Item Title/Subject: Resolution 8169, Consideration of a Minor Subdivision:
Lot Line Change between 3030 & 3032 County Road J;

Introduction:
John Engberg, owner of 3030 County Road J, has applied for a minor subdivision to adjust
the lot line between his property and his late mother's property next door at 3032 County
Road J. The lot line change is not for development purposes or to create any additional lots,
but simply an extra 1,020 square feet of backyard area for the applicant. The applicant has
submitted a Certificate of Survey that shows the property line change. The property at 3032
County Road J is now owned by the children of Mary Engberg and they have agreed to this
subdivision.
Discussion:
A minor subdivision is ordinarily a division of land less than two acres in area in which no
more than one additional lot is created. Even though this particular request isn't creating
additional lots, it is still processed as a minor subdivision.
The lot is zoned R-1, Single Family Residential and the Comprehensive Plan designates this
area for low density residential. The minimum lot width for interior residential parcels is 75
feet and the minimum lot area is 11,000 square feet, and corner lots must be a minimum of
100 feet wide and 12,500 square feet. Below is a table which shows the rear dimensions for
the parcels before and as a result of the proposed adjustment (the front dimensions won't be
changing):
As this table shows, the proposed lots still exceed all city standards.
Park Dedication Requirements.
Subdivisions of land are subject to park dedication requirements consistent with Chapter 1204
of the City Code. When the subdivided parcels are not going to be developed, Staff typically
recommends that the park dedication fee not be required. Since there will be no additional
development on the lots, staff is recommending that the park dedication fee not be required.

Easements.
With most subdivisions, the City requires the owner to dedicate drainage and utility
easements around the perimeter of the lot. Since there will be no construction occurring, staff
is not requiring that these easements be added at this time. The applicant is adding a 15 foot
easement to the rear of the 3032 County Road J property so he will be able to access pipes
he installed to drain stormwater from his backyard, across the 3032 lot and into an existing
underground pipe after the 3032 property is sold.
Public Notice.
No public notice is required for a minor subdivision.
Summary.
The proposed subdivision will simply adjust part of the property line between 3030 and 3032
County Road J to give 3030 County Road J 1,020 more square feet. All minimum city
requirements are met with this request.
Recommendation:
Because the proposed subdivision satisfies all city code requirements, Staff is recommending
approval of Resolution 8169, a resolution approving the minor subdivision of 3030 County
Road J, owned by John Engberg, and 3032 County Road J, owned by the family of Mary
Engberg.

WHEREAS, John Engberg, has requested approval of a minor subdivision to
adjust the common lot line between 3030 County Road, J and 3032 County Road J; and,
WHEREAS, both of the properties are zoned R-1, Single Family Residential, and
are legally -described as:

WHEREAS, the 12 feet by 85 feet of land being detached from 3032 County

WHEREAS, the Applicant proposes to adjust the lot line dividing 3030 and 3032
County Road J to give the property at 3030 County Road J an additional 1,020 square feet
(12'x 85'); and,
WHEREAS, the City Council has reviewed the Applicant's request for a minor
subdivision and has determined that it is in conformance with Chapters 1104, 1201, and
1202 of the Municipal Code; and
WHEREAS, the City Council finds that the Applicant's request for a minor
subdivision is in conformance with the Comprehensive Plan; and,

WHEREAS, since no additional homes or development will occur as part of this
subdivision, a park dedication fee is not required with this subdivision application; and,
NOW, THEREFORE, BE IT RESOLVED that the Applicant shall have 6 months
from final approval to file proper documentation with Ramsey County, and furnish proof of
such recording to the City. If such action is not accomplished by the date so indicated, this
minor subdivision approval shall be considered null and void.
NOW, THEREFORE, BE IT FINALLY RESOLVED that the Mounds View City
Council approves a minor subdivision, lot line adjustment, of 3030 and 3032 County Road
J, subject to the following stipulations:
The Applicant shall complete any and all requirements after final review of the
Certificate of Survey and title commitment by the City Attorney.
2. The proposed legal descriptions are subject to approval by the Ramsey County
Torrens Department. The Applicant shall arrange to amend the Certificate of
Survey if any changes are required by Ramsey County.
3. This approval is subject to review of documents as stated in Title Commitment
101344682, Schedule B, Section I, #5.
4. The Applicant is responsible for reimbursing the City of all costs associated with
this subdivision request.

