Item Title/Subject: Public Hearing – Consideration of Resolution 8506, a
Resolution Reapproving a Conditional Use Permit for a 150
foot Cell Tower at 4860 Mustang Circle, Dell-Comm; Planning
Case CU2014-001
Introduction:
The applicant and property owner, FAC Holdings, operating in Mounds View as Dell-Comm,
is requesting reapproval of a conditional use permit (CUP) to construct a 150 foot cell tower
on their property at 4860 Mustang Circle. Dell-Comm designs, furnishes and installs
telecommunications systems, applications and services. They have been in business since
1990 and do infrastructure cabling, fiber optic cabling, outside plant cabling, security
solutions and telephone systems. The City Council approved the CUP in September of 2014
but due to issues with the FCC, the applicant was unable to proceed with the tower
construction within the required timeframe resulting in a lapse of the CUP. The issues with
the FCC have been addressed and the applicant is ready to move ahead with the
construction.
City Code Requirements:
Section 1124.03, Subd. 2: Allows for towers and antennae as a conditional use in specific
districts. Industrial districts allow towers and antennae up to 150 feet tall.
Section 1124.05 Subd. 1 Setbacks: The minimum setback from any property line or public
right-of-way for a wireless telecommunications tower is thirty feet (30’) unless abutting a
residential district, then at least half the height of the tower. When placed on a lot improved
with a principal building, the wireless telecommunications tower shall be located only in the
rear yard or interior side yards not abutting streets. Wireless telecommunication towers shall
not be placed between the principal building and any street abutting the property. Setbacks
for accessory equipment structures associated with wireless telecommunication towers and
antennae shall meet the requirements as outlined in Section 1104.01, subdivision 4 of the
Zoning Code.
Section 1125.01, Subd. 1e: The Planning Commission is required to review the possible
adverse effects of the requested conditional use.
Section 1125.01, Subd. 1g: which states that the Planning Commission shall make findings
of fact and recommend such actions or conditions relating to the request as it deems
necessary to carry out the intent and purpose of the Zoning Code and forward such findings
to the City Council.

Discussion:
Dell-Comm is proposing to construct a 150-foot tall cell tower on their property.
Telecommunication towers are allowed in all zoning districts, but the heights permitted vary
by the property zoning. Industrial districts allow for the tallest towers at 150 feet. The
proposed tower would be located on the southeast corner of their property in a wooded,
unused area (refer to the attached map and site plan.) Dell-Comm would own the tower and
use it for employee training and certification purposes, along with leasing antenna space to
cellular phone companies.
The CUP would remain in effect indefinitely so long as there are no changes to the operation
and there have been no problems or reasons which would warrant the City Council to re-
examine the CUP.
CUP Considerations:
Chapter 1125 of the Zoning Code requires that the Planning Commission review and address
any potential adverse effects which include, but are not limited to, relationship with the
Comprehensive Plan, geographical area involved, potential depreciation, the character of the
surrounding area and the demonstrated need for such a use. The Planning Commission
reviewed the request at its meeting on September 17, 2014, forwarding its positive
recommendation and findings of fact to the City Council. Each of these potential adverse
effects is addressed below from the original Commission action:
Relationship with the Comprehensive Plan. Dell-Comm’s property is zoned I-1, Industrial, and
is surrounded by other industrial businesses and the Townsedge Manufactured Home Park on
the north side. If the requested conditional use permit were approved, this CUP would be
consistent with the Comp Plan “Light Industrial” land use designation for this property.
The Location and Character of the Surrounding Area. Dell-Comm is located on Mustang
Circle in an industrial area of the City. The tower would be located in the southeast corner of
their property, in an unused, heavily wooded area. Access to the cell tower would currently
only be through Dell-Comm’s parking lot. They will make a 12-foot wide gravel access drive
from their parking lot, along the east side of the property going south to the tower. The site
plan shows a 20-foot wide future gravel access road leading to Mustang Circle, but there are
no plans to construct this road at this time.
The residential manufactured home park on the north side of 4860 Mustang Circle is
approximately 500 feet from where the tower will be located. There is a wooded border with
tall, mature trees along the property line between the manufactured home park and the
industrial properties on Mustang Drive and Mustang Circle. The tower itself will be setback 55
feet from the east and south property lines. The tower and the ground equipment are required
to be surrounded by an eight foot (8’) fence for security and screening. This fenced area will
have approximately 40-foot setbacks from the east and south property lines. The fence and
ground equipment will be approximately 250 feet from the street and won’t be visible due to
the woods. The proposed cell tower should not be out of place in this primarily industrial area.

Depreciation. Since the surrounding area is primarily industrial, the proposed tower should
result in little adverse effect upon the surrounding area. There is a residential neighborhood on
the north side of Dell-Comm’s property, but due to their office building and the woods, the tower
should not be very noticeable to these residents.
The Demonstrated Need for Such a Use. Cell phones have become an item that most people
now have, and the industry continues to expand. Due to this growth, communication
companies must continue to offer better and larger coverage areas. This part of the City is in
need of improved cell service, and since telecommunications is Dell-Comm’s industry, they can
also use the tower for training their employees in addition to providing a tower for other cell
companies to install their antennas.
Planning Commission Action:
The Planning Commission reviewed this request on September 17, 2014 and voted 5-0 to
recommend approval of this conditional use permit.
City Council Action:
The City Council approved the requested Conditional Use Permit at its meeting on September
17, 2014.
Public Input:
The reapproval of the Conditional Use Permit was advertised in the City’s official newspaper on
January 22, 2016, with notices sent to property owners within 350 feet, as required. Staff has
not received any calls or feedback in response.
Summary:
All City zoning and code issues are satisfied with this request. The Federal Communications
Commission (FCC) has reviewed the coordinates, structure type and height and determined
that this structure does not need to be registered with them, and there are also no Federal
Aviation Administration (FAA) requirements for this tower.
Recommendations:
Hold the public hearing and take testimony from staff, the applicant and the public. Review
the plans and discuss the proposed cell tower. Staff review revealed no deficiencies since
the last approval and thus prepared Resolution 8506 reapproving the conditional use permit
for Council consideration.

NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council makes
the following findings of fact related to the conditional use permit request:
1. The proposed telecommunications tower meets the requirements as outlined in
Chapter 1124 of the Zoning Code.
2. The request is consistent with the Mounds View Comprehensive Plan in that a cell tower is consistent with the Light Industrial land use designation for this area.

4. The proposed telecommunications tower would not depreciate the neighboring
properties.
5. The applicant has sufficiently demonstrated that a need exists for expanded
telecommunications coverage in the Mounds View area.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council
approves a conditional use permit for the telecommunications tower, with conditions as
follows:
1. Access to the equipment shall be protected by a secure 8-foot chain link fence.
2. No advertising signage will be allowed attached to the pole or fencing.
3. The tower shall not exceed 150 feet in height or have any lighting.
4. The Conditional Use Permit (CUP) shall become null and void if the work for
which the CUP was granted is not completed within one year from the date of
approval unless a petition for extension of time in which to complete the work has
been granted by the City Council.
NOW THEREFORE, BE IT FURTHER RESOLVED that this Conditional Use Permit
shall have no expiration date and shall remain in force so long as the conditions agreed
upon herein are observed.

NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council has
determined that the findings of fact articulated in Resolution 8304, the resolution which
originally approved the CUP, remain applicable and shall be incorporated herein by
reference.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Mounds View City
Council reapproves the conditional use permit for the telecommunications tower, with
conditions as follows:

Discussion:
The City of Mounds View Citizen of the Year Award recognizes ordinary citizens who have
demonstrated initiative to improving the community, whose service or performance exemplifies the
spirit of giving back and who inspire others in their volunteer efforts.
The nominations were reviewed by the City Council at the March Work Session. The City Council
made a decision to designate the 2016 Mounds View Citizen of the Year Award to Virgil Beyer.
The Mounds View Citizen of the Year Award is scheduled to be presented at the March 20, 2017,
Town Hall Meeting, located at Mounds View City Hall. Staff has attached a draft of the plaque that
will be presented at the Town Hall Meeting.
Recommendation:
It is recommended that the City Council approve the attached Resolution 8729, appointing Virgil
Beyer as the 2016 Mounds View Citizens of the Year.

