Discussion The City Council is being asked to hold a public hearing regarding the assessments established as part of Improvement No. 2014-C01 Mustang Drive and Mustang Circle Pavement Rehabilitation and Drainage Improvements. The public hearing will provide an opportunity for members of the public to comment on the proposed assessment roll. The required 14-day notice was published in the Sun Focus and mailed out to abutting property owners on October 9, 2015. After the public hearing, staff will be asking the Council to adopt the assessments via attached Resolution 8472. The actions requested are required by Minnesota Statutes Chapter 429, which specifies the steps that must be taken to assess property owners for the cost of local improvements. The proposed street improvements are eligible for assessment and following this process will allow the benefitting property owners to be assessed for the improvements. The total cost of this project is detailed below: Construction - $370,029.80 Design - $67,900 Materials Testing - $5,237 Total - $443,166.80 This cost is below the estimated total cost of the project. The savings is due to the fact that the contractor did not utilize the entire estimated quantities on several items, most notably the Class II rip rap material which was a savings of over $32,000. Attachment: Proposed Assessment Roll RESOLUTION NO. 8472 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA ADOPTING A SPECIAL ASSESSMENT LEVY FOR MUSTANG DRIVE STREET AND UTILITY IMPROVEMENT PROJECT WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for Improvement No. 2014-C01, Mustang Drive and Mustang Circle Pavement Rehabilitation and Drainage Improvements, which includes Mustang Drive between Old Highway 8 and Mustang Circle and Mustang Circle between Mustang Drive and the northern cul-de-sac, NOW, THEREFORE, BE IT RESOLVED by City Council of the City of Mounds View, Ramsey County, Minnesota that the City of Mounds View that: 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable with the first half of property taxes (May 15, 2016), and shall bear interest at the rate of 5.5 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2015. To each subsequent installment, when due, shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the city treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and he/she may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The city administrator shall forthwith transmit a certified duplicate of this assessment to the county auditor to be extended on the property tax lists of the county. Such assessments shall be collected and paid over in the same manner as other municipal taxes. According to Mr. Kluthe’s email, there are now only two (2) dogs at his residence. Mr. Kluthe requests to withdraw his application for a Residential Kennel License. The City sent notices of this public hearing to residents within 500 feet radius of 7869 Greenwood Drive more than ten (10) days prior to this public hearing. In addition, the notice of public hearing was published in the City’s official newspaper. Staff recommends opening the public hearing for comment, and then close the public hearing. Due to the withdraw of Mr. Kluthe’s and Ms. Zaiger’s Residential Kennel License application, no further action needs to be taken. Respectfully submitted, ____________________ Desaree Crane Item No: 07B Meeting Date: October 26, 2015 Type of Business: CB Administrator Review: ____ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Desaree Crane, Assistant City Administrator Item Title/Subject: Public Hearing, Resolution 8471, a Resolution to Consider a Residential Kennel License for Gerald Kluthe and Lanette Zaiger, located at 7869 Greenwood Drive Background Gerald Kluthe and Lanette Zaiger own a home located at 7869 Greenwood Drive. They currently have three (3) dogs (2 Rat Terriers and 1 Belgian Tervuren). All dogs are current on their rabies shots and have been licensed (tagged). Discussion On August 25, 2014, the Mounds View City Council approved Ordinance 890, which revised the requirements for obtaining a kennel license by not requiring residents to present a petition, but instead to have Staff send a public hearing notice to property owners or those occupying the land within five hundred feet (500’) radius at least ten (10) days before the public hearing. The City sent notices of this public hearing to residents within 500 feet radius of 7869 Greenwood Drive more than ten (10) days prior to this public hearing. Staff has received animal complaints with this property, and many police calls. In addition, Staff recently received four (4) phone calls from neighbors not in favor of Gerald Kluthe and Lanette Zaiger receiving a residential kennel license. The neighbors did not want to submit their concerns in writing, but all four neighbors stated they were concerned that Mr. Kluthe’s dogs always appear to escape and run at large in the neighborhood. Gerald Kluthe and Lanette Zaiger will be present at this meeting to answer any questions. Recommendation Staff recommends opening the public hearing for public comment, and considers Resolution 8471. If approved, this