For the Week of November 13- November 17, 1995 ADMINISTRATION ADMINISTRATION • In case you have not noticed, MnDot has finally allowed Blue advertising signs for Mounds View exits off Interstate 35W. These signs allow the local merchants to advertise that there are restaurants, gas stations and motels off Highway 10 and County Road I. This was one of the issues that the service businesses complained about during the retention survey process. The owner of Mounds View Inn was one of the key advocates for this issue. • The closing of 2625 Highway 10 has been delayed until Nov. 27 at 2:00 pm. AA Environmental was having to wait for some documents prior to making their final analysis on the property. Otherwise, all the papers are in order. • Officer Tom Baumgart did an excellent job presenting safety tips to businesses at the Business Safety Seminar last week. We held a morning and an afternoon session. There were five participants for the morning session (Multitech, Minnesota Fabrics, Radio City (2) and Western Bank) and one for the afternoon session (Fina). I believe all the businesses that attended went away with a wealth of information and its just too bad the attendance was so low. • I attended a Mounds View Business Association meeting where we sent farewell to Samantha. In addition the future of the association was discussed. It was decided to have two members take part in a task force to evaluate how Mounds View businesses needs can be met by the New Brighton Chamber. The members felt strongly that to become part of a joined Chamber there would need to be a name change to include Mounds View. Carol Johnson, Addie Lane Floral and Steve Shack, Rent All are the designated members from Mounds View on the task force. Cathy ( PARKS, RECREATION AND FORESTRY PARKS: * Steve and Jeff are working on filling and grading areas of Hillview Park to provide for an even surface for flooding the pleasure skating rink. They are making a small berm along the northern property line to ensure that melting ice does not flow into the neighbors-backyard. * Park vandalism occurred this past weekend resulting in damage to Silver View Park picnic shelter door and lock. Persons also entered Hillview Park building and sprayed the fire extinguisher throughout the interior requiring many hours of clean-up of the room, carpet and furnace system. * The tanker truck is being prepared for winter ice rink flooding. Flooding modifications are being installed. * Daily field work and inspections occur with repairs and maintenance performed as necessary. RECREATION: * I will be attending the Executive Development School for Parks and Recreation Directors next week, November 26 - December 2, in Albuquerque, New Mexico. I will be attending many classes of interest including Partnerships, Strategic Planning, Personnel Management, Accessibility/ADA, Concession Management, Working with the Media, RFP's, RFQ's and Spec Writing, Recreational Injury Liability, Ethics and Executive Duty, and Market Research. Each of the class topics are very appropriate for my job. Although the school is tightly scheduled with classes from early morning to 9:00 p.m. every evening, it should be a tiring, but informative week. There will also be an idea exchange and open forum for focusing on issues of the day. * Mary drove for the first WIC activity this Tuesday, November 21. The County is very appreciative of Marv's assistance in this program which is directly aimed at low- income families with young children. * Shade is taking a few days of well deserved vacation. FORESTRY: * Rick and crew will be trimming a few select boulevards which have overhanging tree limbs. This small budgeted amount of time will only scratch the surface of boulevard tree trimming that is necessary. * Rick had planned on moving approximately 4 trees this week but because the tree spade is broken down, it looks like time will be spent in repairs instead. GOLF COURSE: * I have prepared-an-informationpacketfor-Eff=tive G•olf-Cour e-SystemJohn is delivering the packet to them for review. We will be meeting with them this week to provide any additional information that they may need in order to evaluation operations. PUBLIC WORKS * On November 15, the radio contractor came in and checked all of radio's in the vehicles and equipment. (This is the first step in obtaining a new radio system.) * The Sewer Department is televising the sewer lines and recording all of the pertinent data in the new inspection software. * The Phoneread system will be up and running again, November 27th. * Mike is working on the specifications for the purchase of the 1996 dump truck. We are able to work off of the State bid and if all goes well, the city should be able to purchase a 96 truck at 95 prices. * Bacons Electric installed a new starter at Well 6, and has begun working on Well 5, November 15. * Mike will be attending a Drug and Alcohol Seminar, November 16 and then after that, he will be attending the MPWA Fall Conference. (Thursday and Friday) Tracy COMMUNITY DEVELOPMENT IN-KIND SERVICES PROVIDED TO FRIDLEY The City of Fridley approached the City of Mounds View this past week requesting in-kind services-to-assist-in-the-examination-of groundwater-contamination-at-one ofthei -wells. This project is a part of the overall wellhead protection project which is being coordinated by the Minnesota Pollution Control Agency. Because the plume of the groundwater extends into Mounds View and could potentially impact the City, Fridley asked for in-kind services. Engineering Aide Jim Hess will be working with the representatives of Fridley on the project. OUT OF THE OFFICE As you are reading this, I will be somewhere in the Catskill mountains of New York pursuing the elusive whitetail deer. I hope to have many good stories to tell upon my return. Have a happy Thanksgiving, and I'll see you on the 27th. Paul FINANCE This week the Finance Department is rolling right along. Maybe a few bumps, some familiar ruts, and