Mayor Linke explained that this portion of the meeting was designated for anyone who wished to speak to the Council on items that were not on the Agenda. 411 Russ Warren, 8044 Greenwood Drive,Chairman of the Charter Commission, explained that the Charter Commission met on October 3, 1996 and there were two actions taken which they wished to bring to the Page 4 October 14, 1996110 Mounds View City Council attention of the City Council. He noted that the Council's action on September 23, 1996 in accepting Council member Hankner's resignation by a simple motion appears non-conforming to Charter Section 2.05,MN State Law 410.21 and Charter Section 4.05. He further stated that the Charter Commission respectfully suggests that Council member Hankner resubmit her resignation effective by November 4, 1996 to insure compliance with the Charter requirements should it remain her desire to avoid a Special Election. The Charter Commission also requested that the City Council not act on any Charter changes currently before them. Mr.Bob Long,City Attorney, explained that the Council was unaware of Ms.Hankner's resignation until the September 23rd meeting, therefore a Resolution had not be prepared for approval at the meeting. What the Council did was act by a motion due to the absence of a written resolution with the intention of approving the Resolution at the next meeting. He explained that the City has followed the Charter requirements and that under Section 2.05 of the Charter, one of the conditions in which the City Council can acknowledge a vacancy that is deemed to exist is when a written resignation is before them. A written letter was submitted by Ms.Hankner at the September 23rd meeting. In regard to resignations which become effective at a future date, the Charter is silent, and therefore the City must refer to State Law. Ruth White,2917 County Road I,noted a correction of Charter Commission Resolution 96-1. The ninth paragraph should be changed from"City Council"to "City Charter". 4111 Alice Fritz, 8072 Long Lake Road, stated as an election judge she feels the way the Ms.Hankner's Council seat will be filled is unfair to people who are now running for office and those who may have run if they had been aware of the other position available. She feels it is unfair to the voters because the ballots will not disclose that they will be voting for three. She would like the Council to reconsider having a special election. David Jahnke,8428 Eastwood Road, asked if the ballots will be fixed so that voters will know that they are voting for three. Mayor Linke noted that the ballots will not be fixed. Attorney Long explained that the State Law requires that the City turn in the names of the candidates to the County Auditor within 45 days of the election. At the time they were submitted, there were only two council seats open. The Charter also states that the City cannot file less than 56 days before the election. Therefore, the seats will be filled by the two receiving the most votes, but a third name is not being listed on the ballot because they have already be turned in to the County. Mayor Linke explained that the voters will be electing the two four-year term seats. Voters will be made aware that even though they are only voting for two, three people will be elected. The third highest vote will take over Ms.Hankner's remaining two years. Ms.Hankner explained that in a general election, there will be a larger number of people voting that the city will get in a special election. The city is following the State Law and the Charter Requirement and the City is fulfilling their responsibility of abiding by those guidelines. • It was noted that voters will be told that they can only vote for two. If they vote for three, the ballot will be 411 spoiled. Page 5 dllOctober 14, 1996 Mounds View City Council Mr.Jahnke also asked if the Bel Rae would be a self-supporting building and if the city knew how much money would need to go into the building. A discussion followed. Mayor Linke gave a brief summary of what types of uses the building could house. Until a decision is made as to what exactly the building will be used for,it is difficult to know. At this time,he does not anticipate tax dollars going in to support the building. Mr.Whiting noted that an Information Meeting would be held in regard to the Bel Rae on Monday, October 21, 1996 at 6:00 p.m. Residents are urged to attend to get an update on the status of the project and also to provide input. Duane McCarty, 8060 Long Lake Road, stated he feels there is nothing in the Charter that would have prevented the City Council from stating"Vote for Three"on the ballot. Mr.Long stated he spoke with Ms.Pelzer of Ramsey Council Election Bureau and there were not filings open for the third seat and the city had already certified the names of the candidates so the ballot could not be printed as "Vote for Three"when there were not three offices officially listed on the ballot. Therefore, it likely would have created more confusion to have listed the ballot that way. PUBLIC HEARINGS: 0 Public Hearing