Explanation/Summary(attach supplement sheets as necessary) Summary: State Statutes allow for the deferral of special assessments for senior citizens (age 65 or older) or individuals who are totally and permanently disabled for whom it would be a hardship to make the payments on said special assessments. The City adopted the provisions of this statute via Section 202.13 of the City Code. Said Section of the City Code stated"... the City Council shall adopt a resolution establishing standards and guidelines for determining the existence of a hardship relative to any special assessment adopted under this Chapter ...". It does not appear that such a resolution has been adopted. The City has recently received one application for a deferral on the Pleasant View Drive project and we anticipate receiving another application on the Bronson Drive project. In order to act on these applications, it appears that the Council should adopt a resolution setting forth the criteria under which such an application will be evaluated. Based upon the League of Minnesota Cities Local Improvement Guide and discussions with the Cities of Fridley and New Brighton, Resolution 5043 was drafted. RECOMMENDATION: Approve Resolution 5043. Bruce Kessel, Finance Director Resolution No. 5043 CITY OF MOUNDS VIEW County of Ramsey State of Minnesota A resolution setting forth the terms and conditions for deferral of special assessments for senior citizens due to payments on said assessments causing a fmancial hardship. WHEREAS, State Statutes and the City Code Section 202.13 allow for the deferral of special assessments for anyone age 65 or older for whom it would be a financial hardship to make payments on said special assessments; and WHEREAS, City Code Section 202.13 states "... the City Council shall adopt a resolution establishing standards and guidelines for determining the existence of a hardship relative to any special assessment adopted under this Chapter..." and it does not appear that such a resolution has been adopted. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Mounds View, Minnesota that the following guidelines shall be used in determining whether a deferral of a special assessment shall be granted: 1. Ownership. The applicant must be the fee simple owner of the property or must be a contract vendee for fee simple ownership. An applicant must provide either a recorded deed or contract for deed with the application to establish a qualified ownership interest as required herein. 2. Homestead. The property must be the applicant's principal place of domicile and classified on the City's and County's real estate tax rolls as the applicant's homestead. 3. Net income. The average annual payment for all assessments levied against the subjected property exceeds one percent of the adjusted gross income of the applicant and all other joint tenants,tenants in common or contract vendees in title to the property during the preceding year from the assessment levy. Net income determinations shall be made using federal and state income tax forms. For purposes of this paragraph, the average annual payment shall be equal to the total amount of the assessment, interest not included, divided by the number of years over which it is to be assessed. BE IT FURTHER RESOLVED, that all deferred special assessments shall be subject to and charged simple interest at the prevailing interest rate applicable at the time the assessment was originally levied. Said interest shall be payable upon termination of the deferred status. Explanation/Summary(attach supplement sheets as necessary) Summary: Two weeks ago this item was on the agenda and pulled off because the job description was not included in the Council packets. The item was again discussed during the November 4 work session and I will give a short review of this request again here. This reclassification is a result of my attempt to reorganize the administrative and finance departments and accommodate the personnel now with the City. Council will recall that Michelle Chambers was not replaced when she left, and at that point I wanted to reevaluate staffing levels and organization. My long term proposal is to combine the personnel of the two departments, name the Finance Director as the department head, not replace or promote administrative intern Dawn Weitzel upon her departure, and add some personnel responsibility to Cathy Bennett as EDA Director. This is that request. The strength of the request is to place Ms. Bennett in a backup personnel position to my own, to clarify roles and positions within the department, and when all is said and done, reduce personnel costs in this department. The weaknesses currently are in the final and practical determination of the percentage of her time that will go to this personnel responsibility. That determination will at some point necessitate an appropriate general fund allocation to the position, whereas now her duties are strictly TIF funded. I do not see a need to address this at this point, and can revisit the topic after she returns from her leave and we have some working time with this approach to determine the time devoted to non-TIF work. To complete the reorganization, when the administrative intern position is vacant, I will be requesting the hiring of an office secretary to assist the department with their work. I will also need to address the administrative aide position which took on new