APPROVAL OF MINUTES A. November 27, 2017, City Council Meeting Minutes. Council Member Meehlhause requested a correction on Page 1, Line 35 stating this line should read County Commissioner. Council Member Meehlhause requested a correction on Page 5, Line 3 recommended this line refer to the section of roadway between County I and County H2. Mayor Mueller requested a correction on Page 5, Line 37 noting her comment should read: she asked if the trail segment has had an impact on the north side of Mounds View Boulevard at Groveland Road. C. December 11, 2017, City Council Meeting Minutes. Council Member Meehlhause requested a correction on Page 7, Line 40 removing the words He noted. Council Member Meehlhause requested a correction on Page 7, Line 42 noting City Planner/Supervisor Sevald's comment should have been referred to by the Mayor. Mayor Mueller explained the minutes accurately reflected the conversation regarding handicap parking but noted her original question was missing. She suggested these minutes be tabled until this portion of the minutes could be reviewed. Council Member Meehlhause requested a correction on Page 9, Line 41 adding a comma after Katrina's name. Council Member Meehlhause requested a correction on Page 12, Line 39 stating this line should read several employees have retired. Council Member Meehlhause requested a correction on Page 13, Line 9 stating this line should read New Americans Academy. PUBLIC COMMENT Mounds View City Council January 2, 2018 Regular Meeting Page 4 1 Bill Urbanski, 2367 Sherwood Road, provided the Council with a folder that had copies of letters 2 from concerned Mounds View residents. He spoke to the Council regarding the INH 3 development noting he was opposed. He did not support the City having a gun shop and 4 shooting range in a residential neighborhood and less than one-half mile from Edgewood Middle 5 School. He encouraged the Council to consider the unintended consequences of having a gun 6 range at this location. He commented on the draft preliminary site plan and understood that TIF 7 was being proposed for the INH development. He discussed how an economic downturn could 8 impact property taxes in Mounds View and stated he did not want to see a gun club constructed 9 with no market rate apartments. He commented on the Arden Hills Rice Creek Commons 10 development and recommended Phase I of the INH development include market rate apartments. I 1 He encouraged the Council to review the letters within his handout and thanked the Council for 12 their time. 13 14 Kenneth Glidden, 5240 Edgewood Drive, stated he lived six houses down from the Crossroad 15 Pointe site. He explained this was the third meeting he has attended and noted he has concerns 16 with why this development was being pursued. He asked why the Council was considering a gun 17 club as part of this development. He indicated this was a prime piece of real estate that should 18 stand on its own merit. He stated he was bothered by how other communities viewed Mounds 19 View but noted he was proud to live in this City. He encouraged the Council to work to improve 20 the image of the City. He stated he was troubled by the fact the City Council was pursuing a 21 development that could cast the City in a bad light. He recommended the City Council wait to 22 develop this site until another option came along. He anticipated this property would become 23 more desirable after TCAAP begins to develop. 24 25 8. SPECIAL ORDER OF BUSINESS 26 A. Resolution 8880, Appreciating Jessica Rieland for Her Service on the 27 Mounds View Economic Development Commission. 28 29 Interim City Administrator Zikmund requested the Council adopt a Resolution of Appreciation 30 thanking Jessica Rieland for her service on the Mounds View Economic Development 31 Commission. He read the Resolution in full for the record. 32 33 34 35 36 37 38 39 40 41 42 43 44 45 MOTION/SECOND: Meehlhause/Hull. To Adopt Resolution 8880, Appreciating Jessica Rieland for Her Service on the Mounds View Economic Development Commission. Council Member Meehlhause thanked Ms. Rieland for her service to the community. Mayor Mueller thanked Ms. Rieland for sharing her expertise and energy with the EDC and the City of Mounds View. Ayes — 5 Nays — 0 Motion carried. 9. COUNCIL BUSINESS A. Resolution 8884, Appointing Nyle Zikmund as City Administrator. Mounds View City Council January 2, 2018 Regular Meeting Page 5 1 Finance Director Beer requested the Council adopt a Resolution appointing Nyle Zikmund as 2 City Administrator. He commented on the hiring process that has been followed since the 3 retirement of former City Administrator Ericson. He explained the City received 50 applications 4 for this position and noted an executive search firm has assisted the City with the hiring process. 5 He commented on the interviews that were held with the final five candidates on December 15th 6 and 16th and recommended the hire of Nyle Zikmund as the City Administrator. He reported the 7 draft contract had been sent to the City Attorney for review and comment. 8 9 Mayor Mueller thanked Finance Director Beer for his assistance with the City Administrator 10 hiring process. She thanked all of the department heads for assisting with the candidate 11 interviews. She thanked the Council for their time and input during the hiring process. Mayor 12 Mueller read Resolution 8884 in full for the record. 13 14 MOTION/SECOND: Mueller/Meehlhause. To Adopt Resolution 8884, Appointing Nyle 15 Zikmund as City Administrator. 16 17 Ayes — 4 Nays — 0 Abstain — 1 (Bergeron) Motion carried. 18 19 A round of applause was offered by all in attendance to welcome City Administrator Zikmund to 20 the City of Mounds View. 21 22 B. Resolution 8882, Selection of the Acting Mayor, Treasurer and Official 23 Newspaper and Depositories for 2018. 24 25 City Administrator Zikmund requested the Council select an Acting Mayor, Treasurer, official 26 newspaper and depository for 2018. 27 28 Mayor Mueller commented on the submitted newspaper quotes and recommended the official 29 newspaper of record be Sun Focus with the St. Paul Pioneer Press as the City's secondary 30 newspaper. 31 32 Council Member Meehlhause supported this recommendation. 33 34 Council consensus was to recommend the Sun Focus for the City's official newspaper of record. 35 36 Mayor Mueller recommended the depositories move forward as recommended by staff. She 37 asked who would like to serve as Acting Mayor for 2018. 38 39 Council Member Gunn stated she would be willing to serve as the Acting Mayor again in 2018. 40 41 Council consensus was to recommend Council Member Gunn serve as the Acting Mayor for 42 2018. 43 44 MOTION/SECOND: Meehlhause/Hull. To Waive the Reading and Adopt Resolution 8882, 45 Selection of the Acting Mayor, Treasurer and Official Newspaper and Depositories for 2018. Resolution 8883, Appointing City Council Members and City Staff as 5 Representatives for City Commissions and Other Organizations. 6 7 City Administrator Zikmund requested the Council appoint City Council members and City staff 8 as representatives for City Commission and other organizations. He reviewed the list of past 9 appointments with the Council and explained a representative to the Blaine/Mounds View Spring 10 Lake Park Fire Board was no longer needed. He discussed the importance of the Anoka County 11 Fire Board representative being in attendance at the fall meeting. He commented on how the 12 Human Resources Committee would have formal agendas and would be making 13 recommendations to the City Council. 14 15 Finance Director Beer encouraged the Council to keep the same two Council Members on the 16 Human Resources Committee for continuity proposes. Council Member Meehlhause and 17 Council Member Hull were both willing to continue serving on the Human Resources 18 Committee. 19 20 Mayor Mueller noted Human Resources Technician Rayla Ewald would now be serving on the 21 Human Resources Committee. 22 23 Mayor Mueller reported she was willing to continue to serve on the Ramsey County League of 24 Local Government. She stated she would be happy to continue as the League of Minnesota 25 Cities representative with Council Member Gunn serving as the alternate. She explained she 26 would continue her position with the North Metro Mayor's Association with Council Member 27 Gunn serving as the alternate. Mayor Mueller commented she would also serve as the liaison for 28 Metro Cities. 29 30 Council consensus was to support the Mayor in these positions. 31 32 Council Member Gunn indicated she would like to continue serving on the I -35W Coalition. 33 Mayor Mueller thanked Council Member Gunn for her great work with this organization. 34 Council Member Hull stated he could serve as the alternate for this group. 35 36 Council Member Meehlhause indicated he could continue as the representative for the Minnesota 37 North Metro Tourism Board. 38 39 Council Member Meehlhause stated he was willing to serve as the YMCA Advisory Committee 40 representative with Council Member Hull acting as the alternate. 41 42 Mayor Mueller stated she would need a volunteer to serve as the NSCC/NSAC representative. 43 Council Member Bergeron volunteered for this position and Finance Director Beer would act as 44 the alternate. 45 Mounds View City Council January 2, 2018 Regular Meeting Page 7 1 Council Member Bergeron indicated he would act as the Council Liaison to the City's 2 commissions and committees with Council Member Meehlhause serving as the alternate. 3 4 Council Member Meehlhause reported he would serve as the Northeast Youth and Family 5 Services representative and Council Member Hull volunteered to be the alternate. 6 7 Mayor Mueller indicated there was an opening for a second Councilmember to be part of the 8 North Suburban Business Council. 9 10 Council Member Meehlhause was willing to continue on the North Metro Business Council. It 11 was noted Business Development Coordinator Beeman and City Administrator Zikmund would 12 also be attending these meetings on behalf of the City. 13 14 Council Member Gunn stated she would serve on the Anoka County Fire Protection Board and 15 Council Member Meehlhause would serve as the alternate. 16 17 Mayor Mueller summarized all of the appointments as discussed and agreed upon by the City 18 Council. 19 20 MOTION/SECOND: Hull/Gunn. D. Resolution 8881, Approving the Hire of Karla Keys as Police Administrative Assistant. Human Resources Technician Ewald requested the Council approve the hire of Karla Keys as Police Administrative Assistant. She noted this position became vacant in October of 2017. Staff was directed by the Council to post and hire for this position. She reported the City received 125 applications were received and Karla Keys was being recommended for the position. She noted Ms. Keys has 13 years of experience with other Police Departments and her start date with the City of Mounds View would be Tuesday, January 16tH MOTION/SECOND: Gunn/Meehlhause. To Waive the Reading and Adopt Resolution 8881, Approving the Hire of Karla Keys as Police Administrative Assistant. Ayes — 5 Nays — 0 Motion carried. 10. REPORTS A. Reports of Mayor and Council. Mounds View City Council January 2, 2018 Regular Meeting Page 8 1 Council Member Meehlhause asked if any members of the City Council would be attending the 2 League of Minnesota Cities training on January 26th and 27th. He stated he would be attending 3 the training. 4 5 Council Member Gunn stated she was interested in attending the training but had to see if she 6 could get the day off of work. 7 8 Mayor Mueller indicated she would be attending the training and recommended staff post for a 9 quorum for this event. 10 11 Mayor Mueller wished everyone a safe and happy 2018. She read a press release from Police 12 Chief Harder in full for the record noting the City of Mounds View has been designated a Heart 13 Safe Community. The requirements to become a Heart Safe Community were described at length 14 and she commended the City and the Mounds View Police Department for their efforts on 15 achieving this designation. 16 17 Mayor Mueller stated November was a difficult month for her as she had five family members 18 pass away and just last week a close family friend, Corky Schurr of Corky's Heavy Duty Towing, 19 passed away. She noted his visitation would be held on Wednesday, January 3 and his funeral 20 would be held on Thursday, January 4th at the Emmanuel Christian Center. She noted a luncheon 21 would be held at The Mermaid after the funeral along with a time for sharing. 