ADJOURNMENT Item No: 7A Meeting Date: November 9, 2015 Type of Business: PH & CB City of Mounds View Staff Report To: Honorable Mayor and City Council From: James Ericson, City Administrator Item Title/Subject: Resolution 8465, Consideration of a Conditional Use Permit for an Oversized Garage at 2443 Hillview Road; Planning Case CU2015-002 Introduction: Steven Smith, applicant and property owner of 2443 Hillview Road, is requesting approval of a conditional use permit to construct an addition to the existing attached garage on his property. The applicant plans to add a 29.5’ x 20’ addition (590 square feet) to the rear of the existing 29.5’ x 22’ (649 square feet) garage, which would create an “oversize” 1,239 square foot garage. The applicant has submitted plans for a garage larger than what the City Code allows as a permitted use. The City limits the size of accessory buildings, whether attached or detached from the house, to a maximum of 952 square feet. Any building larger than 952 square feet must get City approval of a conditional use permit. The garage the applicant is proposing would be 1,239 square feet. Requirements: Section 1106.03, Subd. 1: This part of the Code limits the height of an accessory building, the number of accessory buildings, the backyard coverage ratio of accessory buildings and specifies roof style and pitch. A Conditional Use Permit (CUP) is required for garages exceeding 952 square feet. Section 1106.04, Subd. 6: This part of the Code enumerates the conditions for garages exceeding 952 square feet. The garage must be permanent, be uniform in appearance with the home, not exceed 35 feet in width, and not exceed 1,800 square feet of total accessory building area on the lot. Section 1125.01, Subd. 1: The Planning Commission is required to review the possible adverse effects of the requested conditional use. Discussion: The applicant’s request for a conditional use permit to construct the 1,239 square foot garage satisfies the requirements as stated in Section 1106.03 and 1106.04, Subdivision 6 of the Mounds View Zoning Code. The proposed garage would meet all City setback, height and accessory building coverage requirements. The applicant’s property is 0.41 acres (143.57’ x 125’). The City Code limits backyard building coverage to 20% of the yard area. The garage addition would cover approximately 7.8% of the backyard area. 2443 Hillview Road CUP Request November 9, 2015 Page 2 The City Code also specifies that the roof for all accessory buildings exceeding 250 square feet, shall match or be similar to the character and style of the roof of the principal structure, and have a pitch or slope of at least 2-12, but no steeper than 12-12. CUP Considerations: Chapter 1125 of the Zoning Code requires that the Planning Commission review and address any potential adverse effects of a conditional use that include, but are not limited to, the relationship with the Comprehensive Plan, geographical area involved, potential depreciation, the character of the surrounding area and the demonstrated need for such a use. Staff has addressed each of these potential adverse effects below. Relationship with the Comprehensive Plan. The Comprehensive Plan designates this property as low-density residential, as well as the surrounding area. The Comp Plan encourages the development and maintenance of residential areas to improve the quality, appearance and attractiveness of housing units and residential property in general. W ith this project, the applicant would be creating more garage space for storage. Such additional storage would be a benefit to the property and to the neighborhood. The Geographical Area Involved. The applicants’ home is located on Hillview Road, in an established single-family residential neighborhood. Depreciation. The proposed garage would benefit the subject property both in a practical sense by providing additional on site, indoor parking and storage, as well as in an economic sense, as the addition would increase the “value” of the property. Increased property values are a benefit to everyone. The Character of the Surrounding Area. The applicants neighborhood is entirely single-family residential. The homes in this area are a variety of styles with a lot of wooded areas, and the lot sizes vary. The garage will be the same width as it is now so the front appearance of the house will not change. The garage will just extend an additional 20 feet into the backyard. The Demonstrated Need for Such a Use. The applicant is proposing a 1,239 square foot garage that would allow for more indoor storage and workshop space, along with vehicle parking. The Planning Commission reviewed this request and the potential adverse effects at its meeting on Wednesday, November 4, 2015. The Planning Commission approved Resolution1038-15 which recommended approval of the CUP request to the City Council. Staff has not received any feedback from area neighbors and none were in attendance at the Commission’s meeting. 