A. MVHRP -Proposal to Purchase 6991 Pleasant View Drive.
Director Jopke gave his report as follows:
At the EDA meeting on April 13, 1998, the Commission approved the appraisal and negotiation
for purchase of 6991 Pleasant View Drive for participation in the Housing Replacement
Program. The City acquired appraisal on the property was in the amount of$56,000. Joe
Witzman, property owner, had received the Ramsey Councty assessed value of the home and
property at$60,500. Mr. Witzman wishes to sell his property at a minimum of the taxed value
on the property.
Stigney questioned the appraisal methods and suggested that the City revise its policies and come
up with a more consistent way of getting properties appraised.
• Koopmeiners asked Attorney Long if Ramsey County's appraisal could be challenged.

Attorney Long suggested that the process is a negotiated process. If the appraisal is slightly less
than the asking price is you can ask yourself, "Do you want to buy it, or is it worth paying the
extra money?" The appraisal process is in place to look out for the best interest of the citizen's
money, he added.
MOTION/SECOND: Stigney/Koopmeiners to approve EDA resolution No. 98-EDA-93,
authorizing the purchase of property located at 6991 Pleasant View Drive for the Housing
Replacement Program.

Item Title/Subject: Request for Extension - 8265 Spring Lake Road

SUMMARY
On January 30, 1998,the EDA sold the property located at 8265 Spring Lake Road to Preferred Builders, Inc. for
the redevelopment of a 1900 square foot single family home through the Housing Replacement Program. At the
time of the sale, the developer and the City entered into a Purchase and Redevelopment Agreement which requires
Preferred Builders to complete the construction of the home by July 5, 1998, subject to Unavoidable Delays. The
development agreement refers to Unavoidable Delays as:
"...delays beyond the reasonable control of the party seeking to be excused as a result thereof which are the
• direct result of strikes, other labor troubles, prolonged adverse weather or acts of God,fire or other casualty
to the Minimum Improvements, litigation commenced by third parties which,by injunction or other similar
judicial action, directly results in delays. or acts of any federal, state or local governmental unit(other than
the City or Authority in exercising their rights under this Agreement)which directly result in delays..."
At no fault to the developer,the City created a delay due to an error in the Purchase and Redevelopment Agreement
pertaining to the vacation of easements which required corrections on behalf of the City. In addition,the developer
has indicated that the number of destructive storms in recent months have set back construction schedules as well
as available contractors, contributing to the delayed in efforts to complete construction of the home. At this point,
the developer has received a building permit for the construction of the home and has prepared the subject site for
building. The developer has also indicated that construction will begin on or before July 15, 1998,and will be
completed within 90 days.
RECOMMENDATION
Approve EDA Resolution No. 98-EDA-94 authorizing a 90 day extension to the completion date July 5, 1998, as
indicated in the Purchase and Redevelopment Agreement, for the construction of a single family home by Preferred
Builders, Inc. for property located at 8265 Spring Lake Road.

RESOLUTION APPROVING AN EXTENSION TO THE REQUIRED COMPLETION DATE FOR
THE REQUIRED CONSTRUCTION OF A SINGLE FAMILY HOME AT 8265 SPRING LAKE
ROAD BY PREFERRED BUILDERS,INC.
WHEREAS, On January 30, 1998,the EDA sold the property located at 8265 Spring Lake Road
through the Housing Replacement Program to Preferred Builders,Inc. subject to the construction of a 1900
square foot single family home; and
WHEREAS,the Purchase and Redevelopment Agreement between the EDA and Preferred Builders,
Inc. required the construction of a single family home to be completed by July 5, 1998, subject to Unavoidable
Delays including adverse weather and delays by the local government authority; and
WHEREAS,the City of Mounds View created a delay to the construction of the home due to an error
in the Purchase and Redevelopment Agreement pertaining to the vacation of easements which required
corrections on behalf of the city; and
WHEREAS,the developer has indicated that in recent months the number of destructive storms have
set back construction schedules for the builder as well as other contractors which has delayed efforts to
complete construction of the home; and
• WHEREAS, Preferred Builders, Inc. has obtained a building permit and has prepared the subject site
for construction and has indicated construction will begin on or before July 15, 1998, and will be completed

NOW THEREFORE,BE IT RESOLVED,that the Economic Development Authority of the City of
Mounds View hereby recommends an extension to the completion date for the construction of a single family
home located at 8265 Spring Lake Road as required by the Purchase and Redevelopment Agreement between
the Mounds View Economic Development Authority and Preferred Builders, Inc.

Item Title/Subject: Vacancies on the Economic Development Commission.