22 23 Mayor Mueller indicated her step -mother-in-law, Janet Mueller, passed away from complications 24 with Alzheimer's on Tuesday, January 2"d. She sent her sympathies to the Wack and Mueller 25 families. 26 27 Mayor Mueller noted she would be meeting with Boy Scout Troop #267 on Thursday, January 0h 28 to assist them with their Citizenship in the Community Merit Badge. 29 30 Mayor Mueller explained the Comprehensive Plan Task Force would be holding their first 31 meeting on Tuesday, January 9th. She noted the 601h Anniversary Celebration Committee would 32 also be meeting on Tuesday, January 9th at City Hall. 33 34 B. Reports of Staff. 35 36 Police Chief Harder thanked the City Council for their attendance at the New Americans 37 Academy. He explained this helped to make this a truly great event. He commended Officer 38 Heineman for her efforts on getting residents certified in CPR and for malting Mounds View a 39 Heart Safe Community. He encouraged local organizations to contact the Police Department if 40 interested in having their employees trained in CPR. 41 42 Police Chief Harder encouraged the public to attend a 3 on 3 hockey game between the Police 43 and Fire Departments that would occur at Lambert Park on Friday, January 26th to benefit the 44 Police Foundation. He explained the event would have food and a live auction. It was noted the 45 event would begin at 5:30 p.m. Mounds View City Council January 2, 2018 Regular Meeting Page 9 2 Police Chief Harder reported the Second Annual Father -Daughter Ball would be held on 3 Saturday, February 24th at the Mounds View Community Center. He stated registration was 4 being taken at this time. 5 6 Police Chief Harder provided the Council with an update on the Shop with a Cop event that was 7 held in December and noted 25 children were positively impacted by this event. He thanked the 8 Council for assisting and decorating at this event. 9 10 Public Works Director Peterson stated the Council would be touring the new Public Works 11 Building on Monday, January 8t" at 5:00 p.m. 12 13 Public Works Director Peterson commented on the number of water lines breaks that have 14 occurred over the past few weeks. He encouraged homeowners to open up their crawl spaces and 15 closets in order to heat their water lines during cold spells this winter. 16 17 Public Works Director Peterson reported he had been working on a new right-of-way Ordinance 18 with the City Attorney and asked if the Council wanted to review this item in a worksession prior 19 to being placed on a Council agenda. 20 21 Council Member Gunn recommended this item come before the Council as soon as possible. The 22 Council was in agreement. 23 24 Finance Director Beer stated he was proud to report the City's new website was live. 25 26 City Planner/Supervisor Sevald reported the City's new Building Official Nick Henley began 27 working for the City today. 28 29 City Administrator Zilcmund stated the Public Works Department has received a limited 30 certificate of occupancy and would begin moving equipment into the equipment bay this 31 weekend. 32 33 City Administrator Zikmund reported he scheduled an all staff meeting for Thursday, January 4"' 34 at 1:30 p.m. 35 36 C. Recognition of Dave Long for 34 Years of Service to the Park, Recreation and Forestry Commission (Plaque to be presented by Mayor Mueller). Mayor Mueller recognized Dave Long and thanked him for his 34 years of dedicated service on the Park, Recreation and Forestry Commission and read Resolution 8791 in full for the record. She presented Mr. Long with a plaque on behalf of the City of Mounds View. A round of applause was offered by all in attendance. Set a Public Hearing for Monday, February 26, 2018, at 6:30 p.m. to 35 Consider Amending Municipal Code, Section 702.01, Subd 13 (b) regarding 36 Possession, Aiming or Discharging of Weapons. 37 38 Council Member Bergeron stated this Public Hearing would consider amending City Code 39 Section 702.01, Subdivision 13(b) regarding the possession, aiming and discharging of weapons. 40 He requested this item be tabled until he receives answers from the City Attorney regarding the 41 legal definition of premises and the regulatory authority of the City. 42 43 Mayor Mueller asked if these questions could be answered in the next six weeks. 44 45 Council Member Bergeron stated it would be his preference to have the answers before him prior Mounds View City Council January 8, 2018 Regular Meeting Page 3 1 to setting a Public Hearing on this matter. 2 3 MOTION/SECOND: Bergeron/Gunn. To Table Setting a Public Hearing to Consider Amending 4 Municipal Code, Section 702.01, Subd 13 (b) regarding Possession, Aiming or Discharging of 5 Weapons to a date uncertain. 6 7 Council Member Bergeron stated there were several legal matters regarding State and Federal 8 law and a rented firearm that needed to be further explained to him, prior to this item moving 9 forward. He reported the developer (INH) had the intention of selling the property. He 10 expressed concern with how this land would be used by individuals with weapons. He discussed 11 several State Statutes that addressed this matter and reported he needed further clarification on 12 this matter prior to the City Code Amendment being considered by the Council. 13 14 Mayor Mueller asked if staff had been in communication with City Attorney Riggs regarding this 15 matter. City Administrator Zikmund stated he had made a call to the City Attorney, and he was 16 confident this item could be addressed at an upcoming meeting. 17 18 Council Member Meehlhause reported City Attorney Riggs would be in attendance at the January 19 22"d meeting and could address the questions that had been raised prior to that meeting. He 20 asked if Council Member Bergeron would be comfortable placing this item on the January 22nd 21 Consent Agenda. 22 23 City Administrator Zikmund explained the Council would have to remove this item from the 24 table in order to take action at the January 22nd meeting. 25 26 Council Member Bergeron stated this was his understanding. PUBLIC COMMENT 32 33 William Urbanski, 2367 Sherwood Road, stated there were a number of residents present tonight 34 to speak against the location of a gun range at the Crossroad Pointe site. He explained he was 35 not opposed to the Second Amendment. 36 37 Ann Zierdt, 7416 Park View, indicated she was opposed to a gun range being located on the 38 property at Mounds View Boulevard and County Road H2. She stated she was the parent to an 39 Edgewood Middle School student that had recently relocated to Mounds View for its school 40 system. She encouraged the Council to consider Mounds View was already a destination City 41 because of its incredible schools and strong public safety. She believed the proposed gun club 42 would undermine this positive image and will have a negative impact on home values. She 43 stated Mounds View had strong property values but by placing a gun club in a residential 44 neighborhood this would not send a positive message to future homebuyers. She feared the gun 45 club would bring lead exposure and long-term expenses to the community. She discussed the Mounds View City Council January 8, 2018 Regular Meeting Page 4 1 filters that would need to be in place and the protocols that would have to be followed for proper 2 disposal of lead. She was of the opinion it was not in the City's best interest to expose its 3 residents and young children to this type of lead exposure. She quoted Pat Egan from INH on a 4 comment he made at a community meeting last fall stating, "But we can't control the person that 5 is coming in the door. We don't know what their level of safety and training is. That is why we 6 have a gun safety range officer." She explained the developer acknowledges there is an increased 7 safety risk by having a gun club on this property in our community but fails to counter this risk. 8 She reported the only way to eliminate this risk would be to build the gun range in another 9 location, away from residential neighborhoods, schools and the City's most vulnerable residents. 10 She stated the bottom line is that this risk is avoidable and other opportunities do not carry the 11 same level of risks. She encouraged the City Council to not consider a gun club at the 12 intersection of Mounds View Boulevard and County Road H2. 13 14 Pastor Ronald Letnes, 2917 124th Circle NE in Blaine, explained he was the Chair of the 15 Engaged Gun Violence Prevention Work Group of the St. Paul Area Evangelical Lutheran 16 Church of America. He reported this organization was not anti -gun but rather pro -gun safety. 17 He spoke against the location of the proposed gun range in Mounds View noting it was 18 problematic to personal safety. He explained the proposed site was in a high traffic, educational, 19 business and residential area. He did not believe it was wise to introduce more guns into this 20 area as it could create a potential for gun violence. He stated private homes border the proposed 21 gun range on two sides. In addition, an apartment complex and senior living facility was located 22 directly across the street with Edgewood Middle School located only 500 yards to the south. He 23 provided further comment on the businesses located in close proximity to this intersection. He 24 explained that more and more refugees were coming to the United States to escape gun violence 25 and do not understand the need for guns. He encouraged the Council to understand the fact that 26 the proposed gun range would allow for the discharge and selling of guns. He explained that 27 injecting guns into a high traffic area increases the risk of gun violence. He provided further 28 statistical information to the Council regarding gun deaths in Minnesota. He urged the Council 29 to find a more appropriate and safe location for the safe practice of gun rights. 30 31 Vern Rice, 7412 Park View Drive, emphasized the relationship this gun range would have to the 32 adjacent neighborhood. He explained he and his wife purchased their home based on the 33 neighborhood. He stated he did not want to see a decline in his neighborhood because of the gun 34 club. He anticipated that many homeowners would move if the gun club were to locate in 35 Mounds View at this intersection. He discussed how property values were adversely impacted by 36 gun clubs in residential neighborhoods. He encouraged the Council to do better than the 37 proposed project. 38 39 Cheryl Schrader, 2566 Hillview, explained she runs a childcare program from her home. She 40 stated she was responsible for eight precious children. She discussed the training she has to 41 attend on a yearly basis, much of which centered on safety. She indicated she did not want her 42 neighborhood to be involved in an active shooter situation. She stated she could not believe this 43 request was being considered by the City Council for this community. 44 Mounds View City Council January 8, 2018 Regular Meeting Page 5 I Jodi Hemingson, 5671 Quincy Street - Apartment #1, understood there were concerns regarding 2 gun clubs. However, she believed that the comments made this evening were addressing worst 3 case scenarios. She stated a gun club did not have to be in Mounds View to have a drive by with 4 an automatic weapon. She explained this person would not be buying an automatic weapon at a 5 local gun club. She reported she lived in North Minneapolis for 25 years and moved to 6 Robbinsdale and then Mounds View. She discussed her experience of living in Robbinsdale near 7 a Bob's Gun Club stating residents did not see people running around with uncased guns in the 8 parking lot. She indicated there were rules, both City and State that would have to be followed, 9 along with a code of ethics by the people visiting the gun club. 10 11 Mary Scotch, 7806 Gloria Circle, stated she was not aware of the firing range and gun club that 12 was being proposed until just recently. She commented that a lot of citizens do not go home to 13 investigate the happenings in their City. She encouraged the Council to provide residents with 14 more information regarding the proposed development. She explained her main concern was 15 with the City's infrastructure and noted she opposed the gun club. She noted her mother lived at 16 Bel Ray, which was very close to the subject property. She encouraged the Council to pursue 17 something more valuable at this intersection. 