He assumed the day today operational and second in command duties formally held by Mike Ulrich prior to his promotion to Public Works Director. At that time, it was discussed that his position would be re- evaluated at the end of 1995 and consideration given to a -position) designation as Public Works Foreman. For the past year, Tim has performed the second in command duties with more than satisfactory results. He is organized, available, knowledgeable and • is able to supervise the multi-functions of the public works department in Mike Ulrich's absence. Mr. Weinke is currently at level C, $15.70/hr. It is recommended Mr. Weinke advance to Level D, $16.02/hr. According to the Public Works Labor Agreement, there is a four level job classification system, Level A, B, C, and D. To advance from one level to the next, specified criteria are to be met. Explanation/Summary (attach supplement sheets as necessary.) - UMMARY; Pete Linder, representing Linder's Greenhouses, has made application for a conditional use Permit to allow for the operation of an outdoor sales operation at Mounds View Square. Chapter 40.19, Subdivision D (2), allows for open or outdoor sales in a B-4 zoning district with the issuance of a conditional use permit. As you may recall, Linder's was issued a conditional use permit in 1995 to allow the operation at Mounds View Square. The current request would allow the operation to be set up in the same manner and same location as 1995. Staff has reviewed the submitted application and found it meets all applicable sections of 0 Zoning Code. As requested last year, Mr. Linder would like to hook up to a hydrant on the property in order to obtain water for his operation. Associated charges and deposits will remain the same as last year. Staff has checked with the Director of Public Works and as long as the applicant meters the hydrant usage, there is no problem with the request. Staff would also like to add that the City received no negative comments on the operation last year. The Planning Commission has reviewed this item and recommends approval in Resolution No. 442-96. I would lice to state that the Flower Mart at this location last spring was very successful and we had many customers comment that they were happy to have us here. As far as I know there were no problems with our being here and we feel we were good neighbors for the shopping center and the community. We are eager to return. You will note that nothing has changed from last year and we will operate in 1996 the same as.in 1995. _ Our electricity will come from the pylon in the lot near the Flower Mart. The first change proposed in the Ordinance is to establish occupancy standards based on square footage • requirements as required by the Uniform Building Code. Up until now, the Department of Housing and Urban Development required a maximum occupancy of two person per bedrooms. Because it was found to be unconstitutional to restrict the number of occupants in a dwelling unit, HUD has abolished their current occupancy standards. Individual municipalities may establish occupancy standards based on square footage requirements. This change is reflected in Section 1005.09, Subdivision 8. • The second change proposed is to require inspections to be conducted prior to issuance of a Multiple Dwelling Registration. Currently, the all multiple dwellings are issued licenses by April 1. With this change,registration certificates will be issued upon compliance with the Housing Code. The third change proposed addresses the correction of immediate hazards stating that no occupancy shall be permitted if an immediate hazard exists (immediate hazards are listed in Section 1005.14, Subdivision 4). This would allow the City to require that any hazards listed in this section be corrected immediately (or within a time specified by the City). If repairs are not completed within this specified time, the City would be authorized to make the repairs and asses the costs to the property. Section 1005.09 of the Mounds View City Code is amended by adding a new subdivision to read: Subd. 8. Room Dimensions: a. Ceiling Heights: Habitable space shall have a ceiling height of not less than seven feet six inches (7'6") except as otherwise permitted in the Section. Kitchens, halls, bedrooms, and toilet compartments may have a ceilingheight of not less than seven feet(7') measured to the lower projection from the ceiling. Where exposed beam ceiling members are spaced at forty-eight (48") on center, ceiling height shall be measured to the bottom of these members. Where exposed beam ceiling members are spaced at forty-eight inches (48") or more on center, ceiling height shall be measured to the bottom of the deck supported by these members, provided that the bottom of the members is not less than seven feet (7') above the floor. If any room in a building has a sloping ceiling, the prescribed ceiling height for the room • is required in only one-half('/2)the area thereof. No portions of the room measuring less than five feet(5') from the finished floor to the finished ceiling shall be included in any computation of the minimum area thereof. If any room has a furred ceiling, the prescribed ceiling height is required in two-thirds (2/3) the area thereof, but in no case shall the height of the furred ceiling be less than seven feet(7'). b. Floor Area: Dwelling units and rooming units shall have at least one (1) room which shall have not less than one hundred twenty (120) square feet of floor area. Other habitable rooms, except