in Consideration of Ordinance 591 Relating to Licensing Amending Title 500, Chapter 502 and 503,Sections 502.03,502.06,502.07,503.03,503.06 and 503.07 by Adding New Subdivisions to the Mounds View Municipal Code. Mayor Linke opened the Public Hearing at 7:43 p.m. Mr.Long noted that this Ordinance gives the procedure set up and the authority to allow for temporary intoxicating and non-intoxicating liquor licenses for certain events held on City public property. The Insurance provider for the city is recommending different dollar amounts than what staff originally proposed for licensing requirements and therefore, the Council may wish to amend the ordinance prior to its adoption to reflect those changes. Changes would be necessary in Sections 502.07,Subd. 1(E)and also in 503.07,Subd. 1(C). Mr.Duane McCarty,8060 Long Lake Road, asked what impact this Ordinance could have on other city owned property such as parks, etc. Mr.Long noted that each event would need a temporary license so the city would have the ability to deny the request. Ms.Hankner stated this was a concern she raised earlier and she would feel more comfortable if the temporary liquor licenses were restricted to just the Bel Rae facility and the golf course. Mayor Linke closed the Public Hearing at 7:56 p.m. IICOUNCIL BUSINESS: Page 6 October 14, 1996 Mounds View City Council A. Consideration of Granting a Limited Use Agreement to Mr.Benjamin T.Doll to Allow a Concrete Driveway in a Portion of the Unimproved Right-of-Way for Greenwood Drive East of 2601 Sherwood Road. Mr. Whiting noted that this agreement is meant to accommodate Mr.Doll who inadvertently built part of his driveway in the public right-of-way. It was noted that Mr.Doll will be responsible for any maintenance or repair of the driveway and that he will pay for the removal of the driveway upon the city's termination of the agreement. MOTION/SECOND: Blanchard/Linke to grant the limited use agreement to Mr.Benjamin T.Doll to allow a concrete driveway in a portion of the unimproved right-of-way for Greenwood Drive east of 2601 Sherwood Road. VOTE: 4 ayes 0 nays Motion Carried D. Consideration of Resolution No. 5027 Rescinding Resolution No.4987 Establishing a Uniform Schedule of Fees and Charges. Mayor Linke explained that this revises the fee schedule for the city, incorporating the fees for Therapeutic Massage Licensing, temporary intoxicating liquor licensing, the building permit fee for telecommunications antenna and fees for usage of the Bel Rae facility. Mr.Ulrich noted that he felt the city should consider setting an hourly set up fee as some events would require more set up time than others. 1 Page 7 4110 October 14, 1996 Mounds View City Council Mr. Whiting stated he felt when the city is confronted with a use request which would require more intensive set up or clean up,they may need to reconsider the fees at that time. Comments have been made that the kitchen has been condemned and he would like to clarify this. Suggestions for changes to the kitchen have been made by the inspectors before it can be licensed. Report of Administrator: No report. Report of Staff: Mr.Ulrich noted that the Sewer Department has been doing some underground inspections of the city sewer mains and if residents receive a photo from the department they likely have root problems and he would recommend contacting the city for explanation or contact a sewer cleaning company to take care of the problem. Report of Attorney: Mr.Long stated he had attended the Airport Task Force meeting immediately preceding the Council meeting. An additional meeting has been scheduled for October 28th at 7:00 p.m. 411 to hear from the Noise Abatement Planners in regard to some of the potential restrictions that can be put on the airport by the Noise Abatement Plan that will be adopted and also the concerns about the proposed Page 8 October 14, 1996 • Mounds View City Council capital improvements that have been suggested as a part of the comprehensive update that may not be permitted by the Airport Decree. CITY COUNCIL MEETING DATE O N November 12, 1996 •A 47.'4-PartnetS'S Item Description: Senior Citizens Hardship Deferral of Special Assessments Administrator's Review/Recommendation: -No Comments to supplement this report -Comments attached. Explanation/Summary(attach supplement sheets as necessary) Summary: State Statutes allow for the deferral of special assessments for senior citizens (age 65 or older) or individuals who are totally and permanently disabled for whom it would be a hardship to make the payments on said special assessments. The City adopted the provisions of this statute via Section 202.13 of the City Code. Said Section of the City Code stated"... the City Council shall adopt a resolution establishing standards and guidelines for determining the existence of a hardship relative to any special assessment adopted under this Chapter ...". It does not appear that such a resolution has been adopted. The City has recently received one application for a deferral on the Pleasant View Drive project and we anticipate receiving another