18 19 Jeff Noritko, 2400 Mounds View Boulevard, stated he owns Moe's Restaurant. He explained he 20 supported the proposed development noting it was more than just a gun club. He feared the 21 residents speaking tonight were throwing out the baby with the bath water. He understood that 22 Mounds View was pro-business and was pursuing a project that worked for the City. He 23 encouraged the residents of Mounds View to conduct research on gun clubs and Heartland. He 24 indicated he visited both the Chanhassen and Osseo Gun Clubs. He stated in each visit he never 25 saw an uncased gun or heard any noise. He believed the developers were proposing a respectful 26 operation that would benefit the community. He discussed how the new market rate apartments 27 would benefit Mounds View and his business. He indicated the proposed project was fully 28 funded and was not requesting any TIF. This was a huge plus for the City. It was his opinion the 29 City would benefit by the proposed development and he believed the two developers were stand 30 up individuals. 31 32 Steve Chambers, 2957 Sherwood Place, commented he grew up on a farm in Iowa and noted a 33 highly regarded gun club was near his home. He stated 30 years ago an individual visited this 34 gun club in Iowa high on drugs and a terrible shooting with fatalities occurred. He feared that the 35 same type of event could occur in Mounds View. He explained he and his wife moved to 36 Mounds View 40 years ago because it was a safe community. He stated in all the conversations 37 he has had with members of the community, there has been very little support. He urged the City 38 Council not to locate a gun club in the midst of the City. 39 40 Scott Schrader, 2566 Hillview, stated his understanding was the developer was proposing 41 apartments and a gun club with light retail as two separate phases of the project. He suggested 42 Phase I of the project move forward with the apartments and that further consideration be made 43 for the gun range and light retail. He encouraged the City Council to do the right thing on behalf 44 of the entire community and only allow the apartments at this time. 45 Mounds View City Council January 8, 2018 Regular Meeting Page 6 1 Carl Spande, 5219 Irondale Road, thanked the Council for their time and stated he fully 2 supported the project. He believed the proposed apartments would greatly benefit local 3 businesses, such as Moe's. He explained he was a gun owner and has frequented other gun 4 ranges. He stated he was not afraid for his four kids that the proposed gun range would bring 5 about an active shooter. He encouraged Mounds View residents to look at the members in their 6 community who already own guns and would be using this gun range. He stated at this time 7 those gun owners are driving outside of the community to spend their money. He indicated he 8 had more fear of his kids getting a concussion playing sports than there being a gun problem in 9 the community. 10 11 Mary Kay Walsh-Kaczmarek, 8345 Pleasant View Drive, wished the Council a Happy New 12 Year. She stated the Council could not predict the best or worst case scenario that could occur at 13 the gun range. However, she encouraged the Council to consider the risks to the community. 14 She feared that the market rate apartments would not be filled given the fact it was located next 15 to a gun range and therefore their value would decrease. She questioned what the benefit of the 16 proposed development would be to the City. She stated Mounds View was a residential 17 community that should not be pursuing gun culture that was already too perverse in the United 18 States. She was of the opinion the City would be repeating the same mistake that had been made 19 with Medtronic. She indicated the gun range was a redundancy and noted other ranges were 20 available in Spring Lake Park, Blaine and Otsego. She believed there was a dichotomy of views 21 as to what Mounds View should be and she encouraged the Council to keep the City focused on 22 its strong schools and being residential in nature. 23 24 Mayor Mueller thanked the public for their comments. 25 26 Mayor Mueller recessed the City Council meeting at 7:23 p.m. 27 28 Mayor Mueller reconvened the City Council meeting at 7:26 p.m. 29 30 9. COUNCIL BUSINESS 31 A. Resolution 8887, Differential Pay for Patrol Officer David and Development 32 of Policy. 33 34 City Administrator Zikmund requested the Council approve a pay differential for Patrol Officer 35 David and the development of a policy. He explained Patrol Officer David recently received 36 extended deployment papers which led to a differential pay discussion. He noted the Personnel 37 Committee discussed this matter and was recommending differential pay for four to five months 38 or until she is released from the deployment. Staff also recommended the drafting of a policy to 39 further address this issue. He noted this item would be discussed further at their February work 40 session meeting. 41 42 Mayor Mueller noted Officer Sarah David would be deployed from January 16, 2018 through 43 May 15, 2018. She reported the City must keep her position open for her but was not required to 44 pay differential wages. Council Member Meehlhause reported the Human Resources Committee wanted to support this City employee during her deployment by offering differential pay to cover the difference between what the National Guard would be paying her when compared to her job with the Mounds View Police Department. He stated this seemed like the right thing to do while she is away serving the country. Council Member Bergeron indicated this was a very honorable act and he was proud to offer his support. Mayor Mueller stated she would like Patrol Officer David to be happy, safe and returned to the City of Mounds View. She thanked the Mounds View Human Resources Committee for their work on this item. Ayes — 5 Nays — 0 Motion carried. B. First Reading and Introduction of Ordinance 940, Amending Municipal Code, Section 910, regarding the Management of Right -of -Way within the City of Mounds View. Public Works Director Peterson requested the Council introduce an Ordinance amending City Code regarding the management of right-of-way within the City of Mounds View. He discussed the changes made by the State that now allowed for small cell towers in public right-of-way. He reported the proposed changes had been reviewed by both staff and the City Attorney. Staff noted the Planning Commission reviewed this item at their January 3rd meeting and recommended approval of Ordinance 910. Council Member Meehlhause asked if these types of cell towers would be handled through a permitting process versus a conditional use. City Planner/Supervisor Sevald stated this was the case. He commented on the new legislation and noted small cell towers were allowed in all zoning districts except residential and historical districts. In those two cases, cities could require a conditional use permit instead. He reported staff was recommending that rather than requiring a conditional use permit, the small cell towers would be permitted through the Public Works Department. Council Member Gunn asked what the permit fee would be. Public Works Director Peterson stated this had yet to be determined by staff. Mayor Mueller asked if other cities had a fee structure in place. Public Works Director Peterson reported this was a fairly new initiative that was still being determined. Further discussion ensued regarding the size of small cell towers. Mounds View City Council January 8, 2018 Regular Meeting Page 8 2 Mayor Mueller questioned when the City would be ready to issue permits for small cell towers. 3 Public Works Director Peterson explained staff would be ready to issue permits after the second 4 reading of this Ordinance. 5 6 Council Member Gunn asked if the City would charge a fee for the use of its poles. Public 7 Works Director Peterson reported a $150 fee per year would be charged for use of City's poles. 8 9 MOTION/SECOND: Gunn/Meehlhause. Resolution 8890, Approving Four (4) Hours of Comp/Flex Time for all FT 19 Employees in Recognition of Outstanding Service for 2017. 20 21 City Administrator Zikmund requested the Council approve four (4) hours of Comp/Flex time for 22 all full-time employees in recognition of their outstanding service in 2017. He stated this 23 recommendation was brought about after the Council's worksession meeting held on December 24 4th. In recognition of staff's great efforts the Council was being asked to approve four hours of 25 comp/flex time. 26 27 Council Member Hull stated 2017 was a rough year for the City's employees and the Human 28 Resources Committee would like to reward its employees for their outstanding service to the 29 community through the four hours of comp/flex time. 30 31 Mayor Mueller thanked all staff members for their great work in 2017. 32 33 MOTION/SECOND: Meehlhause/Bergeron. Public Works Director Peterson requested the Council approve miscellaneous purchases for the Public Works Facility. He explained that during the phasing of this project some of the items were not included in the construction contract, but were included in the overall project. He discussed the potential of combining all Public Works staff at the new facility and noted how this Mounds View City Council January 8, 2018 Regular Meeting Page 9 1 would impact the project, noting one additional office would be needed. He commented on the 2 furniture and appliance allowance for this project. Staff recommended the Council approve the 3 furniture and appliances expense along with the change order for the additional office space. He 4 reported he was proposing to have cubicles in the office space which was more economical, and 5 would also be repurposing existing office equipment for additional cost saving measures. 6 7 Council Member Gunn asked what the price would be for the office furniture. Public Works 8 Director Peterson recommended this number be $18,000. 9 10 Mayor Mueller requested further information on the expense for the additional hard-shell office. 11 Public Works Director Peterson reported this expense would be $7,013.25. 12 13 Council Member Gunn noted the Resolution would have to be amended to note only one hard - 14 shell office was being built and not three. 15 16 Mayor Mueller requested Finance Director Beer rerun the expense numbers for the purchases in 17 order for the Council to include this in the motion for approval in Resolution 8891. Finance 18 Director Beer reported the expenses totaled $37,013.25. 19 20 Council Member Gunn stated the Resolution would need to be amended to include which fund 21 would be used for this expense. He noted the City's Business Development 38 Coordinator was interested in serving on the League of Minnesota Cities Board as this group 39 currently had an opening. REPORTS 14 A. Reports of Mayor and Council. 15 16 Council Member Meehlhause reviewed his upcoming meeting schedule. He noted he would be 17 attending an NYFS Executive Committee meeting on Thursday and YMCA meeting on Monday, 18 January 15th. He stated he would be attending an NYFS HR Committee meeting on Wednesday, 19 January 171h. He commented on the great deal of HR work that he has been doing as a Council 20 liaison. 21 22 Council Member Meehlhause recommended a thank you letter be sent to the cities of Blaine and 23 Spring Lake Park for allowing Mounds View to store their equipment in their facilities. 24 25 Mayor Mueller proposed a Resolution of Appreciation be offered to Blaine and Spring Lake Park 26 being signed by all five Council Members. 27 28 Council Member Gunn requested information on the upcoming Fire versus Police hockey game. 29 Theresa Cermak noted there were would be a Police versus Fire Hockey Game on Friday, 30 January 26, 2018 at 5:30 p.m. at Lambert Park. All proceeds from the event would benefit the 31 Mounds View Police Foundation. 32 33 Ms. Ceimak updated the Council on Festival in the Park. She explained the committee was 34 working on its finances while also getting contracts in place for this year's event. She noted a 35 dance would be held on Friday, August 17th. She explained she was still seeking a volunteer to 36 organize the crafting event and stated the next Festival in the Park Committee meeting would be 37 held on January 16th at 7:00 p.m. at City Hall in the Conference Room. 38 39 Mayor Mueller reported the Comprehensive Plan Taskforce would be holding its first meeting on 40 Tuesday, January 9th at 7:00 p.m. at City Hall. She noted this meeting will be broadcast for the 41 public. 