kitchens, shall have an area of not less than seventy (70) square feet. Where more than two (2)persons occupy a room for sleeping purposes, the required floor area shall be increased at the rate of fifty (50) square feet for each occupant. Sec. 3. Section 1005.12, subdivision 2 of the Mounds View City Code is amended by adding a new subparagraph to read: d. The certificate shall state that the structure has been inspected and is in compliance with the requirements of this Chapter. Sec. 4. Annual Renewal of Registration: The owner of a multiple dwelling or his agent shall annually apply for a renewal of the certificate of registration on or before September Mareh 30. Renewal of the registration is contingent upon compliance of this Chapter. Sec. 5. Section 1005.12, subdivision 5 of the Mounds View City Code is amended to read: Subd. 5. Transfer of Registration: A certificate of registration for the unexpired portion of the licensed term is transferrable, for a fee of fifteen dollars ($15), to any person who has actually acquired legal ownership of a registered building for thc unexpired portion of thc tcrm for which is was issued or rcissucd; provided, that thc application to transfer such registration is filed with thc Building Inspcction Department prior to actual change of legal ownership. It is the responsibility of the current owner to notify the purchaser that a transfer must be filed with the Building Inspection Department immediately upon acquiring legal ownership. A fee, established by City Council resolution, shall be charged for any additional inspections or attempted inspections required, whether due to the multiple dwelling failure of the reinspection, the Enforcement Officer's inability to gain access to the multiple dwelling at the time of attempted reinspection, or otherwise, and must be paid before a certificate of registration will be issued. Sec. 7. Section 1005.14 is amended by adding new subdivisions to read: Subd. 3. Posting to Prevent Occupancy: The Building Inspection Department may prevent occupancy of any building or structure in violation of the Chapter by posting the building or structure. Posting may occur if any owner, agent, licensee, or other responsible person has been notified by inspection report of items which must be corrected within the time provided for in the inspection report or this Chapter and such corrections have not been made within the stated time. No person shall remove or tamper with any placard or other device used for posting. No person shall reside in, occupy, or cause to be occupied any building structure, or dwelling that has been posted to prevent occupancy. Subd. 4. Correction of Immediate Hazards: a. Immediate hazards shall include, but not be limited to: • (1) Heating systems that are unsafe due to burned-out or rusted heat exchangers; burned-out, rusted, or plugged flues; inadequate venting; connection to unsafe gas supplies; or lack of capacity to adequately heat the dwelling unit. (2) Water heaters that are unsafe due to burned-out or rusted heat exchangers; burned-out, rusted, or plugged flues; inadequate venting; connection to unsafe gas supplies; or lack of temperature or pressure-relief valves. (3) Electrical systems that are unsafe due to overloading; damaged or deteriorated equipment; improperly taped or spliced wiring; exposed uninsulated wires; inadequate distribution systems; such as the improper use of extension cords; or ungrounded systems. (4) Plumbing systems that are unsanitary due to leaking waste systems, fixtures, or traps; lack of a water closet; lack of washing or bathing facilities; cross-connection of pure water supply with fixtures or sewage lines; or lack of adequate water supply. (5) Structural systems, walls, chimneys, ceilings, roofs, • foundations, and floor systems that will not safely carry imposed loads. (6) Refuse;garbage,human waste, dead vermin or other animals, animal waste, or other materials causing unsanitary conditions. (7) Lack of adequate light or air. (8) Infestation of rats, insects, or other vermin. (9) Other conditions creating an immediate threat to the health or safety of an occupant, the premises, or any other person or property. b. No occupancy shall be permitted of any vacant dwelling unit if an immediate hazard exists on the premises. c. If a dwelling unit is occupied and an immediate hazard exists on the premises, immediate corrective action shall be taken by the owner, agent, licensee, or other responsible person. If immediate corrective action is not taken, the Enforcement Officer may order that the dwelling unit be vacated. Sec. 8. Section 1005.16, subdivision 2(b) is amended to read: b. Mailing and Posting of Notice: The notice of violation shall be sent by certified mail to the last known address of such person, and. If the violations are not corrected within thirty (30) days,such notice shall be published once in the City's official newspaper. Sec. 9. Section 1005.16, is amended by adding a new subdivision to read: Subd. 4. Up until now, the Department of Housing and Urban Development required a maximum occupancy of two person per bedrooms. Because it was found to be unconstitutional to restrict the number of occupants in a dwelling unit, HUD has abolished their current occupancy standards. Individual municipalities may establish occupancy standards based on square footage requirements. This change is reflected in Section 1005.09, Subdivision 8. The second change proposed is to require inspections to be conducted prior to issuance of a