responsibilities after Michelle left. In all this still will be a reduction of one in the department's personnel. This is the context under which this request is being made. Council will note the change in title as well to Director of Economic Development in the resolution and job description. Explanation/Summary(attach supplement sheets as necessary) Summary: The Mounds View Zoning Code allows for certain non-residential uses to be developed in residential districts with the approval of a conditional use permit. These uses include: • Public or semi-public recreational buildings and neighborhood or community centers,public and private educational institutions limited to elementary,junior high and senior high schools and religious institutions such as churches,chapels,temples and synagogue. • Governmental and public utility buildings and structures necessary for the health,safety and general welfare of the community. • Day care,group nursery. • Nursing homes and similar group housing but not including hospitals,sanitariums or similar institutions. • Parking facilities for adjacent commercial...establishments. These uses differ from single family residential uses in that they have parking lots. The current setback requirement for parking lots is five feet from property lines. During the discussions on the New Apostolic Church, which was proposed on property at 3025 County Road H, it became apparent that citizens feel five feet is not sufficient to provide adequate buffering between parking lots and residences, and that having a parking lot that close to their property has a detrimental effect on the residential character of the neighborhood. Mr. Danny D. Moon, 6929 Pleasant View Drive, has requested that the Zoning Code be amended to require a minimum 15 foot setback between parking lots and property lines, when the parking lots are for churches or any commercial uses, and these uses abut residential uses. Section 1125.01, Subd. 2 allows any person owning real estate within the City to initiate a request to amend the Zoning Code. In studying this request, the Planning Commission and staff expanded the scope of the proposed amendment to include setting a minimum lot size for non-residential uses in residential districts, and to clarify other provisions in the Zoning Code related to setbacks. The Planning Commission is also recommending that the setback between parking lots for non-residential uses and residential properties be 20 feet for sites of 2.5 acres or less, and 30 feet for sites of more than 2.5 acres. These dimensions are larger than the 15 feet requested by Mr. Moon, and are based on Mayor and City Council Planning Case No. SP-008-96 Page 2 the setbacks observed on existing church sites in Mounds View. A chart is attached showing the approximate setbacks between parking lots owned by existing churches and abutting residential properties. The requirement for 20' or 30' setbacks for parking lots would not apply to governmental or public utility buildings. The proposed ordinance would: • add a definition of"principal building" • clarify that the setbacks in the table in 1104.01 Subd. 3 pertain to principal buildings • clarify when and how front setbacks for new residences in the R-1 and R-2 districts shall be adjusted based on the setbacks of existing residences in the same block • clarify that garages,which are part of a residence and have a side setback of five feet,cannot be converted into living space between five feet and ten feet of the side lot line • create a section on setbacks for accessory buildings,and clarify setback provisions such that no accessory buildings may be located in front of a residence in the residential districts,and side setbacks from streets on corner lots shall be the same as the residence(30 feet). Such proposed assessment, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands maned therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2 . Such assessment shall be payable in equal annual installments extending over a period of ten (10) years, the first of the installments to be payable on or before the first Monday in January 1997 , and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assessment resolution. This Informational Meeting will be held: 7:00 PM Wednesday,January 10, 1996 Council Chambers City Hall 2401 Highway 10 The City's Pavement Management Study has identified Bronson Drive, between Edgewood Drive and Raymond Avenue, as needing to be reconstructed. In addition,the City's 1976 Storm Water Drainage Facilities Report, indicated that the drainage facilities on Bronson Drive are undersized. Therefore, the properties along Bronson Drive as well as properties contributing runoff to the Bronson Drive Drainage facilities(generally located between County Road I and H2, and Edgewood Drive and Raymond Avenue) are included in the notice of this Informational Meeting. Project issues and design concepts will be discussed at the meeting. Generally,the improvements will consist of street reconstruction, storm sewer and sanitary sewer improvements, sidewalks and miscellaneous restoration. At this time,the City has authorized the consulting engineering firm, SEH, Inc,to prepare a Feasibility Report to look at the project alternates, determine costs and cost recovery. There were three alternates included in the plan. As you might recall the first alternate was to install pipe in the ditch from Belle Lane to