42 43 Mayor Mueller stated she was pleased to report the City's new website was up and running. She 44 encouraged the public to check the website out and bring any problems to staff's attention. 45 Mounds View City Council January 8, 2018 Regular Meeting Page 11 1 Mayor Mueller indicated the 60th Anniversary Celebration Committee would be meeting on 2 Tuesday, January 9th at 7:00 p.m. at City Hall in the Conference Room. 3 4 Mayor Mueller reported she would be attending a leadership conference on Friday, January 26th 5 and Saturday, January 27th. She explained the focus of this conference would be on 6 communication. 7 8 Mayor Mueller stated last week she attended a merit badge session with four scouts from Troop 9 #267. 10 11 Mayor Mueller explained she received a letter from the Ralph Reeder Food Shelf thanking the 12 City of Mounds View for their generous donations in December of 2017. She reported the food 13 shelf was able to get well stocked in preparation for families in need in 2018. She noted the food 14 shelf was seeking a new location as they would have to move out of Pike Lake Elementary 15 School. 16 17 B. Reports of Staff. 18 19 City Administrator Zikmund stated The Boulevard project would be reviewed by the Council 20 again on January 22nd 21 22 City Administrator Zikmund reported staff would be updating the City's website to include 23 further information on the INH Development being proposed for Crossroad Pointe. 24 25 City Administrator Zikmund reviewed the proposed agenda for the Council retreat that would be 26 held on Monday, January 29th. 27 28 City Administrator Zilcmund commented on the Engineering Tech job description and noted the 29 education requirements had been changed which would lower the hourly wage. 30 31 City Administrator Zikmund reviewed the February worksession agenda with the Council. 32 33 Public Works Director Peterson provided the Council with a progress report on the Public Works 34 Facility. He stated staff would begin moving equipment into the new facility on Tuesday, 35 January 9th. He noted one truck would remain in Blaine (the Vactor) in order to keep this bay 36 open for the contractor. 37 38 Public Works Director Peterson reported the recently purchased plow truck was working great 39 for the City. He stated interviews for the Superintendent position would be held on January 22nd 40 and 23`d 41 42 Finance Director Beer asked where the Council wanted to meet for their retreat on Monday, 43 January 29th. Developer Fee - The proposed developer fee is approximately 9% of TDC, which is within the typical industry range of 8-10% for LIHTC projects. The Developer is also deferring approximately 81 % of their developer fee. The deferred portion of the fee is then paid to the Developer through future cash flow, which is projected to take approximately 13 years and is longer than the typical 8-10 years. The reasonable developer fee and higher deferred fee helps minimize the project's funding gap. 4. Rents - The proposed rents are within 5% of the regulatory maximum allowed to be charged in projects using LIHTC proceeds. 5. Operating Expenses - The operating expenses of approximately $3,900 per unit per year are within the typical range of $3,500 to $4,500 per unit per year. 6. Management Fee - The proposed management fee of 5.8% of revenue is higher than the typical 3% to 5% of revenue; however, reducing the fee has a nominal impact because this relatively small project produces less revenue. 7. Reserves - The annual deposit to replacement reserves is set at $450 per unit per year, which is typical for projects that include financing from Minnesota Housing. MWF Apartment Proposal January 16, 2018 Page 3 8. First Mortgage — The analysis confirms that the Developer has maximized the potential first mortgage. The proposed 4.6% interest rate and 40 -year term are competitive in the market and help minimize a funding gap. Low-income Housing Tax Credits ("LIHTC") — The project anticipates tax credit pricing of $0.93 for every $1.00 of available tax credits, which generates approximately $3.8 million of proceeds. Tax credit pricing declined at the end of 2016 and has remained lower than realized in the prior several years. Tax credit pricing on many current projects is between $0.85 and $0.95. Smaller projects like this one also tend to draw less attention from tax credit investors resulting in lower pricing. Based on current conditions, the assumed tax credit equity is reasonable. 10. TIF Note — The proposed $546,000 of TIF assistance represents approximately 4% of total project costs. Depending on the project type, TIF assistance is commonly in the range of 4-10% of total project costs. 11. MWF GP Loan — The Developer currently anticipates including a $517,000 loan from itself to resolve a remaining funding gap that is not covered by the TIF, mortgage, or other public proceeds. This type of loan is referred to as a General Partner Loan or GP Loan. This GP loan would be repaid through future cash flow or through refinancing after the initial 15 -year affordability compliance period. For projects using LIHTC, it is somewhat uncommon for developers to provide GP Loan; however, this suggests that MWF is working to minimize the funding request. MWF may seek additional funding sources to reduce or eliminate the GP Loan; however, that would not change the conclusion of this analysis unless MWF secures more additional funding than the current GP Loan amount. Based on the submitted project information, the Developer has maximized the potential private mortgage and low-income housing tax credit proceeds. However, a demonstrated financial gap remains. The proposed development will not reasonably be expected to occur solely through private investment within the reasonably near future. Due to the costs associated with developing the property and constructing housing with affordable rents, this project is feasible only through assistance. If approved, the new lease would go into effect on August 1, 2018 and run through July 31, 2023. Discussion: The City Council requested proposals from Creative Kids Academy and the YMCA of the Greater Twin Cities for the lease and operation of the child care space. Both proposals were presented to the City Council at a work session and it was it was the City Council's consensus that Creative Kids Academy provided the proposal that was the greatest benefit for the City. The attached extension agreement was originally drafted by Kennedy & Graven. The only changes are to the dates, rent and property tax consideration as well as the inclusion of the tenant's requirement to cover 50% of the costs of the dishwasher. Most of the bill provisions became effective on May 31, 2017, with the exception that the prohibition on moratoria does not take effect until January 1, 2018 for those cities that did not have a right-of-way ordinance in place on or before May 18, 2017. To give those cities an opportunity to enact an ordinance regulating their public right-of-way. The new law requires a separate permit process for small cell wireless facilities. The City has 90 days after the date a small wireless facility permit application is submitted to issue or deny the permit. Discussion: Public Works and Community Development are working with Kennedy Graven the City Attorney on updating Ordinance 940, section 910 regarding the management within in the City's right-of-way. Staff has also reviewed and purpose changes to the Zoning Ordinance to make small cell wireless a permitted use within the right-of-way. The Planning Commission reviewed the proposed ordinance amendment as it relates to the Zoning Code (Title 1100) at its January 3, 2018 meeting, recommending approval of that section (Resolution 1082-18). There was discussion of the pros & cons if the antennas were a permitted use vs. a conditional use within Residential districts, as well as the desire for colocation, how many antennas may be expected (unknown), and the service area of individual antennas (unknown). At the January 8 City Council meeting the City Council approved the First Reading and setting the Public Hearing for Monday January 22. The City Council of the City of Mounds View hereby amends Title 900 (Public Ways and Property), Section 910 (Right -of -Way Management), and Title 1100 (Zoning Code), Section 1124 (Wireless Telecommunication Facilities), by inserting the double -underlined language and removing the strieke language, and updating numbering as follows: TITLE 900 PUBLIC WAYS AND PROPERTY 910.1: FINDINGS, PURPOSE, AND INTENT: The City hereby enacts this new Chapter of this Code relating to right-of-way permits and administration and to provide for the health, safety and welfare of its citizens, and to ensure the integrity of its streets and the appropriate use of the rights-of-way. This Chapter imposes reasonable regulation on the placement and maintenance of facilities and equipment currently within its rights-of-way or to be placed therein. It is intended to complement the regulatory roles of state and federal agencies. This Chapter shall be interpreted consistently with 1997 Session Laws, Chapter 123, substantially codified in Minnesota Statutes, sections 237.16, 237.162, 237.163, 237.79, 237.81, and 238.086 (the "Act") and 2017 Session Laws, Chanter 94 amending the Act. and the other laws governing applicable rights of the City and users of the right-of-way. This Chapter shall also be interpreted consistently with Minnesota Rules Part 7819.0050 — 7819.9950 where possible. To the extent any provision of this chapter cannot be interpreted consistently with the Minnesota Rules, that interpretation most consistent with the Act and other applicable statutory and case law is intended. Ordinance 940 Page 2 "r.Ot ELECTION TO MANAGE THE PUBLIC RIGHT-OF-WAY: In accordance with the authority granted to the City under state and federal statutory, administrative and common law, the city hereby elects pursuant to this Chapter to manage rights -of -ways within the jurisdiction. 910:03: DEFINITIONS: The following definitions apply in this Chapter of this Code. References hereafter to "Sections" are unless otherwise specified references to Sections in this Chapter. Defined terms remain defined terms whether or not capitalized. Subd. 1. ABANDONED FACILITY means a facility no longer in service or physically disconnected from a portion of the operating facility, or from any other facility, that is in use or still carries service. A facility is not abandoned unless declared so by the right-of-way user. Subd. 2. APPLICANT means any Person requesting permission to Excavate or obstruct a right -of- way. Subd. 3. CITY means the City of Mounds View, Minnesota. For purposes of Section 910.27, City means its elected officials, officers, employees and agents. Subd.-� 4 COLLOCATE or COLLOCATION means to install, mount, maintain, modify, operate, or replace a small wireless facility on, under, within, or adjacent to an existing wireless support structure or utility pole that is owned privately, or by the city or other governmental unit. Subd. 5. COMMISSION means the Minnesota Public Utilities Commission. Subd. -&-6. CONGESTED RIGHT-OF-WAY means a crowded condition in the subsurface of the public right-of-way that occurs when the maximum lateral spacing between existing underground facilities does not allow for construction of new underground facilities without using hand digging to expose the existing lateral facilities in conformance with Minnesota Statutes, section 216D.04. subdivision 3, over a continuous length in excess of five hundred feet (500'). Subd. 6—.7. CONSTRUCTION PERFORMANCE BOND means any of the following forms of security provided at permittee's option: Ordinance 940 Page 3 (a)Individual project bond b -Cash deposit; Cci c Security of a form listed or approved under Minnesota Statutes, section 15.73 subdivision 3; d) d—Letter of Credit, in a form acceptable to the LGU; Oe e -Self-insurance, in a form acceptable to the LGU; f Blanket bond for projects within the City, or other form of construction bond, for a time specified and in a form acceptable to the City. Subd. -7-.-8. DEGRADATION means a decrease in the useful life of the right-of-way caused by excavation in or disturbance of the right-of-way, resulting in the need to reconstruct such right -of- way earlier than would be required if the excavation or disturbance did not occur. Subd. 8-.9. DEGRADATION COST subject to Minnesota Rules 7819.1100 means the cost to achieve a level of restoration as determined by the City at the time the permit is issued, not to exceed the maximum Restoration shown in plates 1 to 13, set forth in Minnesota Rules parts 7819.9900 to 7819.9950. Subd. -10. DEGRADATION FEE means the estimated fee established at the time of permitting by the City to recover costs associated with the decrease in the useful life of the right- of-way caused by the excavation, and which equals the degradation costs. Subd.