Multiple Dwelling Registration. Currently, the all multiple dwellings are issued licenses by April 1. With this change, registration certificates will be issued upon compliance with the Housing Code. The third change proposed addresses the correction of immediate hazards stating that no occupancy shall be permitted if an immediate hazard exists (immediate hazards are listed in Section 1005.14, Subdivision 4). This would allow the City to require that any hazards listed in this section be corrected immediately (or within a time specified by the City). City staff held a congratulatory reception for the new bride and groom on Tuesday, February 21st. Michele and Jack will be living in Forest Lake. • I assissted Cathy Bennett in researching information on the background of the Bel-Rae Ballroom. Paul ECONOMIC DEVELOPMENT/MARKETING Auto Central Site • I talked with Norwest Bank regarding the procedures for purchase of the Auto Central site. The property is scheduled for sheriff sale on April 5th (originally he told me March 5th) at Ramsey County Court House. If the City purchases the note, we would still be required to make a bid at the sheriff sale. If someone bids higher then we could get our money back. If the bid is awarded to us, there is still a 6 month redemption period where Mullins could come current on the note and regain the property. In this case, I would recommend that the City wait until the redemption period is over. It is likely that the bank Metro Livable Communities Act-Award of Pilot Grants • At the last meeting of the 35W Corridor Group (Roseville, Mounds View, New Brighton, Arden Hills and Shoreview) I found out that the Met Council approved funds for five pilot projects out of the Demonstration Account. Guess where those communities are? St. Louis Park, Minnetonka, St. Paul, Minneapolis and NW Co-op which involves Brooklyn Park, Brooklyn Center, Crystal and Robbinsdale. Apparently, these projects all involved a transportation element and have sucked up 1/2 of the total appropriated amount of the funding account for 1996. In an effort to steer some of the funds to the Northern Suburbs the 35W Corridor Group will strategize on applying for a joint project along 35W. Keep you posted! Bel-Rae Update • I will have an appraisal and legal opinion by the March work session for your review. In addition, I have called a dozen Cities regarding feasibility studies and am working on bids for a Phase I environmental study. • I have received several calls from residents regarding the project, therefore decided to put an update on the procedure in Mounds View Matters. This will include a summary of the information in the resolution that was passed by the EDA. A senior called concerned with the long term operating costs. A previous employee of the Bel-Rae and resident was concerned with the ventilation for children. She said the air conditioning did not work very well and the smell may cause health problems for children. A parent who's daughter has a reception scheduled in August wanted to know if there was a possibility that they would not be able to have the reception and if they could still have the same liquor sales arrangement that currently exists. Staff addressed each call appropriately. I will be on vacation in sunny California from 2/23 thru 3/4 but will be at the 3/4 work session. Cathy Congratulations Michele and Jack! We all wish you the very best! RECYCLING Wednesday, February 14 I attended a Recycling Coordinators meetings. Ramsey County is in the process of passing an Administrative Penalty Order which gives Ramsey County and localities substantial increase in penalizing non-complying haulers and Hazardous Waste facilities and landfills. APOs allow a faster turn-around time to get the company into compliance. SCORE contracts for 1997 will cover a two year period instead of a period of one year. The 2nd year contingent upon funding. MAUMA Thursday, February 22 , Dawn and I attended a MAUMA meeting at the Maplewood Community Center. February's professional development topic is creative problem solving. Audrey Anderson, the workshop presenter, is a consultant with the Wilder Foundation. Ms. Anderson has worked with a wide range of nonprofit organizations and uses creative problem solving techniques frequently with clients to assist them in envisioning new solutions. BILL SUMMARIES This one is still in the making: A possible bill that would eliminate the state sales tax on local government purchases in exchange for a cut in HACA. The proposal would supposedly be revenue neutral for each city. The details are not worked out, but the cut in HACA would seen to be permanent and the benefit from the sales tax exemption could grow over time. Low income rental housing This bill would require cities contemplating construction of new low-income rental projects in areas with a concentration of low income multi-family rental properties of five or more units. It would require developers to file a community impact statement and hold a public hearing prior to considering whether to approve the project. Sales tax repeal for local government purchases The proposed bill is very simple; repeal the sales tax on local government purchases on sales occurring after June 30, 1996. Community notification A bill notifying the public when a serious sex offender moves into the neighborhood was approved by the House Judiciary Committee. Last year this bill was stalled in the Senate, but this year has already passed the Senate Crime Prevention Committee. Under HF2045, each state