2443 Hillview Road CUP Request November 4, 2015 Page 3 Recommendation: Staff recommends the City Council hold the public hearing and consider Resolution 8465, a resolution approving a Conditional Use Permit for an oversized garage as requested, with the following noted conditions: 1. The garage shall not be used for commercial purposes, living space or other uses not allowed within the R-1 Single-Family Residential district or by the Zoning Code. Should the use change for which the permit was granted; the Conditional Use Permit shall be considered null and void. 2. The garage addition shall be designed and maintained to provide a uniform appearance with the existing house and garage. 3. The Conditional Use Permit (CUP) shall become null and void if the work for which the CUP was granted is not completed within one year from the date of approval, unless a petition for extension of time in which to complete the work has been granted by the City Council. The request is consistent with the Mounds View Comprehensive Plan in that the Comprehensive Plan encourages the development and maintenance of residential areas to improve the quality, appearance and attractiveness of housing units and residential property in general. 3. The proposed garage would not be out of place given the character and geography of the surrounding area involved. 4. The proposed garage would not depreciate the neighborhood. 5. The applicant has sufficiently demonstrated that a need exists for the proposed oversized garage. NOW, THEREFORE, BE IT FURTHER RESOLVED that the Mounds View City Council approves the conditional use permit for the 1,239 square foot garage, with conditions as follows: 1. The garage shall not be used for commercial purposes, living space or other uses not allowed within the R-1 Single-Family Residential district or by the Zoning Code. OTHER INSPECTIONS / PLANNING FEES Applicants are responsible for all costs incurred associated with the filing, review and processing of development applications. Such fees are to be paid in escrow up front or upon receipt of statement from the City of Mounds View. Fees may include but are not limited to costs for consultants retained by the City, consultant planning services, attorney, and engineer fees. A deposit may also be required to cover costs of public notices, materials and staff time spent in the review, research or preparation of materials associated with this application. The applicant shall be responsible for all reasonable incurred costs in excess of the initial fee and/or deposit amount. Any portion of the deposit not spent or encumbered shall be refunded to the applicant within 30 days after consideration of the application is completed. Payment of park dedication fees is required with subdivision applications. Application fees are not refundable. Building Inspections Inspections conducted outside of normal business hours $63.25/hr. The Zoning Code currently allows fences up to 4-feet tall in any part of a property, but fences that are taller than 4-feet are only allowed behind the front line of the house. Properties that are on corners have two front yards and therefore are limited in where they can put a taller fence. Property owners often desire taller fences for privacy and safety reasons, and the Planning Commission has been very understanding of this and approved every fence height variance request. Commissioners have suggested that the zoning code should be amended to allow for these taller fences since there have been several variance requests for taller fences and they are always approved. Discussion Staff researched several nearby cities’ codes pertaining to fences, and all 12 of the cities checked allow at least 6-foot tall fences in a street abutting side yard of a corner lot. The Planning Commission suggested allowing up to a 6-foot fence in the second front yard of a corner lot with at least a 1 foot setback on the street frontage side. A fence taller than six feet on a corner lot would still need to go through the variance process. In addition to the corner lot fence height issue, staff has proposed additional language revisions to this chapter based on issues that have come up: - Specified that no plantings, not just trees and shrubs, over 30-inches tall would be allowed in the 30-foot sight triangle at intersections, - No fence or wall may interfere with natural drainage, and - Public or semi-public properties may have fences up to 8-feet tall in any yard area. The Planning Commission reviewed the proposed code amendment on October 7, 2015, and approved Resolution 1037-15 recommending approval of the revisions to the zoning code pertaining to fences, screening and landscaping, and recommended adoption by the City Council. The City Council considered proposed Ordinance 909 at its meeting on October 26, 2015, and approved the first reading as presented. Staff Report Ordinance 909 November 9, 2015 Page 2 Revisions Since First Reading The ordinance presented for the second reading and adoption has been revised since the first reading to provide additional clarity regarding a fence or wall