Item Title/Subject: Proclamation for National Public Works Week
Background
Since 1960 the American Public Works Association (APWA) has sponsored National Public Works
Week. This is an opportunity to energize and educate the public on the importance of public works
to their daily lives: planning, building, managing, and operating at the heart of local communities to
improve everyday quality of life.
In Mounds View, the Public Works Department consists of 16 men and women whose duties range
from mowing to maintenance, from engineering to utilities, from administration to construction, from
plowing to painting. Their efforts are essential to the ensuring the quality of life that we enjoy each
day. With that in mind, National Public Works Week is an opportunity show appreciation for the
work that they do day in and day out, rain, shine or snow.

PROCLAMATION
WHEREAS, public works services provided in our community are an integral part of our
citizens everyday lives; and
WHEREAS, the support of an understanding and informed citizenry is vital to the efficient
operation of public works systems and programs such as water, sewers, streets and
highways, public buildings, and parks; and
WHEREAS, the health, safety, and comfort of Mounds View greatly depends on these
facilities and services; and
WHEREAS, the quality and effectiveness of these facilities, as well as their planning, design,
and construction is vitally dependent upon the efforts and skill of public works officials; and
WHEREAS, the efficiency of the qualified and dedicated personnel who staff public works
departments is materially influenced by the people’s attitude and understanding of the
importance of the work they perform,
NOW, THEREFORE, I, Joe Flaherty, Mayor of the City of Mounds View, do hereby proclaim
the week of May 15-21, 2016 as
“NATIONAL PUBLIC WORKS WEEK”
in The City of Mounds View, and I call upon all citizens and civic organizations to acquaint
themselves with the issues involved in providing our public works and to recognize the
contributions in which public works officials make every day to our health, safety, comfort,
and quality of life.

P ROCLAMATION
TO RECOGNIZE NATIONAL POLICE WEEK 2016 AND TO HONOR THE SERVICE
AND SACRIFICE OF THOSE LAW ENFORCEMENT OFFICERS KILLED IN THE
LINE OF DUTY WHILE PROTECTING OUR COMMUNITIES AND SAFEGUARDING
OUR DEMOCRACY
WHEREAS, there are approximately 900,000 law enforcement officers serving in
communities across the United States, including the dedicated members of the
Mounds View Police Department; and
WHEREAS, nearly 15,725 assaults against law enforcement officers were
reported in 2014, resulting in approximately 13,824 injuries; and
WHEREAS, since the first recorded death in 1791, almost 20,000 law
enforcement officers in the United States have made the ultimate sacrifice and been
killed in the line of duty; and
WHEREAS, the names of these dedicated public servants are engraved on the
walls of the National Law Enforcement Officers Memorial in Washington, D.C.; and
WHEREAS, 252 names of fallen heroes are being added to the National Law
Enforcement Officers Memorial this spring, including 123 officers killed in 2015 and
129 officers killed in previous years; and
WHEREAS, the service and sacrifice of all officers killed in the line of duty will be
honored during the National Law Enforcement Officers Memorial Fund’s 28th Annual
Candlelight Vigil, on the evening of May 13, 2016; and
WHEREAS, the service and sacrifice of all officers killed in the line of duty will be
honored during the Minnesota Law Enforcement Memorial Association’s Annual
Candlelight Vigil, on the evening of May 15, 2016; and
WHEREAS, the Candlelight Vigil is part of National Police Week, which takes
place this year from May 15 – 21, with some events taking place before the official
dates of Police Week 2016; and
WHEREAS, May 15, 2016, is designated as “Peace Officers Memorial Day”, in
honor of all fallen officers and their families; and

WHEREAS, the service and sacrifice of Ramsey County Suburban Law
Enforcement officers killed in the line of duty will be honored during the Suburban
Ramsey County Law Enforcement Memorial Ceremony, on May 12, 2016; and
NOW THEREFORE, BE IT RESOLVED, that the Mounds View City Council
formally designates May 15 - 21, 2016, as Police Week in The City Of Mounds View,
and publicly salutes the service of law enforcement officers in our community and in
communities across the nation.