prison and treatment facility would set up a committee to certify on a case-by-case basis, the public risk posed by all sex offenders who are about to be released. Notification would depend on the severity of the case. If enacted, the bill would become effective January 1, 1997. Friendly land use In this bill local governments would be encouraged to establish a sustainable development plan. The plan would involve the"development of land and waters that minimizes environmental damage and provides for economic opportunities and community well-being." Preservation of the environment for future generations is the goal. There are no funding or enforcement provisions in the bill. Dawn ( PARKS, RECREATION AND FORESTRY PARKS • Monday, February 19 was the last day that park buildings were open at the ice skating rinks. Rinks were open one week longer than scheduled due to money saved from the cold week when rinks were closed. Rink maintenance has ceased. Park building reservations for groups will resume. • Swings are being installed at playgrounds where animal swings were removed last Fall • Jeff Weinke and Steve Dazenski took their Chemical Applicators Licensing test. • The crew continues to collect branches broken during the ice storm. RECREATION • The March/April City Newsletter has been prepared this week, going to print Friday. • Mary drove for the WIC program again this week.. • The Parks and Recreation Commission meets Thursday evening. • We have a new student office assistant. His name is Josh Brown. He is an Oak Grove/Irondale High School student that lives in Mounds View. He will be coming in the office after school about 2:30 p.m. and working until 5:30 p.m. • Mary chaperoned the School Vacation trip Monday, February 19 -President's Day. This was a joint program with Arden Hills and Vadnais Heights. • The Department received three requests from college students for internships in the Spring/Summer. We have a reputation of being an excellent sponsor for internships, providing a wide variety of experiences for college near-graduates. Each will be interviewed and one will be chosen. • FORESTRY • The branch pick up has concluded. The City has been swept through entirely once, with callbacks for those places that were missed. The program has now concluded. Anyone that missed the branch pickup are being informed that a Spring Cleanup Day will provide opportunity for them to rid of their branches. • Rick is preparing the bid proposals for 1996 tree removal services. GOLF COURSE • The Golf Brochure has been distributed. Registrations for leagues begins March 9. Lesson registrations are being taken presently. • John continues to interview staff and develop staffing schedules to begin in mid March at the Clubhouse and April for course maintenance. • Attached are letters for your information. Hopefully this information will provide you with a little insight as to the Department's involvement in the community-with programs and activities that are directed especially towards youth and teens. Mary S. FINANCE • The Finance Department is continuing to look at computers and software options for our department. Dorothy, Kitty and I went for a demonstration on Wednesday. The additional options and increased speed of processing is amazing. • At this time, utility payments are the top priority for Dorothy and Marge. Dorothy, Todd from Waterpro, and Sara from Computerservice, are working out the final details on the billing procedure. • Kitty has been working on accounts payable this week. Besides talking with the computer companies, she also attended the MIS Committee meeting this week where computer technology was a topic. • This week the "Accounting Detail " of the 1996 adopted budget was handed out to City Staff. There are extras if anyone needs a book. The official 1996 City of Mounds View Adopted Budget is still in the process of being put together. The bond sale went well and after a few more details that process should be behind us until next time. The auditors will be here very soon so I continue to work on providing all the worksheets and information they will need. The Finance Department congratulates, Jack and Michele. COMMUNITY DEVELOPMENT • Two new townhomes are under construction by Larry Beach on Silver Lake Road. • The Property Managers Group met in New Brighton on Wednesday, February 21, 1996. A member from the Multi-Housing Association discussed options for membership and provided an update on 1996 legislation. • The first building permit for a new home in Sherwood Estates has been issued. All public utilities for Sherwood Estates are expected to be completed by Spring of • 1996. • All building permits for new homes in Greenfield Ponds have been issued. • ■ Six new home permits have been issued in Mounds View since January 01, 1996. • Specifically, three in Greenfield Ponds, one in Sherwood Estates, and two units were built by Larry Beach on Silver Lake Road. • The Community Development Department would like to congratulate Michele and Jack Chambers on their marriage. • As a side note, Barb, Jennifer, Kitty, Mary and Joyce saw the movie Mr. Holland's Opus this weekend. It was a great movie --we all gave it a big thumb's up 1111111 Joyce PUBLIC WORKS Staff has received an inquiration from American Portable Telecom(APT), researching the possibility of installing communication antennas on the water tower. Staff met with a consultant representing APT last week to discuss various options. On Tuesday a proposal was received. Unknowingly to myself, Paul has