the surface water pond behind Pinewood Elementary School instead of clearing and reshaping the ditch. The other two alternates were for the utilization of plastic pipe for the storm sewer through part of the project, or the entire project. Staff is recommending that plastic pipe be installed throughout the entire project, and that the pipe also be installed verses merely clearing and regrading the existing ditch. The Rice Creek Watershed District is still reviewing the plans,but staff does not anticipate and complications resulting from their review. A summary of the bid tab accompany's this report. Staff recommends award of the contract to include the base bid and alternate 2 & 3 to the low bidder, Forest Lake Contracting for the sum of$578,529.68. WHEREAS, a contract has been let(costs have been determined) for the improvement of Bronson Drive between Edgewood Drive and Raymond Avenue by Forest Lake Contracting and the contract(bid)price for such improvement is $578,529.68, and the expenses incurred or to be incurred in the making of such improvement amount to $149,703.97 so that the total cost of the improvement will be $728,233.65, and ; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MOUNDS VIEW: 1. The portion of the cost of such improvement to be paid by the city is hereby declared to be $399,616.14 and the portion of the cost to be assessed against benefited property owners is declared to $328,618.00, and; 2. Assessments shall be payable in equal annual installments extending over a period of 10 years, the first of the installments to be payable on or before the first Monday in January, 1997, and shall bear interest at the rate of seven (7)percent per annum from the date of the adoption of the assessment resolution, and; 3. The Clerk-Administrator, with the assistance of the city engineer(consulting engineer), shall forthwith calculate the proper amount to be specially assessed for such improvement against every assessable lot,piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and he shall file a copy of such proposed assessment in his office for public inspection. 4. The clerk shall upon the completion of such proposed assessment, notify the council thereof. 5. The assessment hearing for the proposed assessment shall be held on Tuesday, November 12, 1996, 7:10pm, at the Mounds View City Hall in the council chambers to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 6. The Clerk-Administrator is hereby directed to cause a notice of the hearing on the proposed assessment to be published once in the official newspaper at least two weeks prior to the hearing, and he shall state in the notice the total cost of the improvement. He shall also cause mailed notice to be given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearings. 7. The owner of any property so assessed may, at any time prior to certification of the assessment tot he county auditor,pay the whole of the assessment on such property, with interest accrued to the date of payment, to the Finance Director-Treasure, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of the assessment. He/She may at any time thereafter, pay to the Finance Director-Treasure the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Following her presentation, staff will request Council's consideration of three resolutions. The first resolution (NO.5033) is approving the construction plans for the project. The next resolution(No. 5034) is approving the cooperative agreement with Ramsey County for the construction participation and lastly is resolution No. 5035 approving Parking restrictions on Old Highway 8. Staff will also request Council's authorization to proceed with permanent and temporary easement offers to the parties involved in the project. County Cost Participation Policy THIS AGREEMENT, by and between the City of Mounds View, Minnesota, a municipal corporation, hereinafter referred to as the"City", and Ramsey County, a political subdivision of the State of Minnesota, hereinafter referred to as the "County"; WITNES SETH: WHEREAS, the County and the City desire to'reconstruct Old Highway 8 (CSAH 77) between the City limits and County Road H; and WHEREAS, this segment of Old Highway 8 has been designated by the Minnesota Department of Transportation as eligible for certain costs from the County State Aid Highway fund; and WHEREAS, this segment of Old Highway 8 has been designated as State Aid Project 62-677-21; and WHEREAS, this subject road segment is located within the City of Mounds View; and RESOLUTION NO. 5034 PAGE TWO OF FOUR WHEREAS, plans for S.A.P. 62-677-21 showing proposed alignment profiles, grades, and cross sections for the improvement of CSAH 77 within the limits of the City as a County State Aid Highway project will be presented to the City; and WHEREAS, the project includes, in addition to other things, grading, paving, concreted curb and gutter, storm sewer, turf establishment, and utility adjustments; and WHEREAS, the grading provisions require acquisition of certain right of way and temporary construction and slope easements prior to construction; and WHEREAS, the project will be submitted to the Minnesota Department of Transportation to determine the eligibility of the storm sewer for State Aid funds; NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: 1. The County shall prepare the necessary plans, specifications and proposals in accordance with the approved feasibility study. Costs of revisions to project items previously approved in the feasibility study will be paid for by the party requesting the revisions. 