Item Title/Subject: National Police Week Proclamation
Introduction:
Established in 1962 by President Kennedy and a joint resolution of Congress, National
Police Week pays special tribute to the law enforcement officers who have lost their
lives in the line of duty for the safety and protection of others.
Recommendation:
It is the recommendation of staff that the following proclamation is declared. Please
read the proclamation out loud.

PROCLAMATION
WHEREAS, there are approximately 900,000 law enforcement officers serving in
communities across the United States, including the dedicated members of the Mounds
View Police Department;
WHEREAS, some 60,000 assaults against law enforcement officers are reported
each year, resulting in approximately 16,000 injuries;
WHEREAS, since the first recorded death in 1792, nearly 20,000 law enforcement
officers in the United States have made the ultimate sacrifice and been killed in the line of
duty;
WHEREAS, the names of these dedicated public servants are engraved on the walls
of the National Law Enforcement Officers Memorial in Washington, D.C.;
WHEREAS, 321 new names of fallen heroes are being added to the National Law
Enforcement Officers Memorial this spring, including 120 officers killed in 2012 and 201
officers killed in previous years;
WHEREAS, the service and sacrifice of all officers killed in the line of duty will be
honored during the National Law Enforcement Officers Memorial Fund’s 25th Annual
Candlelight Vigil in Washington, D.C., on the evening of May 13th, 2013;
WHEREAS, the Candlelight Vigil is part of National Police Week, which takes place
this year locally during the evening of May 15, 2013;
WHEREAS, May 15th is designated as Peace Officers Memorial Day, in honor of all
fallen officers and their families;
THEREFORE, BE IT RESOLVED that the City of Mounds View formally designates
May 12-18, 2013, as
“Police Week in Mounds View ”
and publicly salutes the service of law enforcement officers in our community and in
communities across the nation.

PROCLAMATION
WHEREAS, public works services provided in our community are an integral part of our
citizens everyday lives; and
WHEREAS, the support of an understanding and informed citizenry is vital to the efficient
operation of public works systems and programs such as water, sewers, streets and
highways, public buildings, and solid waste collection; and
WHEREAS, the health, safety, and comfort of this community greatly depends on these
facilities and services; and
WHEREAS, the quality and effectiveness of these facilities, as well as their planning,
design, and construction is vitally dependent upon the efforts and skill of public works
officials; and
WHEREAS, the efficiency of the qualified and dedicated personnel who staff public works
departments is materially influenced by the people’s attitude and understanding of the
importance of the work they perform,
NOW, THEREFORE, I, Joe Flaherty, Mayor of the City of Mounds View, do hereby
proclaim the week of May 19-25, 2013 as
“NATIONAL PUBLIC WORKS WEEK”
in The City of Mounds View, and I call upon all citizens and civic organizations to acquaint
themselves with the issues involved in providing our public works and to recognize the
contributions in which public works officials make every day to our health, safety, comfort,
and quality of life.

an On Sale Intoxicating Liquor License for Moe’s, located at

Background:
In accordance with Chapter 502 of the Mounds View City Code, a public hearing is
required for all liquor license renewals.
Moe’s has not submitted the city liquor license application materials and the applicable
fees. Application materials and fees were due to the City on May 8, 2013. Staff
received a phone call from the owner, and he indicated to Staff that liquor license
materials and fees for Moe’s will be submitted to the City no later than Friday, May 17,
2013.
The notice of this public hearing was sent to the business owner and to residences
within a 350 feet radius. The Notice of Public Hearing was also published in the City’s
official newspaper.
Recommendation:
Staff recommends opening the Public Hearing for public comment, and postpone this
item to the next City Council Meeting on Tuesday, May 28, 2013.

In accordance with Chapter 502 of the Mounds View City Code, a public hearing is
required for all liquor license renewals. The City of Mounds View issued an intoxicating
liquor license for The Mermaid effective July 1, 2012, and their renewal is before the City
Council for consideration. The Mermaid’s Intoxicating Liquor License will expire June 30,
2013.
Discussion:
The notice of this public hearing was sent out to residences within a 350 feet radius, and
the Notice of Public Hearing was published in the City’s official newspaper. Property taxes
are current on this property.
The Mermaid has submitted their city liquor license application materials and the applicable
fees. The deadline for submitting liquor license applications and fees was on Wednesday,
May 8, 2013. The following investigations and inspections have been conducted to
determine whether there is cause for the City to deny the above referenced intoxicating
liquor license application:
Police Inquiry and Investigations (Mounds View Police Department)
The Mounds View Police Department is currently planning a compliance check operation
before the expiration of this license. Staff recommends this license renewal be contingent
on a satisfactory report from the Mounds View Police Department.
Staff has submitted a criminal background check to the Minnesota Bureau of Criminal
Apprehension, and has not received the criminal background check. This liquor license
renewal will be contingent on a satisfactory background check.
Utility Billing Inquiry (City of Mounds View)
The Finance Department has issued a satisfactory report for The Mermaid.
Fire Inspection (City of Mounds View Fire Marshal)
The City’s Fire Marshal has not inspected this facility. This liquor license renewal will be
contingent on a satisfactory fire inspection.

