ADJOURNMENT Item No: 7A Meeting Date: June 23, 2014 Type of Business: Council Business Administrator Review: _________ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Heidi Heller, Planning Associate Item Title/Subject: Public Hearing for the Consideration of a Preliminary Plat for a 5-lot subdivision at 8211 Red Oak Drive; Planning Case MA2014-002 Introduction: Terry Buchanan, owner of Kayak Remodeling & Redevelopment, has a purchase agreement to buy the east two acres of the Abiding Savior Church property at 8211 Red Oak Drive. Kayak has applied for a major subdivision to split the land into five single family lots. Discussion: The applicant also needs to apply for a Comprehensive Plan map amendment since the Comprehensive Plan existing and future land use maps designate this entire parcel as “church.” It must be changed to “Single family detached” to be consistent with the new residential use. A Comprehensive Plan Amendment requires a public hearing by the Planning Commission, so staff is postponing the public hearing for June 23, 2014 and will instead hold public hearings at the July 2, 2014 Planning Commission meeting and at the July 14, 2014 City Council meeting for both the major subdivision and the comprehensive plan amendment. The residents within the required notification radius area were mailed a second notice about the change and the new public hearing dates. Recommendation: Open the public hearing and take testimony from anyone who would like to speak on this matter, and continue the public hearing until Monday, July 14, 2014. Respectfully submitted, Heidi Heller Planning Associate Item No: 07B Meeting Date: June 23, 2014 Type of Business: Business City of Mounds View Staff Report To: Honorable Mayor and City Council From: James Ericson, City Administrator Item Title/Subject: Resolution 8270 Approving Revisions to the Economic Development Specialist Position Description and Authorizing the Advertisement of the Part Time Position Introduction: Earlier this year, the City Council authorized staff to advertise to fill the vacant Economic Development Specialist position. Staff interviewed qualified candidates with second interviews conducted with three finalists. An offer was extended to the identified top candidate, which, after some negotiations, the candidate rejected. While we were disappointed with the outcome, the process did prompt us to re-evaluate the position description to better reflect our expectations. Discussion: It became clear during the interview process that some of the tasks and responsibilities which we felt were critical to the position were not expressly articulated in the job description. Duties such as marketing, communications, social media outreach and web development were under-emphasized in the description, if mentioned at all. Conversely, given the limited availability of developable land in the community, certain other tasks and duties were deemed to be less “mission critical”. With these points in mind, staff presented a revised job description to Economic Development Commission on May 23, 2014. The Commission agreed with the revisions and supported the re-naming of the position to “Business Development Coordinator”. The Commission and Staff believe that a position focused on matters of business development and business retention would be more consistent with the community’s present needs. These changes were presented to the City Council at the June 2, 2014, Work Session, and staff was directed to bring the revisions back for formal approval and to reauthorize the advertisement for the revised position. At the Work Session, staff indicated that the revised description had been forwarded to Springsted for review, to ensure that the changes being contemplated would not materially impact the nature of the position. Springsted agreed that the changes were not substantial and would not necessitate a revision to the assigned HAY points or to the compensation. Economic Development Specialist Position Description Revisions June 23, 2014 Page 2 Recommendation: Based on the recommendation from the Economic Development Commission, direction provided by the City Council at the June 2, 2014 Work Session and feedback received from the City’s consultant Springsted, staff recommends approval of Resolution 8270, a resolution approving revisions to the Economic Development Specialist job description and authorizing that the position be advertised. Respectfully submitted, ________________________ James Ericson City Administrator RESOLUTION NO. 8270 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING REVISIONS TO THE ECONOMIC DEVELOPMENT SPECIALIST POSITION DESCRIPTION AND AUTHORIZING STAFF TO ADVERTISE TO FILL THE VACANT PART TIME POSITION, RENAMED, “BUSINESS DEVELOPMENT COORDINATOR” WHEREAS, the Mounds View City Council has reviewed the job description of the Economic Development Specialist and believe changes to the position description are necessary to better reflect the needs of the City; and, WHEREAS, one of the proposed changes would involve renaming the position to “Business Development Coordinator”; and, WHEREAS, the Economic Development Commission has reviewed the proposed changes and expressed their support and recommended approval; and, WHEREAS, the position plays a vital role in support of the continued growth and development of the business community and the sustained redevelopment and tax base enhancements on the County Road 10 corridor; and, WHEREAS, the position serves as the link between the City and the business and