Item Title/Subject: Review the Center for Energy and Environment Contract to
Administer the City of Mounds View's Housing Revolving
Loan Programs
Attached is the loan origination agreement between the Economic Development Authority and
the Center for Energy and Environment including Exhibit A, Program Guidelines and Exhibit B,
Mounds View Revolving Loan Program Budget.
Due to financial hardship, the Greater Metropolitan Housing Corporation (GMHC) will no longer
service Mounds View's loan programs after December 31, 2017, forcing the City to find another
agency to administer the loan programs.
Staff has met with the Center for Energy and Environment (CCE) to discuss their programs and
to determine if they are able and willing to service the City of Mounds Views loan programs. It
was determined that they have the capability and would like to contract with the City to continue
servicing its loan programs. Some loan programs are not offered by CCE that were previously
offered by GMHC and they are recommending that the City consider amending or creating one
or more new loan programs to better accommodate the City's residents.
A representative from CEE will be present to discuss the agreement, loan programs, and
recommendations.
Staff would recommend that Council review the documents and have a discussion with the CCE
representative and make any recommendations that they may have. Staff will prepare the
documents making any necessary changes and have the documents ready for approval at a
future regular Council meeting.

provide technical assistance for commercial and industrial buildings with a focus on providing practical
solutions for complex energy issues.
CEE's engineering projects serve several types of facilities including manufacturing, healthcare,
correctional, office, K-12 schools, college campuses, ice arenas, parking ramps and theatres. Our
engineers focus on a variety of systems and equipment from building automation systems to building
envelopes to HVAC equipment to lighting. We also work with alternative and renewable energy equipment.
PROGRAM DESIGN AND DELIVERY
CEE assists electric and gas utilities in the design and implementation of innovative, cost-effective energy
efficiency programs for residential, multifamily and commercial customers.
CEE's program design is firmly rooted in our research. The energy-saving measures implemented in CEE's
programs are selected through rigorous technical analysis performed by our research staff. CEE's program
experts also design cost-effective marketing strategies and incentives to achieve energy savings
through direct action by individuals, businesses and communities. By utilizing the latest behavioral
research and a "one-stop" approach, CEE's programs overcome barriers that many homeowners and
business owners face when considering energy improvements.
Featured Programs
One -Stop Efficiency ShopO— The One -Stop Efficiency Shop@ is a full-service lighting rebate
program available to small businesses in Xcel Energy's Minnesota service territory with an electric
demand of 400 KW or less. The program's turnkey approach is specifically designed to address
the concerns small business owners face when choosing more efficient lighting: limited financial
resources and time, limited knowledge of lighting products and access to quality contractors.
Home Energy Squad Enhanced — Home Energy Squad Enhanced is a one-stop, full service
residential energy program currently offered in partnership with CenterPoint Energy, Xcel Energy
and several cities across the metro. The Home Energy Squad Enhanced program combines the
direct installation of energy-saving devices such as high -efficiency lighting, shower heads and
programmable thermostats with a full assessment of energy-saving opportunities, including a
blower door test to identify insulation and air -sealing needs, a furnace safety check and a
personalized report.
LENDING CENTER
Since 1989 CEE has worked cooperatively with various agencies throughout Minnesota to develop and
fund innovative financing products that address unmet needs and that complement offerings of utilities,
government agencies, private institutions and foundations. CEE finances more than $8 million in energy
efficiency and rehabilitation improvements annually. CEE's variety of financing includes revolving loan
pools, interest rate buy -downs, deferred and forgivable loans and grants.
CEE is a non-traditional lender that offers competitive terms, technical assistance, and a wide array of
flexible financing options for Minnesota businesses, nonprofits, homeowners and multi -family property
owners for -rehabilitation and energy efficiency projects.
INNOVATION EXCHANGE
A core component of CEE's nonprofit mission is to advance the field of cost-effective energy efficiency
in the public interest. The Innovation Exchange houses research and education activities that are
grounded in the practical approaches of our program and field experience.
RESEARCH
Research informs all of our programs. We field test systems and equipment in buildings ranging
from homes to high rise office towers, generating objective data on measured energy savings. We
conduct technology and market assessments to identify tomorrow's energy strategies. Our nationally
recognized research staff has published over 100 technical papers on building and mechanical
system performance.
Building energy systems and enclosures — CEE is leading efforts to field test combination
water and space -heating systems and develop combustion safety protocols through a Northern
STAR DOE Building America team. State of Minnesota -funded work includes field studies of
advanced rooftop HVAC unit controls, condensing boiler efficiency optimization, and reducing the
energy cost of effective ventilation in multi -unit buildings. We are also measuring the reduction in
energy use for air sealing older low- and mid -rise commercial buildings in Minnesota.
Behavioral aspects of energy use— CEE is evaluating energy savings and customer satisfac-
tion from two types of feedback mechanisms on energy use provided to residential customers.
We are also evaluating a service providing energy use feedback to owners/managers of multi-
family buildings.
Indoor air quality — CEE is monitoring incursions of secondhand smoke into non-smokers'
apartments in multifamily buildings, as well as secondhand smoke transfer in hospitality venues.
EDUCATION & OUTREACH
The Innovation Exchange is CEE's resource for practitioners and experts to share best practices,
evaluate novel ideas and discover the next generation of energy solutions. We encourage energy
practitioners to explore tools based on lessons learned from our programs and research.
Knowledge Dissemination — We maintain an online resource center of technical documents
and data -driven tools, host events and webinars, and use innovative communication technologies
to share insight and information with energy professionals.
Information Visualization— We use design to synthesize information ranging from efficient
lighting to the history of energy in Minnesota to both technical and non-technical audiences. Our
video animations demonstrate research project procedures and results. Internally, we visualize
program data sets to identify trends.
Minnesota Energy Challenge—The Minnesota Energy Challenge is a free, online action guide
to help Minnesotans reduce energy waste at home. Since its launch in 2006, more than 29,500
Minnesotans have pledged to save $13 million in energy costs, avoiding 240 million pounds of
CO2 emissions. The Tolby (Turn Off Lights Behind You) program educates Minnesota youth about
energy efficiency.