& 11. DEPARTMENT means the Department of Public Works of the City. Subd. 44-.12. DEPARTMENT INSPECTOR means any person authorized by the Director to carry out inspections related to the provisions of this Chapter. Subd. 4-1-13. DIRECTOR means the Director of the Department of Public Works of the City, or Director's designee. Subd. 43-14.DELAY PENALTY is the penalty imposed as a result of unreasonable delays in right-of-way excavation, obstruction, patching, or restoration as requested bypermit. 4. Subd. 15. EMERGENCY means a condition that (1) poses a danger to life or health, or of a significant loss of property; or (2) requires immediate repair or replacement of facilities in order to restore service to a customer. C•Subd. 16. EQUIPMENT means any tangible asset used to install, repair, or maintain facilities in any right-of-way. Subd. 4&.--17. EXCAVATE means to dig into or in any way remove or physically disturb or penetrate any part of a right-of-way. Subd. 47-18. EXCAVATION PERMIT means the permit which, pursuant to this Chapter, must be obtained before a person may excavate in a right-of-way. An excavation permit allows the holder to excavate that part of the right-of-way described in such permit. Subd. X19. EXCAVATION PERMIT FEE means money paid to the city by an applicant to cover the costs as provided in Section 910.11. Subd.1-9- 20. FACILITY OR FACILITIES means any tangible asset in the right-of-way required to provide utility service. Ordinance 940 Page 4 Subd. 2-W-21. FIVE YEAR PROJECT PLAN shows projects adopted by the local government unit for construction within the next five (5) years. Subd. 2-1-.-22. HIGH DENSITY CORRIDOR means a designated portion of the public right-of- way within which telecommunications right-of-way users having multiple and competing facilities may be required to build and install facilities in a common conduit system or other common structure. Subd. 223 HOLE means an excavation in the pavement, with the excavation having a length less than the width of the pavement. Subd. 24 2-3: LOCAL GOVERNMENT UNIT means the City. Subd. 242-5-. LOCAL REPRESENTATIVE means a local person or persons, or designee of such person or persons, authorized by a registrant to accept service and to make decisions for that registrant regarding all matters within the scope of this Chapter. Subd. 226. MANAGEMENT COSTS means the actual costs the City incurs in managing its rights-of-way, including such costs, if incurred, as those associated with registering Applicants; issuing, processing, and verifying right-of-way or small wireless facility permit applications; inspecting job sites and restoration projects; maintaining, supporting, protecting, or moving user facilities during right-of-way work; determining the adequacy of right-of-way restoration; restoring work inadequately performed after providing notice and the opportunity to correct the work; and revoking right-of-way or small wireless facility permits. Management costs do not include payment by a telecommunications right-of-way user for the use of the right- of-way. unreasonable fees of a third -party contractor used by the city including fees tied to or based on customer counts, access lines, or revenues generated by the right- of-way or for the city. the fees and cost of litigation relating to the interpretation of Minnesota Session Laws 1997, Chapter 123; Minnesota Statutes, sections 237.162 or 237.163 or any ordinance enacted under those Sections, or the City fees and costs related to appeals taken pursuant to Section 910.29 of this Chapter. Subd. 26—.27,OBSTRUCT means to place any tangible object in a right-of-way so as to hinder free and open passage over that or any part of the right-of-way. Subd. 228 OBSTRUCTION PERMIT means the permit which, pursuant to this Chapter, must be obtained before a person may obstruct a right-of-way, allowing the holder to hinder free and open passage over the specified portion of that right-of-way, for the duration specified therein. Subd. 222_. OBSTRUCTION PERMIT FEE means money paid to the City by a permittee to cover the costs as provided in Section 910.11. Ordinance 940 Page 5 Subd. 29-M PATCH OR PATCHING means a method of pavement replacement that is temporary in nature. A patch consists of (1) the compaction of the subbase and aggregate base, and (2) the replacement, in kind, of the existing pavement for a minimum of two feet beyond the edges of the excavation in all directions. A patch is considered full restoration only when the pavement is included in the city's five-year project plan. Subd. M.-31. PAVEMENT means any type of improved surface that is within the public right-of- way and that is paved or otherwise constructed with bituminous, concrete, aggregate, or gravel. Subd. 34—.32. PERMIT has the meaning given "right-of-way permit" in Minnesota Statutes, section 237.162. Subd. 333. PERMITTEE means any person to whom a permit to excavate or obstruct a right- of-way has been granted by the City under this Chapter. Subd. 33—.34. PERSON means an individual or entity subject to the laws and rules of this state, however organized, whether public or private, whether domestic or foreign, whether for profit or nonprofit, and whether natural, corporate, or political. Subd. 34.-35. PROBATION means the status of a person that has not complied with the conditions of this Chapter. Subd. 35—.36. PROBATIONARY PERIOD means one (1) year from the date that a person has been notified in writing that they have been put on probation. Subd. 337. PUBLIC RIGHT-OF-WAY or RIGHT-OF-WAY means the area on, below, or above a public roadway, highway, street, cartway, bicycle lane and public sidewalk in which the City has an interest, including other dedicated rights-of-way for travel purposes and utility easements of the City. A right-of-way does not include the airwaves above a right-of-way with regard to cellular or other non -wire telecommunications or broadcast service. Subd. 3-38. REGISTRANT means any person who (1) has or seeks to have its equipment or facilities located in any right-of-way, or (2) in any way occupies or uses, or seeks to occupy or use, the right-of-way or place its facilities or equipment in the right-of- way. Subd. 339. RESTORE OR RESTORATION means the process by which an excavated right- of-way and surrounding area, including pavement and foundation, is returned to the same condition and life expectancy that existed before excavation. Subd. 39—Subd. 40. RESTORATION COST means the amount of money paid to the City by a permittee to achieve the level of restoration according to plates 1 to 13 of PUC rules. Subd. 40..Subd. 41. RIGHT-OF-WAY PERMIT means either the excavation permit or the obstruction permit, or both, depending on the context, required by this Chapter. Ordinance 940 Page 6 Subd. 41-42. RIGHT-OF-WAY USER means (1) a telecommunications right-of-way user as defined by Minnesota Statutes, section 237.162, subdivision 4; or (2) a person owning or controlling a facility in the right-of-way that is used or intended to be used for providing utility service, and who has a right under law, franchise, or ordinance to use the public right-of-way. Subd. 443. SERVICE OR UTILITY SERVICE includes_ (1) those services provided by a public utility as defined in Minnesota Statutes, section 21613.02, subdivisions 4 and 6; (2) services of a telecommunications right-of-way user, including transporting of voice or data information; (3*services of a cable communications systems as defined in Minnesota Statutes, chapter 238; O+natural gas or electric energy or telecommunications services provided by the City; ()-services provided by a cooperative electric association organized under Minnesota Statutes, chapter 308A; and (6) water, sewer, steam, cooling or heating services. Subd. 43`44. SERVICE LATERAL means an underground facility that is used to transmit, distribute or furnish gas, electricity, communications, or water from a common source to an end-use customer. A service lateral is also an underground facility that is used in the removal of wastewater from a customer's premises. Subd 45 SMALL WIRELESS FACILITY means a wireless facility that meets both of the following qualifications: (1) each antenna is located inside an enclosure of no more than six cubic feet in volume or could fit within such an enclosure: and 2) all other wireless eauipment associated with the small wireless facility provided such equipment is, in aggregate, no more than 28 cubic feet in volume. not including electric meters, concealment elements, telecommunications demarcation boxes battery backup power systems, grounding equipment. power transfer switches, cutoff switches, cable, conduit, vertical cable runs for the connection of power and other services, and any equipment concealed from public view within or behind an existing structure or concealment. Subd. 46. SUPPLEMENTARY APPLICATION means an application made to excavate or obstruct more of the right-of-way than allowed in, or to extend, a permit that had already been issued. Ordinance 940 Page 7 Subd. 44—.47. TEMPORARY SURFACE means the compaction of subbase and aggregate base and replacement, in kind, of the existing pavement only to the edges of the excavation. It is temporary in nature except when the replacement is of pavement included in the local government unit's two-year plan, in which case it is considered full restoration. Subd. 45A& TRENCH means an excavation in the pavement, with the excavation having a length equal to or greater than the width of the pavement. Subd. 46. TE Ti` /''llAiiMUNI A TION49. TELECOMMUNICATIONS RIGHTS-OF- WAY USER means a person owning or controlling a facility in the right-of-way, or seeking to own or control a facility in the right -of- way, that is used or is intended to be used for providing wireless service, or transporting telecommunication or other voice or data information. For purposes of this chapter, a cable communication system defined and regulated under Minnesota Statutes, chapter 238, and telecommunication activities related to providing natural gas or electric energy services whether provided b., a public utility as defined in Minnesota Statutes, section 216B.02, a municipality, a municipal gas or power agency organized under Minnesota Statutes, chapters 453 and 453A, or a cooperative electric association organized under Minnesota Statutes, chapter 308A, are not telecommunications right- of-way users for purposes of this Chapter, except to the extent such entity is offering wireless service. Subd. 450. TWO YEAR PROJECT PLAN shows projects adopted by the local government unit for construction within the next two (2) years. Subd. 51. UTILITY POLE means a pole that is used in whole or in part to facilitate telecommunications or electric service. Subd. 52. WIRELESS FACILITY means Eauipment at a fixed location that _enables the provision of wireless services between user equipment and a wireless service network, including equipment associated with wireless service, a radio transceiver, antenna, coaxial or fiber-optic cable, regular and backup_power supplies,and a small wireless facility. but not including wireless support structures, wireline backhaul facilities, or cables between utility poles or wireless support structures, or not otherwise immediately adjacent to and directly associated with a specific antenna. Subd. 53. WIRELESS SERVICE means anv service using licensed or unlicensed wireless spectrum, including the use of Wi-Fi, whether at a fixed location or by means of a mobile devise, that is provided using wireless facilities. Wireless service does not include services regulated under Title VI of the Communications Act of 1934, as amended, including cable service. Subd. 54. WIRELESS SUPPORT STRUCTURE means a new or existing structure in a right-of-way designed to support or capable of supporting small wireless facilities. as reasonably determined by the city. Ordinance 940 Page 8 x&04211 14: ADMINISTRATION: The Director is the principal City official responsible for the administration of the Rights -of -Way, Right -of -Way Permits, and the ordinances related thereto. The Director may delegate any or all of the duties hereunder. 