Item Title/Subject: Public Hearing: Resolution 8567, to Consider a New
License for Keeping of Honeybees at 7375 Pleasant View
Drive – Applicant: Jens Loder
Introduction:
City Council passed Ordinance 908, which amended Chapter 701 of the City Code to
provide for the keeping of bee hives on properties zoned R-1, Single Family Residential.
Residents would be limited to no more than four (4) hives restricted to backyard areas.
Hive openings must face in toward property owner’s backyard. This Ordinance became
effective on October 25, 2015.
Background:
Applicant Jens Loder, located at 7375 Pleasant View Drive, submitted a license application
to keep and raise honeybees on his property. Attached is the application for the City
Council’s consideration. Mr. Loder will have two (2) hives on his property. Mr. Loder has
not attended any training in beekeeping. However, Mr. Loder has provided a letter waiver
stating that he learned to raise and keep honeybees from his father, who was a master
beekeeper in Illinois. Mr. Loder will be present at this City Council Meeting to answer any
questions you may have.
In accordance with Ordinance 908, initial applications shall be considered by the City
Council after holding a public hearing on the matter. Licenses are valid indefinitely so long
as the hives are operated continuously. This license may be revoked or denied by the City
Council based on negligence or nuisance. In such event, the property owner would be
provided with an opportunity to be heard.
Staff published this hearing in the City’s official newspaper, Sun Focus. Public hearing
notices were also mailed to residents within a 350 feet radius of 7375 Pleasant View Drive.
Applicant did receive a satisfactory report from the Mounds View Police Department.
Recommendation:
Staff recommends opening this public hearing for public comment. Staff recommends
approval of this license.

RESOLUTION APPROVING A HONEY BEE KEEPING LICENSE TO
JENS LODER, 7375 PLEASANT VIEW DRIVE
WHEREAS, the City Council passed Ordinance 908, which amended Chapter
701 of the City Code to provide for the keeping of bee hives on properties zoned R-1,
Single Family Residential; and,
WHEREAS, in accordance with Ordinance 908, initial applications shall be
considered by the City Council after holding a public hearing on the matter; and
WHEREAS, Jens Loder submitted a license application and fees to keep and
raise honeybees on his property located at 7375 Pleasant View Drive; and,
WHEREAS, Staff has reviewed Mr. Loder’s application; and
WHEREAS, Ms. Loder’s application meets all the requirements as set forth in
Ordinance 908; and
WHEREAS, this license is valid indefinitely so long as the hives are operated
continuously; and
WHEREAS, this license may be revoked or denied by the City Council based on
negligence or nuisance.
NOW, THEREFORE BE IT RESOLVED, THAT the Mounds View City Council

In accordance with Chapter 502 of the Mounds View City Code, a public hearing is
required for all liquor license renewals. The City of Mounds View issued an intoxicating
liquor license for Moe’s effective July 1, 2015. This license will expire on June 30, 2016.
Discussion:
The notice of this public hearing was sent out to residences within a 350 feet radius, and
the Notice of Public Hearing was published in the City’s official newspaper. Moe’s has not
submitted their city liquor license application materials and the applicable fees. Deadline
for submitting liquor application materials was Friday, April 29, 2016.
Recommendation:
Staff recommends opening the public hearing for public comment, and continue the public
hearing to the next City Council Meeting on Monday, May 23, 2016.

In accordance with Chapter 502 of the Mounds View City Code, a public hearing is required for all
liquor license renewals. The City of Mounds View issued an intoxicating liquor license for El Loro
effective July 1, 2015, and their renewal is before the City Council for consideration. El Loro’s
Intoxicating Liquor License will expire June 30, 2016.

The notice of this public hearing was sent out to residences within a 350 feet radius, and the Notice
of Public Hearing was published in the City’s official newspaper. Property taxes are current on this
property.
El Loro has submitted their city liquor license application materials and the applicable fees. The
following investigations and inspections have been conducted to determine whether there is cause
for the City to deny the above referenced intoxicating liquor license application:
Police Inquiry and Investigations (Mounds View Police Department)
Staff has submitted a criminal background check to the Minnesota Bureau of Criminal
Apprehension, and has not received the criminal background check. This liquor license renewal will
be contingent on a satisfactory background check.
The Mounds View Police Department will be conducting compliance checks before the expiration of
this license. Staff recommends this license contingent on a satisfactory report from the Mounds
View Police Department.
Utility Billing Inquiry (City of Mounds View)
The Finance Department has issued a satisfactory report for El Loro.
Fire Inspection (City of Mounds View Fire Marshal)
A fire inspection is scheduled for Thursday, June 9, 2016. This license will be contingent on a
satisfactory fire inspection.
Recommendation:
Staff recommends that the City Council open the Public Hearing for public input. Staff recommends
approval of this business license contingent on a satisfactory report from the Mounds View Police
Department, satisfactory criminal background check and a satisfactory fire inspection report. If this

The Mounds View Police Department is currently planning a compliance check operation
before the expiration of this license. Staff recommends this license renewal be contingent
on a satisfactory report from the Mounds View Police Department.
Staff has submitted a criminal background check to the Minnesota Bureau of Criminal
Apprehension, and has not received the criminal background check. This liquor license
renewal will be contingent on a satisfactory background check.
Utility Billing Inquiry (City of Mounds View)
Finance Department has issued a satisfactory report for ABC Liquor.

