Item Title/Subject: Presentation by CenterPoint Energy to Present the City with a
Grant Check
Background:
CenterPoint Energy has awarded grants to cities served by the company through the
Community Partnership Grant Program. For this year, the award grants up to $2,500, giving
priority to applications focusing on safety equipment or special projects.
Discussion:
The Safety Committee submitted for this grant on April 6, 2012, and was notified on April 17,
2012 that the City was awarded this grant, in the amount of $1,500, to purchase equipment
for a carbon monoxide monitor and confined space harnesses for the fire department and
public works personnel.
Don Cunningham of CenterPoint energy would like to present this grant check to the City
during this City Council Meeting.
Recommendation:
Accept the grant check in the amount of $1,500, from CenterPoint Energy.

39th Annual Back to the 50's Weekend
Thank you in advance for your help in processing this proclamation request
by the Minnesota Street Rod Association (MSRA).
The date of MSRA's Back to the 50's weekend event is June 22-24, 2012,
and I have attached proposed language for the proclamation.
Please mail the proclamation by Monday, June 13, 2012 or consider
presenting it on one of the days of registration at the Mermaid/AmericInn to
an MSRA Board member yet to be assigned to receive the document. The
original proclamation will be displayed prominently in the Headquarters
Building on the State Fairgrounds.
If you need any further information on MSRA, the Back to the 50's
Weekend or want me to rephrase the proclamation, please feel free to give

Proclamation
WHEREAS, the Minnesota Street Rod Association (MSRA™) is the largest street
rod association in the United States with an all-volunteer membership of more than
14,000 active family members owning street rods, classic, collector and vintage cars.
WHEREAS, MSRA continually promotes a better understanding of the hobby
among non-street rodders, exchanges knowledge and ideas with members and non-
members in the safety and proper construction of collector cars, and provides guidance in
overall, safe vehicle operation; and
WHEREAS, MSRA, a family-oriented association, continually strives to include,
educate, guide and learn from all generations and serves as a mentor for young people
(including subsidizing a sizeable youth scholarship program) thereby strengthening
family relationships; and
WHEREAS, MSRA participates in community, political, charitable and
promotional events contributing extensive hours to the City of Mounds View, and
communities across the State of Minnesota; and
WHEREAS, the Back to the 50's event welcomes more than 12,000 registered
collector vehicles from across the nation and several foreign nations and nearly 100,000
spectators financially impacting the Twin Cities economy by millions of dollars; and
WHEREAS, MSRA is presenting its family-oriented 39th Annual Back to the
50's™ Weekend, June 22 - 24, 2012, at the Minnesota State Fairgrounds, with registration
activities at the Mermaid Entertainment Center/AmericInn;

Background:
The Minnesota Street Rod Association (MSRA) 39th Annual Back to the 50s Weekend Event
is from June 22 to June 24, 2012 at The Mermaid.
Discussion:
MSRA is requesting a Proclamation be signed by the Mayor proclaiming the weekend of June
22-24, 2012 to be MSRA’s 39th Annual Back to the 50’s. In addition, MSRA is requesting, if
possible, either the Mayor or a City Councilmember be available to present this Proclamation
at The Mermaid as a kick off ceremony to the weekend. This Proclamation could be
presented at anytime during the MSRA’s Back to the 50s weekend.
Recommendation:
Staff recommends approval of the Proclamation. Please read the Proclamation out loud
during this City Council Meeting. Please also indicate to Staff if a member of the City Council
would be available to present this Proclamation during the MSRA’s Back to the 50s Weekend.

Consider an Outdoor Consumption Endorsement for El Loro
Mexican Restaurant
Background:
El Loro Mexican Restaurant, located at 2535 Highway 10, has submitted an application for an
Outdoor Consumption Endorsement. In accordance with Chapter 502 of the City Code:
Outdoor Consumption Endorsement. A special endorsement may be issued by
the City to the holder of a regular on-sale intoxicating liquor or on-sale wine
license to allow sales and consumption of intoxicating liquor outdoors when the
outside service area is immediately adjacent to and contiguous with the licensed
premises. The licensee shall make application for the special endorsement to
the City and provide site plans which illustrate the proposed outdoor service area.
The special endorsement may be issued by the City Council to the licensee by
resolution after a public hearing on the special endorsement is held. The
designated outside service area shall not reduce the number of off-street parking
spaces which would be required if the licensed premises together with the
outside service area were to be newly constructed in conformity with the City’s
zoning code. The City may also require improvements to the outside service
area prior to issuing the special endorsement, including but not limited to, safety
barriers or other enclosures to be placed around the perimeter of the outside
service area in order to protect patrons from any hazards, including vehicular
traffic.
This public hearing was published in the City’s official newspaper.
Discussion:
El Loro currently has an On-Sale Intoxicating Liquor License on file with the City and the
Minnesota Department of Public Safety. El Loro has submitted plans to the Community
Development Department to construct a patio, located near the front entrance of the
establishment. Attached is the submitted plan for the patio for your reference.
Recommendation:
Staff recommends opening the Public Hearing for public comment. Staff recommends approval
of this endorsement.