application n the Bronson Drive project. In order to act on these applications, it appears that the Council should adopt a resolution setting forth the criteria under which such an application will be evaluated. Based upon the League of Minnesota Cities Local Improvement Guide and discussions with the Cities of Fridley and New Brighton, Resolution 5043 was drafted. RECOMMENDATION: Approve Resolution 5043. Bruce Kessel, Finance Director Resolution No. 5043 110 CITY OF MOUNDS VIEW County of Ramsey State of Minnesota A resolution setting forth the terms and conditions for deferral of special assessments for senior citizens due to payments on said assessments causing a financial hardship. WHEREAS, State Statutes and the City Code Section 202.13 allow for the deferral of special assessments for anyone age 65 or older for whom it would be a financial hardship to make payments on said special assessments; and WHEREAS, City Code Section 202.13 states"... the City Council shall adopt a resolution establishing standards and guidelines for determining the existence of a hardship relative to any special assessment adopted under this Chapter..." and it does not appear that such a resolution has been adopted. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Mounds View, Minnesota that the following guidelines shall be used in determining whether a deferral of a special assessment shall be granted: 1. Ownership. The applicant must be the fee simple owner of the property or must be a contract vendee for fee simple ownership. An applicant must provide either a recorded deed or contract for deed with the application to establish a qualified ownership interest • as required herein. 2. Homestead. The property must be the applicant's principal place of domicile and classified on the City's and County's real estate tax rolls as the applicant's homestead. 3. Net income. The average annual payment for all assessments levied against the subjected property exceeds one percent of the adjusted gross income of the applicant and all other joint tenants, tenants in common or contract vendees in title to the property during the preceding year from the assessment levy. Net income determinations shall be made using federal and state income tax forms. For purposes of this paragraph, the average annual payment shall be equal to the total amount of the assessment, interest not included, divided by the number of years over which it is to be assessed. BE IT FURTHER RESOLVED, that all deferred special assessments shall be subject to and charged simple interest at the prevailing interest rate applicable at the time the assessment was originally levied. Said interest shall be payable upon termination of the deferred status. BE IT FURTHER RESOLVED, that the City Council does hereby appoint the City Administrator or his/her designee to develop an application/form for requesting a deferral and to receive, review, and make recommendations to the City Council on all applications for deferral of any special assessment. Adopted this 12th day of November, 1996. Explanation/Summary(attach supplement sheets as necessary) Summary: Two weeks ago this item was on the agenda and pulled off because the job description was not included in the Council packets. The item was again discussed during the November 4 work session and I will give a short review of this request again here. This reclassification is a result of my attempt to reorganize the administrative and finance departments and accommodate the personnel now with the City. Council will recall that Michelle Chambers was not replaced when she left, and at that point I wanted to reevaluate staffing levels and organization. My long term proposal is to combine the personnel of the two departments, name the Finance Director as the department head, not replace or promote administrative intern Dawn Weitzel upon her departure, and add some personnel responsibility to Cathy Bennett as EDA Director. This is that request. The strength of the request is to place Ms. Bennett in a backup personnel position to my own, to clarify roles and positions within the department, and when all is said and done, reduce personnel costs in this department. The weaknesses o^ rrently are in the final and practical determination of the percentage of her time that will go to this personnel fun onsibility. That determination will at some point necessitate an appropriate general d allocation to the sition, whereas now her duties are strictly TIF funded. I do not see a need to address this at this point, and can revisit the topic after she returns from her leave and we have some working time with this approach to determine the time devoted to non-TIF work. To complete the reorganization, when the administrative intern position is vacant, I will be requesting the hiring of an office secretary to assist the department with their work. I will also need to address the administrative aide position which took on new responsibilities after Michelle left. In all this still will be a reduction of one in the department's personnel. This is the context under which