1. CALL MEETING TO ORDER
The Mounds View City Council was called to order by Mayor McCarty at 7:00 p.m., on July 27,
1998.
2. ROLL CALL
MEMBERS PRESENT: Mayor McCarty, Council Members Gunn, Quick, Koopmeiners, and
Stigney.
ALSO PRESENT: Chuck Whiting Clerk Administrator, Carl Schmidt, Assistant to the City
Administrator; Rick Jopke, Community Development Director; Jim Ericson, Planning Associate;
Bob Long, City Attorney; and Dave Hix, Recording Secretary.
Mayor McCarty thanked the City staff and citizens of Mounds View for their support during his
time of illness and continued recovery. He told the Council and viewing audience that because of
his recent stroke and its effect on his health, he would not be running for another term as Mayor
of the City of Mounds View.
3. APPROVAL OF MINUTES
A. July 13, 1998 City Council Meeting Minutes
MOTION/SECOND: Koopmeiners/Gunn to approve the minutes as corrected.
Stigney offered the following correction: On Page 6, at the Vote on Resolution 5251, Concerning
Sufficiency of Corrected Petition for Initiative Regarding the Project Commonly Known as the
Theater Project, Stigney was the Nay vote.
Stigney corrected the spelling of Mike Ulrich.
Mayor McCarty offered the following correction: On Page 2, Item C, Setting the Public Hearing
for July 27, 1998, instead of July 17, 1998.

6. RESIDENTS' REQUESTS AND COMMENTS FROM THE FLOOR
Ralph Durand, owner of the new Mounds View Holiday Station Store, invited the City staff to
an open house event for the new facility to be held August 4, 1998, from 4:30 - 7:00 p.m. He
added there would be a ribbon cutting ceremony at 6:30 that he hoped the City Council would
attend, schedules permitting.
Alan Knowlton, 2912 Highway 10 N.E., told the Council he is a private pilot working out of the
Anoka County Airport. He expressed his concerns in regards to the complaints that have been
filed by City residents about the air traffic noise at the airport. Mr. Knowlton stated he wanted to
help the City organize a formal complaint process so that the proper people received the opinions
that were being expressed. He told the Council the process that the citizens are using now, that
of going directly to the control tower, are falling on deaf ears. Mr. Knowlton gave the Council
the name of Edward G. McKinely, Tower Manager, as the appropriate person to contact when
making complaints in regards to the Anoka Airport facility.
Mayor McCarty invited Mr. Knowlton to sit through the Council meeting and listen to the City
Attorney's Report which would be focusing on the Anoka County Airport.
7. COUNCIL BUSINESS
A. Public Hearing and Second Reading of Ordinance No. 621, Granting a Franchise to
MediaOne to construct, operate and maintain a cable communications system in the City
of Mounds View, and setting forth the conditions accompanying the granting of such a
franchise.

1. Consider Motion Adopting
Whiting gave his report as follows:
The City Council had reviewed the proposal at its last work session and is recommending
approval of the franchise agreement with MediaOne. There have been no public comments
regarding the ordinance.
Mayor McCarty closed the Council meeting and opened the public hearing.
No comments were considered. The public hearing was closed and the Council meeting was
reopened.
MOTION/SECOND: Quick/Koopmeiner to approve Ordinance No. 621 and waive the second
reading.

B. Public Hearing and Second Reading of ordinance No. 620, and Ordinance Amending
Various Chapters of the Mounds view Municipal Code Relating to Driveways, Parking
Areas, and Accessory Buildings.
1. Consider Motion Adopting
Mayor McCarty closed the Council meeting and opened the public hearing.
Ericson gave his report as follows:
Staff had drafted Ordinance No. 620, an ordinance that puts in place proportional guidelines and
permits larger garages based on those guidelines. The ordinance also addressed driveway
surfaces, requiring permanent improved surfaces such as concrete, asphalt or brick for all new
construction, but does not require improved driveways where currently there is none unless a

