ADJOURNMENT CITY OF MOUNDS VIEW OFFICE OF THE MAYOR PROCLAMATION WHEREAS, Arbor Day was first observed in 1872 with the planting of more than a million trees in Nebraska and is now observed throughout the nation and the world; and WHEREAS, the City of Mounds View has been recognized for 33 consecutive years as a Tree City USA Community by the National Arbor Day Foundation for its commitment to urban forestry; and WHEREAS, trees in our City beautify our surroundings, increase property values, shade our park and residences, reduce storm water runoff, reduce energy use, enhance the economic vitality of business areas and promote healthier communities; and WHEREAS, Public Works will be planting a variety of shade trees in various City parks on April 24, 2015. Meeting Date: April 13, 2015 Type of Business: Council Business Administrator Review: _____ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Mark Beer, Finance Director Item Title/Subject: Resolution 8389 Appointing MMKR to Provide Auditing Services for the Years Ended December 31, 2015, 2016, 2017 The City’s contract for auditing services has expired with the 2014 audit. The auditing firm of Malloy, Montague, Karnowski, Radosevich, & Co., P.A. (MMKR) has performed and provided audit services that have been beneficial to the City. MMKR has provided at staff’s request an extension of audit services for the years’ ending December 31, 2015, 2016, and 2017 for Council consideration. The City has received more than satisfactory service from MMKR and the proposed fees reflect minimal increases for 2015, 2016, and 2017. The fee for the 2014 audit was $31,600. The proposed fee for 2015 is $32,200 plus expenses, 2016 - $32,800 + expenses, and 2017 - $33,400 + expenses. Resolution 8389 appointing MMKR as auditors for the years ended December 31, 2015, 2016, and 2017 is attached for your approval. I have also attached the engagement letter that will be signed by the Mayor, the letter of estimated fees for the next three years, and MMKR’s peer review. Respectfully submitted, ________________________ Mark Beer RESOLUTION NO. 8389 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPOINTING MMKR TO PROVIDE AUDITING SERVICES FOR THE YEARS ENDED DECEMBER 31, 2015, 2016, 2017 WHEREAS, Minnesota Statue 471.697 requires all cities with a population over 2,500 to have an annual audit and submit an audited financial report to the state auditor office; and WHEREAS, Malloy, Montague, Karnowski, Radosevich, & Co., P.A. (MMKR) has provided the City of Mounds View with financial auditing services that have been beneficial to the City at a cost of $31,600 for 2014; and WHEREAS, MMKR has provided a letter of engagement that outlines the services which they will perform; and WHEREAS, the audit services described include the base audit, GASB 34 requirements, and the fraud audit requirements for an estimated total of $32,200 plus direct expenses for 2015, $32,800 plus direct expenses for 2016, and $33,400 plus direct expenses for 2017. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Mounds View does hereby authorize the Mayor to sign an engagement letter with MMKR for the provision of auditing services for the years ended December 31, 2015, 2016, 2017. Meeting Date: April 13, 2015 Type of Business: Council Business Administrator Review: _____ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Mark Beer, Finance Director Item Title/Subject: Resolution 8372 Adopting a Special Assessment Levy for a Private Sewer Improvement at 8130 Edgewood Drive The City repaired a sewer line that the resident was unable to effectuate due to the complexity of the repair. The property is located at 8130 Edgewood Drive. The property owner has signed an agreement to waive their right to a public hearing and has agreed to pay the full cost of the private improvement plus interest and the administrative fee. The total cost of the private sewer repair is $12,605.57 The property owner may pay the amount due by 4:30 P.M. on Monday, April 13, 2015 in order to avoid the $35.00 administrative fee. The owner may prepay the assessment between April 14, 2015 and May 13, 2015 without paying additional interest. After that, interest at the rate of 5.50% will accrue from April 13, 2015 through the payment date. This interest rate and administrative fee were set by the City Council in Resolution 7135. On or after May 13, 2015, we will forward the assessment roll to Ramsey County for collection with the 2016 property taxes. Respectfully submitted, ___________________________ Mark Beer RESOLUTION NO. 8372 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA Adopting a Special Assessment Levy for a Private Sewer Improvement at 8130 Edgewood Drive WHEREAS, the City has received a signed petition and waiver agreement from the individual property owner at 8130 Edgewood Drive agreeing to the proposed assessment in the attached assessment roll for a private improvement of a sewer line. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View that: 1. Such proposed assessment roll, a copy of which is attached hereto and made a part hereof, is accepted and shall constitute a special assessment against the lands named therein, and each tract of land therein is hereby found to be benefited by the private improvement in the amount of the assessment levied against it. 2. The assessment as adopted and confirmed shall be payable in equal annual installments over a period of ten (10) years, the first of the installments to be payable on or before the first Monday in January 2016, and shall bear interest at the rate of five and one half (5.5) percent per annum from April 13, 2015. To the first installment shall be added interest on the entire assessment from April 13 2015 through December 31, 2016. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may at any time prior to the certification of the assessment to the County Auditor pay the whole of the assessment, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment, with interest from the date of adoption of this resolution through the date of payment, such payment must be made before May 13, 2015, or interest will be charged through December of the succeeding year. 4. The City Administrator shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the county, and such assessment shall be collected and paid over in the same manner as other municipal taxes. In addition, a separate item of a light bar expense at $2300 is also in the 2015 budget. Maintaining a reliable and well kept fleet of police vehicles is essential in providing quality policing services to the community. The department strives to stay on a 5 year replacement cycle for marked police vehicles and an 8 year replacement cycle for unmarked/administrative vehicles. The current police fleet consists of: • One 2008 Ford Crown Victoria (085) for PSO • One 2009 Ford Crown Victoria (091) for Patrol Use • One 2011 Ford Crown Victoria (111) for K-9 Use • One 2011 Chev Tahoe (112) for Patrol Sergeant Use • One 2013 Ford Interceptor Sedan (131) for Patrol Use • Three 2014 Ford Interceptor Sedans (141, 142, 143) for Patrol Use • One 2014 Ford SUV Interceptor (144) for Patrol Use • Three Unmarked Chev Impalas (2006, 2007, 2014) for Admin /Investigative Use Discussion: At this time, the department is requesting to purchase one of the two budgeted squad vehicles. The current request is for the approval to purchase one 2016 Ford Police Interceptor Utility vehicle. Once the period to purchase the Chevrolet Impalas is announced, the request to seek council approval for that vehicle will be made. That request will consist of one 2015 Chev Impala Sedan unmarked vehicle for administrative/investigative designation. The utility vehicle offers the all wheel drive, but more importantly provides increased interior room as well as additional cargo area for equipment. This addition of another utility vehicle to the fleet will provide increased versatility to the existing group of police vehicles. The acquisition of the 2014 Ford Interceptor Utility vehicle last year has been received most favorably. The Ford Interceptor Utility vehicle is offered at the state contract price from Nelson Auto Center in Fergus Falls for a base price of $25,562. The addition of some necessary options should increase the total cost to $26,533. The equipment setup costs and graphics installation for this utility vehicle is estimated to be approximately $9,400, plus the $2,300 cost for the light bar and siren control system. Set-up costs are higher due to the necessity of purchasing all new equipment, rather than using any existing emergency equipment on hand that is not compatible for this new utility vehicle. The department plans to auction the 2009 Ford Crown Victoria squad, which has the highest mileage and engine hour totals, through the services of Admin Minnesota State Surplus Services in Arden Hills. Recommendation: Staff recommends authorizing the purchase of one 2016 Ford Police Interceptor utility vehicle including all setup costs and the sale of one older Ford Crown Victoria squad car through the Admin Minnesota State Surplus Services auction. Respectfully Submitted, __________________ Thomas