Item Title/Subject: Resolution 8170, Reapproving the Final Plat and
Developers Agreement for the "Coventry Senior Living"
Development; Planning Case MU2010-001
Introduction:
On March 28, 2011, the City Council passed Resolution 7757, which approved the final
plat and developer's agreement for the Coventry Senior Living development. Per City
Code, an applicant has 6 months to record the plat with Ramsey County, and if the
recording does not happen within this timeframe, the plat approval is void. The code
also states that the plat can be reapproved and the applicant given up to another 6
months. Coventry Senior Living is now starting on the project and will be closing on the
properties soon, and then will record the final plat and developer's agreement. Their
current final plat and developers agreement approval expires on November 13, 2013,
and they need more time.
Chapter 1202.07: Final Plat Approval Procedure
Subd. 4. Recording of Final Plat: If the final plat is approved, the subdivider shall, within
six months, record it with the County Register of Deeds or Registrar of Titles and,
within ten (10) days of recording, furnish the City with a reproducible copy of the
final plat showing evidence of the recording; otherwise, the approval of the final plat
shall be void, and the Clerk -Administrator shall so notify the County Register of
Deeds or Registrar of Titles.
Subd. 5. Re -Approval: In the event the plat is not recordable as approved or the
subdivider fails to record within the time prescribed herein, the Council may
re -approve the final plat upon payment of the plat reapproval fee as specified in
Appendix E and the following terms and conditions: a) that the subdivider proves to
the satisfaction of the Council that the delay was caused by conditions beyond the
control of the subdivider, and b) that the extension of time requested has or will
have no adverse effect on the City or property owners of the City, and c) that the
Council shall set the time limit of the extension requested but in no event shall it
exceed six months. (1988 Code §42.05; 1993 Code).

Discussion:
Coventry Senior Living, represented by Greg Johnson, has requested the final plat and
developers agreement be reapproved. They have begun submitting the project plans to
the City and are moving forward with the project.
Recommendations:
Staff requests that the City Council pass Resolution 8170, reapproving the Coventry
Senior Living final plat and developer's agreement.

WHEREAS, Greg Johnson, representing Coventry Senior Living has requested
re -approval of the final plat and the Developers Agreement for the "Coventry Senior
Living" project on three properties legally -described as follows:
Lot 49, Auditor's Subdivision Number 89, Subject to a 5 foot strip easement along

WHEREAS, The applicant has requested that the City rezone the above-
described lands to PUD, Planned Unit Development, which the City now designates as

June 18, 2012, for the major subdivision that combines three lots into one parcel; and,

WHEREAS, the Mounds View City Council has reviewed the following
documents about this proposal:

3. Site Plan, dated September 27, 2012
4. Grading, Utility & Landscape Plans, September 27, 2012
5. Developers Agreement
WHEREAS, on August 9, 2010, the Mounds View City Council held a duly
noticed public hearing about this development and major subdivision and passed
Resolution 7655 that approved the "Coventry Senior Living of Mounds View" preliminary
plat and development review; and,
WHEREAS, the City attorney and Public Works Staff have reviewed the final plat
and they find it to be in conformance with all applicable sections of the Mounds View
City Code, subject to the conditions and requirements contained in this Resolution; and,
WHEREAS, on March 28, 2011, July 25, 2011, November 14, 2011, May 14,
2012, November 13, 2012, and May 13, 2013, the Mounds View City Council approved
the final plat and developer's agreement for the "Coventry Senior Living" subdivision;
and,
WHEREAS, the applicant was not able to record the plat within the required 6
months due to issues beyond their control.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council, having
already approved the Preliminary Plat and Final Plat, re -approves the Final Plat and
Developers Agreement for the "Coventry Senior Living" subdivision, subject to stipulations
as follows:
1. Coventry Senior Living must receive final City Council approvals for rezoning the
development area and easement vacations before starting any work on the
project site.
2. Before the City issues any permits, Coventry Senior Living shall pay to the City a
park dedication fee of $69,300 and a County Road 10 Trail Contribution in the
amount of $8,260.
3. Coventry Senior Living of Mounds View shall enter into various agreements with
the City including (but not limited to) the Developer's Agreement and PUD
Agreement, and said documents shall be recorded with Ramsey County.
4. Coventry Senior Living shall obtain final approval from Rice Creek Watershed
District before starting any construction activity.