910.05 910.5: REGISTRATION AND RIGHT-OF-WAY OCCUPANCY: Subd. 1. Registration: Each Person who occupies, uses, or seeks to occupy or use, the Right - of -Way or place any Equipment or Facilities in or on the Right -of -Way, including Persons with installation and maintenance responsibilities by lease, sublease or assignment, must register with the Director. Registration will consist of providing application information and paying a registration fee. Subd. 2. Registration Prior to Work: No Person may construct, install, repair, remove, relocate, or perform any other work on, or use any Facilities or any part thereof in any Right -of -Way without first being registered with the Director. Subd. 3. Exceptions: Nothing herein shall be construed to repeal or amend the provisions of a City ordinance permitting Persons to plant or maintain boulevard plantings or gardens in the area of the Right -of -Way between their property and the street curb. Persons planting or maintaining boulevard plantings or gardens shall not be deemed to use or occupy the Right -of -Way, and shall not be required to obtain any permits or satisfy any other requirements for planting or maintaining such boulevard plantings or gardens under this Chapter. However, nothing herein relieves a Person from complying with the provisions of the Minnesota Statutes chapter 216D, One Call Excavation Notice System. 910.06-910.6: REGISTRATION INFORMATION: Subd. 1. Information Required: The information provided to the Director at the time of registration shall include, but not be limited to: Ordinance 940 Page 9 (a) Each Registrant's name, One Call Excavation Notice System registration certificate number, address and e-mail address if applicable, and telephone and facsimile numbers. (b) The name, address and e-mail address, if applicable, and telephone and facsimile numbers of a Local Representative. The Local Representative or designee shall be available at all times. Current information regarding how to contact the Local Representative in an Emergency shall be provided at the time of registration. (c) A certificate of insurance or self-insurance: (1) Verifying that an insurance policy has been issued to the Registrant by an insurance company authorized to do business in the State of Minnesota, or a form of self insurance acceptable to the Director. (2) Verifying that the Registrant is insured against claims for Personal injury, including death, as well as claims for property damage arising out of the (i) use and occupancy of the Right -of -Way by the Registrant, its officers, agents, employees and Permittees, and (ii) placement and use of Facilities and Equipment in the Right -of -Way by the Registrant, its officers, agents, employees and Permittees, including, but not limited to, protection against liability arising from completed operations, damage of underground Facilities and collapse of property; (3) Either naming the City as an additional insured as to whom the coverages required herein are in force and applicable and for whom defense will be provided as to all such coverages or otherwise providing evidence satisfactory to the Director that the city is fully covered and will be defended through Registrant's insurance for all actions included in Minnesota Rule subpart 7819.1250; (4) Requiring that the Director be notified thirty (30) days in advance of cancellation of the policy or material modification of a coverage term; (5) Indicating comprehensive liability coverage, automobile liability coverage, workers compensation and umbrella coverage established by the Director in amounts sufficient to protect the City and the public and to carry out the purposes and policies of this Chapter. (d) The City may require a copy of the actual insurance policies if necessary to ensure the Director that the policy provides adequate third parry claim coverage and city indemnity and defense coverage for all actions included in the indemnity required by Minnesota Rule subpart 7819.1250. (e) Such evidence as the Director may require that the person is authorized to do business in Minnesota. Subd. 2. Notice of Changes: The Registrant shall keep all of the information listed above current at all times by providing to the Director information as to changes within fifteen (15) days following the date on which the Registrant has knowledge of any change. 910.7: REPORTING OBLIGATIONS: Subd.1. Operations: Each Registrant shall, at the time of registration and by December 1 of each year, file a construction and major maintenance plan for underground Facilities with the Director. Such plan shall be submitted using a format designated by the Director and shall contain the information determined by the Director to be necessary to facilitate the coordination and reduction in the frequency of excavations and Obstructions of Rights -of -Way. Ordinance 940 Page 10 The plan shall include, but not be limited to, the following information: (a) The locations and the estimated beginning and ending dates of all Projects to be commenced during the next calendar year (in this section, a "Next -year Project"); and (b) To the extent known, the tentative locations and estimated beginning and ending dates for all Projects contemplated for the five (5) years following the next calendar year (in this section, a "Five (5) -year Project"). The term "project" in this section shall include both Next -year Projects and Five (5) - year Projects. By January 1 of each year the Director will have available for inspection in the Director's office a composite list of all Projects of which the Director has been informed of the annual plans. All Registrants are responsible for keeping themselves informed of the current status of this list. Thereafter, by February 1, each Registrant may change any Project in its list of Next - year Projects, and must notify the Director and all other Registrants of all such changes in said list. Notwithstanding the foregoing, a Registrant may at any time join in a Next -year Project of another Registrant listed by the other Registrant. Subd. 2. Additional Next -year Projects: Notwithstanding the foregoing, the Director will not deny an application for a Right -of -Way Permit for failure to include a project in a plan submitted to the City if the Registrant has used commercially reasonable efforts to anticipate and plan for the project. 910.8: PERMIT REQUIREMENT: Subd. 1. Permit Required: Except as otherwise provided in this Code, no Person may Obstruct or Excavate any Right -of -Way, or install or place facilities in the right-of- wav, without first having obtained the appropriate Right -of -Way Permit from the Director to do so. Ordinance 940 Page 11 (a) Excavation Permit: An Excavation Permit is required by a Registrant to Excavate that part of the Right -of -Way described in such permit and to hinder free and open passage over the specified portion of the Right -of -Way by placing Facilities described therein, to the extent and for the duration specified therein. (b) Obstruction Permit: An Obstruction Permit is required by a Registrant to hinder free and open passage over the specified portion of Right -of -Way by placing Equipment described therein on the Right -of -Way, to the extent and for the duration specified therein. An Obstruction Permit is not required if a Person already possesses a valid Excavation Permit for the same project. (c) Small Wireless Facility Permit. A small wireless facility permit is required by a registrant to erect or install a wireless support structure, to collocate a small wireless facility, or to otherwise install a small wireless facility in the specified portion of the right-of-way, to the extent specified therein, provided that such permit shall remain in effect for the length of time the facility is in use, unless lawfully revoked. Subd. 2. Permit Extensions: No Person may Excavate or Obstruct the Right -of -Way beyond the date or dates specified in the permit unless such Person (i) makes a Supplementary Application for another Right -of -Way Permit before the expiration of the initial permit, and (ii) a new permit or permit extension is granted. Subd. 3. Delay Penalty: In accordance with Minnesota Rule 7819.1000 subp. 3 and notwithstanding subdivision 2 of this Section, the City shall establish and impose a Delay Penalty for unreasonable delays in Right -of -Way excavation, Obstruction, Patching, or Restoration. The Delay Penalty shall be established from time to time by City Council resolution. Subd. 4. Permit Display: Permits issued under this Chapter shall be conspicuously displayed or otherwise available at all times at the indicated work site and shall be available for inspection by the Director. 910.09: PERMIT APPLICATIONS: Application for a permit is made to the Director. Permit applications shall contain, and will be considered complete only upon compliance with the requirements of the following provisions: (a) Registration with the Director pursuant to this Chapter; (b) Submission of a completed permit application form, including all required attachments, and scaled drawings showing the location and area of the proposed project and the location of all known existing and proposed Facilities. (c) Payment of money due the City for (1) permit fees, estimated Restoration Costs and other Management Costs, (2) prior Obstructions or Excavations; (3) any undisputed loss, damage, or expense suffered by the City because of Applicant's prior excavations or Obstructions of the rights-of-way or any Emergency actions taken by the City; (4) franchise fees or other charges, if applicable. Ordinance 940 Page 12 (d) Posting an additional or larger construction performance bond for additional facilities when applicant requests an excavation permit to install additional facilities and the director deems the existing construction performance bond inadequate under applicable standards. 910.10: ISSUANCE OF PERMIT; CONDITIONS: Subd. 1. Permit Issuance: If the Applicant has satisfied the requirements of this Chapter, the Director shall issue a permit. Subd. 2. Conditions: The Director may impose reasonable conditions upon the issuance of the permit and the performance of the Applicant thereunder to protect the health, safety and welfare or when necessary to protect the Right -of -Way and its current use. Subd 3 Small Wireless Facility Conditions In addition to subdivision 2, the erection or installation of a wireless support structure the collocation of a small wireless_ facility, or other installation of a small wireless facility in the right-of-way, shall be subject to the following conditions: (a) A small wireless facility shall only be collocated on the particular wireless support structure under those attachment specifications, and at the height indicated in the applicable permit application. (b) No new wireless support structure installed within the right-of-way sha11 exceed 50 feet in height without the city's written authorization, provided that the city may impose a lower height limit in the applicable permit to protect the public health safety and welfare or to protect the right-of-way and its current use and further provided that a registrant may replace an existing wireless support structure exceeding 50 feet in height with a structure of the same height subject to such conditions or requirements as may be imposed in the applicable permit. (c) No wireless facility may extend more than 10 feet above its wireless support structure. (dl Where an applicant proposes to install a new wireless support structure in the right of way the city may impose separation requirements between such structure and any existing wireless support structure or other facilities in and around the right-of-way. (e) Where an applicant proposes collocation on a decorative wireless support structure sign or other structure not intended to support small wireless facilities the city may impose reasonable requirements to accommodate the particular design appearance or intended pmose of such structure. Ordinance 940 Page 13 (fl Where an applicant proposes to replace a wireless support structure, the city may impose reasonable restocking replacement, or relocation requirements on the replacement of such structure. Subd 4 Small Wireless Facility Agreement A small wireless facility shall only be collocated on a small wireless support structure owned or controlled by the city, or any other city asset in the right-of-way, after the applicant has executed a standard small wireless facility collocation agreement with the city The