In accordance with Chapter 502 of the Mounds View City Code, a public hearing is
required for all liquor license renewals. The City of Mounds View issued an intoxicating
liquor license for Vino & Stogies effective July 1, 2012, and their renewal is before the City
Council for consideration. Vino & Stogies’ Intoxicating Liquor License will expire June 30,
2013.
Discussion:
The notice of this public hearing was sent out to residences within a 350 feet radius, and
the Notice of Public Hearing was published in the City’s official newspaper. Property taxes
are not current on this property. According to the Ramsey County Property Tax website,
Vino & Stogies are delinquent for 2012 taxes in the amount of $9,476.16. The owner of
Vino & Stogies, Robert Waste, Jr., will be present at this City Council Meeting to discuss
his plan to pay the delinquent taxes.
Vino & Stogies has submitted their city liquor license application materials and the
applicable fees. The deadline for submitting liquor license applications and fees was on
Wednesday, May 8, 2013. The following investigations and inspections have been
conducted to determine whether there is cause for the City to deny the above referenced
intoxicating liquor license application:

inspection, and a payment plan submitted to the City for the delinquent property taxes. It is
Staff’s recommendation to set a deadline for submitting this payment plan no later than
Friday, June 14, 2013. If this renewal is approved, the time period of this license will be
July 1, 2013 to June 30, 2014.

FOR VINO & STOGIES LOCATED AT 2345 COUNTY ROAD H2
WHEREAS, Vino & Stogies’ Intoxicating Liquor License expires June 30, 2013; and
WHEREAS, all City of Mounds View business licenses must be approved by the
City Council; and
WHEREAS, in accordance with §502.04, subd. 2a of the Mounds View City Code,
no intoxicating liquor or wine license shall be granted for operation on any premises on
which taxes, assessments, utility bills or other financial claims of the City are delinquent or
unpaid; and
WHEREAS, Vino & Stogies are delinquent in payment of their property taxes; and
WHEREAS, Staff recommends approval of Vino & Stogies’ Off-Sale Intoxicating
Liquor License for the period of July 1, 2013 to June 30, 2014, contingent on a satisfactory
report from the Mounds View Police Department, satisfactory criminal background check, a
satisfactory fire inspection, and a payment plan submitted to the City on the delinquent
property taxes no later than Friday, June 14, 2013.

In accordance with Chapter 503 of the Mounds View City Code, a public hearing is
required for all 3.2 Malt Liquor License renewals. The City of Mounds View issued an Off-
sale 3.2 Malt Liquor License for SuperAmerica effective July 1, 2012, and their renewal is
before the Council for consideration. SuperAmerica’s Off-Sale 3.5 Malt Liquor License will
expire June 30, 2013.
Discussion:
The notice of this public hearing was sent out to residences within a 350 feet radius, and
the Notice of Public Hearing was published in the City’s official newspaper. Property taxes
on this property are current.
SuperAmerica has submitted their city liquor license application materials and the
applicable fees. The deadline for submitting liquor license applications and fees was on
Wednesday, May 8, 2013. The following investigations and inspections have been
conducted to determine whether there is cause for the City to deny the above referenced
intoxicating liquor license application:
Police Inquiry and Investigations (Mounds View Police Department)
The Mounds View Police Department is currently planning a compliance check operation
before the expiration of this license. Staff recommends this license renewal be contingent
on a satisfactory report from the Mounds View Police Department.
Staff will be submitting a criminal background check to the Minnesota Bureau of Criminal
Apprehension. This liquor license renewal will also be contingent on a satisfactory
background check.
Utility Billing Inquiry (City of Mounds View)

Introduction:
The applicant, Clair Martin with Northwood Industries, is requesting approval of a conditional use
permit to have outdoor sales and displays on the property located at 2701 County Road 10. This
is the site of the former Hostess Bakery Outlet store. Northwood Industries is based in Hayward,
Wisconsin, and manufactures and sells lawn furniture, gazebos, accessory buildings and small
cabins. They want to open a store in the Twin Cities metro area and are proposing to use an
asphalt area on the southeast side of the parking lot for outdoor sales to display gazebos and
sheds. This property is zoned B-3, Highway Business, and the City Code allows outdoor sales as
a conditional use in B-3 districts.
City Code Requirements:
Section 1114.04 (Conditional Uses in the B-3 zoning district)
Subd. 5: Open or outdoor service, sale and rental as a principal or accessory use and including
sales in or from motorized vehicles, trailers or wagons for a period greater than ten (10) days.
a. Outside services, sales and equipment rental connected with the principal use is limited
to thirty percent (30%) of the gross floor area of the principal use.
b. Outside sales areas are fenced or screened from view of neighboring identical uses or
an abutting R District in compliance with subdivisions 1103.08(l) through (5) of this Title.
c. All lighting shall be hooded and so directed that the light source shall not be visible from
the public right of way or from neighboring residences and shall be in compliance with
sections 1103.08 and 1103.09 of this Title.
d. Sales area is grassed or surfaced to control dust.
e. The open or outdoor service, sale or rental use does not take up parking space as
required for conformity of this Title.
f. The provisions of subdivision 1125.01(1)e of this Title are considered and satisfactorily