permit is pulled for a new garage or garage expansion. Since its first reading the ordinance has
been changed as follows:
1. Page 4, Subd. 2, Section 3, cross out the word "improved with a permanent surfacing
material" and replace that text with "construct with a permanent improved surface". This
change will alleviate the ambiguity of the term "permanent surfacing material."
2. Page 2, Subd. 3, c (1), cross out the words "to mean asphalt , concrete, or brick."
Ericson briefly reviewed the ordinance language as follows for the Council and the viewing
public:
1. Any new or reconstructed driveway shall be improved with a permanent surface; concrete,
brick, or asphalt. Gravel or dirt driveways will not be allowed.
2. No building permit would be issued for the construction of a dwelling garage, garage
expansion unless the driveway surfacing for the project is improved.
3. The square footage of the garage shall not exceed the foundation area of the house
(except by conditional use permit.)
4. The combined square footage for accessory buildings in the rear yard would be reduced
from 25 percent to 20 percent.
5. The maximum garage area without a conditional use permit has been increased from 864
square feet to 952 square feet.
6. The combined square footage for all accessory buildings on one lot shall not exceed 1400
square feet.
7. A shed is allowable even if the garage does exceed 1000 square feet.
8. As many garage stalls as there are units are now allowable in the R-3 and R-4 districts.
9. Commercial and industrial parking stall dimensions would be reduced from 9'x20' to
9'x18'.
10. Gravel driveways have been eliminated from the City Code. All references to temporary
surfaces will be removed to eliminate confusion over the intent of what a temporary
surface is.

11. R-1 and R-2 districts can have 300 square feet of gravel parking area for RV storage.
12. Proof of parking will be allowed as a conditional use with the meeting of the City's criteria
for that proof of parking.
13. A distinction between temporary and permanent surfaces would be eliminated with regard
to setback of a driveway to the side property line.
Mayor McCarty questioned Section 2: Section 902.05, Subd 1, Item b. Drainage Provisions:
The driveway or parking area shall be constructed so as to provide drainage from the garage to
the street unless a variance is granted by the Building Inspector. Mayor McCarty stated, "it was
his own personal experience that if surface water drains through a persons back yard, and is
filtered through a natural assimilation why the City would encourage that rather than require that
water be drained through the street and eventually through the storm sewer system."
Attorney Long stated issues such as this fall under the City's Building Code and not the City's
Zoning Code, so the Building Inspector and not the Planning Commission would have the charge
of determining what should be done in issues such as this.
McCarty suggested that the Council pass Ordinance No. 620 in its present form but he asked staff
to "reassess and polish" Ordinance No. 620 with future amendments that would make the
Ordinance apply equally to everybody.
Mayor McCarty told Ericson the reference to Section 1104, Subd. 4(1a) is not in the City's code
book. He asked Ericson to research the issue and bring it to resolution.
Mayor McCarty asked staff to reconsider the maximum size of allowable accessory buildings;
currently stated as 216 square feet. This figure amounts to 2 percent of the allowable minimum
lot size of 11,000 square feet. He stated that the larger lots in Mounds View need a proportional
formula that would allow a percentage of the lot as an acceptable accessory building size in stead
of the 216 square foot accessory building as the maximum size.
Quick expressed his concern that the formula wouldn't work if an individual decided to have a lot
split.
Dan Coughlin, 8468 Spring Lake Road, spoke in opposition of not issuing permits until another
portion of the property is upgraded. Example: If a person lives on a lake and wants to build a
new fence, he would have to update his septic system before the fence could be built. He
suggested allowing the home owner a one-year period of time to complete the required upgrades.
This would make it financially more reasonable to achieve more expensive types of upgrades.

Ericson stated this would put the City in a position of policing residential projects to make sure
that they are being completed in the required time frame.
Stigney, referring to the City's current ordinance, stated the City currently gives a three-month
consideration, similar to the one Coughlin was suggesting.