Item Title/Subject: Resolution 8562 Adopting a Five Year Financial Plan for 2017
thru 2021
Introduction:
The City Charter, Chapter 7.05, requires that a five year financial plan be prepared annually. It
must be presented at a public hearing and adopted by motion or resolution. Notice was published
for the Council meeting in the Sun Focus on April 22, 2016. Residents are welcome to comment
on the plan at this meeting.
The components of the Five Year Financial Plan are attached for Council consideration. There
are several components to the Five Year Financial Plan. These are the General Fund Multi-year
Operating Budget, the Vehicle & Equipment Replacement Plan, the Capital Improvement
Program, the Impact on Capital Projects Funds’ Cash Balance, and Utility Rate Studies.
This five year plan should be considered a work-in-progress and a guide for Council and Staff to
make longer range decisions. As new information becomes available and conditions change we
can update the components to determine the longer range effect.
General Fund Multi-year Operating Budget:
The multi-year operating budget for the General Fund includes Local Government Aid (LGA) at
90% of the anticipated amount for 2016 and beyond. The Council made a transfer to the Special
Projects Fund in 2014 to begin to replenish the fund and budgeted for a transfer in 2016. The
City is projected to receive $671,517 in LGA under current law for 2017 and certified aid is
$666,795 for 2016.
The plan reflects a 2.50% increase in expenditures for 2017/18 and 3% for the remaining years.
A 3% levy increase is reflected for 2017 and 3.5% for all years after 2017. When possible staff
used known amounts instead of projections. The 2014 and 2015 levies were increased by 2%,
2016 had a 1% increase. 2017 reflects a 3% increase but may be adjusted as we develop the
2017 budget and better information becomes available. This version of the budget assumes that
there will be no additions to personnel or other major changes in operating expenditures. City
staff has declined from 52 in 2006 to 49.75 in 2016.
Capital Improvement Program (CIP):
The Capital Improvement Program has been updated to reflect changes in the project list and is
presented for your consideration. There are a number of projects that have no current funding
source and are reflected as unfunded in the CIP.
Vehicle and Equipment Replacement Plan
The schedule has been updated to reflect retirements, new acquisitions, and changes to
expected useful lives. The current amounts transferred to the Vehicle and Equipment
Fund from the participating funds is sufficient to maintain replacement levels except for
the General Fund. The General Fund amount was reduced to balance the budgets in
2010, 2011, 2012, and 2013 but has been systematically increased starting in 2013.
There is an unfunded balance of $675,000 compared with the prior year of $175,000,
replacement costs and useful lives were updated to reflect more accurate expectations.
Impact on Capital Projects Funds’ Cash Balances:
This presents the sources and uses and impacts to cash for the Capital Improvement Program
on the four capital projects funds for the five year period of this report, 2017 thru 2021.
Utility Rate Studies
Rate studies are included for the utility funds. (Water, sewer, storm water, street light) The water
and sewer rates should be considered for an increase in 2017. The water base rate is proposed
to increase by $2 in 2017, which will add about $8 a year to the average bill. The rate tiers should
be adjusted to reflect changes in water use and this will add $2.52 annually to the average user.
The variable water rate can remain unchanged. The sewer rate is proposed to increase by 6% in
2017, which will add $18 a year to the average residential bill. The need for an increase in both
the water and sewer funds is generated by significant capital expenses from deferred
maintenance and increases in disposal charges by Metropolitan Council Environmental Services
for the current and previous years. Future increases will need to be considered until both funds
stabilize. The storm water rate can be maintained at the current level. Future increases will need
to be considered in 2018 to prepare for the dredging of Silver View storm water pond in 2025 or
later (approx. cost $2 million). The street light rate is proposed to increase by $.25 per quarter
which will add $1 per year to residential utility bills. The increase is needed to support the
transition to LED trail/sidewalk lighting. Water service repair insurance is currently $7.50 per
quarter and we will need to monitor this for future increases. There have been significant
increases in repairs that have occurred over the last three years.
Five Year Financial Plan Adoption:
The Five Year Plan is a blueprint for future years and is only one possible scenario. It is intended
to be changed as priorities change and more current information becomes available. Staff
welcomes Council comments and direction on any desired changes. Once adopted the five year
financial plan will be published on the City’s website.