license will expire on June 30, 2016. Respectfully submitted, ____________________ Desaree Crane RESOLUTION NO. 8471 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING A RESIDENTIAL KENNEL LICENSE LOCATED AT 7869 GREENWOOD DRIVE WHEREAS, Gerald Kluthe and Lanette Zaiger have applied for a Residential Kennel License located at 7869 Greenwood Drive; and WHEREAS, Gerald Kluthe and Lanette Zaiger own three (3) dogs; and WHEREAS, the current dogs owned by Gerald Kluthe and Lanette Zaiger are licensed with the City in accordance with the Mounds View City Code; and WHEREAS, the appropriate paperwork and fees have been submitted to the City; and WHEREAS, in accordance with Ordinance 890, the City sent public hearing notices to registered landowners or those occupying the land within five hundred feet (500’) radius of 7869 Greenwood Drive; and WHEREAS, this license will expire on June 30, 2016. Adopted this 26th day of October, 2015. __________________________________ Joe Flaherty, Mayor ATTEST: ________________________________ James Ericson, City Administrator (seal) Item No: 7C Meeting Date: October 26, 2015 Type of Business: Council Business Administrator Review: _______ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Heidi Heller, Planning Associate Item Title/Subject: Introduction and First Reading of Ordinance 909, Amending City Code Title 1103 of the Mounds View Zoning Code Pertaining to Fences, Screening and Landscaping The Planning Commission discussed allowing 6-foot or 8-foot fences in the second front yard of corner lots. The Zoning Code currently allows fences up to 4-feet tall in any part of a property, but fences that are taller than 4-feet are only allowed behind the front line of the house. Properties that are on corners have two front yards and therefore are limited in where they can put a taller fence. Property owners want the taller fences for privacy and safety, and the Planning Commission has been very understanding of this and approved every fence height variance request. Commissioners have suggested that the zoning code should be amended to allow for these taller fences since there have been several variance requests for taller fences and they are always approved. The Planning Commission agreed that it’s time to amend the zoning code to allow for over 4- foot tall fences on corner lots. Staff researched several nearby cities’ codes pertaining to fences, and all 12 of the cities allow at least 6-foot tall fences in a street abutting side yard of a corner lot. The Commission suggested allowing up to a 6-foot fence in the second front yard of a corner lot with at least a 1 foot setback on the street frontage side. A fence taller than six feet on a corner lot would still need to go through the variance process. Staff has made some additional amendment suggestions to this chapter based on issues that have come up: - Specified that no plantings, not just trees and shrubs, over 30-inches tall are allowed in the 30-foot sight triangle at intersections, - No fence or wall may interfere with natural drainage, - Public or semi-public properties may have fences up to 8-feet tall in any yard area. The Planning Commission reviewed this code amendment on October 7, 2015, and passed Resolution 1037-15, recommending approval of amending the zoning code pertaining to fences, screening and landscaping. Ordinance 909 ORDINANCE 909 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE AMENDING CHAPTER 1103 OF THE MOUNDS VIEW CITY CODE PERTAINING TO FENCING, SCREENING AND LANDSCAPING; SPECIAL PLANNING CASE 198-15 The City of Mounds View ordains: SECTION 1. The Mounds View City Council hereby amends Chapter 1103 of the Mounds View City Code by deleting the stricken language and adding the underlined text as follows: 1103.08: FENCING, SCREENING AND LANDSCAPING: Subd. 1. Height: No fence shall exceed eight feet (8') in height, and in the case of grade separation, such as the division of properties by a retaining wall, the height shall be determined on the basis of measurement from the average point between the highest and lowest grade. Subd. 2. Intersections: No structures or plantings 30-inches or more in height, or fences, structures or planting of trees or shrubs shall be permitted within thirty feet (30') of any corner formed by the intersection of street property lines or the right of way of a railway intersecting a street, except properly constructed chain link fences. Such chain link fences shall not exceed forty eight inches (48") in height from the grade level at the lot line and shall have openings in the wire mesh of not less than one and five-eighths inches (1-5/8") nor more than two and one-fourth inches (2-1/4"). Such fences may follow must be setback at least one (1) foot from the lot line and may meet one (1) foot from to the lot corner. The thirty feet (30') restriction noted above shall consist of the triangle formed by connecting the two (2) points on intersecting lot lines that are each thirty feet (30') from the lot corner. Subd. 3. Location: a. Except as provided in subdivision 2 above, fences not to exceed forty eight inches (48") in height may