this request is being made. Council will note the change in title as well to Director of Economic Development in the resolution and job description. Chuck Whiting, City A ministrator RECOMMENDATION: Approval of Resolution No. 5032 • RESOLUTION NO. 5032 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA APPROVAL OF THE RECLASSIFICATION OF THE POSITION OF ECONOMIC DEVELOPMENT COORDINATOR TO DIRECTOR OF ECONOMIC DEVELOPMENT WHEREAS, Mrs. Cathy Bennett was hired as the Economic Development Coordinator for the City of Mounds View on April 4, 1994; and WHEREAS, as a result of the reorganization of the administration department; and WHEREAS, after assessing Mrs. Bennett's revised position description and current performance level, it has been determined that the best organizational structure for the City of Mounds View, can be attained by a reclassification of Mrs. Bennett's position of Economic Development Coordinator to the position of Director of Economic Development; and WHEREAS,this reclassification shall commence, effective October 4, 1996; and WHEREAS, compensation for the reclassified position shall be $3,944/mo. which equates to Step 2 of the Proposed 5 Step Compensation Plan for this position. These uses include: • Public or semi-public recreational buildings and neighborhood or community centers, public and private educational institutions limited to elementary, junior high and senior high schools and religious institutions such as III churches, chapels, temples and synagogue. Governmental and public utility buildings and structures necessary for the health, safety and general welfare of the community. _ • Day care, group nursery. • Nursing homes and similar group housing but not including hospitals, sanitariums or similar institutions. • Parking facilities for adjacent commercial...establishments. These uses differ from single family residential uses in that they have parking lots. The current setback requirement for parking lots is five feet from property lines. During the discussions on the New Apostolic Church, which was proposed on property at 3025 County Road H, it became apparent that citizens feel five feet is not sufficient to provide adequate buffering between parking lots and residences, and that having a parking lot that close to their property has a detrimental effect on the residential character of the neighborhood. Mr. Danny D. Moon, 6929 Pleasant View Drive, has requested that the Zoning Code be amended to require a minimum 15 foot setback between parking lots and property lines, when the parking lots are for churches or any commercial uses, and these uses abut residential uses. Section 1125.01, Subd. 2 allows any person owning real estate within the City to initiate a request to amend the Zoning Code. In studying this request, the Planning Commission and staff expanded the scope of the proposed amendment to include setting a minimum lot size for non-residential uses in residential districts, and to clarify other provisions in the Zoning Code related to setbacks. The Planning Commission is also recommending that the setback between parking lots for non-residential uses and residential properties be 20 feet for sites of 2.5 acres or less, and 30 feet for sites of 0 ore than 2.5 acres. These dimensions are larger than the 15 feet requested by Mr. Moon, and are based on t Mayor and City Council Planning Case No. SP-008-96 Page 2 the setbacks observed on existing church sites in Mounds View. A chart is attached showing the approximate setbacks between parking lots owned by existing churches and abutting residential properties. The requirement for 20' or 30' setbacks for parking lots would not apply to governmental or public utility buildings. The proposed ordinance would: • add a definition of"principal building" • clarify that the setbacks in the table in 1104.01 Subd. 3 pertain to principal buildings • clarify when and how front setbacks for new residences in the R-1 and R-2 districts shall be adjusted based on the setbacks of existing residences in the same block • clarify that garages, which are part of a residence and have a side setback of five feet, cannot be converted into living space between five feet and ten feet of the side lot line • create a section on setbacks for accessory buildings, and clarify setback provisions such that no accessory buildings may be located in front of a residence in the residential districts, and side setbacks from streets on corner lots shall be the same as the residence(30 feet). It also would allow accessory buildings of 400 square feet or less to be placed within ten feet of the side or rear property line in the business and industrial districts. • create a section on setbacks for parking areas and driveways: * establishes a minimum parking lot setback of 20 feet, for sites having 2.5 acres or less, and 30 feet, for sites having more than 2.5 acres, where the parking lot serves a non-residential use and abuts property in a residential district * retains existing setbacks for parking areas from front property lines in business (30')and industrial(40°) * retains