Discussion: The City of Mounds View holds a MS4 permit issued by the Minnesota Pollution Control Agency (MPCA) and is charged with meeting a number of requirements. One of those requirements is an annual Storm Water Public Information Meeting. Director of Public Works/City Engineer Item No: 07A Meeting Date: June 27, 2016 Type of Business: Council Business City of Mounds View Staff Report To: Honorable Mayor and City Council From: James Ericson, City Administrator Item Title/Subject: Second Reading and Adoption of Ordinance 920, an Ordinance Renaming “Highway Avenue” to “County Road H” Located within the City of Mounds View Introduction: On November 10, 2014, the City Council approved Resolution 8323 which articulated its support of a jurisdictional transfer of Highway Avenue from MnDOT to Ramsey County. In addition to the jurisdictional transfer, the County had requested a functional reclassification from “B Minor Arterial” to “A Minor Arterial”, in anticipation of the expanded and improved capacity designed for the Rice Creek Commons project. Discussion: Most people know this section of roadway as County Road H, however because the roadway was not owned by the County, its assigned name did not reflect the “county road” moniker. With the jurisdictional transfer complete, staff felt it was time to eliminate the reference to Highway Avenue and formalized the commonly used County Road H reference. There are three properties that would be affected by the name change—RJ Riches, Lucky’s Gas Station and the Park & Ride Lot. RJ Riches expressed support for the name change. Staff sent a hearing notice to the newspaper to be published on June 17 and sent formal notices to the affected property owners in the event any would like to comment regarding the name change. Recommendation: Staff has prepared Ordinance 920, an ordinance which changes the name of Highway Avenue to County Road H. Action requested for this meeting is to consider the second reading and adoption of the ordinance renaming Highway Avenue to County Road H. Appendix C of the Mounds View Municipal Code entitled “Street Name Changes” is hereby amended by adding the following: COUNTY ROAD H. A certain street located within the City of Mounds View extending between County Road 10 and Interstate 35W currently known as Highway Avenue shall hereinafter be known as “County Road H” (refer to Exhibit A). Numerical addresses shall remain unchanged. SECTION 2. The affected properties are those shaded on the attached Exhibit. SECTION 3. In accordance with Section 3.07 of the City Charter, City staff shall have the following summary printed in the official City newspaper in lieu of the complete ordinance: On June 27, 2016, the City Council adopted Ordinance 920 which renames Highway Avenue to County Road H, between County Road 10 and I-35W, within the City of Mounds View. A printed copy of the ordinance is available for inspection during regular business hours at Mounds View City Hall and is available on line at the City’s web site located at www.ci.mounds-view.mn.us. The Mounds View Festival in the Park Committee is a non-profit organization that is requesting to have Ole Piper Inn (located in Blaine, MN) to serve liquor during the Mounds View Festival in the Park on August 20, 2016. A public hearing is required for all liquor licenses, and this public hearing was published in the City’s official newspaper. In addition, Public Hearing Notices were sent to residences within 350 feet of Mounds View City Hall. Discussion: All applications and fees have been submitted. However, Staff has not received a satisfactory criminal background check from the Minnesota Bureau of Criminal Apprehension. This license would be contingent on receiving this satisfactory check. The Ole Piper Inn have a current On-Sale Intoxicating Liquor License with the Minnesota Department of Public Safety (Alcohol and Gambling Division), to include a current Minnesota restaurant license with the City of Blaine. Ole Piper Inn can only serve 3.2 Malt Liquor during the festival. All licenses are in good standing. A representative(s) from the Mounds View Festival Committee will be present at this meeting to answer any questions you may have in regard to management, security and distribution of liquor during the Mounds View Festival in the Park event. Erickson, Public Works Director/City Engineer Item Title/Subject: Resolution 8600, Approval of the RCWD 2016 Urban Stormwater Remediation Cost-Share Agreement Background: The Rice Creek Watershed District (RCWD) as part of their goals and objectives in its Watershed Management Plan as well as their efforts in protecting and enhancing the water resources within the district has an annual cost-sharing program. For 2016, the RCWD made $260,000 available to assist cities, counties and other public entities to implement stormwater management projects. The funding for projects that is intended to provide stormwater runoff treatment or volume/peak runoff rate control. Funding is available for up to 50% of the total cost of the project and distributed on a