Section 1125.01, Subd. 1e: The Planning Commission and City Council are required to review
the possible adverse effects of a requested conditional use.
Section 1125.01, Subd. 1g: This section of the City Code states that the Planning Commission
and City Council shall make findings of fact and recommend such actions or conditions relating
to the request as it deems necessary to carry out the intent and purpose of the Zoning Code and
forward such findings to the City Council.
Discussion:
Northwood Industries is a lawn furniture and accessory building and small cabin manufacturer.
They have a facility and retail store in Hayward, Wisconsin, but participate in many of the large
home and garden shows that are held in the Minneapolis and St. Paul area. They want to have
a store in the metro area to better serve and be closer to their Twin Cities customers.
Northwood Industries plans to lease the currently vacant building that, until a few months ago,
had been a Hostess Bakery Outlet store for many years. The building was built in 1973 and is
4,544 square feet. Inside the building there is a large open sales area, and a warehouse/storage
area with outside access from two garage doors that are on the southeast side of the building.
Since some of Northwood’s products are sheds and gazebos, these would need to be displayed
outside. An asphalt parking lot covers almost the entire property, so there is space to designate
an area of the parking lot for the accessory building displays and still meet the parking needs for
this use. The parking requirement is 13 spaces, and the site plan shows 17 spaces could be
available.
The City Code states that outside sales connected with the principal use is limited to 30% of the
floor area of the principal use. Since the building area is 4,544 square feet in size, Northwood
Industries can use 1,363 square feet of space outside for the sales and display area. The
submitted site plan shows closer to 2,000 square feet being used, but the applicant has agreed
to a modified site plan to comply with the area size limit.
CUP Considerations:
Chapter 1125 of the Zoning Code requires that the Planning Commission and City Council
review and address any potential adverse effects which include, but are not limited to,
relationship with the Comprehensive Plan, geographical area involved, potential depreciation,
the character of the surrounding area and the demonstrated need for such a use. I have
addressed each of these potential adverse effects below.
Relationship with the Comprehensive Plan. The Comprehensive Plan encourages existing
businesses to remain and grow in the city, along with the introduction of new businesses within
Mounds View when compatible with surrounding uses. The City has zoned the property at 2701
County Road 10, B-3, Highway Commercial, and the Comprehensive Plan land use designation
for this area is neighborhood commercial. If the requested conditional use permit were
approved, this CUP would be in line with the Comp Plan land use designation for this area.

The Location and Character of the Surrounding Area. The property at 2701 County Road 10 is
located on the City’s commercial corridor. This business is adjacent to commercial and office
uses, along with single family residential in the rear. The applicant is proposing to use some of
the asphalt area on the southeast side of the building for the outdoor sales and displays.
Depreciation. The proposed outdoor sales and display should not have an adverse effect on
surrounding properties. The property was previously a retail bakery store with regular customer
traffic and truck deliveries. The traffic patterns and hours of operation should not change much
from the previous business, and any noise should be minimal. There is currently a six-foot tall
privacy fence along the rear property line to provide screening for the adjacent single family home.
The Demonstrated Need for Such a Use. Northwood Industries has a large geographical area
from which they draw customers, and now want to locate a second retail store in Mounds View to
be closer to their metro area customers. The north metro location with good access, and this
specific property with the large parking lot and freestanding building fit their needs. There are no
businesses in Mounds View that offer the Adirondack style lawn furniture, and accessory buildings
that Northwood Industries sells.
Summary:
The conditional use permit request by Northwood Industries for outdoor sales and displays meet all
of the requirements stated in the Zoning Code. The Planning Commission voted 7-0 on May 1,
2013 to recommend approval of this conditional use permit.
After taking testimony from staff and the applicant, the Council can take one of the following
actions related to the request:
1. Approve the conditional use permit. Resolution 8091 is attached if the Council chooses this
action.
2. Deny the conditional use permit. If the City Council selects this option, Staff would need to
be directed to draft a resolution of denial with findings of fact appropriate to support the denial.
3. Table the request. If additional information is needed before a decision can be rendered or
if more discussion is needed, the Council can simply move to table the request until such
information has been provided. Because of 60-day requirements, the Council would need to act
upon the request as soon as reasonably possible to avoid an inadvertent approval.

permit to operate an auto repair business at 2975 County Road 10. This property is zoned B-3,
Highway Business. The applicant has a purchase agreement for the property which was formerly
a “Thrifty Car Rental” and is planning to open a second location of his auto repair business in
Mounds View.
Requirements:
Section 1125.01, Subd. 1e: The Planning Commission and City Council are required to review the
possible adverse effects of the requested conditional use.
Section 1125.01, Subd. 1g: which states that the Planning Commission and City Council shall
make findings of fact and recommend such actions or conditions relating to the request as it
deems necessary to carry out the intent and purpose of the Zoning Code and forward such