standard collocation agreement may require payment of the following: (a) I to $150 per year for rent to collocate on the city structure. (b) $25 per year for maintenance associated with the collocation; (c) A monthly fee for electrical service as follows: (1) $73 per radio node less than or equal to 100 maximum watts; (2) $182 per radio node over 100 maximum watts; or (3) The actual costs of electricity, if the actual cost exceed the foregoing. The standard collocation agreement shall be in addition to, and not in lieu of, the required small wireless facility permit provided however, that the applicant shall not be additionally required to obtain a license or franchise in order to collocate. Issuance of a small wireless facility permit does not supersede alter or affect any then -existing agreement between the city and applicant, 910.11 ACTION ON SMALL WIRELESS FACILITY PERMIT APPLICATION: Subd 1 Deadline for Action: The city shall approve or deny a small wireless facility permit application within 90 days after filing of such application. The small wireless facility permit and any associated building permit application, shall be deemed approved if the city fails to approve or deny the application within the review periods established in this section. Subd 2 Consolidated Applications: An applicant may file a consolidated small wireless facility permit application addressing the proposed collocation of up to 15 small wireless facilities or a greater number if agreed to by a local government unit, provided that all small wireless facilities in the application: (a) are located within a two-mile radius; (b) consist of substantially similar equipment; and (c) are to be placed on similar types of wireless support structures. Ordinance 940 Page 14 In rendering a decision on a consolidated permit application, the city may approve some small wireless facilities and deny others but may not use denial of one or more permits as a basis to deny all small wireless facilities in the application. Subd 3 Tolling of Deadline: The 90 -day deadline for action on a small wireless facility permit application may be tolled if: al The city receives applications from one or more applicants seeking approval of permits for more than 30 small wireless facilities within a seven-day period In such case the city may extend the deadline for all such applications by 30 days by informing the affected applicants in writing of such extension. (b) The applicant fails to submit all required documents or information and the city provides written notice of incompleteness to the applicant within 30 days of receipt the application Upon submission of additional documents or information the city shall have ten days to notify the applicant in writing of any still -missing information. (c) The city and a small wireless facility applicant agree in writing to toll the review period. 91A.-�910.12: PERMIT FEES: Subd. 1. Fee Schedule and Fee Allocation: The City's permit fee schedule shall be available to the public and established in advance. The permit fees shall be designed to recover the City's actual costs incurred in managing the right-of-way and shall be based on an allocation among all users of the right-of-way, including the City. Subd. 2. Excavation Permit Fee: The city shall epi=Mp.ose an Excavation Permit Fee in an amount sufficient to recover the following costs: (a) the City Management Costs; (b) Degradation Costs, if applicable. Subd. 3. Obstruction Permit Fee: The city shall estahli�'mnose the Obstruction Permit Fee which shall be in an amount sufficient to recover the City Management Costs. Subd 4 Small Wireless Facility Permit Fee: The city shall impose a small wireless facility permit fee in an amount sufficient to recover: (a) the City Management Costs: and (b) city engineering make-ready, and construction costs associated with collocation of small wireless facilities. Ordinance 940 Page 15 Subd. 4: 5. Payment of Permit Fees: No Excavation Permit or Obstruction Permit shall be issued without payment of Excavation or Obstruction Permit Fees. The City may allow Applicant to pay such fees within thirty (30) days of billing. Subd. 5-.-6. Non refundable: Permit fees that were paid for a permit that the Director has revoked for a breach as stated in Section 910.21 are not refundable. Subd. �-7. Application to franchises: Unless otherwise agreed to in a franchise, Management Costs may be charged separately from and in addition to the franchise fees imposed on a right-of-way user in the franchise. 910.12 910.13: RIGHT-OF-WAY PATCHING AND RESTORATION: Subd. 1. Timing: The work to be done under the Excavation Permit, and the Patching and Restoration of the Right -of -Way as required herein, must be completed within the dates specified in the permit, increased by as many days as work could not be done because of circumstances beyond the control of the Permittee or when work was prohibited as unseasonal or unreasonable under Section 910.15. Subd. 2. Patch and Restoration: Permittee shall Patch its own work. The City may choose either to have the Permittee restore the Right -of -Way or to Restore the Right -of - Way itself. (a) City Restoration: If the City restores the Right -of -Way, Permittee shall pay the costs thereof within thirty (30) days of billing. If, following such Restoration, the pavement settles due to Permittee's improper backfilling, the Permittee shall pay to the City, within thirty (30) days of billing, all costs associated with having to correct the defective work. (b) Permittee Restoration: If the Permittee Restores the Right -of -Way itself, it shall at the time of application for an Excavation Permit post a Construction Performance Bond in accordance with the provisions of Minnesota Rules 7819.3000. (c) Degradation Fee in Lieu of Restoration: In lieu of right-of-way restoration, a right-of-way user may elect to pay a degradation fee. However, the right-of- way user shall remain responsible for patching and the degradation fee shall not include the cost to accomplish these responsibilities. Subd. 3. Standards: The Permittee shall perform Patching and Restoration according to the standards and with the materials specified by the Director and shall comply with Minnesota Rule 7819.1100. The Director shall have the authority to prescribe the manner and extent of the Restoration, and may do so in written procedures of general application or on a case-by-case basis. Ordinance 940 Page 16 Subd. 4. Duty to Correct Defects: The Permittee shall correct defects in patching, or restoration performed by permittee or its agents. Permittee shall upon notification from the Director, correct all restoration work to the extent necessary, using the method required by the Director. Said work shall be completed within five (5) calendar days of the receipt of the notice from the Director, not including days during which work cannot be done because of circumstances constituting force majeure or days when work is prohibited as unseasonal or unreasonable under Section 910.15. Subd. 5. Failure to Restore: If the Permittee fails to Restore the Right -of -Way in the manner and to the condition required by the Director, or fails to satisfactorily and timely complete all Restoration required by the Director, the Director at its option may do such work. In that event the Permittee shall pay to the City, within thirty (30) days of billing, the cost of Restoring the Right -of -Way. If Permittee fails to pay as required, the City may exercise its rights under the Construction Performance Bond. 940.13 910.14: JOINT APPLICATIONS: Subd. 1. Joint Application: Registrants may jointly apply for permits to Excavate or Obstruct the Right -of -Way at the same place and time. Subd. 2. Shared Fees: Registrants who apply for permits for the same Obstruction or excavation, which the Director does not perform, may share in the payment of the Obstruction or Excavation Permit Fee. In order to obtain a joint permit, registrants must agree among themselves as to the portion each will pay and indicate the same on their applications Subd. 3. With City Projects: Registrants who join in a scheduled Obstruction or excavation performed by the Director, whether or not it is a joint application by two or more Registrants or a single application, are not required to pay the Excavation or Obstruction and Degradation portions of the permit fee, but a permit would still be required. 910.14-910.15: SUPPLEMENTARY APPLICATIONS: Subd. 1. Limitation on Area: A Right -of -Way Permit is valid only for the area of the Right - of -Way specified in the permit. No Permittee may do any work outside the area specified in the permit, except as provided herein. Any Permittee which determines that an area greater than that specified in the permit must be Obstructed or Excavated must before working in that greater area (i) make application for a permit extension and pay any additional fees required thereby, and (ii) be granted a new permit or permit extension. Ordinance 940 Page 17 Subd. 2. Limitation on dates: A Right -of -Way Permit is valid only for the dates specified in the permit. No Permittee may begin its work before the permit start date or, except as provided herein, continue working after the end date. If a Permittee does not finish the work by the permit end date, it must apply for a new permit for the additional time it needs, and receive the new permit or an extension of the old permit before working after the end date of the previous permit. This Supplementary Application must be submitted before the permit end date. 910.15 910.16: OTHER OBLIGATIONS: Subd. 1. Compliance With Other Laws: Obtaining a Right -of -Way Permit does not relieve Permittee of its duty to obtain all other necessary permits, licenses, and authority and to pay all fees required by the City or other applicable rule, law or regulation. A Permittee shall comply with all requirements of local, state and federal laws, including Minn. Stat. § 216D.01-.09 (One Call Excavation Notice System). A Permittee shall perform all work in conformance with all applicable codes and established rules and regulations, and is responsible for all work done in the Right -of - Way pursuant to its permit, regardless of who does the work. Subd. 2. Prohibited Work: Except in an Emergency, or with the approval of the Director, no Right- of -Way Obstruction or excavation may be done when seasonally prohibited or when conditions are unreasonable for such work. Subd. 3. Interference with Right -of -Way: A Permittee shall not so Obstruct a Right -of -Way that the natural free and clear passage of water through the gutters or other waterways shall be interfered with. Private vehicles of those doing work in the Right -of -Way may not be parked within or next to a permit area, unless parked in conformance with City parking regulations. The loading or unloading of trucks must be done solely within the defined permit area unless specifically authorized by the permit. 9 f0.1 -6r910.17: DENIAL OR REVOCATION OF PERMIT: Subd. 1. Reasons for Denial: The Director may deny a permit for failure to meet the requirements and conditions of this Chapter or if the Director determines that the denial is necessary to protect the health, safety, and welfare or when necessary to protect the Right -of -Way and its current use. Subd 2 Procedural Requirements: The denial or revocation of a Hermit must be made in writing and must document the basis for the denial. The city must notify the applicant or right-of-way user in writing within three business days of the decision to deny or revoke a permit If an application is denied, the right-of-way user may address the reasons for denial identified by the city and resubmit its application. If the application is resubmitted within 30 days of receipt of the notice of denial, no additional application fee shall be imposed. The city must approve or deny the resubmitted application within 30 days after submission. Ordinance 940 Page 18 9-17 910.1 : INSTALLATION REQUIREMENTS: The excavation, backfilling, Patching and Restoration, and all other work performed in the Right -of -Way shall be done in conformance with Minnesota Rules 7819.1100 and other applicable local requirements, in so far as they are not inconsistent with the Minnesota Statutes, Sections. 237.162 and 237.163. 