Mayor McCarty recommended that the Planning Commission be given the opportunity to
interview the prospective candidates for the open Planning Commission seat. Upon completion of
this interview process the City council would then accept the Planning Commission's
recommendation and act to approve that recommendation. He also suggested that the Planning
Commission's number be increased from its current six members up to the allowable nine
members.
Cam Obert, Planning Commission member, stated he was encouraged by the Council's
willingness to ask for the Planning Commission's advise on choosing its own members.
MOTION/SECOND: McCarty/Stigney to recommend to the Planning Commission that they
interview the remaining candidates who want to serve on the Planning Commission, or any other
candidates that may come forward and make a recommendation to the City Council to the number
of nine.
VOTE: Ayes - 5 Nays - 0 Motion carried
Mayor McCarty asked the staff to pay special attention to the year 2000 computer glitch and
make arrangements to have any problems that the City might encounter taken care of as early as
possible. He expressed concern that waiting too long to resolve these issues might leave the City
in a position of not being able to find the technical help would need in the year 1999.
Whiting told the Council that there will be components of the City's budget that will reflect the
fact that the City is taking measures to deal with the year 2000 computer glitch.

Whiting reminded the Council that the Chamber Gala will be held Thursday evening, July 30.
Whiting requested that, in his absence because of vacation time, the City Council by motion
approve Mike Ulrich as the Acting City Clerk Administrator. The dates for his vacation were
stated as being August 5-25, 1998. He stated his selection was based on seniority and
responsibility and familiarity with the City's organization.
MOTION/SECOND: Quick/Koopmeiners to approve the temporary appointment of Mike Ulrich
as Acting City Administrator from August 5, 1998 through August 25, 1998.
VOTE: Ayes - 5 Nays - 0 Motion carried
City Attorney Long gave his report on the Anoka County Airport as follows:
Mounds View had met with the Transportation Committee of the Metropolitan Council in regards
to the ongoing Court Order concerning the Anoka County Airport.
Met Council has decided not to voluntary participate in a Declaratory Judgement as requested by
Mounds View's City Attorney. Reason given was that Met Council is not a party to the
Stipulation signed in 1986. The City of Mounds View asked the Met Council to delay their vote
approving the Anoka County Airport Project to allow the City of Mounds View to bring in a
Declaratory Judgment against the Metropolitan Airport Commission (MAC) to get clarification
on the Court Order.
The Transportation Committee has an August 13, 1998 deadline in which they have to act on the
Anoka Airport Project or it passes by default. They have indicated that they would like to stay
out of litigation and accommodate Mounds View's request. They have agreed to recommend
approval of MAC's plan subject to a request for a waiver from MAC to extend the timeline. If
MAC agrees to an extension in time, and Mounds View proceeds with the declaratory judgment
against MAC, it is hoped that on August 13, 1998, MAC would not take action but would defer
to the timeline of the Court.
MOTION/SECOND: McCarty/Quick to direct the City Attorney to proceed with the
Declaratory Judgement Action regarding the Court Order and Stipulation dated July 1986,
regarding the 1983 Metropolitan Airports Commission Comprehensive Plan Update for the
Anoka County Airport.
Whiting asked the Council to give the City Attorney some idea of how much legal cost the City
would be willing to incur.

Mayor McCarty stated the City cannot back off and get "weak kneed" at this point or MAC
would run right over the top of the City.
Long stated this legal process would not include deposition costs and expert testimony costs. So
in that regard, this process would be less expensive.
Stigney suggested going to the surrounding communities that also would be affected by any
decision and ask them to help fund the litigation that is in process.
Long agreed that this would be a good idea and suggested that the City pursue this course of
action.
Quick asked Long what would happen if the City lost the case.
Long stated that this is just the first round of the fight. The next step, about a two-year process,
would be for MAC to adopt the plan and continue on with the developmental process. There will
be other opportunities both legislatively and legally, if further action is desired.

