SUMMARY:
111 Per Section 3.3, Construction Plan, of Development Assistance Agreement for the Silver Lake
Pointe Project, "the Authority shall approve the Construction Plans if it determines that they conform
to the applicable provisions of this Agreement Such Construction Plans must be rejected in writing
by the Authority within 10 working days of submission or shall be deemed to have been approved by
the Authority." The full plans were submitted to the City's building department on October 31,
1994 and the attached resolution fulfills the requirement for the Authority to approve the
Construction Plans for the Silver Lake Pointe Project within the 10 working days of submission.
I have included a memo from Building Official Rick Jarson which outlines the required changes
to the plans to conform with the City's building codes. Per Section 3.3, Construction Plan,
"approval of the Construction Plans pursuant to this Section 3.3 shall constitute approval for the
purposes of this Agreement only'and shall not be deemed to constitute approval or waiver by the
Authority with respect to any building zoning or other ordinance or regulation...". Therefore, approval
of the resolution 94-EDA17 does not in any way approve the building permit process with the
City's building and engineering department. The resolution is to approve the design and
configuration of the project as it was understood in approval of the Development Assistance
Agreement.

A representative from Common Bond, previously known as Westminster Corporatio', will be
in attendance to show sections of the plans at the EDA meeting on November 14, 1994. If
anyone is interested in reviewing the plans prior to the meeting, a full set of plans will be
available in Conference Room C, Administration Department.
In discussions with Jeff Huggett of MSP Real Estate, the changes and classifications outlined
by Rick Jarson will be addressed to the City's satisfaction. If all goes as planned, the project is
due to close later next week with construction to begin shortly thereafter.

COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING CONSTRUCTION PLANS FOR SILVER
LAKE POINTE PROJECT
WHEREAS, the Board of Commissioners (the "Board") of the
Mounds View Economic Development Authority (the "Authority") entered
into the Development Assistance agreement with Heartland - Mounds
View Common Bond, LLC (the "Developer") approved on May 23, 1994
per Resolution No. 94-EDA 7, and
WHEREAS, the Silver Lake Pointe Project (the "Project") consists
of an 83-unit apartment community, 3-story elevatored building, located
on a 2.7 acre parcel on County Road I and Mounds View Drive just south
of Highway 10 in the City, and
WHEREAS, under Section 3.3, Construction Plans, "the Authority
• shall approve the Construction Plans if it determines that they conform to
the applicable provisions of this Agreement; provided, however, that any
such approval of the Construction Plans pursuant to this Section 3.3 shall
constitute approval for the purposes of this Agreement only and shall not
be deemed to constitute approval or waiver by the Authority with respect
to any building, zoning or other ordinance or regulation, and shall not be
deemed to be sufficient plans to serve as the basis for the issuance of a
building permit if the Construction Plan are not as detailed or complete as
the plan otherwise required for the issuance of a building permit. Such
Construction Plans must be rejected in writing by the Authority within 10
working days of submission or shall be deemed to have been approved by
the Authority.", and
WHEREAS, the Developer submitted Construction Plans to the
City of Mounds View Building and Engineering Department on October
31, 1994, and
WHEREAS, the Authority has reviewed the Construction Plans for
the Project, and
WHEREAS, the Construction Plans conform to the applicable
provisions of the Development Assistance Agreement by and between the
• Authority and the Developer.

NOW THEREFORE BE IT RESOLVED, that the Authority
approves the Construction Plans for the Silver Lake Pointe Project.

RE: SILVER LAKE POINTE SENIOR HOUSING CENTER
I have reviewed the plans for the Silver Lake Pointe development.
Items I discovered that require further clarification or change
are listed in the attached letter dated November 8 , 1994 , to Mr.
Weispfenning.
I informed Mr. Weispfenning during a phone conversation I had
with him on November 8 , that once these issues are resolved, to
1111 the satisfaction of the city, the plans would be approved and the
building permit, pending payment of all appropriate fees, would
be issued.

I have reviewed the plans for Silver Lake Pointe senior housing
project located in Mounds View and have discovered the following
items that require change or further clarification: 1111
1. The drain line for the surface water sump pit which is
located in the garage seems to drain back into the sump pit.
Please check this and provide details showing how this
arrangement will work.
2 . The plumbing plans show the building sewer to be eight (8)
inch diameter. Sheet C-I shows 120' of 6 inch PVC connecting
to a 6 inch PVC riser. Because the building sewer is
required to be 8 inch the connection to the sewer main must
also be 3 inch.
'-3 . The plans show a five foot high fence along the property
line. City code limits the height of this fence to four
feet.
4 . Detail 1/5 on sheet A-5 shows the roof truss heel. Because
of the height of this heel something must be added to provide
lateral stability.
5 . Sheet A-5 shows a wrought iron barrier gate at the top of the
stairs which leads to the garage area. There must be a
landing on both sides of the gate with a length measured in
the direction of travel of not less than forty four inches.
6 . Detail 5/9 must show a draft stop in the concealed space. III1

7 . The plans show that the lowest floor elevation is at 906.
The city's water management plan requires the elevation to be
at 908 . 2 .