be located on any part of a lot. Fences not to exceed ninety six inches (96") in height may be erected on any part of a lot behind the front line of the principal building. The City Council may require or approve fencing up to ninety six inches (96") in height in a front yard to satisfy a buffer or screening condition of a development review or conditional use permit. (Ord. 658, 8-14-00) b. A fence or retaining wall shall be installed on the applicant's property. The fence or retaining wall shall not be installed directly over the property line but shall not otherwise be subject to a setback requirement, except as provided in Subdivision 3c below. (Ord. 773, 8-14-06). Ordinance 909 Page 2 c. Fences on corner lots whose side yard abuts a roadway may be 6 feet in height beginning at the front building line of the principle structure. d. Fences abutting a roadway must have a minimum 1-foot setback from the property line. Subd. 4. Landscaping Required: In all zoning districts, the lot area remaining after providing for off-street parking, off-street loading, sidewalks, driveway, building site and/or other requirements shall be planted and maintained in grass, sodding, shrubs or other acceptable vegetation or treatment generally used in landscaping. The requirements of Chapter 1127.05 must be met for all new developments in the R-3, R-4, B-1, B-2, B-3, B-4, I-1 and PUD districts. (Amended, Ord. 785,12-10-07) Subd. 5. Surface of Fences: Any fence shall be so constructed that the surface facing adjoining properties or public rights of way shall be of finished construction. Subd. 6. No fence or wall shall obstruct natural drainage. Subd. 7. Fences on public and semi-public properties may be erected in any yard to a height of eight (8) feet. SECTION 2. In accordance with Section 3.07 of the City Charter, City staff shall have the following summary printed in the official City newspaper in lieu of the complete ordinance: On November 9, 2015, the City Council adopted Ordinance 909 that amends Chapter 1103 of the Mounds View Municipal Code. These amendments pertain to fencing, screening and landscaping. A printed copy of the ordinance is available for inspection during regular business hours at Mounds View City Hall and is available on line at the City’s web site located at www.ci.mounds-view.mn.us. Staff has suggested revisions to the job description and requests the Council consider the revised description along with the authority to advertise the vacated position. Discussion: As with any position vacancy, we want to examine the core duties being conducted and determine whether the position is needed or if there may be opportunities for restructuring the position. In my opinion, the position is needed, however the position description could be revised to better reflect current responsibilities. I have attached a red-lined version of the position description and would ask that the Council review the proposed changes. I do not believe that the proposed revisions alter the essential nature of the position to the extent to justify a compensation study, but the Council may feel differently. Assuming no compensation study is needed for the revised position, the advertisement would go live on the City’s website and the League of MN Cities website the week of October 26th, with an ad run in the StarTribune on November 1, 2015. Applications would be accepted through the month of November. Assuming enough qualified applications are submitted for consideration, we would rank the candidates and set up interviews. Given how close we may be to the Christmas holiday, interviews may need to be delayed until after January 1, 2016. Best case scenario, I would not foresee anyone starting until later in January. Assist with the receipt and issuance of building and zoning permits, coordinate the maintenance and update of the Comprehensive Plan, upkeep and maintenance of the City’s GIS system and facilitate communication with Mounds View citizens. SUPERVISION RECEIVED Works under the general guidance and direction of the City Administrator Community Development Director. ESSENTIAL DUTIES AND RESPONSIBILITIES • Provides information on the City’s planning program, zoning code and development procedures to citizens, property owners, architects, engineers, developers and contractors and others in a helpful, customer-oriented manner. • Analyzes and prepares reports on development applications to determine compliance with the City’s Comprehensive Plan, Zoning and Subdivision Codes. Coordinates the review of development applications with various departments and agencies. Keeps applicants, property owners, citizens, and other interested parties informed during the course of case review. Prepares development agreements and monitors financial guarantees to ensure assure improvements are completed as required. Does site inspections of development projects to check for compliance with approved plans as assigned. • Reviews building, sign and site fence plans for compliance with Code criteria. • Interprets and administers zoning, subdivision, housing, nuisance and other codes, and makes recommendations when code provisions are vague or in conflict with each other. Identifies inconsistencies in code provisions and recommends code revisions. Prepares code revisions as assigned. He noted that representatives from the County were in attendance to provide 40 the Council with a presentation. 