Discussion
Resolution 8575 provides a payout of Tom Kinney’s accrued/unused sick time. In
accordance with Section 3.45 of Mounds View Personnel Manual, Tom Kinney is authorized
a sick time payout totaling $33,172.20 to his Retirement Health Savings Plan. This is
calculated as 920.86 accrued/unused sick hours times 65% times his hourly rate of $55.42.
Resolution 8575 provides a cash payout on Tom Kinney’s vacation time. In accordance with
Section 3.45(D), of the Mounds View Personnel Manual, Tom Kinney is authorized a
vacation time payout totaling $19,566.59 to his Retirement Health Savings Plan. This
calculated as 353.06 accrued/unused vacation hours times his hourly rate of $55.42.

Engineering/GIS Intern in the Public Works Department
Background:
At the February 8, 2016, City Council Meeting, the City Council approved a revised job
description and authorized Staff to advertise for an Engineering/GIS Intern (Resolution 8519
attached).
The Engineering/GIS Intern is a temporary, part-time position geared toward current or
recent college students in a related field. This employment arrangement allows PW to
obtain skilled help at a fraction of the cost of hiring a full-time, regular employee. Hourly rate
for this position is $11.75/hour. The position is fully funded by the Water and Sanitary
Sewer Enterprise Funds and has no impact on the General Fund.
Discussion:
Staff revised the job description by adding proficiency in ArcView (GIS software solution that
allows you to visualize, manage, and analyze your GIS data), and change the status to a
seasonal internship (part-time). According to the Affordable Healthcare Act, there are
provisions that require employers to offer health insurance to seasonal employees who
work 120 calendar days or more during the year. It further requires that the seasonal
employee who is hired to work for 120 calendar days and worked an average of 30 hours
per week to be offered insurance on the 90th day of his or her employment, and would be
eligible for health insurance benefits for 30 days. In addition to the obvious administrative
nightmare and cost associated with insuring an employee for 30 days, this provision can
also subject employers to obligations under the Consolidated Omnibus Budget
Reconciliation Act (COBRA) upon termination of the employee’s employment, thereby
creating even more burdens to the employer.
The City received six (6) applications, and attempted to interview all six (6). However, two
(2) withdrew their application for consideration because they accepted an internship with
another City/company, and the other applicant did not return the City’s calls. The City
interviewed three (3) candidates. The interview panel consisted of Public Works Director
Brian Erickson, Engineering/IS Technician Jim Hess, and me. It was the consensus of the
panel to recommend Brian Dickenson to the position of Engineering/GIS Intern.

Mr., Dickenson will be graduating this year in the Fall of 2016 at the University of Minnesota
Mankato with a degree in GIS. Mr. Dickenson will be instrumental in assisting the
engineering staff in Public Works to build the City’s GIS base maps and drafting of in-house
engineering drawings and exhibits. Staff believes that a qualified intern will easily offset
consultant costs associated with the GIS data/mapping and engineering drafting services.
Mr. Dickenson will also perform other common daily tasks involving file archiving, field
surveys/investigations, construction inspection, assisting citizens with questions, and other
various and miscellaneous duties of the department.
Work hours for Mr. Dickenson would be a part time (under 30 hours a week not to exceed
the budgeted 680 hours), and will not exceed 119 days. No benefits and no employment
agreement are associated with this position, so if the Council does not approve future
budget monies for the position, the intern position will be terminated. Mr. Dickenson will
start the internship on Tuesday, May 10, 2016, and the internship will end on or about
August 12, 2016.
Recommendation:
Staff recommends that the City Council consider adopting Resolution 8576 that will approve
the hire of Brian Dickenson as Engineering/GIS Intern in the Public Works Department.
Staff received a satisfactory criminal background check on Mr. Dickenson. Mr. Dickenson’s
first day would be on or about May 10, 2016.

