ROLL CALL Mr. Whiting does roll call. Mayor Coughlin, Council members Quick, Marty, Stigney, Thomason, present. 3.APPROVAL OF MINUTES 4. SPECIAL ORDER OF BUSINESS Certificate of appreciation for Senior Station Captain Scott D. Drewitz, retired January 7, 1999, upon completion of 22 years of service with our department. He joined the department on April 3, 1976, while a senior at Centennial High School. The principal had given special permission for Seniors to become volunteer fire fighters and respond during school hours to station four. In 1978 Scott moved to station one area where he served the rest of his tenure with the department. He was promoted to the rank of Captain in November 1980 and served as Senior Station One Captain from 1992 to 1994 and again 1996 until his retirement. He also served as Station One Engineer, Fire Inspector, Deputy Fire Marshal, and Auxiliary Instructor in the areas of medical and aircraft training. Scott attended many special training classes on various areas of fire fighting including fire inspection and prevention, arson detection, radiological monitoring, fire command, leadership, hazardous materials emergencies. He was certified as an EMT, paramedic and at the fire fighter one, two and three levels. During his 22 years of service, Scott responded to more than 3150 fire calls, and attended over 1000 weekly drills. In addition to his fire fighting duties, he willingly assisted with the fire prevention and public fire education presentations and events and participated in our annual open house and tours. Scott received several awards over the years and that included an award of merit for outstanding service in District One in 1981, and award of valor for rescuing a resident at a house fire in 1982, a distinguished service award for exemplary performance in contributions to the fire department and community in 1984, award of merit for attending the most drills at station one in 1985 and 1986, and the fire chief's honorable mention for duties beyond expectations in 1986. The city of Mounds View would like to give a certificate of appreciation. The City of Mounds View recognizes Scott D. Drewitz Senior Station Captain of Spring Lake Park, Mounds View fire department. Mayor Coughlin requests reports. Mr. Marty attended the Planning Commission meeting, the first meeting is to go through bylaws. The Planning Commission did so and made some minor changes and tried to clarify things. The second thing discussed outdoor produce sale the City has in Mounds View, some that come every year that have to reapply for a conditional use permit. They raised some questions as to how it might be more easily handled with staff, rather than coming back to the Planning Commission all the time. Mayor Coughlin stated a public thank you to Poncho Henderson down at the Metropolitan Council. He gave a tour of all the facilities including the under belly of the sewage treatment plant for St. Paul. Gave a tour, updates on Y2K for their computer system, with assurance they are Y2K compliant. j fl MOUNDS VIEW CITY COUNCIL ° CITY COUNCIL MEETING MINUTES X9iAppil OVED MONDAY, FEBRUARY 8, 1999 PAGE 2 Mayor Coughlin stated he had also attended Ramsey County League meeting. Coughlin stated northwest youth and family services outstanding youth. Mayor Coughlin extends congratulations to officer Tim Brennen who had received an award for his youth work D.A.R.E. program and other outreach programs with our middle school and our elementary school. Mayor Coughlin publicly thanks Bruce (Vento) for taking the time to have a town hall meeting here this last Saturday in talking about some of the issues pertaining to Mounds View. Mr. Marty stated at this time we have 125 people registered in programs coming out in the next Mounds View matters, we have 11 new programs. Tai Chi, ballroom dance, senior programs, senior trips, 55 alive classes, full at this time, also council meetings for community hospital. Another program working on is karate, live dancing, starting up swimming lessons, teen nights, two nights a month, for two hours. They are going to be having movies this fall and different activities. This will be supervised. We need an $8000 gym curtain which goes down the half court of the gym and so we will have two basketball courts. Wall padding was discussed because there is not enough runoff area under the baskets. A few items on wish list for the public, a refrigerator for the senior center so the seniors can meet and have their medication or bring snacks. TV and VCR for the meeting rooms. Ping pong tables. Also for donations for games and equipment for the teen area, or open nights for the City. The community is requested to donate these items. There is an outdoor sandlot volleyball, we have supplies that need to be moved. Outdoor basketball court. City Forester has some landscaping and suggestions for when things melted off. Electronic score board was discussed. 6. CONSENT AGENDA 6A. Approve just and correct claims. 