existing setbacks for parking areas from side and rear property lines in business and industrial districts(5') ill • clarifies setbacks requirements from"second"front on through lots • establish a requirement that a property owner obtain an encroachment permit for driveways or parking areas in easements,if required by the City • establish a minimum lot size of one acre for non-residential uses located in residential districts, except for governmental and public utility buildings and structures necessary for the health, safety and general welfare of the community • allows existing parking areas which do not conform to the new setback requirements to be considered legal,non- conforming uses, and allows them to be resurfaced, restriped, repaired and replaced in compliance with the original setback requirements, except that if they are being reconstructed or replaced and it is possible to meet the new setback requirements with losing required parking spaces, they shall be made conforming to the new setback requirements • a number of cross-references have been added to help readers navigate the Code Many of the items listed above as clarifications put our current practices into the ordinance. Provision has • been made for existing parking lots which do not meet the new setback requirements to continue in use and to be repaired and PlitiVA)A, V/Vl, Pamela Sheldon, Community Development Director RECOMMENDATION: The Planning Commission, on a vote of 6 ayes and 0 nays, and the staff recommend approval of Ordinance 590 as presented. 1111 • • To: Pam Sheldon Community Development Director City of Mounds view From: Danny D, Moon • 6929 Pleasant View Drive Mounds View, MN 55112 I would like to propose a change in the building code to setback of parking lots for churches or any commercial property adjacent to residential property be changed from 5 feet to 15 feet so green space is not interrupted on residential properties. This would allow for landscaping to obtain proper growth, such as pine trees, etc. and for room to plow snow. Thank- •u, / Iok' • Danny D. (1988 Code §26.12) _ . 4111 January 3, 1996 Dear Owner/Resident: This letter is to invite you to an Informational Meeting to provide input to the City for the design of Street and Storm Drainage Improvements associated with Bronson Drive. This Informational Meeting will be held: 7:00 PM Wednesday,January 10, 1996 Council Chambers City Hall 2401 Highway 10 The City's Pavement Management Study has identified Bronson Drive, between Edgewood Drive and Raymond Avenue, as needing to be reconstructed. In addition, the City's 1976 Storm Water Drainage Facilities Report, indicated that the drainage facilities on Bronson Drive are undersized. Therefore, the 40 properties along Bronson Drive as well as properties contributing runoff to the Bronson Drive Drainage facilities(generally located between County Road I and H2, and Edgewood Drive and Raymond Avenue) are included in the notice of this Informational Meeting. Project issues and design concepts will be discussed at the meeting. Generally, the improvements will consist of street reconstruction, storm sewer and sanitary sewer improvements, sidewalks and miscellaneous restoration. We will want to know of any drainage problems, traffic concerns , etc. that you may have that can help us properly design the required improvements. At this time, the City has authorized the consulting engineering firm, SEH, Inc, to prepare a Feasibility Report to look at the project alternates, determine costs and cost recovery. The City is interested in obtaining input from the residents and property owners affected by the proposed improvements. SEH and City staff, using input received from this meeting, will proceed with preparation of the Feasibility Report. This information will be brought back to the residents at a second Informational Meeting, prior to finalization of the Feasibility Report. If you have any questions, please feel free to contact me at 784-3114. We look forward to seeing you at the January 10th meeting. X Explanation/Summary(attach supplement sheets as necessary) Summary: The bid opening for the reconstruction of Bronson Drive was held today at 11:00 am. A total of five contractors submitted bids. There were three alternates included in the plan. As you might recall the first alternate was to install pipe in the ditch from Belle Lane to the surface water pond behind Pinewood Elementary School instead of clearing and reshaping the ditch. The other two alternates were for the utilization of plastic pipe for the storm sewer through part of the project, or the entire project. Staff is recommending that plastic pipe be installed throughout the entire project, and that the pipe also be installed verses merely clearing and regrading the existing ditch. The Rice Creek Watershed District is still reviewing the plans, but staff does not anticipate and complications resulting from their review. A summary of the bid tab accompany's this report. Staff recommends award of the contract to include the base bid and alternate 2 & 3 to the low bidder, Forest Lake