Kinney Chief of Police RESOLUTION NO. 8392 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA APPROVING THE PURCHASE OF ONE FORD POLICE INTERCEPTOR UTILITY VEHICLE AND EQUIPMENT SETUP COSTS WHEREAS, the Mounds View Police Department maintains a replacement schedule of police vehicles to ensure that the police department can provide reliable quality service to the community with a dependable fleet of police vehicles; and, WHEREAS, the Mounds View Police Department planned and budgeted for the replacement of two squad cars in 2015 for a total budget of $65,000 with $26,000 designated for the Utility vehicle along with $10,000 in setup costs; and, WHEREAS, Nelson Auto Center in Fergus Falls has been awarded the state bid contract for the 2016 Ford Police Interceptor Police Utility vehicles at an approximate cost of $26,533, and, WHEREAS, a 2009 police squad car will be designated for sale at a future auction administered by the Admin Minnesota State Surplus Services. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View, Ramsey County, Minnesota to authorize the purchase of one 2016 Ford Police Interceptor Utility vehicle at an approximate cost of $26,533 plus setup cost of approximately $9,400 and to sell one older Ford Crown Victoria squad car through the Admin Minnesota State Surplus Services Auction. Background/Discussion: The Municipal State Aid Street System (MSAS) is intended to be a mechanism to identify and fund a “backbone” system of collector and arterial streets. The City is allowed to identify roads to be built or upgraded to certain MSAS standards as part of this system. The total mileage of these roads can be up to 20% of the City’s total street miles. The City then receives Municipal State Aid Street funds based upon the cost to construct these streets to the MSAS standards. These funds can then be used to construct the streets designated on the MSAS System. Attached, as Exhibit A is a map showing the existing approved Mounds View MSAS System. Each year the City submits to the State a streets needs and mileage application for MSAS funding. The State performs routine audits of these applications submitted by cities. During last year’s audit the State found a mistake on the City of Mounds View application, indicating that the City was over the total allowed street mileage for MSAS funding by 1.33 miles. The State requested the City perform an internal audit and review the designated MSAS streets and the total mileage on all streets. Staff, with the assistance of Stantec, found the City was over the mileage by 1.33 miles. Stantec contacted the State to inquire on what steps the City must take in order to resolve this error. The State indicated that the City must revoke some streets listed as MSAS streets in order to comply with the State guidelines. Stantec recommended that Staff look for streets that have not had any work done within the last 19 years, thus keeping the possible pay back lower. The oldest street that has been receiving State aid for the past 20 years is Bronson Drive, last reconstructed in 1996. Quincy Street – (Wooddale to County Road H2), Wooddale Drive - (Edgewood Drive to Quincy Street) and Jackson Street (County Road I to Hillview Road) have not drawn any funding within the last 25 years from the MSAS program. Following is the list of streets Staff is recommending to have revoked. Attached, as Exhibit B is a map showing the streets recommended to be removed from the MSAS System. 1) Route 238 – Wooddale Drive (Existing) – Edgewood Drive to Quincy Street 2) Route 238 – Quincy Street (Existing) – Wooddale Drive to County Road H2 3) Route 243 – Bronson Drive (Existing) – Edgewood Drive to Quincy Street 4) Route 245 – Jackson Street (Existing) – County Road I to Hillview Road. The life of a street that has been constructed or reconstructed is considered 25 years. Bronson Drive was reconstructed in 1996; 2015 minus 1996 = 19 years. By using this formula, 25 years minus 19 years, Bronson Drive has 6 years remaining of MSAS funds reimbursement. The total funds to be received over the 25 year span for Bronson Drive from MSAS would be $423,859.00, so therefore the remaining $101,726.00 will need to be paid back to the State. This payback will be taken out of future funding requests until the full amount has been reached. Recommendation: Public Works Staff recommends the City Council approve revoking the following streets as a MSAS designation and to submit this information by resolution to the Commissioner of Transportation for the State of Minnesota for approval: Route 238 – Wooddale Drive (Existing) – Edgewood