41 42 Beth Engum, Ramsey County, discussed the proposed improvements, project goals, layout, 43 funding and design plans for the County Road H and I-35W interchange. She reported the 44 County wanted to improve pedestrian facilities and safety while also providing increased 45 Mounds View City Council August 24, 2015 Regular Meeting Page 4 mobility across County Road H. She understood the City’s concerns for the local businesses 1 access and discussed the proposed changes to the project that would address these concerns. The 2 cost participation between MnDOT and the County was reviewed and it was noted the City 3 would be responsible for a portion of the pedestrian facility. In addition, the City would pay for 4 the drainage costs based on contributing drainage area. She estimated that the City of Mounds 5 View would contribute $250,000 to the project. The project timeline was reviewed further with 6 the Council. She estimated that construction would begin in March of 2016. 7 8 Mayor Flaherty opened the public hearing at 7:29 p.m. 9 10 James Wilson, 7025 Pleasant View Drive, asked why the City of Mounds View was having to 11 pay for storm sewer costs given the fact MnDOT typically covers this expense. Ms. Engum 12 responded that MnDOT would be contributing $7 million to the project for the bridge 13 replacement. She explained that due to the TCAAP redevelopment, the bridge would be widened 14 and the project scope was expanded. For this reason, all water runoff would have to be captured 15 and treated. The City would be responsible for this treatment due to the fact the water would run 16 outside of the MnDOT right of way. 17 18 Mayor Flaherty understood that the City would be responsible for the water mitigation. He 19 believed that the expense to the City was reasonable. 20 21 City Administrator Ericson requested further information on the $250,000 cost estimate from the 22 County. He noted that City staff had estimated the City’s expenses to be closer to $200,000. Ms. 23 Engum explained that the additional $50,000 expense could be attributed to design expenses and 24 construction costs. She reported that these additional costs would be eligible for State Aid 25 reimbursement. 26 27 Hearing no further public input, Mayor Flaherty closed the public hearing at 7:36 p.m. 28 29 Mayor Flaherty questioned the contribution Arden Hills would be making to the project. Ms. 30 Engum reported that Arden Hills would be making the same contribution to construction and 31 design costs. 32 33 Council Member Meehlhause asked if the County was aware of the name change for County 34 Road 10. He encouraged the County to make this name change in conjuction with the County 35 Road H and I-35W project. 36 37 Council Member Meehlhause requested comment from the County on if Rice Creek Commons 38 was being put on hold. Ms. Engum discussed the Joint Powers Agreement between the City of 39 Arden Hills and the County. She reported that Arden Hills has approved a Master Plan and 40 Comprehensive Plan Amendment for Rice Creek Commons. Before these documents were 41 approved, the County Commissioners requested that Arden Hills consider the County’s request 42 for more flexibility in the plan, and this was not granted. For this reason, the County Board was 43 now discussing the level of flexibility within the Master Plan. 44 45 Mounds View City Council August 24, 2015 Regular Meeting Page 5 Finance Director Beer questioned why the County was charging 25% for construction and design 1 costs, when the City was only being charged 10% for its projects. Ms. Engum commented that 2 State Aid rules allow for reimbursement of these costs and reiterated that the County Road H 3 interchange was a very complicated project. 4 5 Council Member Mueller detested the County Road 10/County Road H stoplight. She believed 6 this intersection was extremely unsafe. She asked if the proposed re-design would improve the 7 safety at this intersection. Ms. Engum commented this was one of the main reasons this 8 intersection was being improved, in addition to the high traffic volume along County Road 10 9 and County Road H. He stated that cities are being more proactive 39 in order to protect and encourage honeybees in the metro area. Staff reviewed the proposed code 40 amendment and recommended the Council waive the First Reading and Introduction of 41 Ordinance 908. 42 43 Mayor Flaherty opened the public hearing at 8:04 p.m. 44 45 Mounds View City Council August 24, 2015 Regular Meeting Page 7 Chip Gruver, 5278 Red Oak Drive, was pleased that the City was amending its code to allow for 1 the keeping of bees. He stated that his grandfather would be training him on bees and asked if 2 this training would be sufficient. He suggested that the City allow for a nucleus hive. He 3 commented that he has a half-acre lot and was requesting the Council consider allowing him to 4 have four hives. Mayor Flaherty thanked him for his previous correspondence. 