Chapter 1114: B-3, Highway Business District
Section 1114.04: Conditional Uses:
Subd. 3. Motor fuel station, auto repair, minor and tire battery stores and service; provided, that:
a. Regardless of whether the dispensing, sales or offering for sale of motor fuels and/or oil
is incidental to the conduct of the use or business, the standards and requirements imposed
by this Title for motor fuel stations shall apply. These standards and requirements are,
however, in addition to other requirements which are imposed for other uses of the
property.
b. The architectural appearance and functional plan of the building and site shall not be so
dissimilar to the existing buildings or area as to cause impairment in property values or
constitute a blighting influence within a reasonable distance of the lot.
c. The entire site, other than that taken up by a building, structure or plantings, shall be
surfaced with a material to control dust, drainage and erosion which is subject to the
approval of the Director of Public Works/City Engineer.
d. A minimum lot area of twenty two thousand five hundred (22,500) square feet and
minimum lot dimensions of one hundred fifty feet by one hundred thirty feet (150' x 130') be
provided.

e. A drainage system, subject to the approval of the Director of Public Works/City Engineer,

n. Provisions are made to control and reduce noise.
o. No outside storage except as allowed in compliance with subdivision 4 of this Section

to the conditional use permit.

Discussion:
North Metro Motors plans to purchase the property at 2975 County Road and open an automotive
repair shop. They currently operate an auto repair and bodywork shop in Ham Lake, and the
Mounds View store would be their second location, but with only auto mechanical work. No body
work or painting would be done at the Mounds View location.
The property at 2975 County Road 10 is zoned B-3, Highway Business, and 0.58 acres in size.
The 1,421 square foot building was built in 1959 and has always been auto-related businesses,
most recently as a Thrifty Car Rental. The building has two garage bays and an office/sales area.
There is room for more than twenty parking spaces in the existing parking lot.
The CUP will remain in effect indefinitely so long as there are no changes to the operation, and
there have been no problems or reasons which would warrant the City Council to re-examine the
CUP.
CUP Considerations:
Chapter 1125 of the Zoning Code requires that the Planning Commission and City Council review

family residential land uses. Across County Road 10 there are commercial uses, including an auto
repair and sales business (which are in Spring Lake Park). All traffic for this business will be using
Spring Lake Road for access. This property has been various types of automotive businesses since
it was built in 1959, and the proposed auto repair business should not change the existing character
of the neighborhood.
Depreciation. A car rental business purchased the property in 1999, but the building has been mostly
unused for the last couple of years. The auto repair business will be a more intense use than car
rentals, and will likely bring more regular traffic to the site. The applicant plans to paint the building
and sealcoat and stripe the parking lot. There is an existing privacy fence on the north and west
sides to screen the adjacent duplex homes from the business. The new business will be a change
from how quiet this site has been over the last couple of years, and there hasn’t been an auto repair
business here for over fourteen years. If the new business maintains the property and limits the
amount of vehicles parked on-site, any adverse effects upon the surrounding area should be minimal.

There are three other businesses in the city that offer auto repair services (35W Auto Repair, Pat’s

strong business and feel this is a good option for their second location.

North Metro Motors is complete car care center. The services that we currently offer are mechanical
work, paint and body work, towing, and auto sales. We are a very small business with only 6
employees however; we have a very large workload. That is where the second location comes into play.
We would like to hire more employees to increase productivity this is why we are looking to expand
our business to the Mounds View location. Our plan for the Mounds View location is to offer
mechanical work and towing services only. We are hoping to add at least 2 more employees to staff the
new location.

shall be installed, stored, utilized and operated inside the building.
5. Service and overhead doors should be kept closed in order to minimize noise
nuisances to the neighborhood.
6. There shall be no outside storage allowed without the prior approval of an amendment
to this conditional use permit.
7. No vehicles or trailers shall be parked on unimproved surface on the property at any
time.
8. This Conditional Use Permit may be reviewed by the City Council if any problems
develop, or if there are any changes to the operation deemed substantial enough to
warrant such a review, in the estimation of the Community Development Director or
the City Council.
NOW THEREFORE, BE IT RESOLVED that all other Conditional Use Permits on file
with this property pertaining to previous uses shall hereby be revoked, rescinded and
considered null and void because the provisions pertaining to those uses are longer being
observed.
NOW THEREFORE, BE IT FINALLY RESOLVED that this Conditional Use Permit shall