also been involved with another communications firm requesting the utilization of the City's tower for antennas. This item will be addressed at the March 4, 1996 Council work session. Both firms will be invited to attend. Water meter installations are now taking place on Wednesdays only. The project is so close to completion that we can taste it. Training for the finance department will be scheduled in the near future.'Approximately 60 installations remain, after registered letters were sent, serving as a final notice. Staff has been dealing with a company that bought out the City's contractual weather forecasting service. This company apparently purchased the old contracts, and assumed the cities involved would continue honoring the old contract. Staff was contacted by the new company's sales representative and told him that we would not be contracting with his company in the future. He wanted to send sample forecasts which we accepted under no financial obligation. This was understood by both parties. Apparently he did not convey this to the appropriate personnel in his office, as they understood that we and many other cities in the Metro area would be requesting services from them. To make a much longer story short, they have referred our unpaid invoices to a collection agency. Staff has pursued this incident extensively with relatively little success. Hopefully it will be resolved in the very near future. Staff has been busy patching potholes, cleaning catch basins and scraping ice from flooded intersections and roadways. The waste oil heaters arrived last week. Mark has been installing them and constructing hanging brackets. The oil storage tank was ordered last week, after designing the configuration of the necessary fittings and adapters. The system is expected to be operational possibly by mid to late March. Storage tanks for liquid calcium chloride and the pump were received last week. Staff will begin to fabricate the spray bar system that will be used to dispense the chemical. These tanks will be installed near the salt shed enclosed by a small additional fence. Decals were applied on the DARE vehicle this week. Tim Pittman finished the body work and painting last week. Hopefully the vehicle will be on the road some time in March. Staff is waiting for parts to arrive. Staff met with a representative from NSP to discuss any electrical projects the City might be undertaking in 1996. Staff received information related to HVAC systems and electric motor replacements. NSP will pay for 50% of the engineering studies required for both of these upgrades. Staff will be researching the possibility of replacing two of the roof top units at City Hall this year, and is also researching more efficient means of pumping water from the booster station. The booster station project will probably take place in 1997. Mike POLICE * THE WHEELS OF JUSTICE In 1992, a suspect intentionally drove into one of our squads cars. The suspect was charged with damage to property. Last week, we received a check for $1,634.00 for the damages. * As you know,Mike Kampa has been off work since October. His shoulder has not responded to therapy and will have it operated on again next Wednesday. We expect he will return the first part of May. * Bob Nelson is vacationing this week in Arizona. * We now have three CHAMBERS in the City. Jack,Michele and the Council. Congratulations to Jack and Michele. * After a couple dozen calls, I talked to a responsible person at MTC. We wanted signs at the Park&Ride to prohibit long term parking. This would not only benefit some of our residents and be a good marketing hook for potential • renters, but it would also remove some of the problems that result from the existence of the business that operates in that particular location currently. The noise and hubbub of a local drinking/concert establishment will certainly not be missed. Also, the site is not particularly attractive andthe possibility of something other than a block of worn asphalt and dirt parking lot with unkempt grass/weeds would definitely be a welcome change. It would certainly reflect better on the city as a whole, since the city buidings are located directly across the street and as we all know this side of Highway 10 could use a little boost in the opinion polls of residents in the local community and surrounding areas. This would not only give the. City of Moundsview and it's residents the opportunity to put something back into the communtiy and beautify it's surroundings, but it will also give area teens a place to go to meet new people, find support in their peers and give them the opportunity to participate in activities they might not have had a chance to experience otherwise. It would also be beneficial to the city if other types of meetings could be established or held at this location in the centers off hours, such as support group meetings, AA and it's other affiliates and as of more recent necessity, a gamblers anonymous might be a good idea. On the other hand, if you were intending to focus the center solely on teens, I feel the teen versions of these programs such as ALATEEN would be beneficial as well as an opportunity for some type of group counseling meetings to be held there. Also, some form of tutoring would be helpful to teenagers who need a little extra help scholastically and maybe a collection of college brochures and books and a person to help the kids investigate schools, apply and give information on financial aid and scholarship applications would be nice.
