehabilitation contract to Thein Well Company, Inc. at the March 27, 2017 Council Meeting Resolution 8736); and, WHEREAS, Thein Well Company, Inc. has successfully completed the well rehabilitation of Municipal Well No. 1 and met all other contract requirements for the project with a substantial completion date of July 7, 2017, and a final construction cost of $37,848.00; and, WHEREAS, City staff recommends accepting the completed well rehabilitation work, and issuing final payment for $37,848.00 to Thein Well Company, Inc. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View, Ramsey County, Minnesota, as follows: 1. Mueller, Mayor ATTEST: James Ericson, City Administrator SEAL) MOUNDS Vi -V of Mounds View Staff Item No: 09H Meeting Date: August 14, 2017 Type of Business: Council Business Administrator Review: To: Honorable Mayor and City Council From: Don Peterson, Interim Public Works Director Michael Richie, Public Works Project Coordinator Item Title/Subject: Resolution 8809, Approving Additional Funding for the 2017 Sewer Rehabilitation Project Background: On June 12, 2017, the City Council approved Resolution 8764, approving a construction contract with Insituform Technologies USA, LLC., ("Insituform") for the 2017 Sewer Rehabilitation Project. The project will line approximately 4,189 feet of sanitary sewer and 133 feet of storm sewer throughout Mounds View. Discussion: Public Works staff completed additional investigation of sanitary sewer pipe while the 2017 Sewer Rehabilitation Project was in the process of going out for bid. During the additional investigation and cleaning, Public Works staff observed a break in the sanitary sewer pipe under Greenfield Avenue between Woodale Drive and O'Connell Drive as well as under Silver Lake Road between Woodcrest and County Road H. Staff also observed excessive infiltration into the sanitary sewer under Sherwood Road between Groveland Drive and Red Oak Drive. As a result, and after the project was awarded to Insituform, staff discussed the possibility of adding these sections of sanitary main to the 2017 sewer rehabilitation project. Doing so would reduce the potential for future emergency repairs and groundwater infiltration. Since Insituform has not started the project, they agreed to the additional sewer lining. They also stated they would maintain their unit prices for the additional 1,078 feet of 8" liner and 326 feet of 10" liner. The awarded unit price for this work is $26.20 per linear foot of 8" liner and $30.80 per linear foot of 10" liner. This would result in an additional cost of $43,293.00. The current contract amount is $128,943.30. The 2017 Sanitary Sewer Fund (730-4823-7050) includes $150,000 for sewer lining and $25,000 in the Storm Sewer Enterprise Fund (745-4415-5150) for this work. The existing contingency of $12,900 (20%) will be reduced to $2,760 (2.1%). Respectfully submitted, Don Peterson — Interim Public Works Director RESOLUTION 8809 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA APPROVING ADDITIONAL FUNDING FOR THE 2017 SEWER REHABILITATION PROJECT WHEREAS, the Mounds View City Council awarded a contract for the 2017 Sewer Rehabilitation Project (City Project No. 2017-008) to Insituform Technologies USA, LLC.; and, WHEREAS, Public Works staff completed additional investigation and cleaning and observed two pipe breaks and excessive groundwater infiltration in the sanitary sewer pipe; and, WHEREAS, lining an additional 1,078 feet of 8" liner and 326 feet of 10" liner in various parts of the City will greatly reduce the chances for additional emergency repairs; and, WHEREAS, there is sufficient funding available in the Sanitary Sewer Fund (730-4823- 7050) and the Storm Sewer Enterprise Fund (745-4415-5150) to add the additional lining to the contract with Insituform Technologies USA, LLC.; and, WHEREAS, Insituform has the capacity to complete this work in a timely manner. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View, Ramsey County, Minnesota as follows: 1. The lining of an additional 1,078 linear feet of 8" and 326 linear feet of 10" sanitary sewer pipes in various parts of Mounds View shall be added to the existing contract with Insituform Technologies USA, LLC. 2. The 2017 Sewer Rehabilitation Project funding is increased in the amount of 43,293.00, with a decrease in the contingency amount from $12,900.00 to 2,760.00. 3. Funding for the additional work shall be from the Sanitary Sewer Fund (730-4823- 7050) and the Storm Sewer Enterprise Fund (745-4415-5150) in the amount of 43,293.00. 4. The Department is rolling out our Body Worn Camera program, has received overdose training and placed Narcan kits in all of our patrol vehicles, and also placed "Mega Mover" drag bags in the squads to help reduce injuries to officers and patients during lift assists. The Mounds View Police Department answered 3416 calls for service from April through June, with our leading crime continuing to be theft. Bike with Police and Fire Event On 7/13/17, the Mounds View Police was invited to bring in the rockwall to the Ramsey County Library. We called our friends at the SBM Fire Department who had helmets reserved for our residents and invited them to bring them to hand out. An estimated 30 kids received new helmets or had their own helmets properly fitted. The rockwall was a huge hit! Squad cars and fire trucks were climbed through and thoroughly checked out. Police Chief Harder and Fire Chief Smith read stories on bike safety and practiced their stop drop and roll! Our message for kids is to always wear their helmets. Our officer's drive around looking to hand out the best kind of ticket out there ... a free Dairy Queen ice cream cone ... to any kid caught wearing their helmet. SAVE Program SAVE Program has been operating smoothly. Our participants enjoying seeing the familiar faces of Officers involved in the program while they are out and about. Eleven new members