which remains the lowest cost and lowest impact way to meet Minnesota's future energy needs.
The Lending Center at the Center for Energy and Environment (CEE) and Minnesota
Housing offer low interest loans for Minnesota homeowners to make improvements
in their homes. CEE, a Minneapolis based nonprofit organization, is the lender for
this program and will assist homeowners through the loan process.

I went through the website and have some questions so I can get some guidelines together. I will list
each program on your site and then make notes.
Assistance for Home Owners Page: The Energy Conservation Deferred Loan is administered by
us and is available. When you click on the link it says the site is currently unavailable. I will get you
the link for this.
Home Improvement Loans:
Ramsy County Residential Rehab Deferred Loan: This program is now being run by Ramsey
County and they may put out for bid next year. But for now, residents should contact Ramsey County
directly. Their phone number is 651-266-8000. Mary Lou Egan would be the contact.
MHFA Fix Up Fund Loan: We administer and is available now
MHFA Rehab Deferred Loan: GMHC stopped administering this program in the fall of 2016 and we
also don't administer this program. This should be removed from the website.
MHFA Rental Rehab Loan: This loan is no longer available. This can also be removed from the
website.
From the Senior Housing Regeneration Program to the General Home Repair Loan I can't find what
the loan terms are or if they were administered by GMHC.
Most of the cities have a regular loan program at rates between 4-5% for general rehab and then a
last resort program. I can create some guidelines for all of the pools that it looks like you had, but
with the amount of funds I would keep it simple.
IDEAS:
Mounds View Home Repair Loan: 4%, up to 10 year loan term and up to $15,000. Income limits
would be an option since we do have a home improvement loan with no income limits up to $20,000
at 5.99%. Maybe go with a 110% of Median based on household size. I have attached the current
HUD Income Table to look at.
Mounds View Interest Subsidy: We just started up 3 (Crystal, Brooklyn Center and Crystal) city
programs with this. It's where you would but the MN Housing rate down from 5.99% to 3%. This
would make your funds go further, but once they are gone they are gone. The income limit on this is
$104,000 for the household. The MN CFUF Loan is up to $50,000, but you could make it smaller and
the funds would go further. I would just need to apply to MHFA on your behalf (with a letter of
endorsement) and hopefully have it up and running January 1, 2018 if we could get it on the MN
Housing agenda soon.

LOAN ORIGINATION AGREEMENT
This LOAN ORIGINATION AGREEMENT ("Agreement") is made by and between the ECONOMIC
DEVELOPMENT AUTHORITY in and for the City of Mounds View, with offices at 2401 Mounds View Blvd,
Mounds View, MN 55112 ("Authority"), and CENTER FOR ENERGY AND ENVIRONMENT, with offices at
2123 d Avenue North, Suite 560, Minneapolis, Minnesota 55401 ("CEE").
RECITALS
A. The Authority has a need for certain professional services and desires to retain CEE to
provide said services, all subject to the terms and conditions contained in this Agreement.
B. CEE is qualified to provide the desired professional services and desires to provide said
services for the Authority, all subject to the terms and conditions contained in this
Agreement.
NOW, THEREFORE, in consideration of the foregoing and the mutual promises contained in this
Agreement, the parties agree as follows:
1. Services/Scope of Work
1.1 CEE shall in conjunction with the Authority develop and deliver the City of Mounds View Home
Improvement Loan Program (hereinafter the "Program") and more fully described in Exhibit A
attached hereto. All activities delivered under the Program shall be coordinated with the
Authority's designated Finance Director, Mark Beer and/or Brian Beeman the Business
Development Coordinator.
1.2 CEE shall assist the Authority staff in marketing the Program. CEE shall insure that the
Authority's sponsorship of the program is a prominent part of any marketing effort.
(OPTIONAL at $65/hr)
1.3 The funding source is exclusively from the Authority and the program will be referred to
as the Authority Funded Program.
2. Compensation
2.1 The Authority shall compensate CEE for services provided under this agreement
according to the following schedule and more fully described in Exhibit B attached hereto:
Loan Set -Up Fee
$1,500.00
The Authority shall pay CEE a one time loan set-up fee. This shall compensate CEE for time and
labor to create the loan program.