corporate communities, promotes the advantages of conducting business within the community and acts as a liaison to many civic and government entities. NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Mounds View approves revisions to the position description attached hereto as Exhibit A, and authorizes staff to post an announcement to fill the vacant position of “Business Development Coordinator” on a part time basis. Performs a variety of routine and complex administrative, technical and professional work in the preparation and implementation of business economic development and redevelopment plans, programs and services, and the preparation and dissemination of marketing and communication materials. __________________________________________________________________ SUPERVISION RECEIVED Works under the general supervision of the City Administrator. SUPERVISION EXERCISED None. ESSENTIAL DUTIES AND RESPONSIBILITIES  Coordinate the activities of the Economic Development Commission (EDC) and assist with matters of the Economic Development Authority (EDA).  Coordinate business and economic development marketing and promotional activities aimed at attracting new development and investments to Mounds View.  Manage the City’s website and social media presence; promote positive online communications.  Provide technical and professional advice and support to other staff members, local development corporations, Ramsey County and relevant State agencies.  Develop and maintain a Business Retention Program via regular contact with business owners, property owners, and economic and business development related community organizations.  Create and distribute marketing materials and brochures in support of the City’s business development programs.  Assist with the negotiation and implementation of development agreements for redevelopment projects including coordination of property acquisition, relocation efforts, site clearances and related actions.  Assist in the administration of the City's business subsidy programs and “Business Toolbox”. Tax Increment Finance (TIF) program and districts. Review and score TIF applications submitted by businesses or developers. Page 2   Assist in the administration of the City’s Tax Rebate Finance (TRF) program. Review and score TRF applications submitted by businesses or developers.  Develop short and long range business and economic development and redevelopment plans; gather, interpret, and prepare data for studies, reports and recommendations.  Develop and maintain a comprehensive database of the inventory of available buildings and sites in the community for business and economic development purposes.  Prepare and maintain information on utilities, taxes, zoning, transportation, community services, financing tools, etc.; respond to requests for information for business and economic re/development purposes; prepare data sheets and other information.  Respond to local citizens inquiring about local business and economic development activities and opportunities.  Monitor local, state and Federal legislation and regulations relating to business and economic development, and report findings, trends and recommendations to City Administrator.  Assist in the application and submission of grants and other outside funding opportunities to further the business and economic development goals of the City. PERIPHERAL DUTIES Attends professional development workshops and conferences to keep abreast of trends and advancements developments in the fields of business and economic development, marketing, social media and business subsidies tax increment financing. MINIMUM QUALIFICATIONS Education and Experience: (A) Must have a B.A. degree in urban planning, business or public administration, economics, marketing, finance, or a related field, and a minimum of one full year of experience in economic/community development and/or redevelopment, business subsidies TIF, chamber of commerce, economic development authority activities, and/or, business retention programs. DESIRED QUALIFICATIONS (A) Masters Degree in urban planning, business or public administration, economics, marketing, finance, or a related field. WHEREAS, the City is owner of City Hall, City Hall Park, and Community Center (collectively the “Park”) located within the City; and WHEREAS, the Corporation desires to sponsor and coordinate an annual community event entitled, “Festival in the Park of Mounds View” (the “Festival”), to be held on August 16, 2014; and WHEREAS, pursuant to Minnesota Statutes, and other laws, the City has the authority to operate a program of public recreation and enter into agreements with the Corporation pertaining to the conduct thereof; and WHEREAS, the City desires that the Corporation sponsor and coordinate the Festival; and WHEREAS, the City is willing to support the Festival, as set forth in this Agreement; and WHEREAS, the Corporation is willing to undertake the Festival sponsorship and support of the City in accordance with the terms and conditions of this Agreement. NOW THEREFORE, the parties agree as follows: 1. Scope of Festival. The Corporation will sponsor and coordinate all aspects of the Festival. 2. Time and Performance. This Agreement will begin as of August 15, 2014, and will terminate as of August 17, 2014 (the “Termination Date”). 