In addition, state law also requires the City Council to annually select an official depository for City funds. In 2016, the Acting Mayor was Carol Mueller. In accordance with Minnesota state law, it requires the City Council to annually designate a legal newspaper of general circulation in the City as its official newspaper In accordance with Section 6.04, of the Mounds View City Charter, it requires the City Council to appoint a City Treasurer. Discussion: The Sun Focus and The Bulletin have each submitted proposals to be the City’s official newspaper for 2017 (proposal letters attached). The Council selected the Sun Focus as the City’s primary newspaper last year. The City Council expressed interest in selecting the Sun Focus as the City’s official newspaper due to the better news coverage that the Sun Focus provides on City matters. All newspapers accept legal notices via e-mail. Pioneer Press did not get back to the City on their Mounds View newspaper circulation. Last year and in years previous the Council selected the St. Paul Pioneer Press as the City’s secondary newspaper. Since the Pioneer Press is a daily newspaper, it would certainly be acceptable for the Council to select the Pioneer Press as the City’s secondary newspaper. The attached resolution appoints the treasurer consistent with Section 6.04 of the City Charter, and also lists the city job positions that are authorized to conduct banking and investment business on behalf of the City. Recommendation: Designate the City’s Acting Mayor, Official Newspaper and adopt Resolution 8687. Attached is Resolution 8689, which authorizes severance to Jeffrey Martin in accordance with the LELS Local 204 Labor Agreement. Discussion Resolution 8689 provides a payout of Jeffrey Martin’s sick time into his Retirement Health Savings (RHSP) account. In accordance with the labor agreement, Mr. Martin is authorized a sick time payout in the amount of $3,399.31 into his RHSP. This is calculated at 217 x 50% x his hourly rate of $31.33. Resolution 8689 provides a payout of Jeffrey Martin’s accrued/unused vacation time. In accordance with labor agreement, Mr. Martin is authorized a vacation time payout totaling $1,794.90. This is calculated as 57.29 accrued/unused vacation hours times his hourly rate of $31.33 Resolution 8689 also provides a payout of Jeffrey Martin’s compensatory time. In accordance with labor agreement, Mr. Martin is authorized a compensatory time pay out totaling $767.59. This is calculated as 24.50 compensatory hours times his hourly rate of $31.33. She has served the City since 1979. At the September 26, 2016, City Council Meeting, the City Council approved a revised Permit Technician job description and authorized Staff to advertise. Discussion: Staff advertised the opening on the City’s website, Star Tribune, government jobs.com, and the League of Minnesota Cities website. Staff interviewed eight (8) qualified candidates, and conducted second interviews on the top two (2) candidates. It was the consensus of Staff to recommend Sherri Eisenbraun to the position of Permit Technician. Sherri Eisenbraun has a Permit Technician certification, and is currently working at the City of Arden Hills since October of 2008 as the Office Support Specialist/Permit Technician. If hired, Ms. Eisenbraun would start at Step 4 of the Pay Scale at $27.00/hour; with an increase to Step 5 of the salary range (currently $28.42/hour) after one year of employment. All increases are subject to a satisfactory performance evaluation. All other City benefits and personnel policies will apply as stated in the Mounds View Personnel Manual. Reference checks are satisfactory. Staff has not received criminal background checks and credit checks on Ms. Eisenbraun. This appointment would be contingent on receiving satisfactory reports. Sherri Eisenbraun would begin employment on or about January 17, 2017. This is a full-time, non-union, non-exempt position. Recommendation: Staff recommends the City Council adopt Resolution 8690, hiring Sherri Eisenbraun to the position of Permit Technician contingent on receiving satisfactory criminal background and credit reports. Respectfully submitted, ________________________ Desaree Crane RESOLUTION NO. 8690 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA APPROVING THE HIRE OF SHERRI EISENBRAUN TO THE PERMIT TECHNICIAN POSITION WHEREAS, upon direction from the Mounds View City Council, the Permit Technician position was advertised; and WHEREAS, Staff interviewed eight (8) qualified candidates and conducted second interviews on two (2) candidates; and WHEREAS, Sherri Eisenbraun’s skills and experience were determined to most closely match the duties and responsibilities as outlined in the job description; and WHEREAS, Ms. Eisenbraun would start at Step 4 of the Pay Scale at $27.00/hour; with an increase to Step 5 of the salary range (currently $28.42/hour) after one year of employment; and WHEREAS, all step wage increases are subject to satisfactory performance evaluations; and WHEREAS, background checks on Ms. Eisenbraun are incomplete, and therefore, hiring would be contingent on satisfactory background and credit checks; and WHEREAS, Ms. Eisenbraun would begin employment on or about January 17, 2017. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council appoints Sherri Eisenbraun to the position of Permit Technician in the Community Development Department, contingent on satisfactory background and credit checks, with employment to commence on or about January 17, 2017. BE IT FINALLY RESOLVED that the City Council does hereby approve the hire of Sherri Eisenbraun to the full-time, non-exempt, non-union position of Permit Technician at Step 4 of the pay scale (currently $27.00/hour). Carol Mueller, Mayor ATTEST: James Ericson, City Administrator (seal) Proposed – Page 1 POSITION DESCRIPTION Position Title: Community Services Officer Department: Police Accountable To: Deputy Police Chief Status: Non-Exempt PRIMARY OBJECTIVE OF POSITION: Provide public service in areas not requiring licensed police officers and to provide community and agency assistance in the areas of animal control. SUPERVISION RECEIVED Works under the supervision of the Deputy Police Chief. SUPERVISION EXERCISED None. ESSENTIAL DUTIES AND RESPONSIBILITIES o Maintain community relations by conducting tours of the department facilities and delivering information, reports, etc., to businesses, schools, or homes as needed by police department. Assist police with community outreach projects. o Perform animal control activities such as responding to calls and complaints on animals, processing dog bite reports and following up as directed, and enforcing animal control ordinances. o Assists stranded motorists, and vehicle lock-out requests. o Retrieve lost and stolen bicycles and maintain the bicycle holding facility. o Complete routine non-emergency reports. o Transport department vehicles for repair and maintenance. o Transport evidence to forensic lab. o Observe all safety rules and procedures. o Parking Enforcement o Assist Patrol Officers with routine functions as trained, directed/requested and assist all City staff as directed by a supervisor. o Performs house-watch duties to help ensure the safety and security of property belonging to residents out of the city for a period of time. o Keeps supervisor informed of all important matters, which require immediate action or attention. o Assist in the maintenance of agency equipment and medical supplies. o Advising property owners of code requirements and enforcement procedures, and obtaining compliance of same. Proposed – Page 2 OTHER DUTIES & RESPONSIBILITIES ○ Perform other tasks as assigned by supervisor. o Observe all safety rules and procedures. o Answer administrative phones when needed. The Community Service Officer (CSO) is assigned to the Patrol Division and reports directly to the Deputy Chief. During the course of their duties, the CSO will come under the authority of other supervisors and shall assist them as much as possible without foregoing their assigned responsibilities. The CSO shall abide by all state statutes, city ordinances, city and department rules and regulations, general orders, procedural directives, and memoranda. W hile working on the street, the CSO shall maintain radio communications with dispatch at all times using proper radio procedures. The CSO shall not drive marked police emergency vehicles unless directed to do so by a supervisor. Defensive driving and courtesy to motorists and pedestrians shall be observed at all times. The CSO will not conduct traffic stops, make custodial arrests, transport prisoners, or handle in progress calls where a certified police officer is necessary. MINIMUM QUALIFICATIONS General: (A) Must be 18 years older at the time of employment; (B) Must possess, or be able to obtain by time of hire, a valid drivers license in any State; (C) No felony convictions of disqualifying criminal histories within the past seven years; and (D) Must be able to read and write the English language. Education and Experience: (A) High school diploma or GED equivalent; and (B) One year of work experience involving public contact or customer service. NECESSARY KNOWLEDGE, SKILLS AND ABILITIES (A) Knowledge of CPR and first aid procedures; (B) Ability to learn the City's geography; (C) Ability to communicate effectively, in English, both verbally and in writing; (D) Ability to learn and apply various rules and directions as set forth in state statutes, city ordinances, and other directives related to law enforcement procedures; Proposed – Page 3 (E) Ability to establish and maintain effective working relationships with City staff and the public; (G) Ability to work independently of close supervision; (H) Ability to meet mental demands of the position; (I) Ability to safely operate a motor vehicle; and (J) Ability to follow verbal and written instructions. PREFERRED QUALIFICATIONS (A) One year of experience in police-related work, such as Police Reserve program, Police Explorer program, or Police Cadet program; (B) Two years of work experience involving public contact or customer service; (C) First Responder certification; and (D) Enrollment in an approved law enforcement curriculum. These properties are in areas where it would not be economically feasible to extend Mounds View water and sewer mains. With regard to the City of Blaine, because our mains do not extend west on County Road J (85th Avenue) beyond Spring Lake Road, the City of Blaine provides the services. Five lots on County Road J are affected. Discussion: A new home is being constructed on a vacant lot at 3016 County Road J. Mounds View staff has been communicating with Blaine staff concerning the utility connections and the appropriate fees. The property owner of 3016 County Road J produced an agreement between the two cities dated 1971 which specifically outlined the costs of the utility connections. The agreement furthermore indicated that the per-foot fees for the sewer and water laterals and the unit charge as outlined in the 1971 agreement would not increase. Neither Mounds View nor Blaine can confirm whether the agreement is still valid or whether amending agreements have been approved since 1971. Since costs have increased substantially since 1971, the City of Blaine is asking the City of Mounds View to execute a new agreement, which does not include any specific fees—the agreement indicates that the fees to connect will be at the going rates as approved by the City of Blaine. Recommendation: The City Attorney reviewed the original agreement from 1971 and opined that the agreement was not likely enforceable, and that it would be an unreasonable expectation that the City of Blaine would have to extend sewer and water services to the subject property at 1971 rates. Accordingly, a new agreement has been prepared by the City of Blaine and they are requesting our approval, which can be done via Resolution 8692. The labor agreement for the officers provides for holiday hours totaling 104 hours per year. Because officers are schedule seven days a week, 24 hours a day, officers are often scheduled to work on holidays. In the case of Officer David who is going through her field training, she will accrue 24 hours of holiday time off with no ability to take the time off. The labor agreement is silent on what to do in this scenario. Discussion: The police department asked the finance department how to deal with the situation of Officer David being unable to utilize the holiday hours. Since there was no past practice to go on, the City reached out to LELS in order to come to a mutual agreement on how to proceed. The options considered included the following: • The officer would forfeit the holiday hours • The officer would be given time off during her field training • The 24 hours of holiday time could carry over to 2017 • The 24 hours of holiday time would be paid out after completing field training Both the City and the Union would rather the officer not forfeit these holiday hours, and the City would prefer the officer not be given the additional time off since continuity in the field training process is critical, leaving two options. The City opposed allowing the carry-over of hours into 2017 leaving a payout of the time subsequent to successfully completing the field training as the only remaining option that would be mutually agreeable to all parties. Should the officer not complete the field training, the holiday hours earned in December as well as any accrued in the early months of 2017 would be forfeited. Recommendation: The City Attorney drafted the attached Memorandum of Understanding (MOU) which has been reviewed by LELS representatives and the employee. Staff recommends approval of Resolution 8693 which approves the attached MOU which is specific to the named employee and specific to the present situation. This agreement would not constitute a past practice nor would it obligate the City to pay out any future unused holiday time at year end or upon separation to the named employee or any other employee. Respectfully submitted, ________________________ James Ericson City Administrator RESOLUTION NO. 8693 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING WITH LAW ENFORCEMENT LABOR SERVICES LOCAL 204 REGARDING HOLIDAY HOURS WHEREAS, the City of Mounds View entered into a labor agreement with Law Enforcement Labor Services (LELS) representing patrol officers and investigators (Local 204), valid from 2014 through the end of 2016; and, WHEREAS, the Labor Agreement, in Article 24, articulates the observed holidays and the number of total holiday hours (104 hours) but does not address how the hours are to be paid or used; and, WHEREAS, the past practice in the department is that the officers are provided a bank of holiday hours which are then used similar to vacation time, with the goal of using twenty-five percent of the banked hours each quarter; and, WHEREAS, the past practice has been that any holiday hours unused at year’s end are forfeited, and, that any holiday hours accrued during field training may be used after successfully completing field training, however, there is no past practice to guide the City for holiday hours that cannot be used due to an officer being in field training; and, WHEREAS, Officer Sarah David will be unable to use holiday hours accrued in 2016 due to being in field training, thus the City and the Union prepared a Memorandum of Understanding to address the situation. NOW, THEREFORE BE IT RESOLVED THAT the Mounds View City Council does hereby approve the attached Memorandum of Understanding to address Officer David’s accrued but unused 2016 holiday hours. NOW, THEREFORE BE IT FURTHER RESOLVED THAT the holiday hours shall be paid out to Officer David upon successful completion of the field training program, at her then current hourly rate.