Loan Origination Fee
$550.00
The Authority shall pay CEE an Origination Fee for each loan closed using the Authority Funded
Program. The Origination Fee shall compensate CEE for assisting borrowers with loan
applications, preparation of loan documents, loan closing and other direct costs of processing
loans. Mortgage filing fees, credit report, flood, title work and a 1% Origination Fee shall be
paid by the borrower. CEE shall provide a copy of closing documents including the loan note
and mortgage as documentation of the loan closing.
Remodeling Advisor Visit Fee(RAV)
$225.00
CEE will provide City of Mounds View homeowners with rehabilitation counseling services to
assist in evaluating projects, bids and how to move forward with their project. The visit fee is
for each site visit or trip to the property. Phone calls, emails and other forms of
communication are included in the fee. (OPTIONAL)
Post Installation Inspection Fee (PII) and Emergency Deferred Loan Inspection $100.00
The Authority shall pay CEE a fee for each post installation inspection (PII) and emergency
deferred loan inspection completed. The PII inspection shall be performed by CEE whenever
the project does not require a building permit to verify the work was completed. The
emergency deferred loan inspection shall be required to determine project eligibility for the
emergency deferred loan program.
The Authority shall compensate CEE only for services completed.
Upon request, CEE will provide marketing services for the following fees: (OPTIONAL)
CEE Labor $65
Hourly rates are inclusive of all overhead expenses and will be charged only for hours directly
related to marketing. CEE will be reimbursed by the Authority for any non -labor, out-of-pocket
expenses, relating to these services on a dollar -for -dollar basis with no mark-up.
2.2 CEE shall invoice the Authority not more than two times each month for the principal of
loans and administrative fees. The Authority shall pay CEE within 20 days of receipt of the
invoice.
3. CLIENT's Obligations
3.1 If requested by CEE, the Authority shall make reasonable efforts to respond promptly
to requests from CEE for information and approvals regarding the services to be
provided under this Agreement.

3.2 If requested by CEE, the Authority shall make reasonable efforts to obtain information
and or permission for access from clients which may be necessary for CEE to provide
the services under this Agreement.
3.3 The Authority shall provide sufficient funding to fund eligible Authority funded loans.
The Authority shall determine the amount of funds allocated to the Program.
3.4 The Authority shall establish eligibility for the Authority Funded Program and shall
provide these criteria in writing to CEE prior to commencement of any marketing
efforts.
3.5 The Authority shall make reasonable efforts to respond promptly to requests from CEE
for information and approvals regarding the services to be provided under this
Agreement.
4. CEE's Obligations
4.1 CEE shall use its best efforts to provide services under this Agreement in a professional
manner consistent with the care and skill used by reputable members of CEE's
profession.
4.2 CEE, and all of its employees or agents, shall comply with all statutes, ordinances,
rules, regulations and other laws applicable to the provision of services under this
Agreement.
4.3 CEE shall secure all permits and licenses required for performance of the services
under this Agreement.
4.4 CEE shall not engage in discriminatory employment practices against any employee or
applicant for employment and shall in all respects comply with all federal, state and
local laws, regulations and orders, including without limitation, Chapter 363 of the
Minnesota Statutes, as amended from time to time. Failure to comply with the
provisions hereof shall be deemed a material default under this Agreement.
5. Term and Termination
5.1 Unless earlier terminated as provided in the following paragraphs, this Agreement
shall become effective on TBD, and continue through TBD. Thereafter, the Agreement
shall automatically renew for successive one (1) year periods, unless CEE or Authority
provides written notice of non -renewal to the other party at least sixty (60) days
before the end of the current term.
5.2 This Agreement may be terminated by either party, for any reason or no reason,
immediately upon written notice to the other party. In the event this Agreement is
terminated by CEE prior to the expiration of the term set forth in paragraph 5.1, the

Authority shall compensate CEE for all services delivered up the date of termination
and CEE shall provide the Authority with such information as the Authority may
request regarding the status of the Authority Funded Program.
5.3 Any termination of this Agreement shall not release either party from their respective
obligations under sections 7 and 8 of this Agreement.