3. City Contribution. The City will provide the assistance of City staff to assist the Corporation as set forth on Exhibit A, which is incorporated herein by reference. The City will provide the assistance of City equipment to assist the Corporation as set forth on Exhibit B, which is incorporated herein by reference. The City will allow use of the Park upon the Corporation requesting and obtaining the appropriate permits from the City for the Park. The City agrees to waive the permit fee for the Park. If the Agreement should be terminated for any reason prior to the Termination Date, the City’s assistance to the Corporation will cease upon termination. In such case any unfulfilled assistance as set forth in Exhibits A and B will remain unfulfilled. The Corporation shall pay any and all taxes due to federal, state, and local governments, and the City shall not withhold any amounts therefore. In addition, the Corporation shall be responsible for any necessary workers compensation and unemployment insurance required for the individuals performing services hereunder, and the City shall have no obligation whatsoever in this regard. 4. Independent Contractor. The Corporation and neither it nor any of its volunteers, employees or agents performing services hereunder shall be an employee of the City. The Corporation is an independent contractor and it shall retain control over the manner and means of the work set forth above. The Corporation understands and acknowledges that the City shall not provide any benefits of any type in connection with this Agreement, including but not limited to health or medical insurance, workers compensation insurance, or unemployment insurance. The Corporation shall in no case have the power to bind or obligate the City in any way to any third-party. 5. Insurance. a. The Corporation shall provide comprehensive general liability insurance for bodily injury and property damage with a combined single limit of $1,000,000 per occurrence. Such comprehensive general liability insurance shall include, but not be limited to, coverage for mechanically-operated amusement devices, alcohol sales, and fireworks displays. The policies of insurance shall name the City of Mounds View as an additional insured. b. The Corporation shall provide evidence of automobile and mobile equipment insurance coverage for all motorized vehicles used in connection with work under this Agreement with a combined single limit for bodily injury and property damage of not less than $1,000,000 per occurrence. c. A Certificate of Insurance showing coverage as indicated above with a carrier that is acceptable to the City of Mounds View as well as a copy of all policies of insurance shall be submitted to the City Administrator at least 30 days prior to the Festival. The City reserves the right to reject the carrier if it is not an A+ carrier licensed to do business in the State of Minnesota. d. Nothing herein shall be construed as a waiver of any immunity or limitation on liability to which the City is entitled under law. 6. Termination. If either party fails to perform its obligations under this Agreement, the other party may terminate this Agreement by giving written notice of the intention to terminate to the other party at least thirty (30) days prior to such termination, provided, however, that if Corporation’s failure to perform its obligations hereunder creates or constitutes, in the sole judgment of the City, a threat to the public health, safety, or welfare, the City may immediately terminate this Agreement. 7. General Terms and Conditions. a. The Corporation will provide all equipment used by the Corporation, except the City equipment as set forth in Exhibit B, which is incorporated herein by reference. b. The Corporation will control its own schedule of work hours as necessary to sponsor and coordinate the Festival. c. Any and all reports, and other work products, whether completed or not, that are prepared or developed by the Corporation as a part of this Agreement shall be jointly owned by the City and the Corporation and shall be made available to the City promptly at the City’s request or at the termination of this Agreement. The Corporation shall provide annual financial reports including all revenues and expenditures related to the Festival for the present year within thirty days of the date of the Festival, and the City will retain these records for three (3) years. d. Any titles of the several parts of the Agreement are inserted for convenience of reference only and shall be disregarded in construing or interpreting any of its provisions. e. A notice, demand, or other communication under this Agreement by either party to the other shall be sufficiently given or delivered if it is dispatched by registered or certified mail, postage prepaid, return receipt requested, or delivered personally to the following addresses: City: 2401 County Road 10 Mounds View, MN 55112 ATTN: City Administrator Corporation: 2085 Hillview Rd Apt. 1 Mounds View, MN 55112-1314 ATTN: Theresa Cermak, President or at such other address with respect to either such party as that party may, from time to time, designate in writing and forward to the other as provided in this Section. f. Any disputes, controversies, or claims arising out of this Agreement shall be heard in the state or federal courts of Minnesota, and the parties to this Agreement waive any objection to the jurisdiction of these courts, whether based on convenience or otherwise. h. If any provision or application of this Agreement is held unlawful or unenforceable in any respect, such illegality or unenforceability shall not affect other provisions or applications that can be given effect, and this Agreement shall be construed as if the unlawful or unenforceable provision or application had never been contained herein or prescribed hereby. i. This Agreement, together with its Exhibits, which are incorporated by reference, constitutes the complete and exclusive statement of all mutual understandings between the parties with respect to this Agreement, superseding all prior or contemporaneous proposals, communications, and understandings, whether oral or written, concerning this Agreement. This Agreement may not be amended nor any of its terms modified except by written authorization and executed by both parties hereto. 