Contracting for the sum of$578,529.68. The total project cost is estimated to be $759,320.21, which includes construction contingency, construction engineering, administration expenses. A unit price for equipment cost was also requested to perform an undetermined amount of pond cleaning in the surface water pond north of Bronson Drive. ,i, --;' . III RESOLUTION NO. 5035 CITY OF MOUNDS VIEW COUNTY 0 F RAMSEY STATE OF MINNESOTA RESOLUTION REQUESTING RAMSEY COUNTY TO RESTRICT PARKING ALONG A PORTION OF OLD HIGHWAY 8 WHEREAS, the County has planned the improvement of Old Highway 8 (CSAH 77) from the New Brighton City Limits to County Road H; and WHEREAS, the County will be expending County State Aid Highway funds (S.A.P. 62-677-21) on the improvement of said street; and WHEREAS, said improvement does not conform to the approved minimum standards as previously adopted for such County State Aid streets and that approval of the proposed construction as a County State Aid street project must, therefore, be conditioned upon • certain parking restrictions; and WHEREAS, the extent of these restrictions, that would be a necessary prerequisite to the approval of this construction as a County State Aid project in the City has been determined. NOW, THEREFORE, IT IS HEREBY RESOLVED, that the City requests the County to restrict the parking of motor vehicles on the both sides of Old Highway 8 from the City limits to County Road H. Adopted this 12th day of November, 1996. ATTEST: MAYOR (SEAL) CITY ADMINISTRATOR CM OF REQUEST FOR COUNCIL CONSIDERATION Agenda Section .1 P STAFF REPORT Report Number: FIZTIM G DITOPHOS Report Date: 11/8/96 0 CITY COUNCIL MEETING DATE% OEM November 12, 1996 _. Special Order of Bus. fro S 8r"ss•Partne4 _ Consent Agenda Public Hearings Council Business Item Description: Consider authorizing the an upgrade to the City's telephone system and a 1996 budget modification to pay for such upgrade. Explanation/Summary(attach supplement sheets as necessary) Summary: • At the present time, City Hall has five telephone lines into City Hall which service Community Development, Finance, Administration, Internet access, and general questions relating to the City. In addition, the City has numerous other lines for other employees or groups of employees such as the City Administrator, Police, Public Works, Park& Recreation, etc. For each of these groups, their is a separate group of telephone lines that can generally be used by only those individuals in that group. At times, all the telephone lines for a group of employees are being used and no calls can be received by that group or other employees do not have access to an outside line. In addition, it is not uncommon for the receptionist to have more calls than she can handle resulting in other employees having to interrupt their work to assist her. Over the last year, there has also been a reduction in clerical help which has compounded the need for finance and community development personnel to assist the receptionist. Also, messages can not always be routed to employees as 0 n as they are taken resulting in delays in responding to callers. In an effort to improve our communication abilities, we are proposing an upgrade to our telephone system as follows: • Consolidate all telephone lines into a"pool"whereby when we receive an incoming call or someone picks up a telephone to make an outgoing call, the first available line would be used. We would dedicate several lines as incoming or outgoing only to insure we maintained the capability to receive calls or call out. • We would have direct inward dial capabilities to relieve the calls coming though the receptionist, which should free up some of her time to perform other tasks. To accomplish the direct inward dial, we would be assigned a block of 60 to 80 new telephone numbers, which would be assigned to individual employees; employees could then distribute their telephone numbers so individuals could bypass the receptionist. The old numbers would continue to work for as long as we want them to, insuring that City services would not be disrupted. General City inquiries would still come through the receptionist. Individual phone numbers would only be given to those individuals that frequently deal with individual employees at the City. • Voice mail capabilities would be added to some employees' telephones; if such employees were on RECOMMENDATION: Approve resolution 5044. _a__ Bruce A. Kessel, Finance Director. the telephone or out of the office, callers would receive a message which would allow them to leave a voice mail message or to transfer to another employee. 