Long told the Council that he would be on vacation for the August 10th meeting but there would
be a replacement available from the law firm during his absence.

The applicants, Leonard Medrud and Arthur Jordan, are currently in the process of
adding a 22'x 22'garage and 7' x 22' mudroom to their existing home located at 2085
Oakwood Drive. Prior to the new garage addition, the applicants used the existing 14' x
22' single-car-detached garage, which is located in the backyard of the residence. The
applicants were requesting a Conditional Use Permit to convert the existing 14'x 22'foot
garage into a accessory building. The existing structure was inspected and seemed to be
in sound condition. The applicants have indicated the facility will be used for storage
purposes.
No letters or phone calls had been received in opposition to the project.
The location of the garage/shed behind the home will hide it from general public view.
Because the building is being left in its current location there will be no change in its view
from the adjacent properties.
Staff recommended approving Planning Commission Resolution No. 540-98,
recommending to the City Council approval of a Conditional Use Permit for Leonard
Medrud and Arthur Jordan, allowing a 280 square-foot oversized shed at 2085 Oakwood
Drive, with stipulations as follows:
1. The Conditional Use Permit shall be recorded with Ramsey County within 60 days
of City Council approval, and a receipt of such recording shall be provided to the
City of Mounds view.
2. The shed shall be kept in good repair and maintained into the future so as to
provide a uniform and consistent building appearance with the existing house.
3. The shed shall not be used for living space or other uses not allowed by the district
in which it is located or by the Zoning Code. Should the use change for which the
permit was granted, the conditional use permit shall become null and void.

4. No other sheds or accessory buildings, other than the garage currently under
construction, shall be allowed on this lot.
5. There shall be no motor vehicle access to this shed, nor shall any motor vehicle be
stored within said structure.

Applicant: Realife Cooperative of Mounds View Inc.
Consideration of Resolution Nos. 552-98 and 553-98, resolutions recommending approval to the
City Council of an amendment to the Silverview Estates PUD and a development review for the
revised senior residential component of the PUD.
The applicant, Realife Cooperative of Mounds View Inc., was present.
Associate Ericson gave his presentation as follows:
Realife of Mounds View Inc., was proposing to substitute a revised senior housing
component of the Silverview Estates PUD which was initially approved on December 8,
1997. The PUD will also be occupied by the Holiday Station Store and office buildings
located on the corner of Silver Lake Road and Highway 10. The proposed senior housing
development would be a 77-unit facility instead of the originally planned 82-unit senior
housing building. This change, if approved, would require an amendment to the PUD for
the site.
Realife of Mounds View Inc., develops cooperative housing. According to the applicant
this type of development offers seniors 62 and over an alternative type of home ownership
that allows them more freedom and less responsibility than conventional home ownership.
The residents own and operate the development through a nonprofit cooperative
corporation.
The proposed building is of a three-story-serpentine design over a one-story-precast-
concrete garage. All units will have decks that overhang the building by six feet. The
garage area will have one-way traffic with angled parking stalls to foster safe vehicular