WHEREAS, the Mounds View Citizen of the Year Award recognizes ordinary citizens

exemplifies the spirit of giving back and who inspire others in their volunteer efforts.; and
WHEREAS, nominations were solicited from the public and were reviewed by the City
Council; and

Item Title/Subject: Resolution 8516, Approving the Joint Powers Agreement
Between Ramsey County and the City of Mounds View for
New Voting System Acquisition and Operation
Introduction:
In 2001, the City entered into a Joint Powers Agreement (JPA) with Ramsey County
Elections for a Voting Machine System. According to Resolution 5618, the City purchased
five voting machines over a five year period.
Discussion:
The City currently has an agreement with Ramsey County Elections for election services,
which includes the task of management and oversight of Primary and General Elections for
the City. Ramsey County Elections is requesting that the City enter into a JPA for the
purchase and operation of new voting machines. The new machines will read and count
paper ballots like the old machines do. However, the new machines will have a larger
display screen that will alert voters if a ballot error is made and provide instructions to
correct it. The new machines will also allow for faster processing of ballots. The new
machines will be used during the 2016 Primary and General Elections.
The City Council discussed this JPA at the October 7, 2013, Work Session with Ramsey
County Elections Manager Joe Mansky. At this Work Session, the City Council felt

WHEREAS, the City entered into a Joint Powers Agreement in 2001 for the
purchase and operation of a new voting system; and
WHEREAS, the City has an agreement with Ramsey County Elections for
election services, which includes the task of management and oversight of Primary and
General Elections for the City; and
WHEREAS, Ramsey County Elections is requesting that the City enter into a
Joint Powers Agreement for the purchase and operation of new election equipment;
and
WHEREAS, efficient ballot preparation and the timely compilation of election
results depend upon the use of a uniform voting system throughout the County, and the
use of a uniform voting systems for all elections enhances election judge and voter
understanding of the voting process and helps to provide equitable treatment of all
voters, regardless of the type of election; and
WHEREAS, Ramsey County and Municipalities has reached an agreement on 1)
the need to replace with existing voting system and to implement a new voting system
in time for use for the 2016 state elections, and 2) the funding for the new elections
equipment.
NOW, THEREFORE, BE IT RESOLVED, that the Mounds View City Council

Public Works (PW) Mechanic Steve Vacek retired from his position effective November 30, 2015. On
November 9, 2015, the City Council approved Resolution 8476, approving a revised job description,
and authorized Staff to advertise for the position of Mechanic. The City received fourteen (14)
applications.
Discussion:
Staff advertised the opening on the City’s website, Star Tribune, government jobs.com, and the
League of Minnesota Cities website. Staff interviewed nine (9) qualified candidates. It was the
consensus of Staff to recommend Scott VanderVegt to the position of PW Mechanic.
Mr. VanderVegt has a certificate in Medium/Heavy Truck Technician at St. Cloud Technical College,
and is a Certified DOT Inspector and ASE Certified in automotive medium heavy truck. He is currently
working as a Mechanic with the City of St. Louis Park.
In accordance with the Public Works Collective Bargaining Agreement, Mr. VanderVegt will start at
Level A ($24.72/hour). All City benefits and personnel policies will apply as stated in the Mounds View
Personnel Manual and the PW Collective Bargaining Agreement.
References checks are currently being completed. This appointment will be contingent on satisfactory
reference checks. In addition, this appointment would be contingent on satisfactory criminal
background checks, satisfactory drug test, and satisfactory pre-employment exam.
Mr. VanderVegt would begin employment on or about February 29, 2016.

Introduction:
On March 26, 2001, the City Council adopted Resolution 5546, which describes the procedure
for hiring Seasonal Employees. This resolution requires that the City Council approve all
seasonal positions.
Discussion:
Annually the City Council has approved the hiring of seasonal Public Works positions.
Resolution 5546 requires that approval take place six weeks prior to actual hire of seasonal
employees; therefore, this is typically done early in the calendar year.
Seasonal Employees benefit the City by providing labor services during periods of higher labor
demand at much lower pay rates keeping overall labor costs down. In return, seasonal
employees benefit from the skills and work ethics they learn on the job. As a result, the
employees, the City, citizens, and taxpayers all benefit from this program.
Historically, there have been three time periods throughout the year when the City has employed
seasonal workers. These periods have been: Summer (10 positions), Fall (2 positions), and
Winter (1 position). In 2009, it was the consensus of the City Council and Staff to decrease the
Summer seasonal positions from 10 to 8 positions, due to the budgetary cuts in state aid. This
number was further reduced in 2010 when the Winter seasonal position was eliminated and the
part-time water division position was reclassified as a public works seasonal position. In 2011
and 2012, the City Council approved 8 seasonal positions. Due to the provisions affecting
seasonal employment under the Affordable Healthcare Act, the Mounds View City Council
passed Resolution 8060 on February 11, 2013, approving the hire of 10 seasonal employees in
2013. In 2014, 2015, and 2016, the City Council passed resolutions approving 10 seasonal
employees.
According to the Affordable Healthcare Act (“Obama Care”), there are provisions that require
employers to offer health insurance to full-time seasonal employees who work 120 calendar days
or more during the year. It further requires that the seasonal employee who is hired to work for
120 calendar days and worked an average of 30 hours per week to be offered insurance on the
90th day of his or her employment, and would be eligible for health insurance benefits for 30
days. In addition to the obvious administrative nightmare and cost associated with insuring an
employee for 30 days, this provision can also subject employers to obligations

under the Consolidated Omnibus Budget Reconciliation Act (COBRA) upon termination of the
employee’s employment, thereby creating even more burdens to the employer.
Staff is recommending hiring 10 seasonal employees and staggering them to ensure that they do
not exceed 119 days. Three of the seasonal positions are paid from the Enterprise Funds (water,
sewer, and storm). Staff has created a means to track this time in order to comply with the
provisions under the Affordable Healthcare Act.
Summer Seasonal Employees – Duties include general Public Works and parks maintenance
duties. The employees generally are employed for about three months in the summer – mid-to
late-May to mid-to late-August. Typically one Parks Division seasonal employee and one Utility
Division seasonal employee begin employment in April.
Fall Seasonal Employee – There are two (2) seasonal positions, one (1) in Public Works Utilities
Division and one (1) in the Parks Division. Historically, summer positions are extended to cover
Duties performed by the Public Works Utilities Division seasonal employee includes assisting
with the utility locates, hydrant and valve maintenance, sanitary sewer and manhole cleaning,
stormwater system maintenance, and other department related duties.
The duties of the fall seasonal employee in the Parks Division include fall activities such as
mowing, leaf clean up, mower maintenance, assisting with brush removal and tree trimming, and
providing assistance in year-end maintenance activities. .
Wage Proposal for 2017 Seasonals:
Staff recommends no wage increases for 2017 Public Works Seasonals. In 2016, new hire
seasonal positions were filled at $11.00/hour, and returning seasonal workers were
compensated at $11.75/hour. Each summer seasonal employee will work up to 40 hours per
week and not exceed 119 calendar days. The fall seasonal employees may also work 40 hours
per week: however, hours may be fewer since these positions are often filled with current college
students that are available part-time only. All seasonal positions will remain on staff for a period
no longer than 119 calendar days.
Recommendation:
Staff recommends approving the Seasonal Public Works Positions for 2017.