6.1 During the term of this Agreement, CEE will obtain and maintain insurance in the
amounts listed below:

Statutory Limit
7.1 CEE represents that the services to be provided under this Agreement are reasonable
in scope and that CEE has the experience and ability to provide the services.
7.2 CEE warrants that any services provided hereunder shall be done in a professional and
workmanlike manner.
7.3 CEE shall indemnify, defend and hold harmless Authority and its officers, directors,
employees and agents from and against any and all claims, damages, losses, injuries
and expenses (including attorneys' fees and damages for death, personal injury and
property damage) which Authority may incur as a result of any act or omission by CEE
in providing services under this Agreement.
7.4 Authority shall indemnify, defend and hold harmless CEE and its officers, directors,
employees and agents from and against any and all claims, damages, losses, injuries
and expenses (including attorneys' fees and damages for death, personal injury and
property damage) which CEE may incur as a result of any act or omission by Authority
in discharging its duties under this Agreement.
Confidentiality
Unless otherwise agreed by Authority in writing, CEE shall maintain in confidence and not
disclose to any third party any information obtained regarding the Authority and/or any of
Authority's clients for which CEE is providing services; provided, however, that this obligation
to maintain confidentiality shall not apply to:
a) Information in the public domain at the time of disclosure;

b) Information which becomes part of the public domain after disclosure through
no fault of CEE; or
c) Information which CEE can demonstrate was known by it prior to the date of
this Agreement.
Notwithstanding the foregoing, CEE shall be entitled to disclose the documents or client
information covered by this paragraph to governmental authorities to the extent CEE reasonably
believes it has a legal obligation to make such disclosures and to the extent CEE reasonably
deems to be necessary; provided, however, that if CEE believes that any such disclosure is
required by law, it shall provide advance notice to the Authority to provide the Authority with a
reasonable opportunity to attempt to obtain an injunction or other protective order preventing
such disclosure.
9. Relationship of Parties
CEE will provide services as an independent contractor under this Agreement. Neither CEE,
nor any of its employees or agents, shall be considered employees of the Authority for any
purpose, and neither shall CEE be eligible for any compensation or benefits which the
Authority may provide to its employees from time to time. CEE shall be solely responsible for
all employment and other taxes applicable to providing services hereunder, and the
Authority will not withhold any taxes or contributions from the compensation payable to CEE
under this Agreement.
10. Notices
All notices, requests, demands and other communications required to be given in writing
under this Agreement shall be given to the other party in person or by mail as provided in
this section. If delivered personally, notice shall be deemed to have been duly given on the
date of delivery. If delivered by mail, such notice shall be sent via first class U.S. mail,
postage prepaid, to the address set forth at the beginning of this Agreement or such other
address as a party may otherwise request by written notice, and notice shall be deemed duly
given three (3) business days after mailing.
11. Assignment
This Agreement shall be binding upon and inure to the benefit of the parties and their
respective heirs, successors and assigns; provided, however, that neither party shall assign or
transfer in any manner, this Agreement or any portion hereof without the prior written
consent of the other party, and any attempt to assign or transfer without prior written
consent shall be void and of no effect.
12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State
of Minnesota.
13. Miscellaneous
13.1 Headings and captions used in this Agreement are for convenience only and shall not
affect the meaning of this Agreement.
13.2 This Agreement contains the entire agreement of the parties and supersedes all prior
agreements, discussions and representations, written or oral, concerning the subject
matter hereof.
13.3 No waiver by the Authority of any term or condition of this Agreement or any
document referred to herein shall, whether by conduct or otherwise, be construed as
a waiver or release of any other term or condition of this Agreement.
13.4 This Agreement may only be amended in a written agreement signed by both parties.
13.5 Except as expressly set forth in section 7, the rights and benefits under this Agreement
shall inure solely to the benefit of the Authority and CEE, and this Agreement shall not
be construed to give any rights, benefits or causes of action to any third party.
13.6 The invalidity or partial invalidity of any provision of this Agreement shall not
invalidate the remaining provisions, and the remainder shall be construed as of the
invalidated portion shall have never been a part of this Agreement.
13.7 CEE shall comply with the provisions of Minnesota Statutes Chapter 13 (Government
Data Practices) that are applicable to the Authority and shall not disseminate any
information concerning loan requests of the borrowers without the prior written
approval of the Authority.
13.8 This Agreement may be signed in any number of counterparts, each of which shall be
deemed an original and one and the same instrument.