5 6 Hearing no further public input, Mayor Flaherty closed the public hearing at 8:06 p.m. 7 8 Council Member Meehlhause asked why bee licensing was being treated differently than 9 chickens/ducks. City Administrator Ericson explained that the keeping of bees differed because 10 the amount of work necessary to manage the hive was considerably different. He did not believe 11 there would be a lot of City involvement in managing beehives. 12 13 Council Member Meehlhause requested further information on a nucleus hive. Mr. Gruver 14 indicated a nucleus hive was the smallest possible size to survive the winter. He commented that 15 the nucleus hive would provide beekeepers some insurance to ensure that the hive continued to 16 thrive after the winter. 17 18 Mayor Flaherty inquired what type of bee training the City was requiring of its beekeepers. Jens 19 Loder, 7575 Pleasant View Drive, discussed the various types of bee keeping courses that were 20 provided in the metro area. 21 22 Mayor Flaherty did not believe that the City was requesting too much by requiring beekeepers to 23 attend a training course. He questioned why Mr. Gruver should be allowed to have more than 24 two hives. Mr. Gruver commented that he has .46 acres and would like to have four hives, given 25 the fact this is allowed on all properties over .5 acres. He did not believe that the bees would be 26 disruptive creatures and for this reason, he was seeking the freedom to have four hives. 27 28 Kathleen Smith, 7405 Spring Lake Road, explained that four hives would assist beekeepers with 29 covering their winter loss. She reported that in Minnesota alone, beekeepers had a 52% loss last 30 winter. She encouraged the Council to allow for homeowners to have more than two hives to 31 assist with winter loss. She appreciated the formal training requirement being suggested by the 32 City. 33 34 Council Member Meehlhause did not believe that Mr. Loder would require training as he has 35 been around bees his entire life. 36 37 Mayor Flaherty agreed with this comment, but wanted all residents to be properly trained. 38 39 Finance Director Beer questioned if the Council would consider approving a variance from the 40 proposed Ordinance to allow for homeowners to have more than two hives on their property. 41 City Administrator Ericson did not believe this was the proper way to manage this situation as it 42 was not a zoning issue and it would be difficult to determine a hardship. 43 44 MOTION/SECOND: Meehlhause/Gunn. To Waive the First Reading and Introduce Ordinance 45 Mounds View City Council August 24, 2015 Regular Meeting Page 8 908, an Ordinance Amending Chapter 701 of the Municipal Code to Permit the Keeping of 1 Honeybees in Certain Residential Districts. 2 3 Council Member Mueller was intrigued by the idea of nucleus beehives. She recommended the 4 Council consider amending the Ordinance to allow for up to four hives on any property. This 5 would allow homeowners to have two to four hives. 6 7 Council Member Gunn supported this recommendation. 8 9 Council Member Hull was in favor of the Council taking baby steps. He wanted to see the two 10 hive limit remain. 11 12 Council Member Meehlhause supported four hives. He believed that homeowners would have to 13 have a proper food source before investing in four hives. 14 15 Mayor Flaherty believed that four hives seemed like too much. He was in favor of the Ordinance 16 remaining as is and that an increase be considered in the future. Resolution 8443, a Resolution Approving the Renewal of an Agreement for 22 Services with the YMCA of the Greater Twin Cities. 23 24 City Administrator Ericson stated the YMCA has been providing Mounds View with recreation 25 programming services and management of the Community Center since 1999. This has been a 26 great working relationship for the City. He reviewed several changes to the Services Agreement 27 between the City and the YMCA and recommend Council approve renewal of the agreement. It 28 was noted the agreement had a five-year term. 29 30 Mayor Flaherty discussed the compensation rates. He asked when the compensation rates would 31 be adjusted. City Administrator Ericson commented that the rates would be adjusted January 1, 32 2016. Further discussion ensued regarding the CPI numbers. He commented that additional 33 language could be included within the agreement to address negative CPI numbers. 34 35 MOTION/SECOND: Gunn/Mueller. He noted fee proposals were requested from 6 two firms and the low bid was provided by Bolton & Menk. Staff discussed the bids further and 7 recommended Council approve the professional engineering design services with Bolton & 8 Menk. 9 10 Council Member Meehlhause requested information on the differences between project design 11 and construction expenses. Project Coordinator Stenglein explained that project design involves 12 the work it takes to create the project plans and bidding documents. He reported the construction 13 expenses centers more around the management and inspection services. 