impeding natural drainage. Because fences are often located within easement areas, the following language has been added to proposed Subd 6 of Section 1103.08: “No fence or wall shall obstruct natural drainage or impede the function and flowage within a dedicated drainage easement”. In addition, Staff would like the City Council consider amending the Ordinance to remove the requirement for a one-foot setback for a fence abutting right of way. While I understand and appreciate the Planning Commission’s reasoning behind the suggested change, requiring such a setback would make hundreds of fences in the City non-conforming and would force residents with existing fences to seek a variance to keep the fence in the same location when it comes time to replace it. Recommendation Staff recommends the City Council open the public hearing for this code amendment and take public feedback regarding the proposed changes. Barring any concerns or additional revisions, staff would recommend approval of the second reading and adoption of Ordinance 909, amending City Code Chapter 1103, pertaining to fencing, screening and landscaping. The Ordinance includes a section that authorizes publication of the ordinance summary in the newspaper in lieu of the entirety of the ordinance, in accordance with Section 3.07 of the City Charter. The Mounds View City Council hereby amends Chapter 1103 of the Mounds View City Code by deleting the stricken language and adding the underlined text as follows: 1103.08: FENCING, SCREENING AND LANDSCAPING: Subd. 1. Height: No fence shall exceed eight feet (8') in height, and in the case of grade separation, such as the division of properties by a retaining wall, the height shall be determined on the basis of measurement from the average point between the highest and lowest grade. Subd. 2. Intersections: No structures or plantings 30-inches or more in height, or fences, structures or planting of trees or shrubs shall be permitted within thirty feet (30') of any corner formed by the intersection of street property lines or the right of way of a railway intersecting a street, except properly constructed chain link fences. Such chain link fences shall not exceed forty eight inches (48") in height from the grade level at the lot line and shall have openings in the wire mesh of not less than one and five- eighths inches (1-5/8") nor more than two and one-fourth inches (2-1/4"). Such fences may follow must be set back at least one (1) foot from the lot line and may meet one (1) foot from to the lot corner. The thirty feet (30') restriction noted above shall consist of the triangle formed by connecting the two (2) points on intersecting lot lines that are each thirty feet (30') from the lot corner. Subd. 3. Location: a. Except as provided in subdivision 2 above, fences not to exceed forty eight inches (48") in height may be located on any part of a lot. Fences not to exceed ninety six inches (96") in height may be erected on any part of a lot behind the front line of the principal building. The City Council may require or approve fencing up to ninety six inches (96") in height in a front yard to satisfy a buffer or screening condition of a development review or conditional use permit. b. A fence or retaining wall shall be installed on the applicant's property. The fence or retaining wall shall not be installed directly over the property line but shall not otherwise be subject to a setback requirement, except as provided in Subdivision 3c below. c. Fences on corner lots whose side yard abuts a roadway may be 6 feet in height beginning at the front building line of the principle structure. Ordinance 909 Page 2 d. Fences abutting a roadway must have a minimum 1-foot setback from the property line. Subd. 4. Landscaping Required: In all zoning districts, the lot area remaining after providing for off-street parking, off-street loading, sidewalks, driveway, building site and/or other requirements shall be planted and maintained in grass, sodding, shrubs or other acceptable vegetation or treatment generally used in landscaping. The requirements of Chapter 1127.05 must be met for all new developments in the R-3, R-4, B-1, B-2, B-3, B-4, I-1 and PUD districts. (Amended, Ord. 785,12-10-07) Subd. 5. Surface of Fences: Any fence shall be so constructed that the surface facing adjoining properties or public rights of way shall be of finished construction. Subd. 6. This report summarizes the steps involved to create and approve an EDA levy to support such activities within the City of Mounds View. Discussion: A typical EDA levy is a levy set by a city at the request of the EDA. For example, if the City Council determines that the EDA needs an additional $43,503 to operate in the coming year, the City could increase the general fund levy by 1% and transfer the amount to the EDA. Because the EDA levy is part of the City levy, it is not a “special levy” under state law and thus the EDA levy is subject to the City’s overall levy limit. For 2016, the City’s Charter imposed levy limit is 1%, which did