6B. Approve the booster station upgrade and Y2K system. 6C. Set a public hearing at 7:05, Monday, February 22, 1999, to consider resolution 531 regarding conditional permit, use permit for an oversized garage located at 8100 Long Lake Road. Motion/Second: Stigney/Coughlin. All in favor of items on the consent agenda. Ayes -5. Nays-0. 7. UNFINISHED BUSINESS 7A. Discussion on city cell phones and their usage. Move this discussion to the work session. At the work session if staff could bring forth the actual cost incurred last year using cell phones and the cost justifications for which cell phones are needed by whom in the city and see if there is some alternative communications. 8. RESIDENTS REQUESTS AND COMMENTS FROM THE FLOOR David Jahnke: 8428 Eastwood Road. Resolution on Edgewood Drive last week that there was a vote 4 to MOUNDS VIEW CITY COUNCIL UNAPPROVED CITY COUNCIL MEETING MINUTES MONDAY, FEBRUARY 8, 1999 PAGE 3 1. Mr. Jahnke asked if this was a preliminary vote with MNDOT. Mr. Jopke stated staff was seeking direction in permission to submit preliminary plans to MNDOT for Edgewood Drive relocation and signal construction on 10 and preliminary plans have been sent to them subsequent to that meeting. Mr. Jahnke is concerned about the $8000 and where that is coming from. Mr. Whiting stated we have a little over$200,000 in the park dedication fund and we can tap into some of this money for that which we already have this in the fund now. It is used for maintaining the parks and maintaining the equipment and building meeting houses. Woodcrest had allotted for$30,000 for building development on Woodcrest Park but because of the land it is not feasible to build there. 9A. PUBLIC HEARING AND SECOND READING OR ORDINANCE NO. 626 Mayor Coughlin opens the public hearing for the second reading of ordinance 626, relating to the changing of the Planning Commission memberships to nine members. Ms. Schmidt stated fund directions from the City Council the staff has amended chapters 401 and 405, through ordinance 626, and 627, which increases the Planning Commission membership as well as the Park and Recreation commission membership to nine members. This is the second and final reading of the ordinance for those items. No public input. Motion/Second: Marty/Stigney. Move to approve ordinance 626, waive the reading. Mr. Whiting does role call vote. Council member Marty, Thomason, Quick, Stigney, mayor Coughlin. Motion passes 5-0. 9B. PUBLIC HEARING AND SECOND READING OF ORDINANCE NO. 627. Mayor Coughlin closes the regular meeting and opens the public hearing on the second reading of ordinance 627 relating to the changing of Park and Recreations memberships to nine members. Ms. Schmidt stated upon direction from Council and staff on chapter 405 of municipal code Park and Recreation Commission from seven members to nine members. No public discussion. Mayor Coughlin stated Council has before you ordinance 627. Motion/Second: Marty/Thomason. Move approval, and waive the reading for ordinance 627. Mr. Whiting stated unlike the prior ordinance this is a change in membership to be effective in 30 days. Mr. Whiting does a roll call vote. Consideration of resolution 5310, requiring all City Council, boards, commissions and committees to cablecast their meetings. Ms. Schmidt stated this resolution requires all City Council, boards, and commissions to cablgcast their meetings beginning on April 1. Motion/Second: Stigney/Marty. Move to approve resolution number 5310, with the change of work session to special session. Mayor Coughlin calls for vote. Ayes-5. Nays-0. 9E. Consideration of resolution 5311, appointing members to the Mounds View Planning Commission. Brian Kaden with the term to expire in 2001. Michael Berke, term to expire in the year 2000. Nordine (Brothen), term to expire in 2001. William (Globby), term to expire in 2001, and Michael (Heckland), term to expire in the year 2000. Motion/Second: Quick/Thomason. Consideration of resolution 9988103, approving a grant application to Ramsey County for CBDG funds to promote crime-free multi-housing. Motion/Second: Marty. To approve resolution 9988103. Consideration of resolution 9988104, and resolution 9988105, approving grant application to Ramsey County, CDBG fund and MHFA super fund for providing funding for housing replacement program. Motion/Second: Quick/Stigney. Approval of resolution 9988104, and 9988105. Ayes-5. Nays -0. Motion carries. Resolution 9988107, appointing economic development commission members. Mayor Coughlin presents as president of this authority the following names of Julie Ann Olson, and Jerold A. (Conn). Both of these positions are for business related seats on the economic development commission. Julie Olson is a real estate agent and Jerold (Conn) is the owner and operator of Action Press here in Mounds View. Mayor Coughlin presents this before the authority for consideration. Respectfully submitted, James Merrill CITY OF MOUNDS VIEW Parks and Recreation Commission January 