were added in May! The relationship with this community and the police has been growing closer and we very much look forward to the continued bond. More education events are planned for the fall. Heartsafe On 5/10/17 the Police Department was invited in to the Adult Education Center and trained 33 people on CPR and AED use. Members from the Survivors Network of MN and SBM Fire Department assisted during this training. In lieu of a video, officers, survivors, and fire personnel demonstrated CPR in acted out scenarios in order to properly educate the learners. The training was challenging and fun! This brings the city another step closer to our HeartSafe designation. On 5/22/17, Brice Bloxham of Mounds View and Raquel Wittkowske of Blaine were trained as team members for this program. They will be assisting in future training events. Other Youth Outreach Events The Mounds View Police Department used our mobile rockwall to reach youth at 10 different events in the last quarter to include: CPY (Community Partners with Youth), Mounds View School District ALC, Pinewood School, new Americans event with the Karen (Burma) community and Maplewood PD, several area church events with youth. School Resource Officer (SRO): The 2016 — 2017 school year has come to a close at Edgewood Middle School. Students have made it through another year, and we wish the Bch grade students good luck as they transition into high school. Incidents at the middle school this quarter requiring law enforcement intervention were again kept to a minimum. A proactive approach this quarter by staff, as the school year drew to a close, made a difference in preventing incidents. There were only a couple of missing/lost cell phones reported this quarter, all of which were recovered and returned to the students. There was only one Disorderly incident reported, one Harassment incident, one Fraud incident report (turned over to an outside agency), and three other Juvenile incidents which were handled through the school, along with parents and the school district. Also in April, SRO Kirk Leitch attended the Pinewood Community Resource Fair on behalf of the MVPD and Edgewood Middle School. SRO Leitch also met with 5th graders at Pinewood Elementary, who will be coming to Edgewood Middle School in the fall of 2017 as 6t1i graders, and presented to them on bullying and harassment. In May, Officer Erickson and his K-9 Partner Niko again returned to Edgewood, in order to give another presentation to the Dogs and Careers Class. Their presentation was again followed by a demonstration of their skills, with SRO Kirk Leitch as their "bite assistant." The presentation was yet again fun and enjoyable for all of the students. CSO Ismail Omar also assisted with Edgewood Middle School Phy-Ed classes in May during their bicycle unit. CSO Omar along with SBM Fire worked with students on bicycle safety, rules, and riding skills. There were also many activities this last quarter at the school, including several choir and band concerts, along with academic and awards banquets. Spring sports eventually came to a close, and students enjoyed their yearend class celebrations for all of their hard work this school year. School safety and security always remains a priority at Edgewood Middle School, especially as the school year comes to a close. Congratulations on another successful school year!! The MVPD hopes that all students, parents, and staff have a fun and safe summer!! MOUNDS VIEW POLICE CANINE (K9) UNIT From April 1St to June 30t" the K9 team responded to 44 calls for service In May the K9 team was deployed 3 times: On 05/24/2017 Officers responded to the 2900 block of Mounds View Blvd for a tip that there was a resident staying at the address with a felony warrant. Contact was made with the suspect while K9 Niko deployed to assist with the arrest. The suspect and was placed into custody. On 5-23-2017 Officers were called to the 2600 block Scotland Court for a suicidal male that cut his wrist with a knife and was unknown if he still had the knife. Officers arrived with K9 Niko and went to the apartment. Officers knocked on the door and the male answered. K9 Niko assisted while officers safely detained the suicidal male without incident. On 5-18-2017 our K-9 team showed off their skills for the kids at Edgewood Middle School. The kids are taking a class in "Careers with Animals". Niko showed off his skills in obedience, article searches, apprehensions, and narcotics searches, and handler protection. This was well received by the kids and staff. In June the K9 team was deployed 8 times: These include tracking suspects, assisting in making arrests, public demonstrations and vehicle searches. On 6-9-2017, Officers were called to the 7600 block of Woodlawn Drive for an active burglary. The homeowner came home and the suspect ran out of the house. Officers tracked with K9 Niko for the suspect. On 6-9-2017, K9 Niko was requested to assist the NBPD with apprehending a felony warrant suspect. Officers gained entry into the suspect's apartment building. Officers gave the K9 announcement and the suspect responded that he gives up and came outside. K9 Niko continued as a deterrent as the suspect was taken into custody. On 6-25-2017 K9 Niko competed in the annual USPCA Police Dog Trial Certifications. Niko certified to continue working as a Police Dog and achieved perfect scores in suspect searches, agility, and suspect apprehension with gunfire. K9 Niko earned first place in Agility and received a nice trophy for his efforts. On 6-23-2017 Officer was called to the 5100 block of Program Ave for a vehicle sniff. The vehicle was believed to have narcotics inside. K9 Niko conducted an interior sniff of the vehicle. Marijuana and paraphernalia were located in the vehicle. New Employee The Mounds View Police Department welcomed probationary Police Officer Sydney Dison last month and she is currently in field training.