not leave any additional levy space to fund EDA activities. State law provides an alternative to an EDA levy as referenced above, and that would be in the form of an HRA levy. Many EDA-enabling resolutions adopt all the powers of an HRA, in addition to those of an EDA. If so, the EDA may levy a separate tax or “HRA levy,” and then the EDA functions as a special taxing district as if it were an HRA and that levy is NOT subject to levy limits or to city debt limits. An EDA using the levy powers of an HRA is limited to a levy no more than 0.01813 percent of the total taxable market value in the city. For Mounds View, that amount would allow for a maximum levy of $161,236. In researching the enabling language for the Mounds View Economic Development Authority, it was discovered that the enabling language did NOT include the adoption of those powers of an HRA. (Resolution 4532, adopted on March 28, 1994, is attached for your reference.) Thus, for the City Council to adopt an HRA levy to fund our economic development program, the enabling language would need to be amended. Resolution 8467 has been drafted by the City Attorney to accomplish the requisite updates to the EDA’s enabling language. EDA Enabling Language Report November 9, 2015 Page 2 Public Notice: To amend the EDA enabling legislation, Minnesota Statutes require that a written notice of the public hearing be published in a newspaper of general circulation within the City once a week for two consecutive weeks prior to the public hearing, the first date of which not occurring more than 30 days prior to the public hearing. The first date of publication was November 6th, the second date of publication one week later, on November 13, 2015. Because of the two consecutive published hearing notices, action on the attached resolution cannot occur until November 23, 2015, as stated in the published notice. The public hearing can be opened (since it had been noticed at the previous Council meeting) but no action can be taken. The public hearing will need to be continued until November 23, 2015, pursuant to the published notice. As design was underway for the Street and Utility Improvement Project – Area H (City Project No. 2014-C04), the decision was made to include the rehabilitation of this lift station as part of the Area H project. This work was included in bid documents and is part of the contract awarded to Northwest Asphalt. Discussion: The inclusion of the lift station rehabilitation as part of the Area H project allowed this work to be bid as part of a larger project. As a result, some economies were realized and the potential need to coordinate between two different contractors was eliminated. At this point Northwest Asphalt has received materials that required a long shipping time, installed dewatering, and is preparing to begin excavation for this phase of the project. However, one necessary item that has not been awarded is the construction services to be provided by Stantec Consulting Services, Inc for the rehabilitation of the Groveland Lift Station. On December 8, 2014, via Resolution 8345, the City Council awarded design services for the lift station. Stantec completed the design work and it was included as part of the bid package for Area H. Resolution 8393 awarded the construction services for the street portion of Area H to Stantec on April 13, 2015. In September 2015, staff met with Stantec to discuss construction progress on Area H. During those discussions, Stantec brought to light the fact that the construction services awarded as part of Resolution 8393 did not include the lift station construction. Stantec then provided a proposal that would cover the staff time required to inspect the lift station rehabilitation. This time would include not only field inspection, but review of the technical shop drawings and other submittals. Ideally, this proposal would have been awarded with the construction services with Resolution 8393; however, that did not happen. In order to ensure the lift station is properly constructed staff recommends that this proposal be accepted and this phase of work be awarded to Stantec. Recommendation: Public Works recommends that the City Council adopt the attached resolution to authorize Stantec to perform construction services related to the lift station rehabilitation. The report outlined the improvements to the trail network along County State Aid Highway (CSAH) 10 through the City of Mounds View. The report divided the trail into 11 segments from County Road H to Pleasant View Drive. The purpose of this memorandum is to summarize the proposed improvements for Trail Segments 6 and 11 along CSAH 10 (see Figure 1 and Figure 2). A preliminary cost estimate for the proposed improvements is also included as part of this report (Appendix A). EXISTING CONDITIONS TRAIL SEGMENT 6 As part of the feasibility report, Trail Segment 6 was identified as the north side of CSAH 10 from Red Oak Drive to Pleasant View Drive. The City recently decided Segment 6 should be shortened as part of this project, and