14 15 Council Member Mueller asked who updated the City’s website on a weekly basis. Project 16 Coordinator Stenglein indicated he was responsible for that task. 17 18 Mayor Flaherty discussed the differences between the two bids and how the costs varied. He 19 anticipated that the representative from Stantec would like to make a comment. 20 21 Phil Gravel, Stantec representative, did not believe that Stantec received the same documentation 22 as Bolton & Menk for the Area I Street and Utility Improvement project. He stated in years past 23 he would present a cost for the design phase, the bidding phase, and the construction phase. He 24 explained that the number presented was strictly for design services, with the understanding that 25 the bidding and construction phases would follow. He reported that the other costs were 26 provided only roughly. 27 28 Mayor Flaherty asked if Stantec was questioning the number provided to the Council regarding 29 construction costs. Mr. Gravel reported this was the case. 30 31 Council Member Gunn asked what Stantec received. Mr. Gravel stated he did not receive RFP 32 per se. He stated in the past Stantec has provided the City with project costs in order to keep the 33 improvement project moving in a timely manner. He indicated he was not aware that the project 34 would be sent out for bid. He supported the entire RFP process, however, he wanted to clarify 35 that Stantec only provided numbers to the City for the project design phase. 36 37 Mayor Flaherty understood there was a discrepancy on the information that was submitted. He 38 believed that there was a miscommunication between Stantec and the City on the RFP process. 39 He was in favor of postponing action on this item until this situation could be clarified. 40 41 Mayor Flaherty questioned how a postponement would impact the project. Project Coordinator 42 Stenglein believed that either firm would be able to survey the project area and complete design 43 plans in a timely manner if this item were delayed two weeks. 44 45 Mounds View City Council August 24, 2015 Regular Meeting Page 10 Mayor Flaherty requested comment from the Bolton & Menk representative. He questioned what 1 type of RFP they received. Mark Kasma, Bolton & Menk representative, stated he did not 2 receive an RFP but rather received a phone call from Brian Erickson requesting Bolton & Menk 3 put together a proposal for Area I. He stated he identified the project, understood the scope of 4 the services and forwarded an estimate to the City of Mounds View. He believed that both firms 5 had the opportunity to provide the City with a bid with an understanding of the scope of the 6 project and Bolton & Menk provided the low bid. 7 8 Mayor Flaherty asked if both firms were given the same information for the RFP. He asked if 9 Bolton & Menk was requested to provide design, bidding and construction costs. Joe Rein, 10 Bolton & Menk, believed that a City would want all of this information in order to properly 11 prepare for a street and utility improvement project. He commented that more thorough design 12 could be done upfront in order to reduce fieldwork; or a less detailed design could be drafted and 13 plans could be finalized in the field. He stated the bottom line was, he did not believe that the 14 City had ever received such a low engineering design/construction fee in the past. 15 16 Mayor Flaherty questioned why the engineering fees received from Stantec were not firm. Mr. 17 Gravel stated he only provided a firm number for the design services, which was his normal 18 practice with the City of Mounds View and the other numbers were estimates. He suggested that 19 the City use $180,000 for a construction number. He discussed how the Area H estimates came 20 in conservatively high and were adjusted as the project continued. 21 22 Council Member Gunn expressed frustration that the bid numbers from both firms had been 23 printed and was uncertain how to address the situation. Mr. Gravel reiterated that he had 24 followed the same bidding process that had been followed with former Public Works Director 25 DeBar and only provided a firm number for the design phase with estimates for the bidding and 26 construction phases. He believed that the construction services for Area H were not approved 27 until the spring of 2015, which he anticipated would be the same process Area I would follow. 28 He commented again, that he was only requested to provide the City with a design number and 29 not a construction number. 30 31 Council Member Gunn questioned where the rough estimate numbers from Stantec came from. 32 Mr. Gravel explained that he provided estimated construction manager hours. 33 34 Mayor Flaherty believed that the Council would have to go with the low bid even if each was an 35 estimation. 36 37 MOTION/SECOND: Gunn/Hull. He was pleased to report 28 that NYFS has a positive cash flow and a small cash bonus was being awarded to employees. He 29 commented that vacation time could only be accrued up to 80 hours after 2018. He noted that he 30 was recommended to continue his service on the Executive Committee for NYFS. 31 32 Mayor Flaherty updated the Council on the North Suburban Cable Commission. He reported that 33 negotiations continue with Comcast and with CenturyLink for a new franchise. 