Drive to Quincy Street Route 238 – Quincy Street (Existing) – Wooddale Drive to County Road H2 Route 243 – Bronson Drive (Existing) – Edgewood Drive to Quincy Street Route 245 – Jackson Street (Existing) – County Road I to Hillview Road, . Respectfully submitted, Don Peterson Interim Public Works Director RESOLUTION NO. 8395 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA MUNICIPAL STATE AID STREET REVISIONS WHEREAS, The State performed a routine audit of the City of Mounds View Municipal State Aid Street System (MSAS) applications and found an error; and, WHEREAS, Staff with the help of Stantec found the City was over the mileage by 1.33 miles; and, WHEREAS, Stantec recommended Staff to look for streets that have not had any work done with in the last 19 years, thus keeping the possible pay back lower; and, WHEREAS, it appears to the City Council of the City of Mounds View that the streets hereinafter described as a revocation should have their designation as a Municipal State Aid Street removed under the provisions of Minnesota law; and WHEREAS, it appears to the City Council of the City of Mounds View that any street segment revoked with a last date of construction within the previous 25 years shall be subject to a prorated repayment under the provisions of Minnesota law; and, WHEREAS, Quincy Street – (Wooddale to County Road H2), Wooddale Drive - (Edgewood Drive to Quincy Street) and Jackson Street (County Road I to Hillview Road) have not drawn any funding within the last 25 years from the MSAS program. WHEREAS, Bronson Drive has a previous construction award date of 1996; and, WHEREAS, the prorated payback calculated for Bronson Drive is $101,726, NOW THEREFORE, BE IT RESOLVED by the City Council of Mounds View that the roads described as follows approving for revocation are: Revocation: 1) Route 238 – Wooddale Drive (Existing) – Edgewood Drive to Quincy Street 2) Route 238 – Quincy Street (Existing) – Wooddale Drive to County Road H2 3) Route 243 – Bronson Drive (Existing) – Edgewood Drive to Quincy Street 4) Route 245 – Jackson Street (Existing) – County Road I to Hillview Road, and hereby are revoked as a Municipal State Aid Street of said City, subject to the approval of the Commissioner of Transportation of the State of Minnesota; and, BE IT FURTHER RESOLVED, that the City of Mounds View authorizes payback of the prorated amount of construction for Bronson Drive in the amount of $101,726; and, BE IT FURTHER RESOLVED, that the City Administrator is hereby authorized and directed to forward two certified copies of this resolution to the Commissioner of Transportation for consideration. At the same time, the Church expressed its desire to sponsor and support worthy community endeavors and created the “Mounds View Service Project Fund” pledging annual donations totaling $25,000. They envisioned the fund to be used to help meet certain community needs jointly identified by the city and the Church that would be “in harmony” with their mission and values. Discussion: Representatives from the City, the Community Center and the Park & Rec Commission have discussed potential funding opportunities for the first half 2015 service project fund donation which totals $15,542.50. A number of programs and improvements which had been reviewed by the representatives were highlighted for Bethlehem’s consideration. The Church’s Pastor for Outreach, Vince Johnson, responded with a letter dated April 3, 2015, recommending the following disbursement schedule: • Safe Afterschool Programs for Youth $2,500.00 • Music in the Park $1,000.00 • Annual Campaign $2,000.00 • Tree Replacement Project $1,500.00 • 2 Mobile Dental Clinics $3,000.00 (Townsedge Terrace and MV MHCs) • Any Silver View Park Shelter Projects $5,542.50 Recommendation: Attached for your consideration is Resolution 8390, a resolution which accepts the donation from Bethlehem Baptist Church in the amount of $15,542.50 and authorizes the distribution of the donations according to the Church’s recommendations. Adopted this 13th day of April, 2015 _____________________________________ Joe Flaherty, Mayor ATTEST: ____________________________________ James Ericson, City Administrator (seal) Item No: 07F Meeting Date: April 25, 2016 Type of Business: Council Business Administrator Review: ____ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Desaree Crane, Assistant City Administrator Item Title/Subject: Resolution 8554, Accepting the Twin Cities Gateway 2016 Member City Marketing Grant Background: Since 2009, the City of Mounds View has been a member of Twin Cities