the trail between Groveland Road and Pleasant View Drive would not be constructed at this time. The intersection of Pleasant View Drive and CSAH 10 is the city limits with Spring Lake Park. Currently, Spring Lake Park has no plans to extend a trail along CSAH 10. In addition, the City prepared a Trails and Sidewalks plan as part of the City’s Comprehensive Plan. This plan shows no other trail and sidewalk connections to CSAH 10 west of Groveland Road. The sidewalk identified in the plan along Groveland Road north of CSAH 10 was recently constructed in fall 2015 as part of the 2015 Street and Utility Improvement Project – Area H. TRAIL SEGMENT 11 As part of the feasibility report, Trail Segment 11 was identified as the south side of CSAH 10 from just west of County Road H2 to Woodale Drive. Segment 11 will fill the gap between the existing bituminous trails at both ends of the segment, resulting in a continuous trail along the south side of CSAH 10 from Silver Lake Road to County Road H. PROPOSED IMPROVEMENTS TYPICAL SECTION A 10-foot wide bituminous trail is proposed for both Segments 6 and 11. The pavement section is proposed to be 2.5-inches of bituminous pavement over 6-inches of class 5 aggregate base. This pavement section will match the existing trail sections constructed most recently along CSAH 10. Soil Page 2 borings will be taken to confirm the pavement section is adequate given the in-situ soil conditions and attempt to identify the location of poor soils, if present. LIGHTING Trail lighting is proposed along both Segments 6 and 11. Lights are proposed to be spaced at approximately 100-foot intervals which matches the spacing on other segments. The lights are proposed to be LED fixtures mounted on the City standard shoe-box style poles. As with past segments, decorative poles are proposed at the major intersections. The decorative poles used on previous segments incorporated a medallion with the City logo as part of the design. The medallion proposed with this project will need to de redesigned as the City logo has since been updated. Along with providing lighting for Segments 6 & 11, there is an existing trail segment immediately adjacent to Segment 11 which doesn’t currently have lighting. This section of trail is located along the south side of CSAH 10 from Long Lake Road to Moe’s. Lighting is proposed to be extended as part of Trail Segment 11 to cover this section of trail. Trail lighting will then be continuous on the south side of CSAH 10 from Silver Lake Road to County Road H. DRAINAGE The existing drainage patterns along CSAH 10 are proposed to be maintained as part of this project. The trail is proposed to be located on the back side of the existing ditch where feasible. Culverts are proposed to be added when the trail crosses the existing ditch and blocks drainage. There are numerous areas with existing drainage issues along both Segments 6 & 11. Most of the existing ditches lack adequate grade for proper drainage. Minor grading to correct the flat grades is not possible. In general, Mounds View has a very flat topography and sandy soils which are conducive to infiltration. Standing water is noticeable in the ditches after large rain events and in the spring when the ground is still frozen. This water eventually infiltrates into the ground. A number of driveway culverts are plugged full of sediment, and others are completely buried or don’t exist. Replacement of these culverts would not solve the drainage issues either. No improvements to the existing drainage system are proposed with this project as the amount of work required to correct the deficiencies would be extensive. LANDSCAPING A small amount of landscaping is proposed to be located along the trail at the major intersections. Since the landscaping will be planted along a County highway, landscaping that can survive the harsh conditions prone to these situations will be chosen. Choosing plantings which require a minimal amount of maintenance will also be important. Other segments of the CSAH 10 trail had extensive landscaping incorporated into the project. The City is lacking the time and resources to maintain these areas and some of them have become overgrown. EDGEWOOD DRIVE AND CSAH 10 INTERSECTION Improvements to the existing trail at the southwesterly leg of the intersection of Edgewood Drive and CSAH 10 are proposed as part of this project. Currently, the trail crosses Edgewood Drive in 2 separate Page 3 locations which are fairly close to each other. One crossing is near the traffic signal and the second crossing is about 50’ southwest of the signal. The crossing located away from the signal is proposed to be eliminated for the following reasons: ·The crossing is located an odd distance away from the intersection and in an unusual location for a typical mid-block crossing ·There is no striped crosswalk or signing notifying motorists of the crossing ·There is another crossing located 50’ away at the signal which is the typical crossing location COST ESTIMATE A detailed cost estimate has been