BACKGROUND:
At the July 6, 1998 work session staff discussed the vacancies which exist on the Planning
Commission and the Economic Development Commission. In addition, there was some question
about the status of Dan Nelson on the EDC. Staff has talked to Mr. Nelson and he has indicated
that he is resigning from the EDC. Therefore there are now two vacancies on the EDC instead of
one. As previously indicated, staff advertised these vacancies in the newspaper and on the city's
web site. Staff has received one additional application since the work session. Wendy Marty,
• Greg Johnson, and Richard Oman listed the Economic Development Commission as their first
choice with the Planning Commission being their second choice. Sean Walther listed the
Planning Commission as his first choice with the EDC being his second choice. Copies of their
applications are attached.
The City code indicates that appointments to the EDC are to be made by the Authority President
with approval of the Authority Board of Commissioners.
REQUESTED ACTION
It is recommended that the City Council discuss the applicants and determine the process to
follow to fill the vacancies. A copy of the form of a resolution which can be used to make the
appointment is attached for your use.

408.01: ESTABLISHMENT: The Economic Development Commission is hereby .
established. The Economic Development Commission is referred to herein as the "Commission".
(Ord. 542, 6-27-94)
408.02: PURPOSE: The Commission shall serve as an advisory commission to the
Economic Development Authority, hereinafter the "Authority", on matters relating to fostering
a positive economic climate, encouraging economic development and enhancing the tax base of
the City. The Commission shall also make recommendations to the Authority regarding retention
and expansion of existing businesses, attraction of desirable new businesses, redevelopment and
rehabilitation opportunities, and other appropriate economic development strategies. (Ord. 542,
6-27-94)
408.03: COMPOSITION:
Subd. 1. Appointed Members, Qualification of Members, Terms of Office: The Commission
shall be composed of seven (7) equal voting members, including three (3) business
representatives and four (4) residents, appointed by the Authority President with the
approval of the Authority Board of Commissioners. Members shall have diverse
qualifications with practical experience consisting of, not limited to, but including one of
the following areas: economics, finance, accounting, real estate, social services and •
marketing. For the purpose of initiating the Commission, the terms of all members shall

expire December 31, 1994. Beginning January 1995, three (3) members shall serve a one
year term, two (2) members shall serve two (2) year terms and (2) members shall serve
three(3)year terms. Thereafter, members shall serve three (3) year staggered terms, with
terms expiring December 31 of each year. At least two (2) of these terms, but not more
than three (3) terms shall expire each year. The appointees shall be duly sworn and take
office at the first regular meeting of the Commission in the month of January each year.
Both original and successive appointees shall hold their offices until their successors are
appointed and qualified. (Ord. 546, 7-25-94)
Subd. 2. Designated Members: In addition to appointed membership, one nonvoting member
shall be designated by the Authority to serve as liaison to the Commission. The terms of
the appointment shall ordinarily be for one year, except that they will terminate with the
office from which the nonvoting appointment is derived. (Ord. 542, 6-27-94)
408.04: CONFLICT OF INTEREST: No person shall be appointed with private or
personal interest likely to conflict with the general public interest. If any person appointed shall
find that their private or personal interests are involved in any matter coming before the
Commission, they shall disqualify themselves from taking part in action on the matter;
alteratively, they may be disqualified by a two-thirds (2/3) majority vote of the Commissioners

408.05: COMPENSATION: Members of the Commission shall serve without
compensation. (Ord. 542, 6-27-94)
408.06 VACANCIES:
Subd. 1. Termination of Appointment: Any Commission member designing to terminate their
appointment to the Commissioner before the expiration of their term shall give written
notification to the Commission chairperson of their intentions. It should be the duty of
the chairperson of the Commission to notify the Authority promptly of any vacancies.
The Authority president, with approval of a majority of the Authority Board of
Commissioners,shall appoint a new member from applications received for the unfulfilled
portion of the term.
Subd. 2. Removal from Office: Any member of the Commission may be removed from office
for just cause and on written charges by at least four-fifths (4/5) of the entire Authority.
Such member may be entitled to a public hearing before such a vote is taken. An
• appointed member may also be removed by the Authority for nonattendance at
Commission meetings if a Commissioner is absent from five (5) regularly scheduled
meetings per year or from three (3) consecutive meetings, without the consent of the

opportunity to learn more about my profession from the view point of decision and policy

RESOLUTION APPOINTING ECONOMIC DEVELOPMENT COMMISSION MEMBERS TO FILL
VACANCIES
WHEREAS, the Economic Development Commission acts as an advisory commission to the Economic Development
Authority on matters that relate to fostering a positive economic climate,encouraging economic development,and enhancing
the tax base of the City; and

WHEREAS,the Economic Development Commission is composed of three business representatives and four
residents; and
WHEREAS, Chapter 408.06,subdivision I of the Mounds View Code,entitled Economic Development Commission,
Termination of Appointment,requires that the"Authority President,with approval of a majority of the Authority Board of
Commissioners,shall appoint a new member from applications received for the unfulfilled portion of a term that has been
terminated"; and
• WHEREAS,resident Steven Larson has resigned prior to the expiration of a term that would otherwise end on

Commission.I have enjoyed my tenure on this commission,and will remember fondly the times and
acquaintances that I have made.
Sadly,due to both personal and professional commitments,I cannot devote the time necessary to do the job
well.