Ordinance amending Title 1100 of the Mounds View City
Code pertaining to Carports and Accessory Uses
Introduction:
Accessory Buildings include any structure other than the home or principal building.
This includes open carports and enclosed private garages. The Zoning Code regulates
the placement, size, and appearance of Accessory Buildings based on what zoning
district the property is located in. Clarification is needed regarding finished material of
carports, and permitted items stored within carports.
Discussion:
The Zoning Code provides definitions for Accessory Buildings, Carports, and Private
Garages. Because carports and garages are both accessory buildings, but have
different restrictions, clarification is needed to the text.
This topic was previously discussed in 2000, 2009, and 2014 specific to allowing
Accessory Buildings with tarp-like exteriors. In 2014, the Council decided to continue to
prohibit their use.
The City Council discussed Carports at their March 7, 2016 Work Session. The
Council’s consensus is to continue to prohibit structures composed of tarp-like exterior
materials, and to amend the Zoning Code to clarify the use of Carports for the storage
of motor vehicles, and to prohibit their use for storage of miscellaneous household
items, creating a nuisance in appearance.
The proposed ordinance amendment clarifies that a Carport is an Accessory Building
open on at least one side (as opposed to an enclosed Private Garage). Carports may
have an exterior consisting of metal, fiberglass, or polycarbonate panels (no tarp-like
material). A Carport may be used for the storage of operable motor vehicles, ATV’s,
snowmobiles, trailers, and anything contained within the trailer, such as a boat.
Planning Commission Recommendation:
The Planning Commission discussed this item at their April 20, 2016 meeting,
recommending approval of Ordinance 917, amending Section 1102.02 (Definitions),
and Section 1106.03 (Accessory Uses). The Planning Commission’s discussion
included general zoning requirements for accessory buildings, appearance, permitted
storage, and roof pitch.
Staff Recommendation:
Staff recommends approval of Ordinance 917, an amendment to Section 1102.02 and
Section 1106.03 of the Zoning Code; clarifying allowable exterior materials of a Carport,
and permitted storage within a Carport.

The City of Mounds View ordains:
SECTION 1. The City Council of the City of Mounds View hereby amends Title 1100,
Chapter 1102, Section 1102.02; and Chapter 1106, Section 1106.03 of the Mounds View
Municipal Code by adding the underlined material and deleting the stricken material as
follows:
1102.02: DEFINITIONS:
Subd. 1. ACCESSORY BUILDING OR USE: A subordinate building or use which is
located on the same lot on which the main building or use is situated and which is
reasonably necessary and incidental to the conduct of the primary use of such building
or main use.
Subd. 15. CARPORT: Space for the housing or storage of motor vehicles and enclosed
on not more than two (2) sides. An accessory building open on one or more sides,
utilized only for the covered parking or storage of operable motor vehicles, all-terrain
vehicles, snowmobiles, and trailers.
Subd. 51. GARAGE, PRIVATE: An enclosed detached accessory building or portion of
the principal building, including a carport, which is used for storing vehicles.
1106.03: ACCESSORY USES: The following are permitted accessory uses in an R-1
District:
Subd. 1. Accessory Buildings: A building originally constructed for use as an accessory
building for the storage of materials and equipment accessory to a primary use located
on the property. Accessory buildings, which for these purposes shall include garages,
tool houses, carports, sheds and similar buildings for storage of domestic supply and
noncommercial recreational equipment, whether attached or detached.

Subd 1. Accessory Buildings, including garages, carports, tool houses and sheds,
whether attached or detached.
g. Accessory buildings shall have a weather resistant, treated or finished exterior.
Structures composed of tubular metal and canvas or exposed plywood, particle
board or similar materials shall not be permitted. The City does not allow cloth,
canvas, plastic sheets and tarps or similar materials as primary exterior materials on
accessory buildings (except for green houses).
The exterior finish of Carports may include sheet, ribbed or corrugated metal,
fiberglass or polycarbonate panels, and shall remain open on one or more sides.
i. The roof of all accessory buildings (excluding carports) exceeding two hundred

SECTION 2. In accordance with Section 3.07 of the City Charter, City staff shall have the
following summary printed in the official City newspaper in lieu of the complete ordinance:
On May 23, 2016, the City Council adopted Ordinance 917 that amends Title 1100
of the Mounds View City Code pertaining to the allowable exterior finished material
of Carports, and allowable items that may be stored within Carports.
A printed copy of the ordinance is available for inspection during regular business
hours at Mounds View City Hall and is available online at the City’s web site located
at www.ci.mounds-view.mn.us.
SECTION 3. This ordinance shall take effect and be in force 30 days from and after its
passage and publication, in accordance with Section 3.09 of the City Charter.