910.18-910.19: INSPECTION: Subd. 1. Notice of Completion: When the work under any permit hereunder is completed, the Permittee shall furnish a Completion Certificate in accordance Minnesota Rules 7819.1300. Subd. 2. Site Inspection: Permittee shall make the work -site available to the Director and to all others as authorized by law for inspection at all reasonable times during the execution of and upon completion of the work. Subd. 3. Authority of Director: (a) At the time of inspection, the Director may order the immediate cessation of any work which poses a serious threat to the life, health, safety or well-being of the public. (b) The Director may issue an order to the Permittee for any work which does not conform to the terms of the permit or other applicable standards, conditions, or codes. The order shall state that failure to correct the violation will be cause for revocation of the permit. Within ten (10) days after issuance of the order, the Permittee shall present proof to the Director that the violation has been corrected. If such proof has not been presented within the required time, the Director may revoke the permit pursuant to Section 910.21. 94 0.1-9-910.20: WORK DONE WITHOUT A PERMIT: Subd. 1. Emergency Situations: Each Registrant shall immediately notify the Director of any event regarding its Facilities, which it considers to be an Emergency. The Registrant may proceed to take whatever actions are necessary to respond to the Emergency. Within two business days after the occurrence of the Emergency the Registrant shall apply for the necessary permits, pay the fees associated therewith and fulfill the rest of the requirements necessary to bring itself into compliance with this Chapter for the actions it took in response to the Emergency. If the Director becomes aware of an Emergency regarding a Registrant's Facilities, the Director will attempt to contact the Local Representative of each Registrant affected, or potentially affected, by the Emergency, direct them to take whatever action may be necessary to respond to the Emergency, or otherwise take whatever action the Director deems necessary to respond to the Emergency if Registrant does not timely respond. The Cost shall be borne by the Registrant whose Facilities occasioned the Emergency. Ordinance 940 Page 19 Subd. 2. Non -Emergency Situations: Except in an Emergency, any Person who, without first having obtained the necessary permit, Obstructs or Excavates a Right -of -Way must subsequently obtain a permit, and as a penalty pay double the normal fee for said permit, pay double all the other fees required by the Legislative Code, deposit with the Director the fees necessary to correct any damage to the Right -of -Way and comply with all of the requirements of this Chapter. °'�91 .21: SUPPLEMENTARY NOTIFICATION: If the Obstruction or Excavation of the Right- of -Way begins later or ends sooner than the date given on the permit, Permittee shall notify the Director of the accurate information as soon as this information is known. 910.24-910.22: REVOCATION OF PERMITS: Subd. 1. Substantial Breach: The City reserves its right, as provided herein, to revoke any Right -of -Way Permit, without a fee refund, if there is a substantial breach of the terms and conditions of any statute, ordinance, rule or regulation, or any material condition of the permit. A substantial breach by Permittee shall include, but shall not be limited to, the following: (a) The violation of any material provision of the Right -of -Way Permit; (b) An evasion or attempt to evade any material provision of the Right -of -Way Permit, or the perpetration or attempt to perpetrate any fraud or deceit upon the City or its citizens; (c) Any material misrepresentation of fact in the application for a Right -of -Way Permit; (d) The failure to complete the work in a timely manner; unless a permit extension is obtained or unless the failure to complete work is due to reasons beyond the Permittee's control; or (e) The failure to correct, in a timely manner, work that does not conform to a condition indicated on an order issued pursuant to Section 910.18. Subd. 2. Written Notice of Breach: If the Director determines that the Permittee has committed a substantial breach of a term or condition of any statute, ordinance, rule, regulation or any condition of the permit the Director shall make a written demand upon the Permittee to remedy such violation. The demand shall state that continued violations may be cause for revocation of the permit. A substantial breach, as stated above, will allow the Director, at his or her discretion, to place additional or revised conditions on the permit to mitigate and remedy the breach. ordinance 940 Page 20 Subd. 3. Response to Notice of Breach: Within twenty-four (24) hours of receiving notification of the breach, Permittee shall provide the Director with a plan, acceptable to the Director, that will cure the breach. Permittee's failure to so contact the Director, or the Permittee's failure to submit an acceptable plan, or Permittee's failure to reasonably implement the approved plan, shall be cause for immediate revocation of the permit. Further, Permittee's failure to so contact the Director, or the Permittee's failure to submit an acceptable plan, or Permittee's failure to reasonably implement the approved plan, shall automatically place the Permittee on Probation for one (1) year. Subd. 4. Cause for Probation: From time to time, the Director may establish a list of conditions of the permit, which if breached will automatically place the Permittee on Probation for one full year, such as, but not limited to, working out of the allotted time period or working on Right -of- Way grossly outside of the permit authorization. Subd. 5. Automatic Revocation: If a Permittee, while on Probation, commits a breach as outlined above, Permittee's permit will automatically be revoked and Permittee will not be allowed further permits for one year, except for Emergency repairs. Subd. 6. Reimbursement of City Costs: If a permit is revoked, the permittee shall also reimburse the City for the City's reasonable costs, including restoration costs and the costs of collection and reasonable attorneys' fees incurred in connection with such revocation. 9'� 10910.23: MAPPING DATA: Subd. 1. Information Required: Each Registrant and Permittee shall provide Mapping information required by the Director in accordance with Minnesota Rules 7819.4000 and 7819.4100. 10. LOCATION AND RELOCATION OF FACILITIES: Subd. 1. Unless otherwise agreed in a franchise or other agreement between the applicable right-of-way user and the City, Facilities in the right-of-way must be located or relocated and maintained underground in accordance with this section, Minnesota Rule subpart 7819.3100 and Chapter 911 of this Code. Subd. 2. Corridors: The Director may assign specific corridors within the Right -of -Way, or any particular segment thereof as may be necessary, for each type of Facilities that is or, pursuant to current technology, the Director expects will someday be located within the Right -of -Way. All excavation, obstruction, or other permits issued by the Director involving the installation or replacement of Facilities shall designate the proper corridor for the Facilities at issue. Any relocation of Facilities required by the Director shall be carried out in accordance with Minnesota Rule subpart 7819.3100. Ordinance 940 Page 21 Subd. 3. Limitation of Space: To protect health, safety, and welfare or when necessary to protect the Right -of -Way and its current use, the Director shall have the power to prohibit or limit the placement of new or additional Facilities within the Right -of - Way. In making such decisions, the Director shall strive to the extent possible to accommodate all existing and potential users of the Right -of -Way, but shall be guided primarily by considerations of the public interest, the public's needs for the particular Utility Service, the condition of the Right -of -Way, the time of year with respect to essential utilities, the protection of existing Facilities in the Right -of - Way, and future City plans for public improvements and development projects which have been determined to be in the public interest. 910.14-910.25: PRE -EXCAVATION FACILITY AND FACILITIES LOCATION: Registrant shall comply with the requirements of Minn. Stat. § 216D.01-.09 ("One Call Excavation Notice System"). Any Registrant whose Facilities are less than twenty (20) inches below a concrete or asphalt surface shall notify and work closely with the excavation contractor to establish the exact location of its Facilities and the best procedure for excavation. °'910.26: DAMAGE TO OTHER FACILITIES: When the Director does work in the Right -of- Way and finds it necessary to maintain, support, or move a Registrant's Facilities to protect it, the Director shall notify the Local Representative as early as is reasonably possible. The costs associated therewith will be billed to that Registrant and must be paid within thirty (30) days from the date of billing. Each Registrant shall be responsible for the cost of repairing any Facilities in the Right -of -Way, which it or its Facilities damages. Each Registrant shall be responsible for the cost of repairing any damage to the Facilities of another Registrant caused during the City's response to an Emergency occasioned by that Registrant's Facilities. 910. 6--910.27: RIGHT-OF-WAY VACATION: If the City vacates a Right -of - Way, which contains the Facilities of a Registrant, the registrant's rights in the vacated right-of- way are governed by Minnesota Rule 7819.3200. IL7-1 2 : INDEMNIFICATION AND LIABILITY: By registering with the Director, or by accepting a permit under this Chapter, a Registrant or Permittee agrees to defend and indemnify the city in accordance with the provisions of Minnesota Rule 7819.1250. 910. Z910.29: ABANDONED AND UNUSABLE FACILITIES: Subd. 1. Discontinued Operations: A Registrant who has determined to discontinue all or a portion of its operations in the City must provide information satisfactory to the Director that the Registrant's obligations for its Facilities in the Right -of -Way under this Chapter have been lawfully assumed by another Registrant. Subd. 2. Removal: Any Registrant who has abandoned Facilities in any Right -of -Way shall remove it from that Right -of -Way if required in conjunction with other right-of-way repair, excavation, or construction, unless this requirement is waived by the Director. Ordinance 940 Page 22 1�° 19 0.30: APPEAL: A Right -of -Way user that: (1) has been denied registration; (2) has been denied a permit; (3) has had permit revoked; or (4) believes that the fees imposed are invalid, may have the denial, revocation, or fee imposition reviewed, upon written request, by the City Council. The City Council shall act on a timely written request at its next regularly scheduled meeting. A decision by the City Council affirming the denial, revocation, or fee imposition will be writing and supported by written findings establishing the reasonableness of the decision. 910:34-910.31: RESERVATION OF REGULATORY AND POLICE POWERS: A Permittee's or Registrant's rights are subject to the regulatory and police powers of the City to adopt and enforce general ordinances necessary to protect the health, safety and welfare of the public. 1910.32: SEVERABILITY: If any portion of this chapter is for any reason held invalid by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portions thereof. Nothing in this Chapter precludes the City from requiring a franchise agreement with the Applicant, as allowed by law, in addition to requirements set forth herein. TITLE 1100 ZONING CODE 1124.02: DEFINITIONS: The following words and terms, for purposes of this Chapter, shall be defined as follows: Subd 6 SMALL WIRELESS FACILITY means a wireless facility that meets both of the following qualifications: (1) each antenna is located inside an enclosure of no more than six cubic feet in volume or could fit within such an enclosure: and (2) all other wireless equipment associated with the small wireless facility provided such equipment is in aggregate no more than 28 cubic feet in volume, not including electric meters concealment elements telecommunications demarcation boxes battery backup power systems grounding equipment power transfer switches, cutoff switches cable conduit vertical cable runs for the connection of power and other services and any equipment concealed from public view within or behind an existing structure or concealment. TOWER: Any ground -mounted, pole, spire, structure or combination thereof, including supporting lines, cables, wires, braces and masts, to which a telecommunications antenna is attached or affixed.