27, 6:30 pm Minutes Commissioners present: Frank Silvis, Mary Benz, Sherry Gunn, Rob Marty and Dave Long. Commissioners absent: Gary Stevenson, Pam Starr, and Stan McDonald. Staff present: Terri Blattenbauer (YMCA) Meeting called to order at 6:35 pm. Motion to approve the December minutes by Mary, with a second to the motion by Sherry. Motion carries. Terri gave an opening thought on volunteers and their importance on Earth. Opening thoughts will rotate monthly with staff and volunteers. Winter rec programs currently have approximately 150 registered participants. The Grand opening incurred 417 guests with positive comments. Two suggestions from individuals that were discussed involved a"floating" coat rack, to eliminate the security issue of an open coat room, and secondly, kit lockers, for use to lock valuables in while visiting. A program flyer was recently distributed to area schools listing new programs in the Community Center after school and weekends. This includes instructional programs, open gyms, structured gym times, teen gym on Friday nights, and structured birthday parties. The next Mounds View Matters is scheduled to be delivered March 4 & 5. There was discussion regarding the MV Matters not being delivered in several areas of the community. This is a concern,.as it is a main form of communication on programs for all ages in the City of Mounds View. Rob will also discuss this with the City Council. There are approximately 11 new program slated for the March - April edition of the MV Matters. A brochure was shown to the Commission with general information and for feedback, specifically on usage fees and rental fees. Brochure will be printed and available to mail, or pick up at City Hall, the Community Center or for other PR means as well. There was discussion on completion of the gym with the following items: *4-6 additional baskets * Wall padding behind baskets for safety *Divider curtain between 2 basketball courts *Digital scoreboard *Equipment for teens i.e. foosball, pool tables, air hockey etc. *Refrigerator for Sr. lounge *TV/VCR/cart for meetings, movies, playstation, etc. *Landscape/sand VB/basketball court Staff will provide more information in the mail and establish a special meeting to finalize specifics, such as purchasing priorities, quantity, and to purchase or explore other provisions. The Commission is enthusiastic to continue moving forward on this project to ultimately complete it. Frank advised Commissioners to review past information for any information on a 5 year plan for park projects. Terri will get the amount of park dedication money available from the finance department. The determination as to the amount that will be used for community center items will be made once information is received on the construction budget. There was brief discussion on usage of facilities. It was determined that all scout groups should not be charged. In other business:Terri will get information about Commissioner terms and report at the next meeting. Guest Dan Ley from the Irondale Baseball Association visited and shared some concerns with different leagues using Greenfield ball fields and not following protocol. A meeting will be set between park maintenance, recreation, and the association. Date of Report: February 18, 1999 Background: 8100 Long Lake Road is located at the northwest corner of Long Lake and Sherwood Roads. The property is approximately 13,700 square feet. The house and existing detached garage are set back toward the back of the lot and take access from Long Lake Road. The house, at 576 square feet, is presently larger than the existing two-stall garage,which is approximately 400 square feet. The applicant would like to expand the size of the garage by an additional 580 square feet to accommodate vintage and collector-type vehicles that are currently being stored outside. A Conditional Use Permit is required in this case due to the size of the proposed garage. Discussion: The size of the garage after the proposed expansion would be 980 square feet, which is significantly larger than the house. This type of"imbalance"has been discussed at previous meetings of the Planning Commission and City Council, with the general consensus being that a proportional relationship should be maintained between a house and garage. Even so, the City recently approved a similar request for an oversized garage located at 2185 Pinewood Drive--also a corner lot. In that case, however, the proposed garage was 53 percent larger than the house. In this case,the proposed garage at 8100 Long Lake Road would be 70 percent larger than the house. Dimensional Criteria All of the dimensional criteria associated with this request--setbacks, spacing between buildings, width of proposed garage, numbers of access point--satisfy the requirements as stated in Chapter 1104 of the Zoning Code. The back of the proposed addition maintains the currently-existing setback. The requirement that the combined area of accessory buildings