8. The Corporation shall protect, indemnify, defend, and hold harmless the City and its governing body members, officers, agents, servants, and consultants against and from any claim, demand, suit, action, or other proceeding whatsoever by any person or entity whatsoever arising or purportedly arising from this Agreement or the activities undertaken pursuant to it. The provisions of this paragraph 8 shall survive termination of this Agreement. 9. The Corporation will provide the City with a comprehensive accounting and detailing the assistance contributed by the City to the Festival and the Corporation. The Mounds View Festival in the Park is scheduled for Saturday, August 16, 2014. Discussion: The 2014 Festival in the Park Agreement was reviewed by the City Attorney and the Festival Committee. The President of the Festival Committee, Theresa Cermak, will be present to answer any questions. Recommendation: Attached for your approval is the 2014 Festival in the Park Agreement. Staff recommends approval of Resolution 8272, authorizing the execution of the agreement with the Festival in the Park of Mounds View for the August 16, 2014, Festival in the Park event. Respectfully Submitted, __________________________ Desaree Crane RESOLUTION 8272 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING THE EXECUTION OF THE AGREEMENT WITH THE FESTIVAL IN THE PARK OF MOUNDS VIEW FOR THE 2014 FESTIVAL IN THE PARK WHEREAS, The City of Mounds View desires to co-sponsor an annual community event entitled “Mounds View Festival in the Park” to be held on August 16, 2014; and WHEREAS, the 2014 Festival Agreement, attached as Exhibit A, has been reviewed by the City Council, the City Attorney, and have been reviewed and approved for execution by the Festival in the Park of Mounds View Committee, the non-profit organization in charge of the Festival. NOW, THEREFORE BE IT RESOLVED that the Mounds View City Council does hereby approve the attached Festival Agreement as set forth in Exhibit A and authorizes its execution by the Mayor and City Administrator. Meeting Date: June 23, 2014 Type of Business: Council Business City Administrator Review: ______ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Mark Beer, Finance Director Item Title/Subject: Resolution 8271 Adopting and Reporting Performance Measures Background: The legislature created the Council on Local Results and Innovation in 2010. (CLRI) The CLRI created standardized performance measures that will aid residents, taxpayers, and state and local elected officials in determining the efficacy of cities in providing services. Participation in the standard measures program is voluntary. Discussion and Recommendation: To participate, a city must adopt, implement, and publish a minimum of 10 performance measures as provided by the CLRI. The City of Mounds View already maintains a number of the standard performance measures and will add more in the future. The standard measures will be published on the City’s website and in the next edition of Mounds View Matters. The City will also be eligible for reimbursement of $.14 per capita or $1,701.70 for participation in the program. Attached is resolution 8271 and the list of standard performance measures that the City Council will adopt. Staff recommends approval. Respectfully submitted, ___________________________ Mark Beer RESOLUTION NO. 8271 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION ADOPTING AND REPORTING PERFROMANCE MEASURES WHEREAS, in 2010, the Minnesota Legislature created the Council on Local Results and Innovation; and WHEREAS, the Council on Local Results and Innovation developed a standard set of performance measures that will aid residents, taxpayers, and state and local elected officials in determining the efficacy of municipalities in providing services; and WHEREAS, benefits to the City of Mounds View are outlined in MS 6.91 and include eligibility for a reimbursement as set by State statute; and WHEREAS, any municipality participating in the comprehensive performance measurement program is also exempt from levy limits for taxes, if levy limits are in effect; and WHEREAS, the Mounds View City Council has adopted and implemented at least10 of the performance measures, as developed by the Council on Local Results and Innovation, and a system to use this information to help plan, budget, manage and evaluate programs and processes for optimal future outcomes; and NOW THEREFORE LET IT BE RESOLVED THAT, the Mounds View City Council will report the results of the performance measures to its citizenry by the end of the year through publication in the quarterly Mounds View Matters news letter, posting on the city’s website, or through a public hearing at which the budget and levy will be discussed and public input allowed. BE IT FURTHER RESOLVED, The Mounds View City Council directs staff submit to the Office of the State Auditor the actual results of the performance measures adopted by the city.