Introduction:
An engineering intern for the Public Works (PW) Department was first approved by the City
Council in June 2006 in lieu of a seasonal maintenance worker to assist with the
administrative/engineering staff. This minor shift in staffing was proposed to better enable PW
to administer activities associated with the many upcoming public improvement projects planned
at that time. The position description was tweaked in February 2010 between internships to
include GIS (geographical information systems) duties and to better describe the overall duties
and accommodate some shortcomings of the previous version.
The GIS Engineering Intern is a temporary, part-time position geared toward current or recent
college students in a related field. This employment arrangement allows Public Works to obtain
skilled help at a fraction of the cost of hiring a full-time, regular employee. Current PW Staff have
extensive experience and skill in working with AutoCAD and ArcGIS, the software programs
already owned by the City, which will, in turn, allow a current or recent college student to obtain
“real world”, on-the-job experience resulting in a “win-win” situation. The position is fully funded
by the Water and Sanitary Sewer Enterprise Funds and has no impact on the General Fund.
Discussion:

Advertisement for Bids, Street and Utility Improvement Program, Area I
Background:
The City is in the process of reconstructing 26 miles of City-owned streets and associated underground
utilities as part of the Streets and Utilities Improvement Program (Program). The Program includes design
standards, a financing plan, a prioritization/implementation (staging) plan, and a communication plan for
implementing reconstruction over an initially planned 9-year period (2009-2018) with an estimated
program cost of $28 million.
The next and final project area scheduled for construction is Area I (see attached partial plan set). Area I
contains 3.6 miles of streets and is located in the northeast part of the city and includes:
• St. Michael Street between Oakwood Drive and County Road I
• St. Stephen Street between Oakwood Drive and County Road I
• Jackson Drive between Hillview Road and County Road I
• Quincy Street between the northern dead end and County Road I
• Interstate I-35W Service Road between Cornell Drive and Pinewood Drive
• Hillview Road between Jackson Drive and Interstate I-35W Service Road
• Oakwood Drive between its eastern dead end and Interstate I-35W Service Road
• Terrace Drive between Jackson Drive and Interstate I-35W Service Road
• Pinewood Drive between Jackson Drive and Interstate I-35W Service Road
The adjacent properties are predominantly single-family housing or parkland. Jackson Drive, Hillview
Road and Quincy Street are the non-standard streets in this area due to municipal state aid status and
pedestrian/bicycle accommodations.
The City Council has taken the following steps, thus far, specific to Area I of the Street and Utility
Improvement Program:
• 8/24/15 – Authorized engineering design & preparation of bidding document (Res. 8449)
• 11/23/15 – Considered stormwater infiltration basin (SIP) appeals (Res. 8482)
• 11/23/15 – Approved non-standard street design and parking restrictions for Area I (Res. 8483)
In addition to the Council actions above, the Street and Utility Committee held three meetings to discuss
the aspects of the project. The Committee heard from residents regarding the non-standard streets and
provided input to the City Council regarding their preferences. Additionally, the Committee provided
information and heard appeals regarding the proposed stormwater basin locations. Staff has met with
various residents in the area and discussed concerns regarding Hillview and Oakwood Parks with Parks
and Recreation and Forestry Commission.
Discussion:
Bolton & Menk, Inc. (BMI) has completed the plans and specifications for use in soliciting public bids for
the construction of Area I. These bidding documents have incorporated the Program standards and City
Council approved non-standard issues and decisions as established in the resolutions noted above. BMI
has estimated the total construction cost of Area I at $4,268,035. This cost is split among the State Aid
participating street and stormwater improvements at $691,800 and the non-state aid or local
improvements at $3,576,235.
The next step in the project development of Area I is the bid phase. This involves advertising the project,
distributing plans and specifications, answering questions, and issuing clarifications for bidding
requirements, reviewing and tabulating bids received, and making an award recommendation. BMI will
provide assistance with phase of the project.
If the attached resolution is adopted, bidding documents will be finalized and project advertised in the
official City newspaper (Sun Focus) and a regional trade publication for three weeks before bid opening.
MnDOT approval for State Aid standard streets is anticipated prior to distribution of the bidding
documents. A bid opening date of March 15, 2016 is proposed, with Council consideration of award on
March 28, 2016. A neighborhood meeting will be scheduled after award and prior to construction start to
discuss the phasing and impacts of this project with the residents. Construction is anticipated to begin in
May once the spring load limits are removed.
In addition to the street work, municipal underground utilities needing repair, rehabilitation and/or
replacement have been incorporated into the documents as recommended by Public Works staff. Some
of the sanitary and stormwater lines in the project area are proposed for lining due to deterioration.
Engineering has received some complaints regarding the stormwater basins having street debris wash
into the turf area. As a result, staff has also been working with BMI to establish a curbside ‘sump’ for the
SIPs. The goal of this sump is to ease cleaning debris that may wash into the SIP during a substantial
rain storm. The plans will provide sumps at city owned parcels in order to establish the efficiency of the
sump. If successful, the retrofit of these sumps could be recommended for residents on a complaint
driven basis.
Finally, in reviewing the project, staff is recommending that this project be split over two construction
seasons (2016 and 2017). Initially, Area I was planned as a 3.3 mile project; however, with the
appropriate addition of Quincy between Hillview and County Road I, this project is now 3.6 miles of street
reconstruction. As a result, Area I is now the third longest project of the Program. Additionally, the work
being performed by the Metropolitan Council’s North Area Interceptor Rehabilitation will impact work at
the Hillview and Quincy north intersection and is not anticipated to be complete until August 2016.
Ramsey County will also have their County Road I concrete rehabilitation project underway. That project
will be replacing the traffic signals at County Road I and Quincy Street. The proposed phasing would
have Phase 1 as all work west of Quincy Street and Phase 2 being Quincy Street and everything to the
east. Area I would be still be awarded as one construction contract to one contractor.
Recommendation:
Staff recommends that the City Council adopt the attached resolution approving bidding documents and
authorinzing advertisement for bids for the 2016 Street and Utility Improvement Project – Area I. Doing
so will allow the project to stay on track for a 2016 construction schedule.

WHEREAS, the City Council adopted Resolution 7176 on October 22, 2007,
establishing the Street and Utility Improvement Program (Program), which includes nine
Street and Utility Improvement Projects identified as Areas A through I; and,
WHEREAS, Areas A through H have been or are under construction and total
22.6 miles of the Program; and,
WHEREAS, Area I, known as 2016 Street and Utility Improvement Project – Area
I, City Project No. 2016-C01 is scheduled to be constructed during the 2016
construction season; and,
WHEREAS, the City Council adopted Resolution 8449 on August 24, 2015
authorizing Bolton & Menk, Inc. to perform engineering design services and prepare
bidding documents for the Project; and,
WHEREAS, the City Council adopted Resolution 8482 on November 23, 2015
considering Stormwater Infiltration Program (SIP) appeals in the Project; and,
WHEREAS, the City Council adopted Resolution 8483 on November 23, 2015
approving non-standard street design configurations and parking restrictions for Area I;
and,
WHEREAS, Bolton & Menk, Inc. has prepared plans and specifications for use in
soliciting public bids in general accordance with the Program standards and all
subsequent resolutions noted above; and,
WHEREAS, Rice Creek Watershed District considered the Project permit
application on January 27, 2015 and provided a conditional approval (CAPROC); and,
WHEREAS, plans and specifications have been submitted to the Minnesota
Department of Transportation for review and approval of project eligible funding in
accordance with State Aid standards associated with Quincy Street, Hillview Road and
Jackson Drive; and,
WHEREAS, approval of the plans and specifications must be received from the
Minnesota Department of Transportation prior to awarding a construction contract for
the project.
NOW, THEREFORE, BE IT RESOLVED by City Council of the City of Mounds
View, Ramsey County, Minnesota as follows:
1. The bidding documents prepared by Bolton & Menk, Inc. for construction of the
2016 Street and Utility Improvement Project, Area I, City Project No. 2016-C01
are hereby approved.
2. City staff is hereby directed to cause to be published in the Sun-Focus
newspaper and in a regional trade publication, at least three weeks before the
last day to submit bids, a notice to bidders for the implementation of said project
as required by law.
3. The time and date for receipt of public bids for said project is hereby established
as 2:00 p.m., local time, Tuesday, March 15, 2016, at which time bids will be
publicly opened and read aloud in the Council Chambers of the Mounds View
City Hall.
4. City staff is hereby directed to proceed with all activities necessary for the
procurement of Municipal State Aid Funds for the eligible improvements to be
constructed within the Project.
5. The Mayor and City Administrator are hereby authorized and directed to execute