movement. The City Engineer and Rice Creek Watershed have given the project their
approval. The PUD requires a minimum of 89 parking stalls. The plan as proposed shows
123 parking stalls: 25 stalls in the front of the building (four being handicap accessible)
and 78 parking stalls inside the building. The exterior parking significantly encroaches
into the required front setback of the property. The approved setback is 30 feet. The
plans show the parking lot at 10 feet. The buildingitself encroaches four feet into the
approved 27-foot setback, which has necessitated the PUD amendment. Item 5 of the
PUD document would need to be revised to show a 23-foot building setback. No changes
were proposed or needed in regards to utilities. The Fire Marshal has reviewed the
revised plans and has indicated that a fire hydrant will need to be installed on the east side
of Silver Lake Road. The landscape plan is acceptable with one exception: City Forester
Wriskey has recommended substituting Red Splendor Crab trees for the Radiant Crabs,
which are susceptible to disease in the summer months. The only change in regards to
building access has been the elimination of access by an internal private driveway. The
lighting plan, as submitted, is in compliance with City Code. The light stand height is 15
feet and the foot candles fall within the required range.
A stipulation will need to be added to the site plan resolution, No. 553-98, requiring the
addition of the recommended fire hydrant.
The Commission was charged with deciding if the proposed setbacks were acceptable.
Specifically to review if more spacing between the property lines and the parking lot was
needed.
Staff is recommending approval of Resolution Nos. 552-98 and 553-98.
Dick Hanson, Realife of Mounds View Inc., gave his presentation as follows:
Realife Inc., has been developing senior cooperative housing since 1978. They currently
have developments in Edina, Burnsville, Eden Prairie, and Brooklyn Park. All buildings
are operated under the same cooperative ownership approach. A senior, 62 and over,
buys a share of the cooperative for a predetermined amount of money. The share entitles
the owner apartment rental privileges, property tax benefits, and mortgage interest
benefits just as they would in conventional home ownership. 'A management consultant,
usually Realife Inc., is hired to help run the day-to-day operations of the facility.
The rent from the apartments goes to cover the building mortgage, maintenance funds,
and property tax fund. A board of directors is established from within the residents to
oversee the management of the building. Only the board of directors can authorize an
increase in the rental fees. Hanson stated, "Historically, rent increases have been held to a

minimum because the building owners are the renters."
The loan for the building is HUD guaranteed. Before HUD will underwrite the project,
the development must be 90 percent presold.
Of the proposed development's 77 units, 36 two-bedroom apartments will have a share
cost from $17,500 to $22,000. The monthly rents on these 36 units will range from $550
a month to $580 a month. The rent covers all expenses except telephone, electricity and
cable. There is a cooperative owned mini-bus to help meet the transportation needs of the
residents. There are three 1550 square foot apartments that will rent for $995 with a share
cost of$36,000. No rental rate or share fee was given for the remaining 38 one-bedroom
apartments.
There are four laundry rooms per floor, each containing two washers and two dryers. The
use of the laundry rooms is included as part of the rental fee. Each floor has a storage
room. The common space available throughout the building totals more that 25,000
square feet. These common spaces include libraries, dining room (food service at the
option of the residents), game rooms, media rooms, craft rooms, and a shop in the
basement.
Commissioner Brasaemle expressed concerns about the building and parking lot
encroaching on the required setbacks.
Mr. Hanson stated that because the parking, as shown, had more than the required
number of parking stalls, some of these parking stalls could be removed to bring the
building in compliance with the setback regulations.
Associate Ericson recommended that Resolution No. 552-98 be revised by deleting the
reference to a 10 foot parking lot setback and recommended that Resolution No. 553-98
be revised to require the applicant to update the site plans to show a 30-foot parking lot
setback to show a fire hydrant on the east side of Silver Lake Road and to show the
NURP pond not encroaching into the wetland area.

3025 County Road H
Applicant: Duane and Nancy Peterson
Consideration of Resolution No. 549-98, a resolution recommending approval of a minor
subdivision to the City Council.
,) The applicant, Duane Peterson was present.
Associate Ericson gave his report as follows:
Duane and Nancy Peterson were requesting approval of a minor subdivision to create two
lots from their property located at 3025 County Road H. A copy of the required
surveyor's certificate showing the proposed lot split was presented. The property
currently has 100 feet of frontage on Pleasant View Drive and 225 feet along County
Road H. The applicant was proposing to split off the west 125 feet of the lot to create a
12,500 square foot corner lot. The remaining 100 foot by 100 foot lot, 10,000 square
feet, would be 1,000 square feet too small to be a legal lot by Mounds View standards. In
order to rectify this situation, the applicant had arranged to purchase a 10 foot wide by
100 foot long strip of property from the neighbor to the east, Mr. Steve Borden, residing
at 3009 County Road H. A simple deeded land transfer would be executed between Mr.
Borden and Mr. Peterson to accomplish the land acquisition.
The proposed legal descriptions and certificate of survey had been reviewed by the City's
Engineering Technician. The City Attorney has been asked to draft an easement
document to convey the drainage and utility easements.
It was stated that a $825 park dedication fee, 5 percent of the value of the land not
including the land under the existing home, would need to be collected as a condition of
approval. There was also an unpaid water utility bill that Ericson requested the applicant