5. No demolition, grading or construction activity may proceed without the
contractor obtaining all necessary permits.
6. The developer or contractor shall locate all utilities within the development
underground.
7. The developer or contractor shall obtain the necessary permits for all work
occurring within the City and County rights of way.
8. Coventry Senior Living shall complete all requirements after final review of the
final plat by the City Attorney, including securing Title Insurance for the new
easement.
9. Coventry Senior Living shall meet all requirements of the City's Public Works
Director and engineering consultant, Stantec.
10. Coventry Senior Living shall satisfy all of Ramsey County requirements.
11. The approval contemplated herein is subject to the condition that Coventry
Senior Living paying for all costs concerning this subdivision incurred by the City
Attorney, city consultants, and any other costs of a similar nature.
NOW, THEREFORE, BE IT FINALLY RESOLVED that re -approval of this final
plat and Developers Agreement is subject to recordation with Ramsey County, which
shall occur within 6 months of Council approval. Within 90 days of the recording,
Coventry Senior Living shall furnish the City with proof of the recording; otherwise, the
approval of the final plat shall be void.

Item Title/Subject: Introduction and First Reading of Ordinance 884, Amending
Chapter 1008, Regulating Signs
The corridor is the City Council's priority this year and the Planning Commission was
asked to review the Zoning Code in order to better promote and accommodate
development along County Road 10. The Planning Commission started by discussing
general development ideas to make the Corridor look better. One of those ideas was
changing the style and height allowances of the signage that is along the Corridor to only
allow monument style signs, and to reduce the setback amount.
The Commission discussed sign code changes and proposed a few changes, some that
would affect signs for the entire City, and others that are specific to properties along the
Corridor. The Commission recommends lowering the height limits in the Business,
Industrial and CRP (Conservancy, Recreation & Preservation) zoning districts from 20
feet or 35 feet down to 16 feet, and requiring some type of masonry materials (brick,
stone, stucco) for all signs throughout the City. The other suggestions are reducing the
minimum setback and sight triangle amounts from properties that are adjacent to County
Road 10. Since there is a lot of excess right-of-way space between the street pavement
and the front property lines, the Commission felt it would not cause problems for signs to
move closer to County Road 10. The side setback requirements are not changing.
The City Council reviewed the proposed code amendments at the November 4, 2013
Worksession. The Council agreed with the amendments and requested the addition of
language to the Nonconforming Signs section to clarify that "replacement" doesn't mean
the entire sign, only the graphics panels.
Recommendation
Review Ordinance 884 with the proposed City Code amendments for ground signs and
nonconforming signs.

The City of Mounds View ordains:
SECTION 1. The City Council of the City of Mounds View hereby amends Chapter
1008.09 of the Mounds View City Code pertaining to Ground Sign Heights, by District,
by deleting the str+Eken language and adding the underlined text as follows:

SECTION 2. The City Council of the City of Mounds View hereby amends Chapter
1008.10 of the Mounds View City Code pertaining to Specific Sign Type Standards and
Requirements, by deleting the stfie-ken language and adding the underlined text as
follows:
1008.10: SPECIFIC SIGN TYPE STANDARDS AND REQUIREMENTS:
Subd. 1. Ground Signs: The following standards shall be maintained for all ground signs,
excluding incidental, temporary, home occupation, campaign, identification and real

a. No part of a ground sign shall be nearer than three feet (3) to any building
unless such sign is placed parallel to the side of the building. (Ord. 679, 5-29-01)

b. No part of a ground sign shall be nearer than 15 feet (16) to any perimeter lot
line, nor located within a thirty (30) -foot sight triangle on any property abutting two
(2) intersecting street right of ways. However, ground signs on properties that front

` The sight triangle is formed by connecting the two end points of 30 -foot lines extending in both

f. Notwithstanding the provisions of subdivision 6 of this Section (1008.10,
subdivision 6), no more than one (1) pole or pylon sign shall be allowed per lot.
However, the ground sign area allowance may be divided between one (1) pole or
pylon sign and a monument sign or between multiple monument signs, subject to
the requirements herein, provided that one (1) or more of the following conditions
are applicable: (Ord. 679, 5-29-01; Ord. 769, 5-8-06; Ord. 816, 1-22-09)
(1) The lot abuts multiple street right-of-ways, in which case a sign may be
located along each frontage. (Ord. 679, 5-29-01)
(2) There are multiple curb cuts or driveways accessing the property, in
which case a sign may be located near each access point or driveway,
provided the signs are separated by no less than two hundred feet (200').

(3) The width of the lot, as measured along its longest street frontage,
exceeds two hundred and fifty feet (250'), in which case multiple signs may
be located along the long frontage provided such signs are separated by no

Q. Ground signs must include masonry construction materials such as stone, brick
or stucco.
SECTION 3. The City Council of the City of Mounds View hereby amends Chapter
1008.13 of the Mounds View City Code pertaining to Nonconforming Signs by deleting
the stricken language and adding the underlined text as follows:
1008.13 NONCONFORMING SIGNS: It is the intent of the City with this Chapter that
nonconforming signs shall not be enlarged or expanded, nor should a person use this
Chapter as grounds for adding other signs or uses prohibited elsewhere in the same
district. It is further the intent of the City with this Chapter to permit legal nonconforming
signs to remain if such signs are safe, maintained in good condition and if such signs have
not been abandoned, moved or removed. Any sign, including a billboard, legally existing
at the time of the passage of this Ordinance that does not conform to the provisions of this
ordinance shall be considered a legal nonconforming sign and may be continued including
through repair, replacement of graphics panels, restoration, maintenance, or improvement
but not including the moving, enlargement or expansion of the sign. "Expansion" shall be
defined as any structural alteration, change or addition that is made outside of the original

SECTION 5. In accordance with Section 3.07 of the City Charter, City staff shall have the
following summary printed in the official City newspaper in lieu of the complete ordinance:
On November 25, 2013, the City Council adopted Ordinance 884 that amends Title 1000,
Chapter 1008 of the Mounds View Municipal Code. These amendments will amend
regulations for Ground Signs and Nonconforming Signs. A printed copy of the ordinance
is available for inspection during regular business hours at Mounds View City Hall and is
available on line at the City's web site located at www.ci.mounds-view.mn.us
SECTION 6. This ordinance takes effect 30 days after its publication in the official City
newspaper.

Council Member Mueller noted the Festival in the Park Committee would be meeting on October
22, 2013 at 7:00 p.m. at City Hall in the Conference Room.
Council Member Mueller indicated the Ramsey County League of Local Government would be
meeting for a presentation and tour at the McCarrons Water Treatment Plant at 6:00 p.m. on
Thursday, October 24, 2013.
Council Member Mueller reported she would be attending the Board of Directors meeting for the
League of Minnesota Cities on Wednesday, October 16, 2013. The group would be discussing
the pending data practice lawsuit.
Mayor Flaherty stated October 11th was Minnesota Cities Day as proclaimed by the Governor.
Mayor Flaherty commented there would be a public information meeting on Monday, October
21s' at 7:00 p.m. at City Hall for Area G of the Street Improvement Project. He encouraged all
residents in this area to attend.