Introduction:
As staff was reviewing fee schedules and policies for 2016 in relation to Tax Increment
Financing (TIF) and Tax Abatements, it became apparent that the TIF and Tax Abatement
policies were outdated and in need of attention. As a result, staff and the City’s legal &
financial consultants have reviewed the policies and recommend a combined, updated TIF
& Tax Abatement Policy, which is proposed to be called “The City of Mounds View
Economic Development Authority Public Financing Policy & Application.” The EDC
reviewed the proposed policy on January 15, 2016, and the City Council reviewed the
proposed policy at its February 1, 2016, work session. Resolution 8512 is attached for
consideration by the Council.
Discussion:
The City of Mounds View’s Tax Abatement Policy was last updated September 22, 2003.
The City’s TIF Policy was last updated June 12, 2000. As staff was reviewing the policies,
it became apparent that some of the language in the policies was in need of updating due
to statutory changes and to clarify language that often causes confusion in agreements.
Ehler’s, the City’s financial consultant, and Kennedy & Graven, the City’s legal consultant,
have both reviewed and recommended that the TIF & Abatement policies be combined.
The updated version seeks to clarify and bring the policy up-to-date with current statutes
and has also incorporated language from other cities’ policies. The proposed policy is now
entitled, “The City of Mounds View EDA Public Financing Policy & Application”. The
combined policy proposes the following:
Combines the purposes, objectives, and policies from the previous Abatement and
TIF policies. These were very similar, so all of those policy ideas are represented in
the combined policy.
The TIF policy had square footage, tax and valuation minimums listed. We
removed this concept because any project that meets all of the policy criteria will
need to at least meet those thresholds anyway. The old policy had evaluation
criteria that assigned points for these things. Excluding this simplifies the policy.

Any reference to Tax “Rebate” Financing was replaced by the statutory language of
Tax Abatement.
We removed the section about administration of TIF, as many of the concepts
discussed in that section are handled elsewhere in the policy. The remaining TIF
administration items are very detailed to include in a policy. Instead, we included in
the Public Financing Principles section this language: “Tax Increment Finance
districts will be administered in accordance with applicable Minnesota State
Statutes, the Tax Increment Finance Plan, and the Development District Plan.”
In the Business Subsidy section, we simplified the language to harmonize with the
Business Subsidy Policy and avoid being redundant.
The application process and fees match the Business Subsidy Policy (i.e., $3,000
non-refundable application fee and a $10,000 deposit once the assistance has
been approved to move forward, to be prorated and returned to the applicant for
any unused portion at the City’s discretion.)
The TIF and Abatement policies differed in their approach to having the applicant
agree to the fee. The Abatement policy had a stand-alone agreement to be
executed, whereas the TIF application requires a signature acknowledging the fee
(and requires it to be remitted with the application). The latter approach is cleaner
so that is how the policy is written. There would be a term sheet, preliminary
development agreement, or some other type of agreement if the applicant gets to
that point that will contractually obligate payment of the fees.
At the advice of Ehler’s, we modified the sample but-for analysis to reflect current
financing rates and to show a return with assistance that is just under 8%, rather
than the 12% listed in the previous policy. Since Ehler’s typically advises returns
limited below 12%, we thought this made sense, so as not to give the wrong
impression.
There is now one application document that combines the two previous to preserve
all previous elements of both.
There is one Commercial Industrial review worksheet and one Housing worksheet.
We tried to leave this exactly the same as before, however there are minor
changes for consistency with the policy revisions.

I. POLICY PURPOSE:
The Mounds View Economic Development Authority, hereafter referre d to as the EDA,
promotes the development and enhancement of the City of Mounds View’s tax base. The
purpose of this policy is to establish the City of Mounds View’s position relating to the use
of public financing for private development above and beyond the requirements and
limitations set forth by State Law. For the purposes of this policy, public financing may
include, but may not limited be to: Tax Increment Financing (TIF), Tax Abatement,
contributions of real or personal property, infrastructure de velopment, a reduction or
deferral of any tax or fee, and any grants, loans, or loan guarantees made with City and/or
EDA funds.
This policy shall be used as a guide in the processing and review of applications
requesting public financing. The fundamental purpose of providing public financing in
Mounds View is to encourage desirable development or redevelopment that would not
otherwise occur but-for the assistance provided through the use of such financing.
It is the intent of the EDA to provide the min imum amount of public financing at the
shortest term required for the project to proceed. Preference is given to projects leveraging
funding from other public and private sources. The EDA reserves the right to approve or
reject projects on a case by case basis, taking into consideration established policies,
project criteria, and demand on City services in relation to the potential benefits from the
project. Meeting policy criteria does not guarantee the award of public financing to the
project. Approval or denial of one project is not intended to set precedent for approval or
denial of another project.
II. OBJECTIVES FOR THE USE OF PUBLIC FINANCING
As a matter of adopted policy, the EDA will consider public financing to assist private
development projects to achieve one or more of the following objectives:
To retain local jobs and /or increase the number and diversity of jobs that offer
stable employment and/or livable wages and benefits as defined in the City’s
Business Subsidy Policy.
To encourage additional unsubsidized private development in the area, either
directly or indirectly through “spin off” development.
To facilitate the development process and to achieve development on sites that
would not be developed without public financing assistance.
To remove blight and/or encourage redevelopment of commercial and industrial
areas in the city that result in high quality redevelopment and private reinvestment.
To offset increased costs of redevelopment (e.g. contaminated site clean-up,
demolition expenses) over and above the costs normally incurred in development.
To create and support a broad range of housing choices in Mounds View.

To encourage the revitalization and redevelopment of the County Road 10 Corridor.
To contribute to the implementation of other public policies, as adopted by the city
from time to time, such as the promotion of quality urban or architectural design,
energy conservation, and decreasing capital and/or operating costs of local
government.
To enhance and diversify the City of Mounds View’s economic base and to increase
the tax base.
To finance the costs associated with public infrastructure and public facilities.
III. PUBLIC FINANCING PRINCIPLES
The guidelines and principles set forth in this document pertain to all applications for City
public financing regardless of whether they are considered a Business Su bsidy as defined
by Statute. The following general assumptions shall serve as a guide for City public
financing:
A. All viable requests for City public financing assistance shall be reviewed by staff,
and, if staff designates so, a third party municipal advisor who will inform the City of
its findings and recommendations.
B. TIF and abatement will be provided on a pay-as-you-go-basis. Any request for
upfront assistance will be evaluated on its own merits and may require security to
cover any risks assumed by the City.
C. Any developer receiving public financing shall provide a minimum of ten percent
(10%) owner cash equity investment in the project.
D. Public financing will not be used in circumstances where land and/or property price
is in excess of fair market value. Situations of blight and unsightly properties will be
considered on a case-by-case basis.
E. Developer shall be able to demonstrate a market demand for a proposed project.
Public financing shall not be used to support purely speculative projects.
F. Public financing will not be utilized in cases where it would create an unfair and
significant competitive financial advantage over other projects in the area.
G. Public financing shall not be used for projects that would place extraordinary
demands on city services or for projects that would generate significant
environmental impacts.
H. The developer must provide adequate financial guarantees to ensure completion of
the project, including, but not limited to: minimum assessment agreements, letters
of credit, personal guaranties, etc.
I. The developer shall adequately demonstrate, to the City’s sole satisfaction, an
ability to complete the proposed project based on past development experience,