shall not exceed twenty percent of the rear yard does not apply in this case, as there effectively is no backyard on this property due to the depth at which the home has been constructed on the lot. Maki CUP Request 8100 Long Lake Road February 22, 1999 Page 2 Adverse Effects and CUP Criteria The City Code, in Section 1125.01, Subd. 1, states that the possible adverse effects of a conditional use permit request shall be examined prior to taking action. The following represent those items explicitly stated in the Code: 1. Relationship with the Comprehensive Plan. The Comprehensive Plan encourages the development and maintenance of residential areas so as to improve the quality, appearance and attractiveness of housing units and residential property in general. The Comprehensive Plan designates this property, 8100 Long Lake Road, as low-density residential. This proposal does not conflict with the Comprehensive Plan. 2. The Geographical Area Involved. 4. The Character of the Surrounding Area In this area of Mounds View, there is a good mix between larger lots and smaller lots. Most of the homes in the immediate area are of the same size and age, many of which having garages as large or larger than that of 8100 Long Lake Road. More than half of the garages in the area are attached to the principal structure. A larger garage on the subject property would not appear out of place. 3. Whether such use will tend to or actually depreciate the area in which it is proposed. Increasing the size of the existing garage will have an immediate positive impact on the property value for the subject property, and may actually increase the perceived values of the homes surrounding 8100 Long Lake Road in that vehicles which were once parked or stored outside would be stored inside the garage addition. It is not conceivable that this garage addition would depreciate the surrounding area in any way. 5. The demonstrated need for such a use. The existing garage is too small for the needs of the property owner. The applicant desires a large enough garage to park his vehicles inside,protected from the elements and possible vandalism. This proposal appears to satisfy the adverse effects criteria. The City Code also identifies the criteria for granting a conditional use permit, which are outlined in Section 1125.01, Sub 3b. The response to the these criteria, grouped in logical, not numerical, order are as follows: (1) The use will not create an excessive burden on existing parks, schools, streets and other public facilities and utilities which serve or are proposed to serve the area. (7) The use will not cause traffic hazards or congestion. Maki CUP Request 8100 Long Lake Road February 22, 1999 Page 3 (8) Adequate utilities, access roads, drainage and necessary facilities have been or will be provided. Adding an addition to the garage, even one as large as is being requested, would not create a greater impact on existing public facilities,parks, schools or services, on utilities or access roads, nor would it create an increare in traffic on adjacent streets. (2) The use will be sufficiently compatible or separated by distance or screening from adjacent residentially zoned or used land so that existing homes will not be depreciated in value and there will be no deterrence to development of vacant land. (3) The structure and site shall have an appearance that will not have an adverse effect upon adjacent residential properties. Because this is a small lot, the expanded garage would have little visual screening. In terms of its relationship with the two adjoining properties, the garage is separated from the property to the north by another garage, so the expansion would have little impact upon that property. The property to the west would not be separated by much distance or any physical screening. (4) The use, in the opinion of the City Council, is reasonably related to the overall needs of the City and to the existing land use. (5) The use is consistent with the purposes of the Zoning Code and the purposes of the zoning district in which the applicant intends to locate the proposed use. (6) The use is not in conflict with the Comprehensive Plan of the City. Garages and detached accessory outbuildings are typical uses in residential areas, and allow for the storage of vehicles and yard and garden equipment. Having this expanded shed would allow the property owner to store vehicles currently left outside within a secure and protected structure. Staff believes that the adverse affects of this development proposal are minimal and are far out- weighed by the benefits. However, depending upon one's interpretation of the request in terms of the "intensity" of the proposed garage expansion in comparison to the existing home, the proposal may be in conflict with the"appearance" criteria. Staffs only concern with this proposal is the proportional imbalance of the proposed garage (980 sf) in comparison to the house (576 sf). Staff also believes that it is