MOUNDS VIEW LOAN PROGRAM GUIDELINES
The City of Mounds View is making funds available for homeowners to make improvements to their
properties. The Mounds View Loan Program is designed to supplement existing loan programs available
from MHFA, CEE, private lenders and other housing resources. This program is not intended to be the
sole source of improvement funds available to the City. Center for Energy and Environment shall serve
as the administrator for the Mounds View Loan Program and will secure the most beneficial financing
based on the borrower's needs independent of the funding source.
Interest Rate: 4% fixed
Amortization Type: Amortizing. Closed-end (Monthly Payments Required)
Loan Amount: Minimum of $2,000 and Maximum of $15,000.
Total Proiect Cost: The borrower must have sufficient funds necessary to cover the cost of the entire
project (as outlined in the bid(s). Additional funds may come from the applicants personal savings, gifts,
or other NON Roseville EDA loans.
Loan term: Generally, one year per $1,000 borrowed. This will be somewhat flexible depending on the
size of the loan and the borrower's ability to repay the loan. The minimum term is 1 year; the maximum
term will be 10 years.
Eligible Properties: 1-4 unit owner -occupied properties located within the geographical boundaries of
the City of Mounds View. Townhomes and Condominiums are eligible (interior improvements only).
Ineligible Properties: Dwellings with more than four units, cooperatives, manufactured homes, time
shares, properties held in the name of a trust and properties used for commercial purposes.
Eligible Borrowers: All borrowers must be legal residents of the United States, as evidenced by a social
security number, Including: U.S. Citizens, Permanent Resident Aliens, Non -Permanent Resident Aliens.
TAX IDENTIFICATION NUMBERS (ITIN) ARE NOT ACCEPTABLE.
Ineligible Borrowers: Including but not limited to: - Foreign Nationals, Non -Occupant Co -Borrowers,
and Properties held in the name of a trust.
Ownership/Occupancy: Owner- occupied only.

Loan - to - Value Ratio: The ratio of all loans secured by the property, including the new loan, should
not exceed 110% of the property value. Half of the improvement value may be added to the initial
property value.
Income Limit: TBD.
Debt - to - Income Ratio: Applicant must have the ability to repay the loan. An applicant who has a debt
to income ratio in excess of 50% will be ineligible to receive financing.
Credit Requirements: 1) All mortgage payments must be current and reflect no 30 day late payments
history in the past 12 month period (without reasonable explanation) 2) All real estate taxes must be
current. 3) No outstanding judgements or collections. 4) Bankruptcy must have been discharged for at
least 18 months prior to loan closing. 5) The redemption period on prior foreclosures must have
occurred at least 18 months prior to the loan application date. 6) Generally, no more than two 60 -day
late payments on credit report. Any 60 day late requires a documented explanation and reasonable
reasons; medical, unemployment, divorce. 7) No defaulted government loans.
Multiple Loans per Property: More than one loan per property is allowed, however, the outstanding
balance(s) cannot exceed $15,000.
Eligible Use of Funds: Loans may be used to finance most interior and exterior improvements that
improve the basic livability of the property. Garages, decks, porches, retaining walls, skylights,
landscaping and fences can be repaired, replaced or built as new construction. Contractors must be
properly licensed and permits must be obtained when required.
Ineligible Use of Funds: Payment for work initiated prior to the loan being approved and closed, unless
due to emergency. Recreation or luxury projects (pools, lawn sprinkler systems, playground equipment,
saunas, whirlpools, etc.), furniture, non -permanent appliances (unless part of a full kitchen remodel),
and funds for working capital, debt service, homeowner labor or refinancing existing debts are NOT
allowed.
Bids: 2 bids are required when the work from any one contractor exceeds $5,000. All contractors must
be properly licensed, as required by the City of Mounds View.
Sweat Equity/ Homeowner Labor: Work maybe performed by property owners on a "sweat equity"
basis. Loan funds may be used only for the purchase of materials. Loan funds cannot be used to rent
tools/ equipment or compensate for labor. The property owner will provide evidence to CEE that they
have the ability to complete the work.
Post Installation Inspection: Permits must be obtained and signed off by a City inspector where
required; when not required, a post installation inspection will be performed by CEE to ensure the work
has been completed before any funds will be released.
Loan Security: All loans will be secured with a mortgage in favor of the City of Mounds View. Borrower
will pay all applicable title and filing fees, which may be financed in the loan amount.