Introduction:
On March 28, 2011, the City Council passed Resolution 7757, which approved the final
plat and developer’s agreement for the Coventry Senior Living development. Per City
Code, an applicant has 6 months to record the plat with Ramsey County, and if the
recording does not happen within this timeframe, the plat approval is void. The code
also states that the plat can be reapproved and the applicant given up to another 6
months. Coventry Senior Living is now starting on the project and will be closing on the
properties soon, and then will record the final plat and developer’s agreement. Their
current final plat and developers agreement approval expires on May 13, 2013, and
they need more time.
Chapter 1202.07: Final Plat Approval Procedure
Subd. 4. Recording of Final Plat: If the final plat is approved, the subdivider shall, within
six months, record it with the County Register of Deeds or Registrar of Titles and,
within ten (10) days of recording, furnish the City with a reproducible copy of the
final plat showing evidence of the recording; otherwise, the approval of the final plat
shall be void, and the Clerk-Administrator shall so notify the County Register of
Deeds or Registrar of Titles.
Subd. 5. Re-Approval: In the event the plat is not recordable as approved or the
subdivider fails to record within the time prescribed herein, the Council may
re-approve the final plat upon payment of the plat reapproval fee as specified in
Appendix E and the following terms and conditions: a) that the subdivider proves to
the satisfaction of the Council that the delay was caused by conditions beyond the
control of the subdivider, and b) that the extension of time requested has or will
have no adverse effect on the City or property owners of the City, and c) that the
Council shall set the time limit of the extension requested but in no event shall it
exceed six months. (1988 Code §42.05; 1993 Code).

WHEREAS, on August 9, 2010, the Mounds View City Council held a duly
noticed public hearing about this development and major subdivision and passed
Resolution 7655 that approved the “Coventry Senior Living of Mounds View” preliminary
plat and development review; and,
WHEREAS, the City attorney and Public Works Staff have reviewed the final plat
and they find it to be in conformance with all applicable sections of the Mounds View
City Code, subject to the conditions and requirements contained in this Resolution; and,
WHEREAS, on March 28, 2011, July 25, 2011, November 14, 2011, May 14,
2012 and November 13, 2012, the Mounds View City Council approved the final plat
and developer’s agreement for the “Coventry Senior Living” subdivision; and,
WHEREAS, the applicant was not able to record the plat within the required 6
months due to issues beyond their control.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council, having
already approved the Preliminary Plat and Final Plat, re-approves the Final Plat and
Developers Agreement for the “Coventry Senior Living” subdivision, subject to stipulations
as follows:
1. Coventry Senior Living must receive final City Council approvals for rezoning the
development area and easement vacations before starting any work on the

reviewed the attached applications at their last meeting.
Discussion:
The Planning and Zoning Commission reviewed the applications and voted by ballot. The
results were the following:

The Planning and Zoning Commission were not able to come to a consensus on who to
recommend to this commission. According to the Mounds View City Code §401.02, subd 1, the
Planning and Zoning Commission shall consist of seven (7) members from the resident
population of Mounds View, other than person elected to a public body, to be appointed by the
City Council, and based on the recommendation of the Planning and Zoning Commission, from
the applications submitted. The Planning and Zoning Commission is requesting that the City
Council appoint either Keith Cramblit or Julianne Love to fill Ms. Miller’s vacated seat.
Recommendation:
Staff recommends that the City Council review the attached applications and make the
determination on whom to appoint to the Planning and Zoning Commission. This commission
seat will expire on December 31, 2014.

Background/Discussion:
As part of the Public Works Department’s maintenance program, utility carts / golf carts
have been used to perform maintenance and inspections in the various divisions of
Public Works, specifically in the Parks and Street departments.
Full time employees along with seasonal employees use these carts. The carts have
made the department more efficient allowing the employees to cover more ground. It
has also been cost savings to the City as these carts were acquired from the City Golf
course in 2005. Prior to having this equipment available the Department used old pickup
trucks and squads cars to send seasonal employees out to perform a wide range of jobs
such as but not limited to pathway and sidewalk inspections. Over the years the pickup
trucks and old squad cars have been sold. Only a few carts remain in use and there has
been no budget allocation to acquire new utility carts. In 2012, an engine on one of the
used carts seized up. The age and cost to repair this type of unit is cost prohibitive and
the City would not see any return on this investment.
Discussion:
During the 2013 budget process and working with the Finance Director, $8,000.00 was
placed in the 2013 budget to purchase a used cart for the Public Works Department.
Staff met with several vendors and inquired about the sale for any used or new utility
carts they may have.
Staff received a quote from Tri State Bob Cat of Little Canada, MN to purchase a used
model 3400 utility cart with 140 operating hours, for $7,500 not including sales tax. This
type of utility cart is more in line with the type of work that Public Works performs on a
regular basis.
Recommendation:
Staff recommends the approval to purchase this used model 3400 utility cart from Tri
State Bob Cat of Little Canada MN for a cost of $7,500 not including sales tax or
applicable license fees from account 100-4360-7030.