School Resource Officer (SRO)
The SRO performs various duties on a daily basis at Edgewood Middle School which include
the following:
• assisting with traffic flow in front of the school
• ensuring the school is secured each morning
Y providing a police presence in the hallways during passing times and in the cafeteria
during lunch times
• investigating crimes that occur on school property
• assisting with lock down, fire, and severe weather drills
• serving as a member of the school crisis team
• providing police support to school dances and after school activities
• assisting at Pinewood Elementary as needed
• being a liaison between the school and the police department
Y forming positive relationships with students
In September, the SRO made the following incident reports:
• 1 follow up for an OFP violation
• 1 medical
• 1 harassment
• 1 follow up for a theft of bicycle
• 1 info to narcotics
No juveniles were arrested or sent to diversion by the SRO. One student was sent to the
hospital for an evaluation.
Some additional services the SRO provided at the school this quarter included:
• Maintaining the school radio communications system
• Deescalating out of control students
• Contacting juvenile probation officers
• Operation of the school surveillance system
• Locating truant students
• Locating and recovering stolen bikes, electronics, and other property
Highlights from 3rd Quarter
The SRO spent the first day of school welcoming new students and the incoming 6th
graders to Edgewood Middle School. He helped students with learning their locker
combinations and finding their way around the school.
SRO's from the Mounds View School District met with officials from the school district
to discuss the new school year. This year the district will be hiring police officers for
after school events in order to provide additional security. The district is relaxing its
electronic devices policy for students and is encouraging students to bring devices to

school. As a result, they expect a possible increase in thefts of electronic devices
which the SRO's will have to investigate.
• The school district upgraded security measures across the district. Visitors to the
school are now required to present a photo ID. Their names are crosschecked with a
database of predatory offenders before being allowed to enter the building. Visitors are
then given a temporary picture ID to wear while they are in the building.

The summer/fall months are generally a busy time for the Ramsey County Traffic Safety
Initiative (RCTSI). The RCTSI partners with the Minnesota Office of Traffic Safety in the
Toward Zero Deaths program. In the 3`d quarter, the Mounds View PD participated in 4 DWI
saturations, one speed and a Labor Day DWI enforcement detail.
The first DWI saturation was held on August 3`d and was hosted by the Ramsey County
Sheriff Office. The entire detail conducted 157 traffic stops and made 8 DWI arrests.

The second DWI saturation occurred on August 16th and was hosted by the North Saint Paul
PD. The entire detail conducted 183 traffic stops and made 13 DWI arrests.
The third DWI saturation was held on September 20th and was hosted by the Maplewood PD.
The entire detail conducted 140 traffic stops and made 11 DWI arrests.
The fourth DWI saturation occurred on September 27th and was hosted by the Minnesota
State Patrol. The saturation focused on the highways in Ramsey County. The entire detail
conducted 156 traffic stops and made 10 DWI arrests. Sergeant Zender worked the detail,
conducting 15 traffic stops and making a DWI arrest (which resulted in a vehicle forfeiture).
There were 11 other DWI saturations conducted by the RCTSI during the 3`d quarter. Mounds
View PD did not participate in these events due to our current staffing shortages. The
department currently has two new hires involved in "Field Training."
Over the dates of July 6th- 21St Mounds View PD officers participated in the "July Speed
Enforcement' detail. We had 6 officers work this event over the course of the detail for a total
of 65 hours. Our officers conducted 155 traffic stops resulting in the following citations: 117
for speeding, 2 seatbelts, 2 for drive after suspension/ revocation and 9 for miscellaneous
violations.
Over the dates of August 16th- 31St, Mounds View PD officers participated in the "Labor Day
DWI Enforcement' detail. We had 7 officers work this event over the course of the detail for a
total of 78 hours. The detail resulted in 2 DWI arrests. Our officers conducted 120 traffic stops
resulting in the following citations: 2 for seatbelts, 7 for speeding, 9 for drive after suspension/
revocation and 25 for miscellaneous violations.