4111 For the main City telephone number, we could have an after hour message. We could also explore informational messages for areas such as voting,Park& Recreation programs, registrations, cancellation of programs/games, etc. Overall, the proposal should improve service, and better utilize existing staff time. To accomplish the proposed system improvement, we would need to contract with Executone to modify our equipment at an estimated cost of approximately$16,500; the proposed equipment is covered under the State of Minnesota's pricing schedule and as such, has already been competitively bid out. We would also need to upgrade our service from U.S. West; they have partnerships with other entities to perform such work and have recommended using US Acomm which has submitted a proposal for a cost of$3,500 for equipment upgrades and a 120 month contract for service; the service proposal has a 30 month payback and the overall proposal from US Acomm would lower our monthly telephone bill from US West by approximately $200 per month. Pricing for the US Acomm equipment is covered under a rate tariff and as such, is not subject to competitive bidding requirements. At the present time, one administration position is vacant, Jennifer is on a maternity leave and Dorothy is on an extended leave which are resulting in additional strains on remaining employees. The 1996 budget included$25,000 for an organizational study; due to management and staff changes that have occurred in the last year plus the decision to leave one administrative position vacant, it is proposed to use the money originally budgeted for the organizational study to fund the telephone system upgrade. This should improve the organizational efficiencies and allow for other changes to be made that may have been identified by an organizational study. t • • Resolution No. 5044 CITY OF MOUNDS VIEW County of Ramsey State of Minnesota A resolution modifying the 1996 budget to transfer up to $21,000 from Office of the City Administrator - Other Professional Services to Central Services Capital Outlays for upgrades the City's telephone service. WHEREAS, $25,000 was budgeted for an organizational study of the City in 1996 and due to personnel changes and restructuring, such a study is not deemed to be in the best interest of the City at this time; and WHEREAS, the present telephone configuration resulting in the inefficient use of staff time. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Mounds View, Minnesota that the City Clerk-Administrator is hereby authorized to upgrade the City's telephone service at a cost of approximately $21,000 and the Finance Director is hereby instructed to modifying the 1996 budget by transferring up to $21,000 from Office of the City Administrator - Other Professional Services to Central Services Capital Outlays to pay for such upgrade. • Adopted this 12th day of November, 1996. S gjS-Partne'Q Consent Agenda IMMIN Public Hearings 7 Council Business Item Description: Consider authorizing the Finance Director to file the required annual disclosure statements with the SEC and to negotiate a contract for administrative services for the City's Section 125 plan. Explanation/Summary(attach supplement sheets as necessary) Summary: Recently enacted federal legislation requires the City to file annual disclosure statements with the Securities and Exchange Commission relating to the financial health of the City whenever certain conditions are met. The conditions generally relate to when City has outstanding bonds. Last year the City entered into a contracted with Springsted, Inc to prepare the required disclosure at a cost of$1,500 per year; the contract does not specify a term but can be canceled by either party by giving 90 days notice. Based upon my past n experiences, I feel that I should be able to complete the required disclosure at a nominal cost, basically for the cost of obtaining required information from outside sources such as Ramsey County and possibly a nominal charge from a consultant for clarifying one or more minor points associated with the disclosure statement. 0 the early 1990's, the City established a Section 125 plan for its employees (a section of the Internal evenue Code which allows employees to pay for some of their medical costs with pre-tax dollars). The City contracted with DCA to administer the Plan; DCA charges a set fee per participating employee and but also has a minimum fee of$150 per month, plus additional fees for year end reporting;the total annual fee for 1996 will be $2,050. Based upon my experience with other administrators, this fee appeared to be high and as such, I contacted several other plan administrators to obtain additional information of their fee structure and level of service. Based upon this, it appears that if the City would change plan administrators, the fee would be approximately $1,200 for the first year and$500 for subsequent years. Our plan year runs from January through December and as such, if the City is to change Plan Administrators, we would need to do so by early December to insure that we could complete all the necessary changes by January 1st. I have been in contact with DCA to see if they would modify their fee structure and have not received their response as of the writing of this report. As such, I am requesting authorization to negotiate with DCA and if they are unable to modify their fee structure to authorize the City Clerk-Administrator to enter into a contract with the Plan Administrator that he feels will best serve the needs of the City.