Item Title/Subject: Resolution 8103, Approving the Purchase of a 72-inch Deck Mower
for the Public Works Department
Background:
The Public Works Department mows over 150 acres of parks, trials, and right-of-ways. In 2006,
the City purchased a Jacobson Turfcat T628D. The primary function of this mower is to perform
what is called “trim mowing” in the City parks and grounds of City owned property. Trim mowing
allows the operator to get into areas that the large 16-foot mower is not able to maneuver within.
Discussion:
The Turfcat T628D mower is a hydrostatic 4 wheel drive mower. The hydrostatic transmission has
internal parts that to make the mower operate in forward and reverse. During warm up
procedures, the mower is started in a neutral position. In 2012, as the operators started the warm
up procedure, they noticed that the mower started to “creep” forward. The City mechanic adjusted
the mower per the manufacturer recommendations and this seemed to decrease the creeping
motion.
At start up and service this year, the creeping of the mower had become worse. The City
mechanic again tried to adjust the transmission but was not able to. A short term fix was to place
the mower against a stationary object in order to keep the mower from moving but this is not
practical in the field nor is it safe.
Recently, the mower was sent to the vendor to get an estimate to repair this worsening creeping
condition. The cost is estimated to be $2,500-$3,000 to replace the hydrostatic transmission. While
the mower is six years, the mower has 1400 hours on it; this equates to 84,000 miles on a car.
Public Works has recommended a replacement cycle of 6 to 7 years for this mower. However, this
cycle was modified to 10 years a couple years ago as shown on the 5-year financial plan.
With the repair costs and the age of the mower the City is at a breakeven point. The trade-in would
be worth more than what the repairs would cost. The mower is budgeted for replacement in 2017
and based on the trade-in value today the City would receive $2,000.
Staff contacted the vendor, Turf Werks from Eagan MN, and received a quote off the cooperative
state bid from for a new Jacobson Turfcat 628D-4WD for $20,356.78 not including sales tax. Turf
Werks will give the City a trade-in value of $6,000. The cost for the new Jacobson would be
$14,356.78 plus sales tax of $987.03 for a total of $15,343.81.
Recommendation:
Staff recommends approving the purchase of a new Jacobsen Turfcat 628D-4Wd with a 72” Rear
Discharge Deck to replace the 2007 model for a total of $15,343. Monies to fund the purchase will
be from the Vehicle and Equipment Replacement Fund (460-4360-7030). To accommodate this
purchase, the $90,000 budgeted for the Aebi will be delayed until next year.

Background:
In March 2013, the City Council approved a revised position description and authorized
advertisement for rehiring the vacant maintenance worker position in the drinking water
subdivision (Res. 8072). The position was posted internally for one week (per Public Works
maintenance labor agreement) without interest, and then advertised on the League of
Minnesota Cities and City websites beginning March 19, 2013. Twenty-four applications
were received by the April 12, 2013 deadline and only five met the minimum requirements.
Staff interviewed the top candidates in mid-April and decided to re-evaluate the position
requirements.
Discussion:
Attached is a “redlined” version of the proposed changes to the position description. All
revisions are related to experience and license/certification portions of the minimum
qualifications section. The water operator certification has been changed from a Class C to
D, and timelines to obtain other licenses and certifications have been slightly tweaked. In
addition, completion of a water/wastewater technology program will be equivalent to one
year experience. The revisions will allow graduates from a post-secondary water or
wastewater technology to be eligible to meet the certification requirements necessary for
the position. Applicants meeting the proposed requirements will still have the skill set and
knowledge needed to perform the job, and it can be expected that the City will receive more
interest in the advertised position.
Recommendation:
Staff recommends that the City Council adopt the attached resolution that will approve the
revised position description and reauthorize advertisement for rehiring for the drinking water
maintenance worker position.

PRIMARY OBJECTIVE OF POSITION
To perform a wide variety of skilled and general maintenance work activities and functions including
operating, maintaining, inspecting, and repairing the infrastructure and equipment associated with the
municipal drinking water system including water distribution pipes and services, gate valves and curb
stops, fire hydrants, water meters and readers, well houses and water treatment plants, water tower
and storage systems, and the booster station. This position primarily focuses on the drinking water
distribution system components and will assume the responsibilities of the Lead Utility Worker in
his/her absence.
This position will also perform work tasks of other O&M subdivisions involving wastewater collection
system, stormwater conveyance and ponds, streets and trails, parks and recreation facilities, buildings

Participate in Best Management Practices (BMPs) related to the City’s Wellhead Protection
Program (WHPP).
Participate in inspecting and documenting repairs, installation, and modifications to public and
private water, sanitary sewer, or storm sewer utility work.
Perform and participate in other maintenance activities including snow plowing and ice control,
storm debris clean up, building and grounds maintenance, vehicle and equipment maintenance,
water main breaks, etc. Operate a variety of vehicles, heavy and light equipment, power and hand
tools, and perform manual labor while participating in O&M activities.
Document and record inspections, maintenance, repairs, installations, and other work activities in
accordance with records retention schedules and program requirements.
Participate in the Public Works “Standby Duty” and “Call Back” programs for after-hours and