general reputation, and credit history, among other factors, including the size and
scope of the proposed project.
J. The developer shall proactively attempt to minimize the amount o f public financing
needed through the pursuit of grants, innovative solutions in structuring the deal,
and other funding mechanisms.
K. For the purposes of underwriting the proposal, the developer shall provide any
requested market, financial, environmental, or other data requested by the City or
its consultants.
L. All public financing proposals shall optimize the private development potential of a
site.
M. Tax Increment Finance districts will be administered in accordance with applicable
State Statutes, the Tax Increment Finance Plan, and the Development District Plan.
N. When possible, TIF shall be used to finance public improvements associated with
the project. The priority for the use of TIF funds is:
1. Public improvements.
2. Site preparation, site improvement, land purchase, and demolition.
3. Legal, administrative, and engineering costs.
O. It is the City’s policy to establish the following types of TIF districts:
1. Economic Development Districts
It is desired that the project result in a minimum creation of
one full time job per $25,000 of TIF, or
Result in a significant increase in the tax base.
2. Redevelopment Districts
The market value of a redeveloped site shall increase by a
minimum of 50% of the current market value.
3. Housing Districts
May be considered on a case-by-case basis.
IV. PROJECT QUALIFICATIONS
All public financing requests considered by the City of Mounds View must meet each of
the following requirements:
A. The project shall meet at least one of the objectives set forth in Section II and
satisfy all the provisions set forth in Section III of this document.
B. The developer shall demonstrate that the project is not financially feasible but-for
the use of public financing.
C. The project shall comply with all applicable laws.
D. The project must be consistent with the City’s Comprehensive Plan, Land Use
Plan, and Zoning Ordinances.

E. The project shall serve at least two of the following public purposes:
Creation of jobs with livable wages and benefits.
Significantly increase the City’s tax base.
Enhancement or diversification of the city’s economic base.
Industrial development that will spur additional private investment in the
area.
Fulfillment of defined City objectives such as those identified in the City’s
Comprehensive Plan, among others.
Removal of blight or the rehabilitation of a high profile or priority site.
Enhancement or diversification of the City’s housing stock.
Development that will spur additional private investment in the area.
F. The developer will pay all applicable application f ees and pay for the City and
EDA’s fiscal costs, including creation of the TIF Plan, if applicable, and legal
advisor time as stated in the City’s policies.
V. SUBSIDY AGREEMENT & REPORTING REQUIREMENTS
All developers/businesses receiving public assistance from the City shall be subject to the
provisions and requirements set forth by the City’s Business Subsidy Policy and Minnesota
Statutes Sections 116J.993 to 116J.995.
A. In granting a business subsidy, the City shall enter into a subsidy agreement with
the recipient that provides the following information: wage and job goals (if
applicable), commitments to provide necessary reporting data, and recourse for
failure to meet goals required by the Statutes.
B. The subsidy agreement may be incorporated into a broader d evelopment
agreement for a project.
C. The subsidy agreement will commit the recipient to providing the reporting
information required by the Statutes.
VI. APPLICATION PROCESS FOR PUBLIC FINANCING
A. Application for all public financing requests shall be made using the Public
Financing Application provided by the City of Mounds View Business Development
Coordinator, or designee.
B. The Public Financing Application shall request information required within the City’s
policies, including but not limited to; a detailed description of the project; a
preliminary site plan; the amount of business subsidy requested; the public purpose
of the project; the number and types of jobs to be created; the wages and benefits
to be paid new employees; a detailed project budget with verifiable funding sources
and uses; and a detailed operating pro forma, if applicable.
C. The applicant agrees and acknowledges to pay a non -refundable $3,000 Public
Financing Application Fee.

D. City staff and/or consultants review the application and complete the Commercial-
Industrial and/or Housing Worksheets. The Application and Worksheets are
primarily designed to score the desirability of the proposed project. Each project will
be evaluated on a case-by-case basis to determine the extent to which they meet
the City’s desired objectives.
E. At the time of acceptance by staff of the Public Financing Application, the applicant
shall deposit $10,000 with the City to cover attorney and consultant costs incurred
as part of establishing a TIF district or abatement, the TIF plan, drafting and
negotiating a development agreement, and conducting any fiscal analysis that may
be required to meet the requirements of utilizing any public financing. If additional
expenses are incurred beyond the $10,000, prior to the execution of a development
agreement, the City shall notify the applicant in writing and the applicant will be
required to deposit additional funds upon notice. Any unused portion of the $10,000
deposit may be prorated and returned to the appl icant at the city’s discretion.
F. Following a review by appropriate City staff/consultants the application shall be
referred to the Economic Development Authority for further action.
G. Before granting a business subsidy that exceeds $150,000, the City shall provide
public notice and hold a hearing on the subsidy.

Agreement to Pay Costs of Review
It is the policy of the City of Mounds View to require applicants to pay costs incurred by the City in reviewing and
acting upon applications, so that these costs are not borne by the taxpayers of the City. These costs include all of
the City’s out-of-pocket costs for expenses, including the City’s costs for review of the application by the City’s
Financial Consultant and City Attorney, or other consultants, recording fees, and necessary publication costs.
The application processing fees cover anticipated costs; costs incurred above the application fee will be invoiced as
they are incurred, and payment will be due within thirty (30) days. Application fees are not refundable. If payment
is not received as required by this agreement, the City may suspend the application review process and may deny
the application for failure to comply with the requirements for processing the application. Payment for costs will
be required whether the application is granted or denied.
The undersigned has received the City’s policy regarding the payment of costs of review, understands that
reimbursement to the City of costs incurred in reviewing the application will be required, agrees to reimburse the
City as required in the policy and make payment when billed by the City, and agrees that the application may be
denied for failure to reimburse the City for costs as provided in the policy.
Note: All Major shareholders will be required to sign personal guarantees and a minimum assessment

Information in summary form only to report its findings to the City provided that Ehlers first presents

disclosures of confidential information or other inaccurate information are contained in such report.

or recorded, directly or indirectly, by any means whatsoever, without the prior consent of Developer.
4. The Information shall remain the property of Developer, and any Information provided
in tangible form shall be returned to Developer upon completion of such inspection. Any copies,
duplications, abstracts, summaries or other recordings of the Information made with Develope r’s
consent shall be returned to Developer upon demand.
5. Ehlers agrees that any breach of the obligation of confidentiality imposed hereby shall
constitute irreparable harm to Developer and shall entitle Developer to equitable relief enjoining any
further breaches of this Agreement, together and in conjunction with any and all such other remedies as
may be available to Developer at law or in equity.