Canine Unit (K-9)
The past few months have been very busy for our K-9 Unit. During the first week of July, our
K-9 unit participated in their first United States Police Canine Association (USPCA) region 12
trials. This is an annual event that gathers K-9 units from the upper Midwest together to test
their skills in several different areas of field work. This included apprehension, article
searches, drug searches and agility. Officer Nick Erickson and his K-9 partner Niko received
very high scores for their first time participating in this event. We are very proud of their
accomplishments and look forward to next year's trials.
On National Night Out, Nick and Niko attended several local block parties and demonstrated
a few of their fun skills to the people gathered.
In August the K-9 unit performed a demonstration for a large crowd that was gathered at the
City of Mounds View's annual Festival in the Park event. This demonstration was well
attended and warmly received by those who were in attendance.
Nick and Niko were featured guests and ambassadors for an event at the Mounds View
Animal Hospital in celebration for their 25 years of providing veterinarian services to area pet
owners.
The K-9 unit also performed a demonstration at the local Kinder Care for the children and
staff. (See photo below)
From July 01St, to September 3151, the K-9 unit responded to 143 calls for service, 3 assists
with apprehensions, 4 narcotics searches and 4 tracks and area searches. If you would like

Crime Prevention/DARE
The crime prevention officer organized a successful National Night Out this past August with
a total of 31 registered parties. Officer Keckeisen and numerous other Mounds View officers
paid personal visits to each of these parties throughout the city.
During the summer months, the crime prevention officer continually monitors the predatory
offenders registered in the city, along with tabulation of monthly alarm reports and
subsequent false alarm fees. The crime prevention officer conducts initial firearms and use of
force training for new and current officers. This officer has also been shifted to more of a
patrol assignment to offset some of the patrol coverage levels.
News from the Department
Officer Erickson and Niko attended the USPCA Region 12 Certification trials in St. Peter, MN.
The K-9 unit performed remarkably well and attained the desired PD -1 certification in the
areas of apprehension, article searches, narcotic searches and agility.

On the first Tuesday in August, the police department staff attended 31 registered National
Night Out parties throughout the city. The wet weather affected some of the parties, but
everyone participating still had an enjoyable time.
Officer Erickson and Niko received their custom made K-9 ballistic vest for Niko which was
donated by the non-profit group, Vested Interests in K -9's. This organization is a 501 C (3) all
volunteer charity whose mission is to provide bullet/stab protective vests for law enforcement
dogs throughout the United States. Funds were raised by Vested Interests in K -9's through a
Group On Grassroots campaign online. Each custom made vest costs $950.00. Niko will now
have the same level of protection as the officers.
Mid -august also saw another annual Festival in the Park celebration. The weather was
glorious making the parade, car show, fireworks and all other entertainment a huge success!
Our K-9 Unit provided an action packed demonstration that proved to be popular with the
crowd. Thanks to Officer Erickson, Investigator Berling and Officer Demarest for their great
efforts in showcasing the skills of Niko.

The police department welcomed the hiring of two new police officers, Greg Randolph and
James Stoffel. This hiring filled two vacancies which brings the department back to the
authorized strength of 19 officers. Both officers started employment on September 23, 2013
and are in the midst of their field training, which lasts 14 weeks. Each new officer must
complete three phases, each lasting 4 weeks, with three different field training officers. A final
two week "shadow" period concludes the training process. The "shadow" period is where the
new officer performs all duties independently with a field training officer (FTO) acting solely
as an observer in plain clothes.

The police department held a DNR Hunter Gun Safety course during the month of
September. Sgt Wolf, Sgt Zender, Inv Berling, Inv Hellpap and Officer Demarest all shared
instruction for 19 students who received DNR certification. This certification allows students
to purchase a hunting license in Minnesota and other states requiring a hunter safety
certificate. The course consists of 16 hours of classroom and field experience in the safe
handling of firearms, first aid and hunter responsibility. The course concludes with live fire on
a gun range with a .22 caliber rifle.
