Project, "the Authority shall approve the Construction Plans if it 40 determines that they conform to the applicable provisions of this Agreement....... Such Construction Plans must be rejected in writing by the Authority within 10 working days of submission or shall be deemed to have been approved by the Authority. " The full plans were submitted to the City's building department on August 31, 1995 and the attached resolution fulfills the requirement for the Authority to approve Construction Plans for the Midwest I.V. Project within the 10 working days of submission. Building Official Rick Jarson will provide me with a memo by Monday's meeting on September 11, 1995 outlining any required changes to the plans to conform with the City's building codes. Per Section 3.3, Consttsiction Plan, "approval of the Construction Plans pursuant to this Section 3.3 shall constitute approval for the purposes of this Agreement only and shall not be deemed to lonstitute approval or waiver by the Authority with respect to any building, zoning or other ordinance or regulation... ". Therefore, approval of the resolution 95-EDA-31 does not in any way approve the building permit process with the City's building and engineering department. The resolution is to approve the design and configuration of the project as it was understood in approval of the Development Assistance Agreement.. Project. is -.,� J RESOLUTION NO. 95-EDA-31 • CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING CONSTRUCTION PLANS FOR MIDWEST I.V. PROJECT WHEREAS, the Board of Commissioners (the "Board") of the Mounds View Economic Development Authority (the "Authority") entered into the Development Assistance agreement with the Bridges Leasing Co., LLC (the "Developer") approved on August 28, 1995 per Resolution No. 95-EDA-30, and WHEREAS, the Midwest I.V. Project (the "Project") consists of the construction of an approximately 30,000 square foot office/warehouse/manufacturing facility, for.Midwest I.V., manufacturer and distributor of home health care pharmaceuticals and Laser Cutting & Technology, an industrial precision laser cutting firm, on a 2.87 acres parcel on Lot 3, Block 1, North Star Industrial Park 2nd Addition, and WHEREAS, under Section 3.3, Construction Plans, "the Authority shall • approve the Construction Plans if it determines that they conform to the applicable provisions of this Agreement; provided, however, that any such approval of the Construction Plans pursuant to this Section 3.3 shall constitute approval for the purposes of this Agreement only and shall not be deemed to constitute approval or waiver by the Authority with respect to any building, zoning or other ordinance or regulation, and shall not be deemed to be sufficient plans to serve as the basis for the issuance of a building permit if the Construction Plan are not as detailed or complete as the plan otherwise required for the issuance of a building permit. Such Construction Plans must be rejected in writing by the Authority within 10 working days of submission or shall be deemed to have been approved by the Authority.", and WHEREAS, the Developer submitted Construction Plans to the City of Mounds View Building and Engineering Department on August 31, 1995, and WHEREAS, the Authority has reviewed the.Construction Plans for the Project, and • RESOLUTION NO. 95-EDA-31 • PAGE TWO OF TWO WHEREAS, the Construction Plans conform to the applicable provisions of the Development Assistance Agreement by and between the Authority and the Developer. . NOW THEREFORE BE IT RESOLVED, that the Authority approves the Construction Plans for the Midwest I.V. Project. Project. Mr. Jarson has reviewed the architectural plans submitted but is waiting to review the structural plans to complete his approval. Structural plans certified by a structural engineer. 2 . Affidavit from the structural neer eng iindicatingthe roof is • designed for water accumulation in accordance with UBC section 1605 . 6 . 3 . Special structural testing and inspection schedule as per UBC section 1701 . 1111