Borrower Fees: Borrower will be responsible for a 1% origination Fee, mortgage filing and service fees,
flood certificate and credit report fees all which may be financed in the loan amount.
Underwriting Decision: Applicants must have acceptable credit history. CEE will approve or deny loans
based on a credit report, income verification and other criteria as deemed necessary through CEE's
underwriting guidelines. CEE's decision shall be final. Appeals can be made to the City of Mounds View.
Work Completion: All work must be completed within 120 days of the loan closing. However, when
warranted, CEE may authorize exceptions on a case by case basis.
Loan Security: All NRP loans will be secured with a mortgage in favor of the City of Mounds View
The intent of the Mounds View Emergency Repair Deferred Loan Program is to provide assistance to
property owners in the Nokomis East community who face emergency home repairs and cannot qualify
for other housing related programs to remedy the situation.
Interest Rate: 0%
Loan Amount: Minimum loan is $1,000. Maximum loan is $5,000 within any time period.
Total Project Cost: It is the borrower's responsibility to obtain the amount of funds necessary to finance
the entire cost of the work. In the event the final cost exceeds the original loan amount, the borrower is
responsible to provide proof of having funds to pay for the remaining portion.
Loan term: Loan will be deferred until the borrower sells or transfers title of the property, at which time
100% of the loan is due.
Eligible Properties: Owner -occupied properties with up to 4 dwelling units located within the
boundaries of the City of Mounds View. Condos and townhomes are eligible.
Ineligible Properties: Dwellings that are more than 4 units (these would be considered apartment and
hence commercial properties), co-ops, manufactured homes, time shares, and properties used for
commercial purposes.
Eligible Borrowers: Owners of 1-4 unit properties within the City of Mounds View who meet the
program guideline criteria. The borrower must not be eligible for any other financing administered by
CEE in order to obtain an Emergency Program loan.
Ineligible Borrowers: Include but are not limited to: nonresident owners, non -occupant co -borrowers,
properties held in the name of a trust.
Ownership / Occupancy: Only owner -occupied. Contract for Deeds are eligible.

Multiple Loans per Property/Borrower: Multiple emergency loans on a property are allowed if the
balance is within the overall maximum loan limit.
Eligible Improvements: An emergency is defined as an imminent condition that makes a house
uninhabitable, dangerous to the occupants, or is capable of causing severe health problems. Repairs
that will remedy such emergency repairs are eligible. Examples of eligible repairs include, but are not
limited to, water lines, sewer service, fire hazards, repair to exterior steps, railings, retaining walls, water
seepage into basement, structural problems, or replacement of a furnace or hot water heater.
Repairs that remedy code violations and those needed to address home repairs before they
significantly de -value the home and become much more serious problems, are also eligible
whether or not the city has issued a code violation. Examples of eligible repairs include, but are
not limited to, leakage around windows, rotting fascia, holes in siding, roof leakage, crumbling
brick or concrete and deteriorated retaining walls. CEE will determine eligibility of projects.
Ineligible Improvements: Work initiated prior to the loan being approved and closed. Personal
property items, including appliances, furniture, hot tubs, swimming pools, and other luxury items,
exterior plumbing (e.g. sprinkler systems), non -permanent landscaping fixtures (e.g. potted plants,
furniture, bird feeders), repairs to property used for business or trade purposes, refinancing existing
indebtedness, and labor costs of borrowers and/or residents. CEE will refer to the NENA whenever
eligibility of an improvement project is questionable.
Bidding: Except when labor is provided by the borrower, the borrower must provide a minimum of 1
bid for each improvement project under $5,000 and 2 bids for each project more than $5,000. All
contractors must be properly licensed. Permits must be obtained when required by City ordinance.
Sweat Equity: Not permitted
Property Inspection: Required. Eligible improvements will be determined through an analysis of the
emergency condition of the property. A CEE staff member will perform the analysis to determine the
severity of the situation.
Post Installation Inspection: Properties are subject to a post installation inspection by a CEE staff
member when a permit is not required. Where a permit is required, the work must be signed -off by a
City inspector prior to release of funds.
Work Completion: All work must be completed within 30 days of loan closing. Extensions may be
granted by CEE.

Underwriting Decision: CEE will review the application and submitted documentation for consideration
for other home improvement programs prior to considering the application for the Emergency Repair
Loan Program. CEE will approve or deny loans based on income verification and other criteria. This is a
last resort program. The borrower must not be eligible for any other financing administered by CEE in
order to obtain an Emergency Repair Deferred loan. CEE's decision shall be final.
Loan Security: All NRP loans will be secured with a mortgage in favor of the City of Mounds View.
General Program Conditions
Application Processing: Loans will be distributed on a first come first serve basis as borrowers qualify.
Applicants must provide a completed application package including the following in order to be
considered for funding.
➢ Completed and signed application form
➢ Proof of income
➢ Bids or estimates for proposed projects
➢ Other miscellaneous documents loan officers may require.
Contractors/Permits: Contractors must be properly licensed to work in the City of Mounds View.
Permits must be obtained when required by city ordinance.
Program Costs: Loan origination, post installation inspection and remodeling advisor visit fees will be
paid out of the Program Budget. Loan program marketing efforts will be billed directly to the City of
Mounds View and is a separate expense should the City of Mounds View choose to commission CEE for
marketing support. Borrowers will pay all mortgage filing fees and related closing costs.
Total Project Cost: It is the borrower's responsibility to obtain the amount of funds necessary to finance
the entire cost of the work. In the event the final cost exceeds the original loan amount, the borrower
must obtain the additional funds and show verification of the additional funds in order to be approved
for the loan.
Disbursement Process: Payment to the contractor (or owner in sweat equity situations) will be made
upon completion of work. An inspection will be performed by a City Inspector and/or CEE to verify the
completion of the work. The following items must be received prior to final disbursement of funds:
• Final invoice or proposal from contractor (or materials list from supplier);
• Final inspection verification by a City Inspector (or CEE);
• Completion certificate(s) signed by borrower and contractor;
• Lien waiver for entire cost of work;
• Evidence of city permit (if required)