an occasional surprise around the curve; but no major obstacles. Dorothy, Kitty, and I met with the City's auditors on Tuesday. They were very helpful and will continue be a good source of reference. Kitty is processing payroll this week. She, Scott, and their girls will be leaving Saturday to visit her brother and his family in Maine for Thanksgiving. We will all be thankful and a lot friendlier when she returns if we get paid next week. She is also catching up on some department filing. While Kittyis having fun filing, Dorothy is having fun balancing utilitybilling and sending out final notices. I am reviewing files, handling cash flow, meeting with auditors, and reading tax information from Ramsey County. As I said the Finance Department is just rolling along. The Finance Department would like to thank Mary and Sharie, for all their work preparing the surprise farewell party for Samantha this week. The party was great and Samantha's quick wit and sense of humor kept us all laughing. It was nice to have the "surprise" along with the "bumps" and "ruts" this week. Mary T. POLICE * All of the officers attended "use of force" training this week. This is eight hours training mandated by the State. * Pat, Linda and Tim B. finished up their computer training this week. * Interview notices were sent out this week. We will be interviewing nine candidates on Nov. 29. * On Thursday, Tom Baumgart conducted a safety seminar for businesses. Five Mounds View Businesses were represented. Tim R. RESOLUTION NO. 4847 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING STEP ADJUSTMENT FOR MARK ANDRESCIK, PUBLIC WORKS MAINTENANCE WORKER WHEREAS, Mark Andrescik began working for the City of Mounds View on November 16, 1994; and WHEREAS, Mr. Andrescik's work performance has met the responsibilities of Public Works Maintenance Worker as outlined in the job description; and WHEREAS, his work performance has been determined to be satisfactory; and WHEREAS, a wage adjustment that is consistent with the City's compensation policy is recommended. SUMMARY; Patrick Carlson of North Star Land Services, representing US West Communications, has made application on their behalf for a Conditional Use Permit to allow the construction of an enclosure to house fiber fed telecommunication services. The enclosure serves as somewhat of a "field office" for technicians tracking service related problems in the area. The Municipal Code requires that any structure necessary for the provision of public utility service within the City obtain a Conditional Use Permit prior to its construction. The enclosure is approximately 6'x 9' with an overall height of about 6' . The height of the structure is somewhat deceiving in that an additional 3' is located below ground. US West has indicated that access to the enclosure will be necessary every two to three months and that average length of on-site personnel is two (2) hours. Location of the structure will be in the extreme southwest corner of 2280 Highway 10. Access to the structure will be from Woodale Drive. The applicant has received a 20'x 20' easement from the property owner for the location of the structure. This request is similar to the one approved by the Council in June of this year for a structure on the Multi-Tech property. Staff has reviewed the request and found it to be in with the requirements of the Code. The Mounds View Planning Commission has reviewed the request and recommended approval. SUMMARY; Richard and Julie Oliverius have made application for a Conditional use Permit in order to establish a Residential Dog Kennel on their property at 8426 Groveland Road. Chapter 1106.04, Subdivision 4 of the Mounds View Municipal Code allows Residential Dog/Cat kennels in R-1, Single Family zone districts with the issuance of a Conditional Use permit. A Residential Dog/Cat kennel is defined as "any premises where more than two (2) , but not more than four (4) dogs/cats over six (6) months of age are owned, boarded, bred or offered for sale". The application has indicated that four (4) dogs will be on site. In addition to Chapter 1106, Chapter 701. 04, Subdivision 15 requires that all applicants for Residential kennels provide the City Council with a petition signed by over 50% of all registered land owners or those occupying land within 500 feet of the subject property. Attached you will find such petition for the current application. I have included a map showing the properties which signed the petition. All other materials received as part of the application are included for your review and consideration. It will provide you with information regarding the types of dogs to be raised, as well as information regarding the care and keeping of the animals. The purpose for our request to establish a residential kennel is to allow us to raise and train up to four(4)Field Bred English Springer Spaniels. We purchased our first Field Bred Springer 4 years ago as a family pet, but have since become actively involved in training and participating in field trial competitions. We have been residents of Mounds View for 11 years, at 8426 Groveland Road. We have a traditional family structure(husband and wife), with four children ages 10, 8, 6 & 2 1/2. Our backyard is fenced in to allow the dogs space to run outside of their kennels. We have a 3-run kennel attached to the back of the garage which provides the dogs with a 4x4 space indoors, and a 4x8 run outdoors. As stated above, we have been owners of Field Bred English Springer Spaniels (FBESS) since 1991. We have been active members of the Minnesota English Springer Spaniel Club (MESSC) for 4 years. Rich has done all training and trialing of our dogs himself. We have participated in more than 15 AKC licensed field trials in the past 3 years, as well as 12 fun trials. We attend the field trials as a family whenever possible. In addition to participating in field trials, we have also been actively involved in promoting the FBESS breed. Rich