I. GENERAL POLICY:
The Mounds View Economic Development Authority has the powers under the Minnesota Statute Sections
469.124 through 469.137 and sections 469.001 through 469.047 to govern and monitor the use of tax
increment financing for Mounds View’s tax increment districts and the Mounds View development district
which encompasses the entire boundaries of the City of Mounds View. It is the responsibility of the
Mounds View Economic Development Authority to use tax increment financing as a tool to accomplish the
City’s economic development and redevelopment goals and objectives. The Mounds View Economic
Development Authority understands and abides by the fundamental principal which makes tax increment
financing viable to encourage development and redevelopment which would otherwise not occur.
The Mounds View Economic Development Authority shall consider tax increment financing in cases that
serve to accomplish the City’s development goals and activities as hereby defined in projects eligible for
tax increment financing.
II. PROJECTS ELIGIBLE FOR TAX INCREMENT FINANCING:
Projects eligible for consideration of Tax Increment Financing assistance per the Mounds View
Development Project Plan dated May 9, 1994 include, but are not limited to (1) the attraction, retention,
rehabilitation and preservation of commercial, industrial, retail, residential, recreational and public service
facilities; (2) new and rehabilitated public infrastructure; (3) community and other public service centers;
(4) senior/mature adult and/or other housing development partnerships or other multi-use housings
projects and facilities; (5) other public utilities (including telecommunications); (6) business incubator loan
and other business programs; and (7) transportation systems. More emphasis will be placed on those
items which increase the tax base, eliminate blight, and the m eet the City’s ec onom ic and redevelopm ent
goals.
III. COSTS ELIGIBLE FOR TAX INCREMENT FINANCING:
Project costs qualifying for Tax Increment Financing assistance, as defined under the TIF Act, include
utilities design, architectural and engineering fees directly attributable to site work, site related permits,
earthwork/excavation, soils correction, landscaping, utilities (sanitary sewer, storm sewer, and water),
streets and roads, street/parking lot paving, street/parking lot lights, curb and gutter, sidewalks, land
acquisition, special assessment, legal (relating to acquisition, financing, and closing fees), soils tests and
environmental studies, surveys, park dedication fee, SAC, WAC, charges, titles insurance and TIF
application deposit.
IV. DETERMINATION OF AMOUNT OF ASSISTANCE TO APPLICANT:
Within TIF Districts
The amount of Tax Increment Financing provided to an applicant will be based, in part, on the analysis of
information provided on the application for Tax Increment Financing assistance (Attachment “A”), amount
of increment generated by the project as evaluated by the City’s Financial and/or Bond Counsel and the
City’s economic and redevelopment goals.
The level of assistance provided will be evaluated on a case by case basis and may reflect an increase or
decrease in assistance dependent upon the level of increase in the tax base, amount of elimination of
blight and/or a number of variables that may substantiate the need for assistance. An adjustment in the
amount of assistance that can be provided is at the sole discretion of the Board of the Economic
Development Authority as long as the requested uses are legal under the Minnesota State Statutes for the
use of tax increment financing.
W ithin the Developm ent District (herein ref erred to as the “City” lim its) but outside of T IF Districts
The evaluation of Tax Increment Financing assistance that could be provided to an applicant will be based
on (A) the analysis of information provided on the application for Tax Increment Finance assistance
(Attachment “A”), (B) square footage cost of the project, (C) balance available in the Economic
Development Authority excess tax increment fund and (D) proof of need for assistance under the “but for”
test for use of tax increment financing. See Attachment D for a sample “but for” analysis.

V. TYPES OF ASSISTANCE:
Within TIF Districts
Tax Increment Financing can be provided in either “pay as you go” or “up front” payments. “Pay as you
go” is wherein the Mounds View Economic Development Authority compensates the applicant an amount
equal to a predetermined percentage of the actual increment produced by the project for a predetermined
number of years. The applicant pays for the (re)development up front and then annual payments are
issued to the applicant based on the need for assistance and increment generated from the project. “Up
front” payments is wherein the Mounds View Economic Development Authority must issue revenue or
general obligation bonds to pay for the (re)development prior to the completion of the project. The
increment from the project is then used for repayment of the bonds. The Mounds View Economic
Development Authority gives preference to the use of “pay as you go” assistance to finance private
development projects due to the reduced risk to the community. The EDA will consider “up front” payment
projects that would benefit the entire community and are not possible to be funded under a “pay as you
go” basis.
Within the City but outside of TIF Districts
Financing from the dedicated tax increment fund can be provided in annual installments to the applicant
based on the positive cash flow balance in the Economic Development Authority’s dedicated tax
increment fund and need for assistance based on analysis of the “but for” test for the project. The
dedicated tax increment fund includes a value based on the use and is adjusted along with the budget
process and goals and objectives for economic and redevelopment on an annual basis.
VI. ESTABLISHING A TAX INCREMENT FINANCE DISTRICT:
New tax increment finance districts in the City of Mounds View will be established in accordance with
applicable Minnesota State Statutes, the Tax Increment Finance Plan, and the Development District Plan.
VII. ADMINISTRATION, POOLED FUNDS & PARCEL DECERTIFICATION:
Administration
Tax Increment Finance districts will be administered in accordance with applicable Minnesota State
Statutes, the Tax Increment Finance Plan, and the Development District Plan.
Pooled Funds
Pooled funds are available when the current years increment exceeds existing obligations. In the past,
funds have been allocated for low interest improvement loans, housing replacement, and Highway 10
redevelopment. The Mounds View Economic Development Authority will address the future use of pooled
funds in the following manner: (1) view tax increment as a means secondary to programmatic objectives;
(2) allocate all available pooled increment; and (3) the Economic Development Commission and
Economic Development Authority decides on future development needs and uses TIF and/or other means
to accomplish those ends. (4) in the event that the Economic Development Authority determines pooled
increment should be returned to the respective taxing jurisdictions, the Economic Development
Commission will evaluate the potential action and make a recommendation to the Economic Development
Authority.
To more effectively utilize pooled increment, the Economic Development Commission will recommend
funding priorities to the Economic Development Authority. This will be done in conjunction with the annual
budgetary process. At this time, potential parcels for decertification will also be examined
Requests made for the use of pooled funds by a business or developer outside established TIF districts
are discussed in sections IV and V.
Parcel Decertification
Parcels in Mounds View’s Tax Increment Finance districts will be decertified as required by and in

accordance with applicable Minnesota State Statutes, the Development District Plan, and the TIF Plans as

amended. In the event that the Economic Development Authority desires to return pooled increment to the
respective taxing jurisdictions, the following guidelines will be observed: (1) reserves should be greater
than or equal to next years projected increment; and (2) prior to disbursing pooled funds to the respective
taxing jurisdictions, the Economic Development Authority will consider future projects and community
needs. (3) in the event that parcels are going to be decertified, the Economic Development Commission
will evaluate the potential action and make a recommendation to the Economic Development Authority.
VIII. APPLICATION PROCESS:
The following delineates the Mounds View Economic Development Authority’s application process for Tax
Increment Financing assistance:
1. Applicant submits the completed application (Attachment “A”) and Deposit Agreement
(Attachment “B”) along with all application fees.
2. City staff reviews the application and completes the Application Review Worksheet (Attachment
“C”).
3. Results of the Worksheet are submitted to the appropriate governing authorities for preliminary
approval of the proposal.
4. If preliminary approval is granted, a development agreement, business subsidy agreement, and
amendments to the Tax Increment Financing Plan, along with all necessary notices, resolutions and
certificates are prepared by City staff and/or consultants.
5. If applicable, notices are published and sent to the county and school board.
6. If necessary, public hearing(s) on the proposed project are held.
7. The Economic Development Authority considers final approval of the proposal.

Deposit Agreement for Evaluation of Tax Increment Assistance
By and Between the Mounds View Economic Development Authority

This agreement made as of the day of , 2005 by and between the MOUNDS
VIEW ECONOMIC DEVELOPMENT AUTHORITY, a body corporate and politic, organized and existing
under the laws of the State of Minnesota (the “EDA”) and (“The Applicant”).
W ITNESSETH:
WHEREAS, the EDA has the powers provided in Minnesota Statutes, Sections 469.124 to
469.134 and 469.090 to 469.108 (collectively, the “Act”); and
WHEREAS, pursuant to and in furtherance of the objectives of the Act, the EDA has undertaken a
program to promote development and redevelopment of certain land within the City of Mounds View and
in connection is engaged in carrying out the Mounds View Economic Development Project as detailed in
EDA document dated 5/9/94 (the “Project”) within the City; and
WHEREAS, the redevelopment and development of property within the Project by private
developers are stated objectives of the Project Plan.
NOW THEREFORE, in consideration of a mutual covenants made herein and for other good and
valuable consideration set forth in the Agreement, the parties agree as follows:
Section 1. (The Applicant ) agrees to provide the EDA with a deposit of $5,000 for the EDA’s
consultants to investigate the feasibility of providing Tax Increment Financing assistance to (The
Applicant) for the redevelopment of the (the “Property”). If the EDA incurs additional expenses directly
related to the feasibility of providing Tax Increment Assistance to (The Applicant) beyond the $5,000, prior
to the execution of the Developer’s Agreement, the EDA shall notify (The Applicant) in writing and (The
Applicant) will be required to deposit additional funds as a condition of the EDA entering into any such
Development Agreement.
Section 2. If the project is approved and (The Applicant) proceeds with the project, the EDA shall
reimburse (The Applicant)’s deposit to the extent permissible under the TIF Act. If (The Applicant) does
not proceed with the redevelopment of the Property due to the decision of either the EDA or (The
Applicant), the EDA shall reimburse the applicant for the unused portion of the deposit.
Section 3. Nothing contained in this agreement shall in any way obligate either party to proceed
with the redevelopment of the Property or otherwise enter into a Development Agreement.