RESOLUTION 7958

COUNTY OF RAMSEY
STATE OF MINNESOTA
APPROVING AN OUTDOOR LIQUOR ENDORSEMENT
FOR EL LORO MEXICAN RESTAURANT LOCATED AT 2535 HIGHWAY 10
WHEREAS, El Loro Mexican Restaurant has a current On-Sale Intoxicating Liquor
License on file with the City and the Minnesota Department of Public Safety; and
WHEREAS, El Loro Mexican Restaurant is requesting to sell intoxicating liquor
outdoors; and
WHEREAS, Section 502.03, subd. 7 of the City Code, states that the licensee must
make application for the special endorsement to the City and provide site plans which
illustrate the proposed outdoor service area; and
WHEREAS, all necessary applications and plans for the establishment have been
submitted; and
WHEREAS, staff recommends approval of El Loro Mexican Restaurant’s Outdoor
Liquor Consumption Endorsement.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council does

Item Title/Subject: Resolution 7959, a Resolution to Consider a Cigarette and
Tobacco License for ABC Liquor located at 2840 Highway 10
Background:
ABC Liquor is requesting a Cigarette and Tobacco Business License. In the past, ABC Liquor
did possess a Cigarette and Tobacco License with the City. However, on June 6, 2007, the
Minnesota Department of Revenue cited ABC Liquor for violating the Minnesota State Tax
Code by possessing five (5) packs of untaxed stamped cigarettes for purchase. Due to the
violation, ABC Liquor voluntarily surrendered their Cigarette and Tobacco License.
Discussion:
In accordance with Section 512.05 of the City Code basis for denying this license is the
following:
512.05: BASIS FOR DENIAL OF LICENSE:
Subd. 1. Grounds for denying the issuance or renewal of a license under this chapter include
but are not limited to the following:
a. The applicant is under the age of 18 years.
b. The applicant has been convicted within the past five years of any violation of a
federal, state, or local law, ordinance provision, or other regulation relating to
tobacco, tobacco products, tobacco-related devices, or nicotine or lobelia
delivery devices.
c. The applicant has had a license to sell tobacco, tobacco products, tobacco-
related devices, or nicotine or lobelia delivery devices revoked within the
preceding 12 months of the date of application.
d. The applicant fails to provide any information required on the application, or
provides false or misleading information.
e. The applicant is prohibited by federal, state, or other local law, ordinance, or
other regulation from holding a license.
Subd. 2. However, except as may otherwise be provided by law, the existence of any
particular ground for denial does not mean that the City must deny the license.

Subd. 3. If a license is mistakenly issued or renewed to a person, it shall be revoked upon
the discovery that the person was ineligible for the license under this chapter.
Under Section 512.05 subd 1(b), the violation, which occurred on June 6, 2007, appears to be
within five (5) years of the violation, which could be grounds for denying the license
application. However, under Section 512.05, subd. 2, it states that the existence of any
particular ground for denial does not mean that the City must deny this license. Essentially,
the City Council could either approve or deny the license and still be compliant under this
section of the City Code.
The owner of ABC Liquor Ge Xiong will be present at the City Council Meeting to answer any
questions you may have. Mr. Xiong has submitted the required application materials and fees
for this license. ABC Liquor also received a satisfactory fire inspection report with the City’s
Fire Marshal.
Recommendation:
The City Council could either deny the license application on the grounds that the violation
occurred within five years or the City Council could approve the license under Section
512.05, subd. 2 of the City Code. If the City Council wishes to approve this license, then
attached is Resolution 7959, approving a Cigarette and Tobacco License for ABC Liquor.