Background:
The City established a roof management program that includes municipal buildings and park
facilities. The roofs at the City Hall Park shelters are in very poor shape, and in need of
replacement. Attached photos show the extent of the deterioration. Since their initial installation in
1980, these canopies have never been reroofed. Left without action or replacement these roof s will
continue to deteriorate causing further problems including leaks, rotting of the wood sub surface, etc.
Discussion:
The Public Works Engineering Division prepared plans and specifications in-house and solicited
quotes from qualified roofing contractors. Five roofing contractors were contacted and two
contractors returned a quote. The quote of $7,285 was submitted by Twin City Roofing of Saint
Paul, Minnesota. If awarded, Twin City Roofing will begin scheduling the roof replacement work as
soon as possible, which will likely be mid-May. The contract documents require that the work be
substantially complete by July 15, 2016, with final completion before August 12, 2016. Funding for
this project is budgeted under Park Dedication Fund (451-4470-7050) for $25,000.
Recommendation:
Staff recommends that the City Council adopt the attached resolution approving a construction
contract for $7,285 with Twin City Roofing for replacing the roofs of the City Hall Park canopies.
Staff further recommends a 10% contingency of $730 should additional work resulting from unknown
conditions be discovered during construction. The total budget for construction not to exceed
$8,015. All contingency funding would require pre-approval by the Public Works Director.

Sons for the 2016 Sanitary Rehabilitation Project
Background
The municipal sanitary sewer system is composed of approximately 45 miles of trunk sewer, 900
manholes, and 2 lift stations. The sanitary trunk sewer was largely constructed in the 1960’s and
early 1970’s using (predominately) clay pipe. The use of clay pipe during this time was the industry
standard, but more watertight pipe products (PVC) have been developed and replaced clay pipe to
become the new industry standard the last few decades.
One technique used to fix pipes that are in good condition but have leaky joints is called slip lining.
Slip lining is a method that places a hard liner inside the existing pipe – without digging up the pipe
and streets. Slip lining is considerably less costly than trenching and replacing pipe, and there is no
“inconvenience” cost compared to trenching methods. Attached to this report is a map of the sewer
lines to be slip lined.
Discussion:
Public Works Engineering staff prepared plans, specifications, and bid documents in house for the
2016 Sanitary Sewer Rehabilitation Project. Approval to solicit for public bid was approved by
Council at the April 11, 2016 Council Meeting (Resolution 8546). A public bid solicitation was
executed to obtain pricing.
Bids were received from three qualified slip lining contractors with the low bid being submitted by
Lametti & Sons from Hugo, MN. The breakout is as follows:

Ordinance Revising Section 1006.06 of the Municipal Code
Regarding Certificates of Occupancy and Escrow Deposits
Introduction:
W hen a building is constructed and becomes ready for occupancy, there may remain a few
issues that are not quite complete, issues which would not otherwise prevent the space
from being occupied from a Building Code standpoint. Sometimes the issues are
impractical to complete due to weather conditions, such as final grading, survey, sod,
driveways, etc. in the winter months. In such cases, cities accept an escrow before
granting the Certificate of Occupancy to ensure the work is completed after the occupancy
has been granted.
Discussion:
The City’s Fee Schedule already includes references to Certificate of Occupancy escrows,
in that the City would collect a minimum of $1,000 from the builder or developer if
something isn’t completed at the time occupancy is requested. The following list
represents common issues necessitating potential escrow:
a. Seed/Sod/Landscaping
b. As-built grading survey (covers grading and survey completion)
c. Driveway Installation
d. Curb cut modifications
e. Site clean-up
f. Stormwater management/drainage features/site erosion
g. Right-of-way restoration
h. Any other item as determined by the Building Official
A typical example of when this would come into play would be when a homeowner or
contractor needs to close on a new home in January but the only thing holding up the final
Certificate of Occupancy is installation of a driveway or sod/seed which would be
impractical for the time of year. In such cases, the builder, developer or owner would
deposit the required escrow to ensure the work would be completed when weather was
more permissive, and the City would issue the Certificate of Occupancy.
The proposed revisions to Section 1006.06 provide the authorization to collect an escrow;
the process by which the deposited monies would be used to address whatever work
remains to be completed would be handled in a separate policy document and escrow
agreement.

supported moving it forward for consideration. No changes have been made to the current
version from what was reviewed on May 2, 2016.
Recommendation:
Staff recommends that the City Council consider the first reading and introduction of
Ordinance 916, an ordinance amending the City Code in Section 1006.06 to authorize the
collection of an escrow amount to cover costs associated with certain non-Building Code