(DRINKING WATER) IN THE PUBLIC WORKS DEPARTMENT
WHEREAS, the Public Works Department is staffed with one maintenance
worker who focuses primarily on the operation, maintenance, and repair of the
municipal drinking water distribution system, which is comprised of approximately 47
miles of watermain pipe; 1,000 gate valves and 3,200 curb stops; 450 hydrants; 20
miles of water service pipe (in right-of-way); and 3,200 water meters and readers; and
WHEREAS, the maintenance worker assigned to the drinking water subdivision
was reappointed to the vacant maintenance worker position in the stormwater
subdivision on March 11, 2013 (Res. 8071), whereby leaving the drinking water
maintenance worker position vacant; and
WHEREAS, the City Council approved a revised position description for the
Maintenance Worker (Drinking Water) and authorized advertisement for rehiring the
position on March 11, 2013 (Res. 8072); and
WHEREAS, 24 applications were received, of which five met the minimum
qualifications, and staff interviewed the top candidates; and
WHEREAS, City staff has re-evaluated the minimum requirements of the position
and recommend changes to the license and certification requirements of the position.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Mounds View, Ramsey County, Minnesota as follows:
1. The attached Maintenance Worker (Drinking Water) position description is hereby
approved.
2. Staff is hereby reauthorized to advertise the vacant position to the public.
3. Staff is directed to evaluate applicants and provide a finalist for the vacant

PRIMARY OBJECTIVE OF POSITION
To perform a wide variety of skilled and general maintenance work activities and functions including

School Resource Officer (SRO)
The SRO performs various duties on a daily basis at Edgewood Middle School which include
the following:
• assisting with traffic flow in front of the school,
• ensuring the school is secured each morning,
• providing a police presence in the hallways during passing times and in the cafeteria
during lunch times,
• investigating crimes that occur on school property,
• assisting with lock down, fire, and severe weather drills,
• attending school dances and after school activities,
• assisting at Pinewood Elementary,
• being a liaison between the school and the police department,
• forming positive relationships with students,
From January to March, the SRO made the following incident reports:
• 1 child abuse,
• 1 disorderly conduct,
• 1 warrant arrest,
• 1 possession of marijuana,
• 1 harassment,
• 1 recovered stolen property,
• 1 medical assist.
From those cases, 3 students were cited/petitioned and 2 were sent to the Northwest Youth
and Family Services Diversion Program.
Some of the day to day issues that the SRO assisted the school with during the first quarter
included:
• transporting students to the out of school suspension program,
• picking up truant students,
• counseling students about the law,
• mediating student disputes,
• deescalating out of control students,
• using the security cameras to assist the deans with locating acts of bullying and theft,
• meeting with parents concerned about the safety of their students,
• advising parents and teachers on Facebook/internet crimes,
• counseling students about sexual harassment and “sexting”,
• advising parents regarding their child’s behavior problems at home,
• removing unwanted persons from the school,
• assisting other police departments with investigations related to Edgewood students.
Highlights from 1st Quarter
• The SRO continued to work closely with the school to target students with high
numbers of tardies and absences. He meets with those students on a regular basis to
counsel them and set goals for improvement in those areas.

• The school district called together a meeting of all the SRO’s in the district in order to
discuss security improvements in the wake of recent school shootings.
• The SRO arranged for the Mounds View Police Department to donate several
unclaimed bikes from the property room which the school will be using in a new
engineering class. Students will modify the bikes and create a form of transportation
which will help reduce their carbon footprint.
• Fifth graders from Pinewood and Sunnyside came to visit Edgewood and the SRO
assisted with giving the tour.
Toward Zero Deaths (TZD)
The winter months are a slower time for the Ramsey County Traffic Safety Initiative (RCTSI).
The RCTSI partners with the Minnesota Office of Traffic Safety in the Toward Zero Deaths
program. During this past quarter, the Mounds View PD participated in 4 DWI saturations and
a March speed enforcement detail.
The first DWI saturation was held on January 26th and was hosted by the New Brighton PD.
Our new RCTSI coordinator, Sergeant Tim Wolf worked this event and made a DWI arrest
after witnessing a one vehicle crash.
The second DWI saturation occurred on February 8th and was hosted by the Roseville PD.
Two officers worked this saturation, making an impressive 24 traffic stops, but did not locate
any drunk drivers.
The third DWI saturation was held on March 16th and was hosted by the Saint Paul PD. This
event coincided with the St. Patrick Day festivities in the downtown area. We again had 2
officers work this saturation, with Officer Knitter making a DWI arrest and Sergeant Zender
making 20 traffic stops!
The fourth DWI saturation occurred on March 23rd and was hosted by the Ramsey County
Sheriff’s Office. We had 3 officers participate in the event. No DWI arrests were made, but
certainly not from any lack of effort (45 traffic stops were conducted!).
Over the dates of March 18th- 23rd, Mounds View PD officers participated in the “Speed
Enforcement” detail. We had 5 officers work this event over the course of the week (4 hour
shifts each). Our officers conducted 37 traffic stops resulting in 27 citations for speeding.

The next upcoming period of the TZD/ RCTSI encompasses the months of April-June.
Officers of the Mounds View PD will participate in 6 DWI, 3 seatbelt and 1 speed enforcement
saturation.