RESOLULTION APPROVING A CIGARETTE AND TOBACCO LICENSE FOR
ABC LIQUOR LOCATED AT 2840 HIGHWAY 10
WHEREAS, all City of Mounds View businesses wishing to operate certain type of
businesses must apply to the City for business licenses; and
WHEREAS, ABC Liquor submitted the required application materials and fees; and
WHEREAS, the licensing period would be July 1, 2012- June 30, 2013; and
WHEREAS, all City of Mounds View business licenses must be approved by the City
Council.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council does
hereby approve a Cigarette and Tobacco license to ABC Liquor located at 2840 Highway10
for the period of July 1, 2012 to June 30. 2013.

Item Title/Subject: 2012 Project Area E SUIP Driveway Appeal for a Second
Curb Cut at 5101 Brighton Lane
Introduction:
Michael & Melinda Collins, property owners of 5101 Brighton Lane since 1988, are requesting
City Council approval to install a second driveway curb cut on their property. This lot is on the
northwest corner of Brighton Lane and Woodcrest Drive, with the garage and driveway
accessing Brighton Lane. There are city records of a 1986 permit to install concrete in the
backyard between the house and a shed, and a strip leading to the south property line. The
concrete was installed up to the property line, with grass left between the concrete and the
street. The Collins have occasionally been driving into their backyard from Woodcrest Drive
since there is easy access and the concrete area to park on. They want to continue to be able
to drive into the backyard after the new curbs are installed.
Background:
In February, City Staff mailed letters to property owners in Street & Utility Improvement Program
Area E that have driveway curb cuts that do not meet the current City Code regulations. The
property at 5101 Brighton Lane did not receive a letter because City Staff did not determine
there was a true second curb cut on this property.
Mr. and Mrs. Collins came in to City Hall on Thursday, May 31, 2012 to submit their Private
Improvement Program application and fee for the second curb cut. City Staff originally
approved the request based on aerial photos, but after further review and a site visit, staff
determined that there was in fact no true curb cut at the street and denied the request. Staff
mailed a letter to the property owners on Friday, June 1, 2012, to inform them of the denial.
City staff talked to the property owners to review the City Code and the policies adopted in
Resolution 7338 that set the City standards to address non-conforming curb cuts within the
street and utility improvement programs. The City Code is in place to help improve the look of
properties in Mounds View and to provide consistent policies and standards for all residential
properties in the City. Property owners can appeal this decision as stated in Zoning Code
Chapter 1121.09 Subd 5g:
In conjunction with street improvement projects or in conjunction with individual driveway
replacements projects, nonconforming curb cuts shall be made conforming to whatever
extent practicable. If, in the opinion of the directors of public works, and community
development, a nonconforming curb cut cannot be made conforming without undue
hardship or disruption to the property, the curb cut may remain in existence, unchanged.
Decisions regarding curb cuts may be appealed in writing to the City Council.
At this time, the City is working with the property owners in the SUIP areas to correct only the
curb cuts, not the entire driveway, even if the whole driveway is also out of compliance. The
rest of the driveway does not have to be brought into compliance until it is replaced.

Discussion:
Resolution 7338 outlines the conditions and standards where the City will allow multiple
accesses to single-family property. The resolution states that all of the conditions must be met.
In this case, conditions 1a and 1b are not met.
1a. The access beyond the primary access existed prior to January 2000, or has been
permitted by the City through an approved variance or other acceptable means.
The area for the requested second curb cut is not currently a true curb cut at the street,
and has not existed prior to January 2000. Nor has any type of City approval been given
for a second curb cut to exist on your property.
1b. The access in question has an improved surface in compliance with City Code
requirements.
There is no improved surface (asphalt, concrete or pavers) at the street indicating that a
curb cut exists.
Recommendation:
The City Council should consider testimony from staff, the property owners, residents or any
other affected person or interested party. The City Council will need to determine whether it
believes sufficient reasons exist to allow the property owners to install a second curb cut onto
Woodcrest Drive. Allowing a second curb cut would not be consistent with the standards and
conditions set in the City Code and those in Resolution 7338. Staff has prepared a resolution
of denial for the Council to take action on if they so choose.