Background:
The City of Mounds View has been improving and adding to the trail system throughout the city.
As part of the 2016 – 2020 Five Year Financial Plan Mounds View included the construction of
County State Aid Highway 10 (CSAH 10) Trail Segments 6 & 11, City Project No. 2015-C03.
The City Council has taken the following steps, thus far, specific to CSAH 10 Trail Segments 6
& 11:
• 05/26/15 – Authorized engineering design & preparation of bidding documents
(Resolution 8420)
• 11/09/15 – Authorized Bolton & Menk to proceed with the design (Resolution 8477)
• 03/28/16 – Approve plans and specification and authorize ad for bids (Resolution 8539)
The design includes the construction of bituminous trail, lighting, and pedestrian ramps on the
east side of CSAH 10 from Red Oak Drive to Groveland Road (segment 6) and the west side of
CSAH 10 from north of Moe’s Sports Bar to Woodale Drive (segment 11).
Discussion:
The advertisement for bids was placed in the Sun Focus and Finance & Commerce (regional
trade publication). Five bid proposals were received and read aloud on May 2, 2016. The bids

As part of the design process staff asked that BMI include two additional alternate bid items.
These are items that may or may not be included at the time of contract award and allow for the
possibility of additional amenities as funding permits. For this project the two alternates are:
1. Install lighting on existing trail from Edgewood Drive north to Long Lake Road.
2. Modify/remove existing trail crossings along Edgewood Drive to prevent possible driver
confusion due to two trail crossings in close proximity.
Based on available funding the base bid for trail construction can be completed, and the newly
constructed Segments 6 and 11 would have lighting. However, there is not sufficient funding to
complete alternate 1. Should Council desire to award alternate 1 funding would need to be
identified and it could possibly come from the Street Improvement fund. Including alternate 1
would not require any additional contingency funding.
Alternate 2 is not recommended for award as the portion of trail to be removed is on private
property and would require coordination with the property owner. Staff will likely pursue this
change at a future date.
Funding for this project is a combination of funds from the Street Improvement fund and
Ramsey County cost share. This cost share will be combined with the cost share agreement for
the I-35W/CR H project that Ramsey County is managing. Under that project the City of
Mounds View will be paying for a portion of trail and other improvements constructed by the
County. Thus the county’s share of the trail project will be a ‘credit’ to the city for the amount
owed. The agreement will be brought forward to the Council for approval at a future date.
Recommendation:
Staff recommends that the City Council adopt the attached resolution approving a construction
contract with Northwest Asphalt, Inc. of Shakopee, MN in the amount of $475,846.48 for the
base bid. In addition staff recommends that the Council approve a 3% contingency in the
amount of $14,000.00. This results in a total of $489,846.48 for the construction of the project.

WHEREAS, the City Council adopted Resolution 8420 on May 26, 2015 awarding a
contract to Bolton & Menk, Inc. to prepare bidding documents for CSAH 10 Trail Segments 6
and 11, City Project No. 2015-C03; and,
WHEREAS, the City Council adopted Resolution 8477 on November 9, 2015 authorizing
Bolton & Menk, Inc. to proceed with the design of CSAH 10 Trail Segments 6 and 11, City
Project No. 2015-C03; and,
WHEREAS, the City Council adopted Resolution 8539 on March 28, 2016 approving the
plans and specification and authorizing the advertisement for bids for CSAH 10 Trail Segments
6 and 11, City Project No. 2015-C03; and,
WHEREAS, on May 2, 2016, five sealed bids were received and publicly read aloud as
follows:

WHEREAS, the lowest responsible base bid of $475,846.48 was submitted by
Northwest Asphalt, Inc. of Shakopee, MN; and,
WHEREAS, the City Engineer and Bolton & Menk, Inc. recommend awarding the
construction contract to Northwest Asphalt, Inc for the base bid.
NOW, THEREFORE, BE IT RESOLVED by City Council of the City of Mounds View,
Ramsey County, Minnesota as follows:
1. The bid proposal submitted by Northwest Asphalt, Inc. in the total amount (base bid) of
$475,846.48 for construction of CSAH 10 Trail Segments 6 and 11, City Project No.
2015-C03 is accepted by the City and a construction contract is awarded to Northwest
Asphalt, Inc.
2. City staff is directed to have a construction contract prepared for the Project at said
price, and the City Attorney is authorized to review the prepared construction contract
and any associated documentation submitted by Northwest Asphalt, Inc.
3. Upon satisfactory review of the prepared construction contract and documentation by the
City Attorney, the Mayor and City Administrator are hereby authorized and directed, for
and on behalf of the City, to execute and enter into said construction contract with
Northwest Asphalt, Inc.
4. The Director of Public Works is authorized to make approvals related to contract
modifications during construction of the Project up to a combined total of $14,000 (3%
contingency) on behalf of the City Council.
5. The Mayor and City Administrator are hereby authorized and directed to execute all
appropriate documents to effectuate the actions contemplated by this Resolution.
6. The Mayor and City Administrator, staff and consultants are hereby authorized and
directed to take any and all additional steps and actions necessary or convenient in
order to accomplish the intent of this Resolution.