and the City Clerk "take care of" as a condition of approval.
Staff was recommending approval of Resolution 549-98, a resolution recommending to
the City Council approval of this minor subdivision subject to stipulations.
Ralph Gale Jr., counsel for Mr. Peterson, stated he was aware of the conditions for
approval. He told the Commission that the conditions would be met and a purchase
agreement would be submitted shortly. Parcel A will be put on the market with the hopes
that it will be developed as a single-family home. Parcel B, which currently has a home on
it, will remain as is.
Motion/Second: Obert/Stevenson to approve Resolution 549-98, a resolution recommending to
the City Council approval of this minor subdivision subject to stipulations, Planning Case No.
527-98, as amended.

• Associate Ericson told the Commission the City is waiting to receive a signed
development agreement from the property owner. As soon as this document is received
permits for construction will be issued.
C. City Filing Policy
Associate Ericson told the Commission the Marty family had informed the City that
information and petitions were missing from the City's files on the proposed Harstad
development. The Martys have requested that the City improve its filing system to better
serve the interests of its residents.

At the August 3, 1998 work session the City Attorney discussed with the City Council a request
for an amendment to the developers agreement between the City and MSP Real Estate, Inc. and
Mounds View Family Housing LLC. The proposed amendment is to substitute Mounds View
Family Housing Limited Partnership as the developer in the place of MSP Real Estate, Inc. and
Mounds View Family Housing LLC. A copy of the amendment drafted by the City Attorney's
office is attached for your consideration.
The current agreement in Section 3.05 states that"the Developer may not assign any of its
obligations under this Agreement without prior written consent of the City."
RECOMMENDATION: Staff recommends that the City Council approve Resolution No. 5258
approving the attached First Amendment to the Developers Agreement between the City and
MSP Real Estate, Inc. and Mounds View Family Housing LLC and authorize the Mayor and
Acting City Administrator to execute the document on behalf of the City.

As a result of an analysis of the current organizational chart, and to better reflect the current
operating structure of City Hall, a new organizational chart has been constructed. The following
changes are reflected in the chart:
1. Finance has relocated to the former Park and Recreation spot. As Cable is located in that
space as well,the Cable Tech position has been moved from under Park and Rec to under the
Finance department.
2. The new positions of the Economic Development Coordinator and the Assistant to the City
Administrator are now reflected on the chart.
3. A few positions have been re-titled to better reflect the duties they are currently performing:
a. The title "Department Secretary"has been updated to "Administrative Assistant."
The title of Secretary is outdated and does not reflect the significant job duties that the
individuals in these positions perform.
b. The title of"Payroll and Utility Billing Clerk"has been changed to "Personnel Tech."
This position was formerly under the Finance Department, however is now under the supervision
of Administration. In light of the volume of personnel related work that is performed in this
position, the title change is appropriate, as well as the switch to Administration.
c. The former Administrative Secretary position has been renamed Office
Communications Coordinator. When former employees left and were not replaced,many of the
responsibilities of those spots fell on the Administrative Secretary. This position deals with the
Employee committees, The Mounds View Matters, This Is It, Cable TV, advertisements,
publication and notification or ordinances and resolutions, and telecommunications. The new
title more accurately reflects the job that is being performed.
The proposed organizational chart has been attached for your review.
Staff Recommendation: Approve Resolution 5257 establishing the new Organizational chart for