prepared and is attached to this memo. Ramsey County has a cost participating policy where they will generally participate in the costs for sidewalks and trails constructed within the County right-of-way. The policy states the County may share in 50% of the costs for the surface and base materials for sidewalks and trails. This would include participation in the class 5 aggregate base and bituminous pavement costs of the trail. This program has multiple goals: to revitalize the corridor, to create a sense of space and identity within the community and to improve the safety and operation of traffic and pedestrian activities along County Road 10. Discussion: On May 26, 2015 the City Council, via Resolution 8420, authorized Bolton & Menk, Inc. (BMI) to begin design work on two of the eleven segments that were proposed as part of the Corridor Improvement Program. Segments 1-5, 9 and 10 have been completed to date. The two segments that were awarded to Bolton & Menk are: • Segment 6 – Connection from the existing trail along the north side of CSAH 10 at Silver Lake Road to Pleasant View Drive (original scope). • Segment 11 – Connection from the existing trail along the south side of CSAH 10 just west of Moe’s Sport’s Bar to Woodale Drive. As BMI started their design work it became clear that the cost for these two segments would exceed the funding that was available for this work. As a result staff discussed this with City Council and recommended a reduction in scope on Segment 6 such that it ends at Groveland Road. If extended to Pleasant View Drive there is no existing sidewalk along Pleasant View Drive or CSAH 10 to the west, resulting in a dead end trail. Staff has also contacted Spring Lake Park and at this point in time they have no plan for extending trail along the north side of CSAH 10 to connect into Mounds View. The Council agreed with this reduction which allowed the project to remain within budget restrictions. To date, BMI has completed a topographic survey of the corridor and identified some items to be addressed in the design. This information is outlined in a draft memorandum provided to staff and attached to this report. As a side note, staff has reviewed the draft memo and is not recommended any changes. The final memo should be available for the Council Meeting on November 9, 2015. The items of note in the memo include: • Trail lighting • Drainage • Landscaping • Edgewood Drive/CSAH 10 Intersection Trail lighting will be installed along the new segments of trails. Spacing will be similar to the existing trail at approximately a 100-foot interval. Decorative lights are planned for the intersections and standard (shoebox) fixtures will be provided in between the intersections. The lighting will be LED similar to the recently installed retrofit fixtures. In addition, staff will be reviewing the possibility of adding lighting along the existing segment of trail west of Moe’s to Long Lake Road as there is currently no existing lighting. This will require coordination with the property owners, and staff will return at a future date with additional information regarding this possibility. Drainage along the corridor will be maintained as it currently exists. In most areas the trail will be placed along the back of the existing ditch. Culverts will be installed as needed under the trail; however, no improvements to the existing drainage system are proposed. Landscaping is planned as part of the trail project. However, due to the harsh conditions near CSAH 10, the proper selection of plantings will be critical to insuring its viability. Additionally, the landscaping should be low maintenance as the staff has limited resources to maintain the landscaping. Finally, the intersection of existing trail at Edgewood Drive on the south side of CSAH 10 is in need of safety improvements. Currently there are two legs from the trail that intersect Edgewood Drive. One is at the stop light controlled intersection and ties into a crosswalk. The second is approximately 50’ to the south and has no crosswalk. This crossing is located in such a manner to make it an unsafe crossing due to its proximity to the intersection. As a result, staff would recommend that this project remove the leg of trail that is not at the stop light. This would have the effect of causing pedestrians to move to the existing crosswalk. The estimated cost of $18,000 for this removal would fit within the existing budget. Finally, a detailed construction cost estimate has been prepared by BMI, and is shown in the table below. In addition, based on Ramsey County’s cost share policy an estimated $39,300 of County funding should be available for this work and would reduce the required amount needed from the City. It should be noted that these are preliminary construction estimates and may change based on the bidding climate in the future. Recommendation: Public Works recommends that the City Council adopt the attached resolution to authorize Bolton & Menk, Inc. to continue with their design effort on Trail Segments 6 & 11.