34 35 Mayor Flaherty thanked all of the volunteers who assisted in making Festival in the Park a huge 36 success. 37 38 Mayor Flaherty indicated the Minnesota State Fair would begin on Thursday, August 27th. 39 40 B. Reports of Staff. 41 1. Police Department 2nd Quarter Report 42 43 Police Chief Kinney reviewed the Police Department’s 2nd Quarter report with the Council. He discussed the activities handled by the School Resource 1 Officer (SRO). He reported that Officer Kirk Leitch would be the new SRO at Edgewater 2 Middle School this fall. He was proud of Officer Niko for receiving high marks in a recent 3 competition. He provided comment on a recent life-saving event that occurred in the City. 4 5 Police Chief Kinney indicated he recently toured the Ramsey County response vehicle. He 6 explained that the City’s newest officers were recently sworn in and he was pleased with the 7 work being conducted by the two new officers. He then discussed the Punt Pass Kick 8 Competition that would occur on September 19th at the Edgewater Middle School. He noted the 9 next gun safety course would begin on September 10th. 10 11 Council Member Mueller requested Police Chief Kinney pass along her thanks to the department 12 for locating an autistic boy in our community that had wandered away from his grandmother. 13 14 Mayor Flaherty appreciated the County and City’s Police Department’s participation at Festival 15 in the Park. 16 17 City Administrator Ericson stated he attended the North Metro Mayors Association meeting last 18 week. He explained the 29 agreement was put into place to protect the City in the event the drainage easement were to fill 30 with water. He noted that the property owner was looking to sell the property and a new limited 31 use agreement was necessary in order to close and transfer the property. The 22 group would meet again on Wednesday, October 14, 2015 at 7:30 a.m. 23 24 Council Member Mueller reported the next Festival in the Park meeting would be held on 25 Tuesday, September 22, 2015 at 7:00 p.m. at City Hall. This year’s event would be recapped and 26 planning would begin for the 2016 event. She encouraged anyone interested in volunteering on 27 this committee to attend. 28 29 Council Member Meehlhause explained Twin Cities Gateway would be meeting on Tuesday, 30 September 15, 2015. 31 32 Council Member Meehlhause stated the YMCA Advisory Board met today. He was pleased to 33 report that program revenue was up in 2015 when compared to last year. In addition, banquet 34 center rentals were also up. 35 36 Council Member Meehlhause noted the Lion’s would be holding a Spaghetti Dinner on 37 Thursday, October 8, 2015. 38 39 Council Member Meehlhause invited the public to participate in the Northeast Youth and Family 40 Services Taste of Northeast event on Thursday, October 22, 2015. Tickets were $30 in advance 41 and $40 at the door. 42 43 Mayor Flaherty reported the New Brighton Area Historical Society would be hosting the 19th 44 Annual Harvest Dinner on Sunday, October 11, 2015 at 1:00 p.m. where guests age 80 and older 45 Mounds View City Council September 14, 2015 Regular Meeting Page 6 (with a 55112 zip code) would be honored with a complimentary turkey dinner. Dinner would be 1 $8 for all others wishing to attend. 2 3 Mayor Flaherty invited Mounds View children to participate in the Punt, Pass and Kick event at 4 Edgewood Middle School this Saturday, September 19, 2015 at 3:00 p.m. He noted this was a 5 free event open to the public and was being sponsored by the Mounds View Police Department. 6 7 Council Member Mueller reported the League of Minnesota Cities Local Economy Committee 8 would be meeting on Tuesday, September 15, 2015. 9 10 Council Member Mueller commented the League of Minnesota Cities Board of Directors would 11 be holding a retreat in the City of Mankato on September 23-25, 2015. 12 13 B. Reports of Staff. 14 15 Public Works Director Erickson updated the Council on the Mustang Drive project. He was 16 happy to report that the final wear course had been installed. He explained that Area H required 17 two major sewer repairs that required a great deal of dewatering. He discussed the length of time 18 that it has taken to properly repair these sewer lines and indicated that staff was working to have 19 the pavement replaced. 20 21 Mayor Flaherty encouraged staff to speak with the contractor regarding the importance of 22 community relations. 23 24 Public Works Director Erickson discussed the progress being made at Groveland Park. 25 26 City Administrator Ericson indicated Mayor Flaherty would be attending the Metro Mayor’s 27 Meeting on Wednesday night and he would be attending the League of Women’s Voters Meeting 28 in New Brighton. The topic of discussion would be garbage. 29 30 Finance Director Beer questioned if the Council was interested in continuing its membership 31 with North Metro Mayors. 32 33 Mayor Flaherty recommended the Council discuss this matter further at a future worksession 34 meeting. 