CEE shall submit monthly invoices to the City of Mounds View for the loan principal and
administrative fees and quarterly invoices for the aged delinquency reporting services.
Services performed by CEE will initially be funded from the Total Program Budget as stated
above and paid in accordance with the following schedule.
(1) Origination: Revolving and Emergency $550.00 per loan closed
(2) Post Installation Inspection $100.00 per inspection
(3) Remodeling Advisor Visit $225.00 per inspection
Loan Servicing
The City of Mounds View will contract directly with a servicing company. The City of Mounds
View shall establish a process where CEE receives copies of the monthly servicing reports.
4. Marketing
Marketing efforts will be supported by CEE and marketing costs are not included in the
administrative budget. Hourly rates are inclusive of all overhead expenses and will be charged
only for hours directly related to the labor of all program marketing. CEE will also be reimbursed
by the City of Mounds View for any non -labor, out-of-pocket expenses relating to these services
on a dollar -for -dollar basis.

Introduction:
Administration coordinated review and updating of the City fee schedule. This is done on
an annual basis. Adoption of the schedule is slated for the November 27, 2017 meeting
Discussion:
Revisions to the Fee Schedule are highlighted in red (deletions) and blue (additions).
Specific to the Community Development/Building and Codes area, we are recommending
we migrate from our home crafted fees to state statute. This entails deleting much of the
Mounds View specific and inserting an Appendix that is the statutory citation. Furthermore,
we state that appendix is adopted as "amended from time to time" thus providing an
automatic update if the statute is updated.
Our fees were based on set rates whereby the state, which the vast majority of metro cities
use, based on valuation which is a better reflection of the workload. Based on a survey
done by the Permit Technician, we were slightly below our neighboring communities and
this change will align us with them.
Specific to rental rates at our parks and the YMCA, we are recommending rate adjustments
based on the YMCA Advisory Committee and Park Board recommendations for room
rentals and park building usage. The YMCA room rates at the Community Center go down
for off peak times to entice business usage during those times. Athletic Field and Park
Building rates increase to cover operational and maintenance costs.
Specific to the utility rate increases, Finance Director Beer monitors our current and future
needs along with surveying similar and surrounding communities and is recommending a
rate increase to fund current but more accurately, future investments that will be required to
maintain a safe and reliable municipal utilities.

D. OTHER INSPECTIONS / PLANNING FEES
Applicants are responsible for all costs incurred associated with the filing, review and processing of development
applications. Such fees are to be paid in escrow up front or upon receipt of statement from the City of Mounds
View. Fees may include but are not limited to costs for consultants retained by the City, consultant planning
services, attorney, and engineer fees. A deposit may also be required to cover costs of public notices, materials and
staff time spent in the review, research or preparation of materials associated with this application. The applicant shall
be responsible for all reasonable incurred costs in excess of the initial fee and/or deposit amount. Any portion of the
deposit not spent or encumbered shall be refunded to the applicant within 30 days after consideration of the
application is completed. Payment of park dedication fees is required with subdivision applications. Application