Crime Prevention/DARE
Winter was another busy quarter for the Crime Prevention Unit. Officer Keckeisen continued
to teach the DARE program to over 100 5th graders at Pinewood Elementary School. The
program was somewhat condensed this year, due to the need to shift Officer Keckeisen to
more patrol shift coverage.
Officer Keckeisen organized the fitness and agility testing for our new police officer
candidates. In his training role, he also conducted the firearms, Taser, and control tactics
training for our three new Police Officers, as well as our other officers on staff.
Officer Keckeisen continued to monitor monthly alarms reports to determine crime patterns
and to assign fines for repeating false alarms.
Quarterly Predatory Offender checks continued this quarter. Officer Keckeisen contacted
several offenders to confirm that their registration information is current and correct, and to
provide recent photos to the B.C.A. Contact with the property manager’s coalition to discuss
areas of concern is a continual process, as is addressing specific concerns of citizens in
specific problem areas throughout the city.
Finally, Officer Keckeisen continues to publish and distribute the weekly crime summary and
crime prevention tips.

Canine Unit (K-9)
Officer Nick Erickson and his K-9 partner Niko have been very busy working with our patrol
division. From January 01st to March 31st, 2013, the K-9 team responded to 197 calls for
service. They have made four appearances and demos at various locations. They include
Pinewood Elementary school for parents’ night, the Mounds View Community Center for a
Tupperware fund raising event, and a girl scout troop meeting (pictured below). They also
did a demonstration for the Mounds View-New Brighton Rotary Club. Officer Erickson and
Niko conducted four building searches, two searches for narcotic’s and five assists to other
Officers with arrests.
On one particular incident, Officer Erickson witnessed a vehicle run through a stop sign which
turned out to be stolen and occupied by two suspects. The vehicle fled and a short pursuit
ensued. The vehicle crashed and both suspects fled on foot. Officer Erickson deployed Niko
and the driver was apprehended a short distance from the location of the crash. Officer
Erickson directed other Mounds View Officers to step up a perimeter in an effort to capture
the passenger. Officer Erickson and Niko then tracked the passenger which led them directly
to a house quite some distance away. The male suspect was taken into custody without
further incident. Both suspects were charged with fleeing the police, possession of a stolen
vehicle, and the driver was charged with DUI.
Officer Erickson and Niko are proud to serve the citizens of Mounds View and they are an
integral part of the Mounds View Police Department. The K-9 team conducts daily trainings
that include other Mounds View Officers so all are accustomed to working together. If you

Department News
The police department saw some personnel changes during the first quarter of 2013. On
February 10th, Officer Andrew Olson resigned to begin employment with another law
enforcement agency. On February 27th, Sgt. Bob Nelson retired after 28 years of dedicated
service to the city of Mounds View. Sgt Nelson served in many different roles throughout his
long career. He began his career in 1985 and started as a patrol officer. He went on to serve
as a DARE officer, school resource officer (SRO), investigator and was promoted to the rank
of sergeant in 2005. Bob was instrumental in coordinating the department’s participation in
the Ramsey County Traffic Safety Initiative during the last few years. We will miss Bob and
wish him the best of luck during his retirement!

These police officer positions were filled with the hiring of Officer James Demko and Brian
Smith on March 15, 2013. We are most excited to welcome each of these new officers to our
agency as they begin 14 weeks of training with our field training officers on staff.

The Cystic Fibrosis Foundation held its 32nd Annual Climb for the Cure to defeat Cystic
Fibrosis on February 2, 2013. The climb was held at the IDS Center in Minneapolis. The
purpose of this event is to raise money for the Cystic Fibrosis Foundation in an effort to find a
cure. Climbers needed to climb all 50 floors (1280 steps) to the top of the IDS Center to
complete the challenge. There were over 200 Police, Fire, and EMS personnel who
participated in the Public Safety Challenge Climb with a total of 1,500 climbers that
participated in the whole event. Mounds View Police Sgt. Ben Zender and Mounds View
Police K9 Officer Nick Erickson participated in the Public Safety Challenge Climb. The MVPD
officers raised money to participate in this event and were team members of the Minnesota
State Patrol Team.

During the early winter months, numerous residential burglaries were reported during a 3
month time-span. Through the course of some solid investigative work, a suspect was
identified by a fingerprint recovered from a pop bottle in a recovered stolen vehicle. A search
warrant was subsequently served at the residence of the 21 year old male suspect. Additional
evidence was recovered including shoes that matched footprints at the burglary scenes. The
suspect was arrested and eventually charged with five separate counts of burglary in Mounds
View and two additional burglary counts in Fridley. This investigation was a fine example of
the importance in retrieving physical evidence at crime scenes and the excellent police work
by the officers and investigators!
On March 21, 2013, Sgt. Ben Zender offered a presentation to a class of elementary students
at St Jude of the Lake School in Mahtomedi in honor of their public safety week.

On March 26, 2013, Officer Darrell Meyer was recognized at a New Brighton City Council
meeting for his assistance to their officers and responders for reviving 20 year old, Hannah
Eshenaur, after she went into cardiac arrest on February 2, 2013. Multiple members of the
New Brighton Public Safety Department were recognized, as well as Allina staff and the
Eshenaur family. This was a fine example of emergency responders working together to
achieve a truly life saving result! Congratulations to all of the officers and first responders!