bonds to finance the construction. It is prudent to adopt a reimbursement
resolution in the event that expenditures are incurred prior to the issuance of the
bonds. This will allow the City to repay any preliminary expenditures from bond
proceeds should the City decide to move forward. This resolution does not commit
the City to any future actions it is just a preliminary step that allows flexibility
regarding repayment of any preliminary expenditures. This resolution was
prepared by the City’s bond council at Kennedy & Graven.

RESOLUTION DECLARING THE OFFICIAL INTENT OF THE CITY
OF MOUNDS VIEW, MINNESOTA, TO REIMBURSE CERTAIN
CAPITAL EXPENDITURES OF A PROJECT FROM THE PROCEEDS
OF TAX-EXEMPT BONDS
WHEREAS, the Internal Revenue Service has issued Treasury Regulations,
Section 1.150-2 (the “Reimbursement Regulations”) under the Internal Revenue Code
of 1986, as amended (the “Code”), providing that proceeds of tax-exempt bonds used
to reimburse prior capital expenditures will not be deemed spent unless certain
requirements are met; and
WHEREAS, the City of Mounds View, Minnesota, municipal corporation and a
political subdivision of the State of Minnesota (the “City”), expects to incur certain
expenditures that may be financed temporarily from sources other than tax-exempt
bonds, and later reimbursed from the proceeds of tax-exempt bonds; and
WHEREAS, the City has determined to make a declaration of its official intent
(the “Declaration”) to reimburse certain capital costs from the proceeds derived from
the sale of tax-exempt bonds issued by the City or another political subdivision in
accordance with the Reimbursement Regulations.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MOUNDS VIEW, MINNESOTA AS FOLLOWS:
1. The City may incur certain capital expenditures in connection with a
public works facility (collectively, the “Project”)
2. The City reasonably expects to reimburse the expenditures made for
certain costs of the Project from the proceeds of tax-exempt bonds in a principal
amount currently estimated not to exceed $5,000,000. All reimbursed expenditures
related to the Project will be capital expenditures, costs of issuance of the tax-exempt
bonds or other expenditures eligible for reimbursement under Section 1.150-2(d)(3) of
the Reimbursement Regulations.
3. This Declaration has been made not later than 60 days after payment of
any original expenditure to be subject to a reimbursement allocation with respect to the
proceeds of tax-exempt bonds, except for the following expenditures: (a) costs of
issuance of tax-exempt bonds; (b) costs in an amount not in excess of the lesser of
$100,000 or 5% of the proceeds of the tax-exempt bonds; or (c) “preliminary
expenditures” up to an amount not in excess of 20% of the aggregate issue price of the
tax-exempt bonds that are reasonably expected by the City to finance the Project. The
term “preliminary expenditures” includes architectural, engineering, surveying, soil
testing, bond issuance and similar costs that are incurred prior to commencement of
acquisition, construction, or rehabilitation of the Project, excluding land acquisition, site
preparation, and similar costs incident to commencement of construction.
4. A reimbursement allocation with respect to tax-exempt bonds will be
made not later than 18 months after the later of: (i) the date the original expenditure is
paid; or (ii) the date the Project is placed in service or abandoned, but in no event more
than 3 years after the original expenditure.
5. This Declaration is an expression of the reasonable expectations of the
City based on the facts and circumstances known to the City as of the date hereof. The
anticipated original expenditures for the Project and the principal amount of the tax-
exempt bonds described in paragraph 2 are consistent with the City’s budgetary and
financial circumstances. No sources other than proceeds of tax-exempt bonds are
reasonably expected to be reserved, allocated on a long-term basis, or otherwise set
aside pursuant to the City’s budget or financial policies to pay such expenditures for
which bonds are issued.
6. The action is intended to constitute a declaration of official intent for
purposes of the Reimbursement Regulations.