RESOLUTION DENYING A REQUEST FOR A SECOND CURB CUT
AT 5101 BRIGHTON LANE
WHEREAS, Michael and Melinda Collins, property owners of 5101 Brighton Lane, have
requested City approval to allow a second curb cut to be installed on the south side of their
property; and,
WHEREAS, 5101 Brighton Lane is a corner lot with street frontage on Brighton Lane
and Woodcrest Drive; and,
WHEREAS, the attached garage and driveway face and access Brighton Lane, but a
backyard concrete area has been used occasionally for parking vehicles with access from
Woodcrest Drive; and,
WHEREAS, the City Council adopted Resolution 7338 on September 22, 2008 that set
the policies and standards for nonconforming driveways within the street and utility
improvement program: and:
WHEREAS, Resolution 7338 states that the City will allow multiple driveway accesses
to single family residential properties only if all five of the conditions are met; and,
WHEREAS, Condition 1a of the five City-required conditions states “The access
beyond the primary access existed prior to January 2000, or has been permitted by the City
through an approved variance or other acceptable means”; and,
WHEREAS, there is no true driveway access from Woodcrest Drive, nor has the City
has not given any type of approval for a second curb cut on this property; and,
WHEREAS, Condition 1b of the five City-required conditions states “The access in
question has an improved surface in compliance with City Code requirements”; and,
WHEREAS, there is no improved surface between the street and the property line;
and,
WHEREAS, this appeal does not meet all the conditions for nonconforming driveways
set by the Council in Resolution 7338; and,
WHEREAS, Mr. and Mrs. Collins have appealed the decision of City staff to deny their
second curb cut.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council makes the
following findings of fact about Michael and Melinda Collins’ request for a second driveway
curb cut at their property at 5101 Brighton Lane:

1. Exceptional or extraordinary circumstances do not apply to the property that
warrants approval of the requested second curb cut. The property has the ability to
park at least two vehicles in the primary driveway.
2. The provisions of the Zoning Code and of Resolution 7338 would not deprive the
property owners the ability to have adequate access and parking on their property.
3. Granting the applicants approval for a second curb cut would confer upon the
property owner a special privilege that the City would not extend to other property
owners in the street and utility improvement program.
4. The approval for a second curb cut would be detrimental to the purpose of the City
Code, to the street and utility program and to other property in the street and utility
program in that the City desires to bring nonconforming driveways into conformance
with the City Code whenever possible.
5. The second curb cut could diminish or impair property values within the street and
utility program and negatively affect the city’s vision for improvement to the streets
and to properties within the project area.
NOW, THEREFORE, BE IT FURTHER RESOLVED, based upon the above findings of
fact and testimony provided the City Council meeting, the Mounds View City Council upholds
and affirms the decision of City staff to follow the City standards set in Resolution 7338 for
non-conforming driveways by denying the requested second curb cut for the property at 5101
Brighton Lane.

Item Title/Subject: Business Licensing/Dog License Module (PermitWorks)
The City currently tracks business licensing and dog licensing through a database called Microsoft
Access. The dog licensing database that the City currently uses was developed by a past Public
Service Officer (PSO) who had expert knowledge in database development through Microsoft
Access. The current dog licensing database is failing and current City Staff do not have the
expertise to be able to fix the database issues. Staff has contacted Roseville IT, and they were not
able to correct the issues either. The dog licensing database is no longer able to generate reports
accurately or efficiently.
The City currently uses a database program called PermitWorks. The City uses this database to
track building permits, sewer/water permits, planning applications, and contractor licensing, to
name a few. This program is capable of tracking all property information in Mounds View. The City
can add more database modules to the program to include business licensing, rental licensing and
dog licensing. The expansion would allow City Staff to share and track information more efficiently.
For example, currently if the PSO needs to verify whether a residence has the required dog
licensing, the PSO must either contact or stop by City Hall first to get a dog license report, and then
go back to the residence to issue an Administrative Offense or warning, if necessary. By adding
the dog licensing module to PermitWorks, the PSO would be able to get this information from a
mobile laptop located in the police vehicle. This will eliminate the need to call or go back to the City
Hall to verify information.
PermitWorks also has another expanded database module to track business and rental licensing.
In order for City Staff to currently verify whether a business received a satisfactory fire inspection,
Staff would need to wait for a paper copy of the fire inspection from the Fire Marshal. By having
this expanded module, Staff can pull up the business license database and verify whether a fire
inspection was completed and print out the report.
The expanded license database modules could also draft forms letter, generate reports, and most
importantly Staff can share information between departments by a click of a button either in the
office or by using a laptop outside the office. For the past three (3) years, the City has budgeted for
this module expansion, but the City has not moved forward with the implementation. Attached is
information about the module and the price quoted to the City. Staff would like to present this
option to the City Council for approval at the next City Council Meeting.