35 36 C. He 30 encouraged the City Council to continue to push for a sound wall. 31 32 Mayor Flaherty reported that the City has worked each year on this issue and was seeking 33 legislation to assist with the expenses of a sound wall. It was his hope that when the additional 34 lanes were added to I-35W the sound wall would be included in this project. He understood the 35 need for a sound wall and commented that he has spoken to legislation on four different 36 occasions regarding this matter. 37 38 Council Member Mueller explained that the City was also trying to address the air quality 39 standards along the corridor. 40 41 6. COUNCIL BUSINESS 1 A. 7:00 p.m. Public Hearing: Resolution 8457, a Resolution to Consider a 2 Residential Kennel License for Courtney and Chris Hansen, located at 2364 3 Laport Drive. 4 5 Acting City Administrator Crane requested the Council consider a residential kennel license for 6 Courtney and Chris Hansen to allow them to have four English Springer Spaniels. She reported 7 that the Hansen’s yard was now fully fenced. She commented that the City has received no 8 complaints regarding these animals. Staff noted that proper notification had been made for this 9 item and recommended approval of the request. 10 11 Mayor Flaherty opened the public hearing at 7:08 p.m. 12 13 Frank Blasiak, 2361 Laport Drive, asked if the property could have additional animals onsite and 14 if there would be pickup and drop-off of pets. Acting City Administrator Crane described the 15 differences between a residential and commercial kennel license. She explained the Hansen’s 16 were applying for a residential kennel license, which would allow them to have four dogs on 17 their property, and no more. She indicated the property would not be used as a commercial 18 business. 19 20 Courtney Chris, 2364 Laport Drive, explained her four English Springer Spaniels were show 21 dogs. She commented that her dogs were also used as therapy dogs. 22 23 Mike Szczpenski, 2385 Laport Drive, questioned what City Ordinance addressed pet and kennel 24 requirements. Mayor Flaherty reported Ordinance 890 set the licensing, kennel and pet limits for 25 the City of Mounds View. 26 27 Hearing no further input, Mayor Flaherty closed the public hearing at 7:14 p.m. 28 29 Mayor Flaherty reviewed an email that was sent to the City Council stating opposition to the 30 kennel license. 31 32 Council Member Mueller questioned how long the Hansen’s have lived in Mounds View. She reported a public hearing was required 6 for all transfers of ownerships. It was noted that Menbe, Inc. has a purchase agreement with M.D. 7 Liquors and was requesting transfer. She reported M.D. Liquors has submitted all necessary 8 paperwork and fees. She provided further comment on the tour she 39 took of the new facility. 40 41 Council Member Gunn noted she attended the Music of the Night at Irondale High School on 42 Saturday evening. 43 44 Mounds View City Council September 28, 2015 Regular Meeting Page 5 Council Member Mueller indicated she was in Mankato last week for the League of Minnesota 1 Cities Board of Directors retreat where top priorities for the Executive Director were discussed. 2 3 Council Member Mueller reported 37 years ago she was driving down University Avenue 4 towards south Minneapolis when a car veered into her lane and struck her vehicle head on. She 5 was happy to say she survived that accident and was married in July 36 years ago to her husband 6 Dan, and 35 years ago tomorrow began her career at Target Corporation. Another milestone for 7 her would occur on September 30th, when Groveland Road north of Arden would receive 8 concrete curb and gutter. 9 10 Council Member Meehlhause noted he attended the Twin Cities Gateway meeting two weeks 11 ago. He noted the 20-minute promotional video created for TCG was now available for viewing. 12 He was pleased to report that Mounds View hotel revenues were up 5% when compared to last 13 year. 14 15 Council Member Meehlhause indicated the Mounds View Lions Club would be holding its 16 Annual Spaghetti Feed on Thursday, October 8th at the Kraus-Hartig VFW and the cost would be 17 $9.50 per adult. 18 19 Council Member Meehlhause commented he attend an NYFS board meeting last week. He 20 provided further comment on the unmet and emerging needs of the community that could be met 21 by NYFS. He anticipated that this matter would be discussed further by the Council at an 22 upcoming worksession meeting. 23 24 Mayor Flaherty stated on Saturday, September 19th he attended the Mounds View Police 25 Department’s Punt, Pass and Kick event. He stated 50 kids signed up for this event and the age 26 group winners would be advancing to further competition. 27 28 Mayor Flaherty reported he recently attended a Five Cities meeting with local mayors and was 29 pleased to report that Mounds View had the lowest proposed levy for 2016. 30 31 Mayor Flaherty commented he attended a Super Bowl 50 Committee meeting on September 24th. 32 The committee was seeking information from local communities and how it provides safe play 33 and activities for its residents. 34 35 B.