desirable from a community perspective to have property owners improve their properties with building expansions since the properties are then usually kept in better order. Planning Commission Action: The Planning Commission, at their meeting on February 17, 1999, voted to recommend approval of this conditional use permit request, with stipulations as noted in Resolution 5312. Maki CUP Request 8100 Long Lake Road February 22, 1999 Page 4 Public Comment or Response: Other than the applicant, no residents at the Planning Commission meeting on February 17, 1999, spoke out in regards to this request. Staff indicated to the Commission that it had received one phone call from a neighbor currently out of state. The neighbor was not in favor of allowing the oversized garage due to concerns that a business would be operated from within the garage and that the increased garage space would encourage more vehicles on the lot. Staff has attempted to address these concerns in the resolution with stipulations 2 and 5. Recommendation: It is Staff's and the Planning Commission's recommendation that the City Council favorably consider Resolution 5312, a resolution approving a Conditional Use Permit for a 980 square-foot garage at 8100 Long Lake Road, with stipulations. NOW, THEREFORE,BE IT RESOLVED that the Mounds View City Council approves the conditional use permit requested for a 980 square-foot accessory building with the following stipulations: 1. The conditional use permit shall be recorded with Ramsey County within 60 days of City Council approval, and a receipt of such recording shall be provided to the City of Mounds View. 2. The garage shall not be used for living space or other uses not allowed by the Zoning Code. Should the use change for which the permit was granted,the conditional use permit shall become null and void. 3. The garage addition shall be designed and maintained to provide a uniform building appearance with the house. 4. The driveway leading to the garage expansion shall be improved with a permanent surfacing material of either concrete or asphalt in conjunction with the construction of the garage. If occupancy of the garage is to occur prior to the driveway's improvement,the applicant shall submit a letter of credit or performance bond in an amount equivalent to the valuation of the work yet to be completed, as estimated by the Community Development Director. 5. All vehicles parked at the property shall be parked either upon the driveway's improved surface or within the garage. At no time shall a vehicle be allowed to park upon the grass or off of the improved surface. 6. The existing shed on the lot shall be moved if necessary to maintain a minimum six-foot setback from the garage. 7. The square footage allowed by this Conditional Use Permit shall not exceed 1,060 square feet(980 square feet for the proposed garage, 80 square feet for the existing shed.) Resolution No. 5315 establishes parking restrictions on Edgewood Drive from Bronson Drive to T. H. 10. There will be No Parking allowed on this segment of the newly aligned Edgewood Drive. Resolution No. 5316, approves the plans and specifications for the project, authorizes advertisement, sets the bid date deadline and award date. RESOLUTION NO. 5315 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION ESTABLISHING PARKING RESTRICTIONS WHEREAS, the City Council of the City of Mounds View has planned the improvement of MSAS 232 (Edgewood Drive) from Bronson Drive to T.H. 10 and; WHEREAS, the City will be expending Municipal State Aid Funds on the improvement of this Street and; WHEREAS, the State Aid Project number of this project will be 146-232-02 from Bronson Drive to T. H. 10 in the City of Mounds View, Minnesota and; WHEREAS, this improvement does not provide adequate width for parking on either side of the street, and approval of the proposed construction as a Municipal State Aid Street project must therefore be conditioned upon certain parking restrictions . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View that parking of motor vehicles on both sides of MSAS 232 (Edgewood Drive) from Bronson Drive to T.H. 10 shall be banned at all times . Staff is recommending award to Wenck. Wenck has indicated that a reduction of the cost of the two programs would be applicable if staff was available to contribute more to the process. This puts them in line with the proposal from SEH. The proposals from the three firms are listed below: Earthtech $16,700.00 SEH $15, 650.00 - $18,000.00 Wenck $16, 162.00 - $18,008.00 Staff will try to maximize the amount of input and clerical support to minimize the amount of expenditure required for this project. 0 Michael Ulrich, Director of Public Works RECOMMENDATION: Council award the Risk Management and Process Safety Management Program development to Wenck for a total not to exceed$18,008.00, which will be funded from the Water Department Fund 700-4823-3030, 700-483-23-9100, and Wastewater Department Fund 730-4823-9100.