2. The County shall take bids, and with concurrence of the City, award a contract for construction of this subject project; the County shall perform the construction inspection; the City shall assist the County in the inspection of City utilities. 3. The City shall acquire and pay for all easements and rights of way required for the construction of the project within the City. 4. All County road rights of way and temporary easements will be in the name of the County, and parking and other regulations will be controlled by the County. Any rights of way which cannot be negotiated will be acquired through eminent domain proceedings and thereafter assigned by the City of the County. Upon completion of the project, the County shall vacate right of way not needed for highway purposes to the City. 5. The County and City shall participate in the costs of construction in accordance with the attached Ramsey County Public Works cost participation policy dated 5/1/91 (Attachment B) except as modified below. 6. The County and City shall participate in the costs of storm sewer construction to the extent to be identified by the MN/DOT Hydraulics Engineer's Memorandum on storm sewer cost participation percentages. Upon completion of the project the County shall own and maintain the storm sewer catch basins and leads which directly serve the paved portion of Old Highway 8 and the City shall own and maintain the storm sewer trunk lines and storm sewer laterals servicing property outside the paved portion of Old Highway 8. The County shall own and maintain the storm sewer pond and wetland located on County open space. 8. After the final plans are submitted to the City, any utilities or facilities modified or added to those provisions made in the plans and specifications may be incorporated in the construction contract by supplemental agreement and shall be paid for as specified in the supplemental agreement. Design engineering and construction engineering fees shall be negotiated. 9. The City shall reimburse the County for actual engineering costs incurred on its share of project design and administration as a preliminary engineering fee. The City share shall be identified in partial cost estimates prepared by the County up to the time of contract award. The total preliminary engineering cost borne by the City shall not exceed 10% of its share of construction costs as determined at the time of contract award. 10. The City shall reimburse the County for construction engineering costs for its share of construction costs as identified for each partial payment estimate up to and including final payment. The total construction engineering fee borne by the City shall not exceed 12% of its share of the construction costs as determined by final contract amounts. 11. Throughout the project design and construction, the County shall prepare partial cost and payment estimates for the preliminary engineering fees, construction costs, and construction engineering fees and, at appropriate intervals, notify the City of the costs for the City's items of work. The City shall pay its share of engineering fees and construction costs within twenty-one calendar days of receipt of County invoice. 12. Explanation/Summary(attach supplement sheets as necessary) Summary: • At the present time, City Hall has five telephone lines into City Hall which service Community Development, Finance, Administration, Internet access, and general questions relating to the City. In addition, the City has numerous other lines for other employees or groups of employees such as the City Administrator, Police, Public Works, Park&Recreation, etc. For each of these groups,their is a separate group of telephone lines that can generally be used by only those individuals in that group. At times, all the telephone lines for a group of employees are being used and no calls can be received by that group or other employees do not have access to an outside line. In addition, it is not uncommon for the receptionist to have more calls than she can handle resulting in other employees having to interrupt their work to assist her. Over the last year,there has also been a reduction in clerical help which has compounded the need for finance and community development personnel to assist the receptionist. Also,messages can not always be routed to employees as soon as they are taken resulting in delays in responding to callers. In an effort to improve our communication abilities, we are proposing an upgrade to our telephone system as follows: • Consolidate all telephone lines into a"pool" whereby when we receive an incoming call or someone picks up a telephone to make an outgoing call,the first available line would be used. We would dedicate several lines as incoming or outgoing only to insure we maintained the capability to receive calls or call out. • We would have direct inward dial capabilities to relieve the calls coming though the receptionist, which should free up some of her time to perform other tasks. To accomplish the direct inward dial, we would be assigned a block of 60 to 80 new telephone numbers, which would be assigned to individual employees; employees could then distribute their telephone numbers so individuals could bypass the receptionist. The old numbers