326B.153 BUILDING PERMIT FEES.
Subdivision 1. Building permits. (a) Fees for building permits submitted as
required in section 32613.107 include:
(1) the fee as set forth in the fee schedule in paragraph (b) or as adopted by a
municipality; and
(2) the surcharge required by section 32613.148.
(b) The total valuation and fee schedule is:
(1) $1 to $500, $21;
(2) $501 to $2,000, $21 for the first $500 plus $2.75 for each additional $100 or
fraction thereof, to and including $2,000;
(3) $2,001 to $25,000, $62.25 for the first $2,000 plus $12.50 for each additional
$1,000 or fraction thereof, to and including $25,000;
(4) $25,001 to $50,000, $349.75 for the first $25,000 phis $9 for each additional
$1,000 or fraction thereof, to and including $50,000;
(5) $50,001 to $100,000, $574.75 for the first $50,000 plus $6.25 for each additional
$1,000 or fraction thereof, to and including $100,000;
(6) $100,001 to $500,000, $887.25 for the first $100,000 plus $5 for each additional
$1,000 or fraction thereof, to and including $500,000;
(7) $500,001 to $1,000,000, $2,887.25 for the first $500,000 plus $4.25 for each
additional $1,000 or fraction thereof, to and including $1,000,000; and
(8) $1,000,001 and up, $5,012.25 for the first $1,000,000 plus $2.75 for each
additional $1,000 or fraction thereof.
(c) Other inspections and fees are:
(1) inspections outside of normal business hours (minimum charge two homy),
$63.25 per hour;
(2) reinspection fees, $63.25 per hour;
(3) inspections for which no fee is specifically indicated (minimum charge one-half
hour), $63.25 per hour; and
(4) additional plan review required by changes, additions, or revisions to approved
plans (minimum charge one-half hour), $63.25 per hour.
(d) If the actual hourly cost to the jurisdiction under paragraph (c) is greater than
$63.25, then the greater rate shall be paid. Hourly cost includes supervision, overhead,
equipment, hourly wages, and fringe benefits of the employees involved.

Subd. 2. Plan review. Fees for the review of building plans, specifications, and
related documents submitted as required by section 32613.106 must be paid based on 65
percent of the building permit fee required in subdivision 1.
Subd. 3. Surcharge. Surcharge fees are required for permits issued on all buildings
including public buildings and state licensed facilities as required by section 326B.148.
Subd. 4. Distribution. (a) This subdivision establishes the fee distribution between
the state and municipalities contracting for plan review and inspection of public buildings
and state licensed facilities.
(b) If plan review and inspection services are provided by the state building official,
all fees for those services must be remitted to the state.
(c) If plan review services are provided by the state building official and inspection
services are provided by a contracting municipality:
(1) the state shall charge 75 percent of the plan review fee required by the state's fee
schedule in subdivision 2; and

326B.148 SURCHARGE.
Subdivision 1. Computation. To defray the costs of administering sections
326B.101 to 326B.194, a surcharge is imposed on all permits issued by municipalities in
connection with the construction of or addition or alteration to buildings and equipment or
appurtenances after June 30, 1971. The commissioner may use any surplus in surcharge
receipts to award grants for code research and development and education.
If the fee for the permit issued is fixed in amount the surcharge is equivalent to one-
half mill (.0005) of the fee or $1, except that effective July 1, 2010, until June 30, 2015,
the permit surcharge is equivalent to one-half mill (0005) of the fee or $5, whichever
amount is greater. For all other permits, the surcharge is as follows:
(1) if the valuation of the structure, addition, or alteration is $1,000,000 or less, the
surcharge is equivalent to one-half mill (.0005) of the valuation of the structure, addition,
or alteration;
(2) if the valuation is greater than $1,000,000, the surcharge is $500 plus two-fifths
mill (,0004) of the value between $1,000,000 and $2,000,000;
(3) if the valuation is greater than $2,000,000, the surcharge is $900 plus three -tenths
mill (.0003) of the value behveen $2,000,000 and $3,000,000;
(4) if the valuation is greater than $3,000,000, the surcharge is $1,200 plus one-fifth
mill (.0002) of the value between $3,000,000 and $4,000,000;
(5) if the valuation is greater than $4,000,000, the surcharge is $1,400 plus one-tenth
mill (.0001) of the value between $4,000,000 and $5,000,000; and
(6) if the valuation exceeds $5,000,000, the surcharge is $1,500 plus one -twentieth
mill (.00005) of the value that exceeds $5,000,000.
Subd. 2. Collection and reports. All permit surcharges must be collected by each
municipality and a portion of them remitted to the state. Each municipality having a
population greater than 20,000 people shall prepare and submit to the commissioner once a
month a report of fees and surcharges on fees collected dining the previous month but
shall retain the greater of two percent or that amount collected up to $25 to apply against
the administrative expenses the municipality incurs in collecting the surcharges. All other
municipalities shall submit the report and surcharges on fees once a quarter but shall retain
the greater of four percent or that amount collected up to $25 to apply against the
administrative expenses the municipalities incur in collecting the surcharges. The report,
which must be in a form prescribed by Che commissioner, must be submitted together with
a remittance covering the surcharges collected by the 15th day following the month or
quarter in which the surcharges are collected.
A municipality that fails to report or submit the required remittance to the department
in accordance with this subdivision is subject to the remedies provided by section
32613.082.
Subd. 3. Revenue to equal costs. Revenue received from the surcharge imposed in
subdivision I should approximately equal the cost, including the overhead cost, of
administering sections 326B.101 to 326B.194.