competitive basis. Applications of projects and funding were due on December 31, 2015. Discussion: Staff applied for and ultimately received a grant for a stormwater project at 2255 Lambert Avenue, owned by Tom Fields, which would replace an open and poorly vegetated ditch with reinforced concrete pipe. Currently, this ditch is poorly vegetated as a result each rain event is causing erosion and depositing sediment in the city’s stormwater system. This sediment may require removal from the storm sewer system in the future in order to insure proper functionality. Recommendation: Staff recommends that Council accept this grant to insure that funds are available to assist with this project. Prior to any construction beginning, staff will request approval from Council to approve the design and seek quotes to perform the work. Ultimately, it will also be up to Council to approve the acceptance of the quotes and awarding the work of this storm sewer line. Respectfully submitted, Brian L. Adopted this 27th day of June 2016. ____________________________________ Joe Flaherty, Mayor ATTEST: ____________________________________ James Ericson, City Administrator (SEAL) Item No: 7D Meeting Date: June 27, 2016 Type of Business: Council Business Administrator Review : ____ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Jon Sevald, Planner Item Title/Subject: Second Reading and Adoption of Ordinance 919, an Ordinance Amending Chapter 1008 of the Mounds View Municipal Code Regarding Dynamic Display Signs (ROLL CALL VOTE) Introduction: Dynamic Display Signs (animated digital signs) are a permitted use in the B-2, B-3, B-4, and Commercial PUD districts. Such signs may be used by schools, churches, places of worship or other institutional uses in residentially zoned districts, through a Conditional Use Permit (CUP). A restriction is that such signs utilize “amber” colored lights. The intent is that amber may be less obtrusive to nearby residents. Discussion: On June 1st, the Planning Commission approved a Variance for Messiah Lutheran Church to utilize multi-colored lights on a Dynamic Display in a residential district (Planning Case MU16-001). During the Planning Commission’s May 18th meeting, discussion included that Dynamic Display Signs have been in use for several years, and that people have gotten use to them. Thus, if the City permits their use in residentially zoned districts (with a CUP), the color of the lights is not an issue. If the City Code is amended, it may affect areas in proximity to Pinewood Elementary, Edgewood Junior High, Messiah Lutheran Church, Sunrise Methodist Church, Church Upon the Rock, Abiding Savior Lutheran Church, and Cross of Glory Lutheran Church (Bethlehem Baptist Church is surrounded by industrial). Although a Public Hearing is not required, a notice was mailed to property owners within 350’ of those locations, notifying them of the June 27th Council meeting. Staff heard from one resident near Pinewood Elementary who is opposed to the existing lighted non-dynamic display sign because it is a distraction, and would oppose any additional lighted signs at the school. Recommendation: Staff recommends that the Council conduct a Second Reading and Adoption of Ordinance 919, an Ordinance Amending Chapter 1008 of the Mounds View Municipal Code Regarding Dynamic Display Signs. The City Council of the City of Mounds View hereby amends Title 1000, Chapter 1008, Section 1008.10 of the Mounds View Municipal Code by adding the underlined material and deleting the stricken material as follows: 1008.10 SPECIFIC SIGN TYPE STANDARDS AND REQUIREMENTS Subd. 9 Dynamic Display Signs: c. In addition to all other standards of this chapter, the City allows on-site dynamic display signs subject to the following additional conditions: (2) Notwithstanding subsection 1 above, such signs may be located on the sites of schools, churches, places of worship or other institutional land uses, subject to the following additional conditions: (a) City Council approval of a conditional use permit (CUP) as outlined in Section 1106.04 and Section 1125.01, subdivision 3 of the City Code. (b) Dynamic display signs in residentially zoned districts must utilize amber color lights. (c) (b) Such signs shall not cause glare, disturbance or other problems to any residential properties or land uses. SECTION 2. Deputy Police Chief Steve Menard was appointed as Interim Police Chief effective April 30, 2016. At the February 1, 2016, Work Session, the City Council reviewed a timeline for recruitment for this position. Subsequently, Staff convened a meeting of the Police Civil Service Commission on Wednesday, February 3, 2016, and the members agreed with the recruitment steps proposed by the City Council. At the February 8, 2016, City Council Meeting, the City Council approved the advertisement for the Police Chief position. Based on City Council direction, Staff enlisted the assistance of a professional recruitment firm, Setter & Associates, to assist the City in the recruitment process. Discussion: Staff received twenty-one (21) applications. With the assistance from Setter & Associates, Staff narrowed the candidate pool down to eight (8) candidates. These eight (8) candidates were sent a written questionnaire to measure their writing skills and overall knowledge of leadership, cooperative relationships, policy making, and community policing. After reviewing the written responses, it was the consensus of Staff and Setter & Associates to interview five (5) candidates. On May 12th and 13th, candidates were interviewed by a panel consisting of Mayor Flaherty, Councilmember Mueller, City Administrator Ericson, Assistant Administrator Crane, and New Brighton Public Safety Director Bob Jacobsen. After the interview process was completed, the decision was made to have a second interview process with the top two (2) candidates. The second interview panel consisted of the City Council, Administrator Ericson and Assistant City Administrator Crane on Tuesday, May 24, 2016. The top two candidates interviewed were Deputy Chief Steve Menard (internal candidate), and current Breckinridge, MN Police Chief Nathan Harder. It was the consensus of the City Council to offer the position to Nathan Harder. Item 07E Monday, June 27, 2016 Page 2 Mr. Harder is currently the Police Chief for the City of Breckenridge, MN (2010-present). Formerly, Mr. Harder has worked in the police arena as an Alaska State Trooper (2009), Brooklyn Park PD (2005-2009), Spokane WA PD (2003-2005), and Arlington, TX PD (1997-2003). Mr. Harder has a Bachelors Degree in History/Political Science and is currently pursuing his Masters Degree in Criminal Justice. In addition, Mr. Harder has numerous instructor certifications to include defensive tactics, firearms, active shooter and less-lethal instructor to name a few. He also has an extensive background in community outreach programs. The City Council interview panel forwarded their recommendation to the Police Civil Service Commission who, on May 31, 2016, certified an eligibility list consisting of three names, Steve Menard, Nathan Harder, and David Thompson, in that order. The Police Civil Service Commission did not agree with the interview panel’s recommendation to hire Nathan Harder, and recommended to promote from within the police ranks. The Police Civil Service Commission did acknowledge that the City Council could choose whomever they wanted regardless of the order in which the names appear. Based on the eligibility list, the City Council directed Staff to initiate the background check and evaluations on Nathan Harder. The following background checks and evaluations were conducted, all with positive results: • Background investigation and reference check, conducted by Cardinal Investigations • Psychological evaluation, conducted by Gary L. Fischler & Associates • Medical evaluation, conducted by Multicare Associates Proposal: Nathan Harder will start at Step 2 of the range with an increase to Step 3 after one year of employment. All increases are subject to a satisfactory performance evaluation and City Council consideration. In addition, the City will be offering reimbursement of Mr. Harder’s relocation expenses up to a maximum of $1,000. The City will only reimburse for reasonable expenditures which are supported by valid receipts provided to the City. Respectfully submitted, ________________________ Desaree Crane RESOLUTION NO. 8602 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING THE HIRING OF NATHAN HARDER TO THE POSITION OF POLICE CHIEF WHEREAS, Police Chief Tom Kinney retired from the Mounds View Police Department on April 29, 2016; and, WHEREAS, during the February 8, 2016, City Council Meeting, the City Council approved the advertisement and recruitment or the Police Chief position; and, WHEREAS, based on City Council direction, Staff enlisted the assistance of a professional recruitment firm, Setter & Associates, to assist the City in the recruitment process; and WHEREAS, the City Council directed staff to schedule all necessary background checks and evaluations from the eligibility list provided by the Police Civil Service Commission — Nathan Harder; and, WHEREAS, all background checks and evaluations on Mr. Harder have been conducted with positive results. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council does hereby approve the hire of Nathan Harder to the position of Police Chief, effective August 15, 2016, subject to the provisions and terms of the Personnel Manual, with the following noted compensation, benefits and conditions: W age / Step: $47.11 per hour (Step 2) Step Increases: Step 3 after one year of employment subject to satisfactory evaluation and City Council approval Relocation Allowance: The City is offering a reimbursement of relocation expenses not to exceed $1,000. The City will only reimburse for reasonable expenses which are supported by valid receipts provided to the City. No Contract: Neither this resolution nor the Personnel Manual shall constitute an employment contract. The Police Chief is a non-union, exempt position serving at the will and pleasure of the City Council.