would continue to work for as long as we want them to, insuring that City services would not be disrupted. General City inquiries would still come through the receptionist. Individual phone numbers would only be given to those individuals that frequently deal with individual employees at the City. • Voice mail capabilities would be added to some employees' telephones; if such employees were on RECOMMENDATION: Approve resolution 5044. • Bruce A. Kessel, Finance Director. the telephone or out of the office, callers would receive a message which would allow them to leave a voice mail message or to transfer to another employee. For the main City telephone number,we could have an after hour message. We could also explore informational messages for areas such as voting, Park& Recreation programs, registrations, cancellation of programs/games, etc. Overall, the proposal should improve service, and better utilize existing staff time. To accomplish the proposed system improvement, we would need to contract with Executone to modify our equipment at an estimated cost of approximately$16,500; the proposed equipment is covered under the State of Minnesota's pricing schedule and as such, has already been competitively bid out. We would also need to upgrade our service from U.S. West; they have partnerships with other entities to perform such work and have recommended using US Acomm which has submitted a proposal for a cost of$3,500 for equipment upgrades and a 120 month contract for service; the service proposal has a 30 month payback and the overall proposal from US Acomm would lower our monthly telephone bill from US West by approximately $200 per month. Pricing for the US Acomm equipment is covered under a rate tariff and as such, is not subject to competitive bidding requirements. At the present time, one administration position is vacant, Jennifer is on a maternity leave and Dorothy is on an extended leave which are resulting in additional strains on remaining employees. The 1996 budget included $25,000 for an organizational study; due to management and staff changes that have occurred in the last year plus the decision to leave one administrative position vacant, it is proposed to use the money originally budgeted for the organizational study to fund the telephone system upgrade. This should improve the organizational efficiencies and allow for other changes to be made that may have been identified by an organizational study. • Resolution No. 5044 CITY OF MOUNDS VIEW . County of Ramsey State of Minnesota A resolution modifying the 1996 budget to transfer up to $21,000 from Office of the City Administrator - Other Professional Services to Central Services Capital Outlays for upgrades the City's telephone service. WHEREAS, $25,000 was budgeted for an organisational study of the City in 1996 and due to personnel changes and restructuring, such a study is not deemed to be in the best interest of the City at this time; and WHEREAS, the present telephone configuration resulting in the inefficient use of staff time. Explanation/Summary (attach supplement sheets as necessary) Summary: Recently enacted federal legislation requires the.City to file annual disclosure statements with the Securities and Exchange Commission relating to the financial health of the City whenever certain conditions are met. The conditions generally relate to when City has outstanding bonds. Last year the City entered into a contracted with Springsted, Inc to prepare the required disclosure at a cost of$1,500 per year; the contract does not specify a term but can be canceled by either party by giving 90 days notice. Based upon my past experiences, I feel that I should be able to complete the required disclosure at a nominal cost, basically for the cost of obtaining required information from outside sources such as Ramsey County and possibly a nominal charge from a consultant for clarifying one or more minor points associated with the disclosure statement. In the early 1990's,the City established a Section 125 plan for its employees (a section of the Internal Revenue Code which allows employees to pay for some of their medical costs with pre-tax dollars). The City contracted with DCA to administer the Plan; DCA charges a set fee per participating employee and but also has a minimum fee of$150 per month, plus additional fees for year end reporting;the total annual fee for 1996 will be $2,050. Based upon my experience with other administrators,this fee appeared to be high and as such, I contacted several other plan administrators to obtain additional information of their fee structure and level of service. Based upon this, it appears that if the City would change plan administrators,the fee would be approximately $1,200 for the first year and$500 for subsequent years. Our plan year runs from January through December and as such, if the City is to change Plan Administrators,we would need to do so by early December to insure that we could complete all the necessary changes by January 1st. I have been in contact with DCA to see if they would modify their fee structure and have not received their response as of the writing of this report. As such, I am requesting authorization to negotiate with DCA and if they are unable to modify their fee structure to authorize the City Clerk-Administrator to enter into a contract with the Plan Administrator that he feels will best serve the needs of the City.