Gateway, a nine-city Convention & Tourism Bureau (fellow members include Anoka, Blaine, Coon Rapids, Fridley, Ham Lake, Lino Lakes, New Brighton and Shoreview). One of the Twin Cities Gateway’s programs is the “Member City Marketing Grant.” Beginning in 2011, the program was structured so that each member city receives an annual grant based on the percentage of lodging taxes collected from the prior year. Each year, the Mounds View City Council has chosen to provide grant funds towards Festival in the Park. Below is the breakdown of annual grant fund allocations for the City of Mounds View from Twin Cities Gateway. Year 2010 - $2,000 Year 2011 - $3,673 Year 2012 - $6,600 Year 2013 - $6,429 Year 2014 - $6,504 Year 2015 - $6,504 Year 2016 - $8,672 Discussion: As part of accepting the 2016 grant funds in the amount of $8,672, the City Council is required to enter into the attached grant agreement. Upon accepting the grant, the City must disperse the funds to the community festival(s) and/or event(s) the City Council wants to support. Last year, the City Council approved all grants funds issued to the Festival in the Park of Mounds View Committee. This year the Mounds View Community Center made a request to use some of this month ($1,500) to restructure their website in order to more effectively market their programs to Mounds View residents and surrounding communities. Staff recommends dispersing the grant funds between the Mounds View Community Center ($1,500) and the Festival in the Park of Mounds View Committee ($7,172). Recommendation: Staff recommends that the City Council approve Resolution 8554, accepting the Twin Cities Gateway 2016 Member City Marketing Grant, and providing the grant funds towards the marketing and promotion of the August 20, 2016, Festival in the Park in the amount of $7,172. In addition, Staff recommends providing grant funds in the amount of $1,500 towards website restructuring to market, promote programs and events at the Mounds View Community Center. Respectfully submitted, ________________________ Desaree Crane RESOLUTION 8554 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION ACCEPTING THE 2016 TWIN CITIES GATEWAY MEMBER CITY MARKETING GRANT WHEREAS, the City of Mounds View is a member of the local Convention and Tourism Bureau, Twin Cities Gateway; and WHEREAS, the City of Mounds View has enacted a tax on lodging within the City to help fund Twin Cities Gateway, along with eight other member cities, in accordance with Minnesota Statutes Section 469.190; and WHEREAS, Twin Cities Gateway’s Member City Marketing Grant program provides each member city with an annual grant based on the percentage of lodging taxes collected from the prior year; and WHEREAS, upon the executed “Mounds View 2016 Member City Marketing Grant Agreement” between Twin Cities Gateway and the City of Mounds View, the City will receive $8,672.00 in grant funding in 2016; and WHEREAS, the City of Mounds View is responsible to disperse the grant funds to the community festival(s) and/or event(s) that the City wants to support; and WHEREAS, the grant funds shall be used for marketing and promotional efforts that extend beyond the City’s borders in order to draw tourists to the community. NOW, THEREFORE, BE IT RESOLVED, that the Mounds View City Council does hereby accept the 2016 Twin Cities Gateway Member City Marketing Grant in the amount of $7.712 for the marketing and promotion of the August 20, 2016, Mounds View Festival in the Park Celebration. Whereas the grant funding provided is based on local option lodging taxes collected by the City and the eight other member cities of the Bureau and Whereas the City agrees to expend the grant funding in compliance with MN Statute 469.190 which states the proceeds shall be used for the purpose of marketing and promoting the City as a tourist or convention center and Whereas the Bureau has specified that grant funds must be used for advertising, marketing, and promotional efforts to increase participation, attendance, or visitation to an event, activity, or facility located within the City, and / or to add new activities to enhance existing events, and Whereas the Bureau specifies that advertising, marketing, and promotional efforts for which said grant funding is used must extend beyond the borders, or boundaries of the City and Whereas it is agreed that prior to December 31, 2015, the City will provide an overview of how the Bureau grant funding was utilized and, in accordance with this Agreement, documentation of actual expenses by providing copies of actual receipts or invoices.