I. POLICY PURPOSE
The Mounds View Economic Development Authority, hereafter referred to as the
EDA, promotes the development and enhancement of the City of Mounds View’s tax
base. The purpose of this policy is to establish the EDA’s position relating to the
use of tax rebate financing, otherwise referred to as tax abatement. This policy
shall be used as a guide in the processing and review of applications requesting tax
rebate assistance. The fundamental purpose of tax rebate financing in Mounds
View is to encourage desirable development or redevelopment that would not
otherwise occur but for the assistance provided. It is desirable that Tax Increment
Financing (TIF) be utilized in lieu of TRF whenever possible and if it can be shown
to be beneficial to the City to do so.
The Mounds View EDA is granted the power to utilize tax rebate financing by the
Minnesota Tax Abatement Act, as amended. The EDA reserves the right to approve
or reject projects on a case by case basis, taking into consideration established
policies, project criteria, and demand on city services in relation to the potential
benefits from the project. Meeting policy criteria does not guarantee the award of a
tax rebate to the project. Approval or denial of one project is not intended to set
precedent for approval or denial of another project.
II. DIFFERENCE BETWEEN TAX REBATE & TIF
The primary difference between Tax Rebate Financing (TRF) and Tax Increment
Financing (TIF) is the way in which the dollars are awarded to the project. When
TIF is awarded to a project by the EDA, the other political subdivisions (the school
district and the county) are required to contribute their portion of the increased
taxes to the project. Conversely, when tax rebate financing is requested, each
political subdivision has the option of granting its portion of the current and/or
increased taxes to the project. Depending on the position of the respective taxing
jurisdictions, the dollars generated by TRF are generally less than the dollars
generated with TIF.
III. OBJECTIVES OF TAX REBATE FINANCING
As a matter of adopted policy, the EDA will consider using tax rebate financing to
assist private development projects to achieve one or more of the following
objectives:

A. To retain local jobs and/or increase the number and diversity of jobs that
offer stable employment and/or attractive wages and benefits.
B. To enhance and diversify the City of Mounds View’s economic base and
to increase the tax base.
C. To remove blight and/or encourage redevelopment of commercial,
industrial , or high priority sites in the city that result in high quality
redevelopment and private reinvestment.
D. To facilitate the development process and to achieve development on
sites which would not be developed without TRF assistance.
E. To encourage the revitalization and redevelopment of the County
Highway 10 Corridor.
F. To encourage additional unsubsidized private development in the area,
either directly or indirectly through “spin off” development.
G. To offset increased costs of redevelopment (i.e. contaminated site clean-
up, demolition expenses) over and above the costs normally incurred in
development.
H. To create housing opportunities.
I. To finance the costs associated with public infrastructure and public
facilities.
J. To contribute to the implementation of other public policies, as adopted
by the EDA from time to time, such as the promotion of quality architectural
design, enhanced recreational opportunities, and decreasing capital and/or
operating costs of local government.
IV. POLICIES FOR THE USE OF TRF
A. Tax rebate assistance will be provided to the developer upon receipt of
taxes by the EDA, otherwise referred to as the pay-as-you-go method.
Requests for up-front financing will be considered on a case-by-case basis.
B. It is the intent of the EDA to provide the minimum tax rebate financing,
as well as other incentives, at the shortest term required for the project to
proceed. Unless there is an extraordinary financial need by the developer,
the fiscal disparities portion of the tax capacity value will not be considered
for tax rebate.

C. Any developer receiving a tax rebate shall provide a minimum of twenty
percent (20%) equity investment in the project. Projects utilizing the SBA
504 program will be required to provide a minimum of ten percent (10%)
cash equity investment.
D. Tax rebate financing will not be used in circumstances where land and/or
property price is significantly in excess of fair market value.
E. All TRF proposals shall optimize the private development potential of a
development site.
F. A market demand shall be demonstrated for the proposed project.
G. Tax rebate assistance will not be utilized in cases where it would create
an unfair and significant competitive financial advantage over other projects
in the area.
H. Tax rebate assistance shall not be used for projects that would place
extraordinary demands on city services or for projects that would generate
significant environmental impacts.
I. The developer must provide adequate financial guarantees to ensure
completion of the project, including, but not limited to: assessment
agreements, letters of credit, personal guaranties, and additional
documentation as necessary.
J. The developer shall adequately demonstrate, to the EDA’s sole
satisfaction, an ability to complete the proposed project based on past
development experience, general reputation, and credit history, among other
factors, including the size and scope of the proposed project.
K. For the purposes of underwriting the proposal, the developer shall
provide any requested market, financial, environmental, or other data
requested by the EDA or its consultants.
V. PROJECT QUALIFICATIONS
All tax rebate projects considered by the Mounds View EDA must meet each of the
following requirements:
A. The project shall meet at least two of the objectives set forth in Section III
of this document.

B. The use of tax rebate financing will be limited to:
Industrial development, expansion, redevelopment, or
rehabilitation; or
Commercial redevelopment or rehabilitation; or
Office, or research and development facilities; or
Housing and infrastructure; or.
Public infrastructure
Not all projects will be located along County Highway 10 or will create
housing in the City.
C. The developer shall demonstrate that the project is not financially
feasible but-for the tax rebate financing provided.
D. The project shall comply with all provisions set forth in Minnesota’s Tax
Abatement Law, statues 469.1812 to 469.1815, as amended.
E. The project must be consistent with the City’s Comprehensive Plan, Land
Use Plan, and Zoning Ordinances.
VI. SUBSIDY AGREEMENT & REPORTING REQUIREMENTS
All developers/businesses receiving a tax rebate, or other assistance equal to or
in excess of $25,000 from the Mounds View EDA shall be subject to the
provisions and requirements set forth by the City’s Business Subsidy Criteria as
adopted, and Minnesota Statute 116J.993 to 116J.995 as summarized below.
All developers/businesses receiving tax rebate assistance shall enter into a
subsidy agreement with the Mounds View EDA that identifies: the reason for the
subsidy, the public purpose served by the subsidy, and the goals for the subsidy,
as well as other criteria set forth by Minnesota’s statute 116J.994.
The developer/business shall file a report annually for two years after the date
the benefit is received or until all goals set forth in the application and business
subsidy agreement have been meet, whichever is later. Reports shall be
completed using the format drafted by the State of Minnesota and shall be filed
with the Mounds View EDA no later than March 1 of each year for the previous
calendar year. Businesses fulfilling job creation requirements must file a report
to that effect with the city within 30 days of meeting the requirements.
The developer/business owner shall maintain and operate its facility at the site
where the tax rebate assistance is used for a period of five years after the benefit
is received, or the length of the TRF assistance, whichever is shorter.
In addition to attaining or exceeding the jobs and wages goals s et forth in the
Subsidy Agreement, the borrower shall achieve at least one of the objectives set
forth in Section III of this document.

Developers / Businesses failing to comply with the above provisions will be
subject to fines, repayment requirements, termination of the assistance, and be
deemed ineligible by the State to receive any loans or grants from public entities
for a period of five years.
VII. APPLICATION PROCESS FOR TAX REBATE FINANCING
A. PRIVATE DEVELOPMENT/REDEVELOPMENT PROJECTS
1. Applicant submits the completed application along with a non-refundable
$1,000 application fee. The application fee will be used toward the cost of
professional or technical services provided in the evaluation of the
application, and legal costs incurred by the City for preparation of legal
documents. If the EDA incurs additional expenses directly related to the
evaluation of the application, or for professional or legal services beyond the
$1,000, the EDA shall notify the applicant in writing and the applicant will
be required to deposit additional funds.
2. City staff reviews the application and completes the Application Review
Worksheet.
3. Results of the Worksheet are submitted to the appropriate governing
authorities for preliminary approval of the proposal.
4. If preliminary approval is granted, all necessary notices, resolutions and
certificates are prepared by City staff and/or consultants.
5. If necessary, public hearing(s) on the proposed project are held.
6. The EDA grants final approval or denial of the proposal.
B. OTHER POLITICAL SUBDIVISIONS

Ramsey County and/or School District 621 make their applications to those

This agreement made as of the day of , 200_ by and
between the MOUNDS VIEW ECONOMIC DEVELOPMENT AUTHORITY,
a body corporate and politic, organized and existing under the laws of the
State of Minnesota (the “EDA”) and (The Applicant).
WITNESSETH:
WHEREAS, the EDA has the powers provided in Minnesota Statutes,
Sections 469.1812 to 469.1815, as amended (collectively, the “Act”); and
WHEREAS, pursuant to and in furtherance of the objectives of the Act,
the EDA has undertaken a program to promote development and
redevelopment of certain land within the City of Mounds View
NOW THEREFORE, in consideration of a mutual covenants made
herein and for other good and valuable consideration set forth in the
Agreement, the parties agree as follows:
Section 1. (The Applicant ) agrees to provide the EDA with an
application fee of $1,000 for the preparation of legal documents and for EDA’s
consultant(s) to investigate the feasibility of providing Tax Rebate Financing
assistance to (The Applicant) for the redevelopment of the (the “Property”). If
the EDA incurs additional expenses directly related to the feasibility of
providing Tax Rebate Assistance to (The Applicant), or for professional or
legal services beyond the $1,000, prior to the execution of the Developer’s
Agreement, the EDA shall notify (The Applicant) in writing and (The
Applicant) will be required to pay additional funds as a condition of the EDA
entering into any such Development Agreement.
Section 2. Regardless whether the project is approved by the EDA or
not, the application fee is non-refundable. If (The Applicant) does not
proceed with the redevelopment of the Property due to the decision of either
the EDA or (The Applicant), the EDA shall reimburse the applicant for the
unused portion of the deposit.

Section 3. Nothing contained in this agreement shall in any way
obligate either party to proceed with the redevelopment of the Property or
otherwise enter into a Development Agreement.

Item Title/Subject: Resolution 8513 Approving the Purchase of Two 2016 Ford
Police Interceptor Utility Vehicles
Introduction:
The police department has $74,000 approved in the 2016 budget to purchase two
police vehicles and equipment setups. In addition, a separate item of a light bar
expense at $2300 and an additional $2000 for K-9 vehicle setup costs is in the 2016
budget. This equates to a total available amount of $78,300. Maintaining a reliable and
well kept fleet of police vehicles is essential in providing quality policing services to the
community. The department strives to stay on a 5 year replacement cycle for marked
police vehicles and an 8 year replacement cycle for unmarked/administrative vehicles.
The current police fleet consists of:
• One 2008 Ford Crown Victoria (085) for PSO
• One 2011 Ford Crown Victoria (111) for K-9 Use
• One 2011 Chev Tahoe (112) for Patrol Sergeant Use
• One 2013 Ford Interceptor Sedan (131) for Patrol Use
• Three 2014 Ford Interceptor Sedans (141, 142, 143) for Patrol Use
• One 2014 Ford SUV Interceptor (144) for Patrol Use
• One 2016 Ford SUV Interceptor (161) for Patrol Use
• Three Unmarked Chev Impalas (2006, 2014, 2016) for Admin /Investigative Use
Discussion:
The department is requesting to purchase two of the budgeted squad vehicles and
accompanying equipment setups. Two of the vehicles planned for replacement are the
2011 Chev Tahoe (Sergeants) and the 2011 Ford Interceptor Sedan (K-9) vehicle. Both
of these vehicles would be replaced by 2016 Ford Interceptor Utility vehicles. These
utility vehicles have been received most favorably among staff with their increased
interior room, cargo storage space and the all-wheel drive feature.
The Chev Tahoe would be re-purposed to become the PSO vehicle. This will allow the
PSO additional cargo and storage area to aid in the transport of animals and
equipment. The K-9 Crown Victoria would be placed up for state auction, along with the
2008 Crown Victoria PSO vehicle. The auction service used would be the Admin
Minnesota State Surplus Services in Arden Hills.
The Ford Interceptor Utility vehicle is offered at the state contract price from Nelson
Auto Center in Fergus Falls for a base price of $25,562.95. The addition of some
necessary options should increase the total cost to $26,315.95.
The equipment setup costs and graphics installation for the utility vehicle is estimated to
be approximately $11,190.62 for one utility vehicle and $12,737.70 for the K-9
designated vehicle. It is important to note that set-up costs for these utility vehicles are
higher due to the necessity of purchasing all new equipment, rather than using any
existing emergency equipment on hand that is not compatible for these new utility
vehicles. The K-9 vehicle also requires the deployment/heat alert system and custom K-
9 seat insert.
The total projected cost for both vehicles and required equipment set-ups is $78,550.
This amount is over the budget amount by $250. Staff requests this amount receive
approval with the additional expense coming from the police equipment supplies
account.
Recommendation:
Staff recommends authorizing the purchase of two 2016 Ford Police Interceptor utility
vehicles including all setup costs and the sale of a 2008 and a 2011 Ford Crown
Victoria squad cars through the Admin Minnesota State Surplus Services auction.

Introduction:
On January 12, 2016, Police Chief Tom Kinney submitted his notice of retirement, effective
April 29, 2016. Chief Kinney has been police chief since 2010, after serving as interim
chief for a year. Chief Kinney has worked for the Mounds View Police Department for over
thirty years and we are thankful for his service to the community.
Discussion:
The Council reviewed the proposed timeline below at its work session on February 1,
2016, and expressed support for the steps discussed. Subsequently, staff convened a
meeting of the Police Civil Service Commission (PCSC) on Wednesday, February 3,
2016, and the members also agreed with the steps proposed.
As reviewed on Feb 1, the following potential timeline is anticipated:

Feb 9, 2016: Job posting goes live on LMC page, our page and elsewhere
Mar 4, 2016: Deadline to submit applications

At the Council’s February work session, there was consensus expressed for enlisting the
assistance of a professional recruitment firm to help with the process. It may be beneficial
to approach the recruitment process from a more “a la carte” standpoint, meaning the City
would still manage the process but would utilize consultants for many of the subtasks.
We’re already anticipating that we’d engage a consultant to conduct more extensive
backgrounding and another to conduct psychological examinations, bringing in a consultant
to assist with ranking and initial screening would also be helpful. I envision the consultant
would meet with Council members and possibly members from the police department early
in the process to get a sense for what the City’s needs are and how those needs would be
best satisfied by a particular candidate.

At this point, staff is still soliciting proposals from firms having experience in public sector, if
not public safety, recruitment, backgrounding and testing. Our intent is to seek approvals
from the City Council on the issue of consultants at the February 22, 2016 Council
meeting.
Recommendation:
Consider Resolution 8520, a resolution approving revisions to the Police Chief Job
Description and approving the posting of the position. Staff will request authorization at a
subsequent meeting regarding the use of any recruitment consultants for this process.

Police Chief is subject to the authority of the Police Civil Service Commission and the
City Council.
SUPERVISION EXERCISED
Exercises supervision over all Police Department Staff.
ESSENTIAL DUTIES AND RESPONSIBILITIES
• Implements a program of law enforcement and public service which will
engender the respect and confidence of citizens, preserve law and order and
protect life and property.
• Clearly defines and interprets department rules, regulations and operating
policies for all assigned personnel to ensure consistent understanding and
compliance with such policies throughout the department.
• Maintains open and on-going communication with the City Administrator
• Delegates responsibility and commensurate authority to department officers in a
manner which will remove uncertainty about their assigned responsibilities and
the level of performance expected.
• Conducts routine tours and inspections of police beat to keep abreast of
developments in the City and evaluate the performance of assigned officers.