has served as the New Member Chairman of MESSC for the past 2 years. He has also worked at the MESSC booth at the annual Game Fair for the past 3 years. Rich has been actively involved in other aspects of the field trials as well. He has acted as a judge's steward for past MESSC sponsored field trials, and will be on the Field Trial Committee for the 1995 MESSC fall field trial. He has also been involved as a judge in the informal field trials (called fun trials) held by all three Minnesota springer clubs. Additionally, he recently completed an AKC approved judging seminar for English Springer Spaniels and hopes to judge field trials in the future. As stated , we are actively involved in training and trialing English Springer Spaniels. We would like the opportunity to increase our participation, and to get other family members involved in training and trialing. We have attached other documentation which may provide you with additional information regarding our dogs and the care they receive. First is an article which provides some insight to field trials from a non-participating spectators point-of-view. The second document is a recommendation from our vet. It details the type of care given to our dogs. Specifically, the applicant is requesting that the northernmost 225 feet of Lots 10 and 11 of Spring Lake Park Knolls Addition be rezoned from its current designation of R-1, Single Family Residential, to R-2, Single and Two Family Residential. The request, if approved, would allow the development of the property as owner-occupied twinhomes. The remaining portions of the two lots would stay R-1. Chapter 1125.01 Subdivision 1 (e) of the Mounds View Municipal Code identifies those factors upon which the City Council should base its decision relative to any rezoning request. Those factors, and an analysis of their relevance, are as follows: 1) Relationship to Municipal Comprehensive Plan The Comprehensive Plan in its current form identifies these parcels as low density residential. The R-2 zoning classification falls within the parameters of low density and would therefore be consistent with the direction of the Plan. 2) Geographical area involved The parcels are bounded on the South and East sides by Bronson Drive and Silver Lake Road. To the North is additional R-2 property and, to the West is Single Family. 3) Whether such use will tend to or actually depreciate the area in which it is proposed The applicant has constructed similar twinhomes immediately north of the proposed rezoning location. The values of those properties (in excess of $160,000 per unit) leads to a positive impact on the area. For review: In the fall of 1994, Sherri Ruf, representing Louis Downing made application for a Wetland Alteration Permit to allow the construction of a single family home in the Wetland Buffer Area. Mr. Downing was the owner of Lot 2, Block 1 Downing Addition (please see attached area map for location of property) . Chapter 1010. 08 Subdivision 1 c of the Mounds View Municipal Code requires the issuance of a Wetland Alteration Permit for ". . . the construction, alteration or removal of any structure. . . " in or upon a Wetland Zoning District. The Wetland Buffer Area is defined as being a part of the overall Wetland Zoning District. Following Council review in 1994, the applicant was directed to have a wetland delineation performed on the property in order to establish exact limits of the wetland area. In September of this year, Ms. Ruf provided Staff with a delineation performed by a professional engineer. In addition to the delineation, Ms. Ruf provided Staff with two (2) proposals for developing the property as single family housing. The first proposal would allow the applicant to purchase a portion of property immediately west of ' her own which is currently owned by the City via tax forfeiture. The reason for this proposal is that, although it would allow construction within the wetland buffer zone, it would do so without disturbing the existing wetland. The second proposal would involve mitigation of wetland area in order to facilitate development of the site. Both proposals are depicted in renderings attache to this memorandum. Beth Nixon, one of our wetland specialist,did a brief review of the wetland delineation. I had her review the project since we had no performance history.(previous review of work performed) of the delineator. My own review will concentrate on the drainage and wetland impacts of the proposal. Beth indicated that it was not a great report,but was average to below average. She felt that if SEH had final review on the delineation, further clarifications of some of the items would have been required. We both felt that since the project was small,Rice Creek's review of the delineation would be acceptable. SITE PLAN NO. 1 - (Requires the City to Sell a Portion of the Property to Sherri Ruf) From a drainage perspective, the site plan proposed in very acceptable. It maintains the existing drainage pattern of the lot. This allows for the backyards along the east side of the property to drain as they do today. The only area of concern is the proposed grading on the south end of the lot. Drainage from the east to the west must be maintained. I would recommend a culvert under the walkway to the park. This will assure future drainage from the east. The minimum building elevation proposed has the necessary freeboard(2-feet) above the 100-year ponding elevation of 889.9. Due to the size of the change in land use, increased runoff from the house and driveway will have no impact on the 100-year flood elevation. The proposed site is within the 100-foot buffer of the wetland. The purpose of the buffer is to protect the adjacent wetlands. If construction is permitted in the buffer area, the developer or owner would need to demonstrate that"best management practices"were being done to protect the wetland. The site as drawn does not appear to try and protect the wetland. As shown, the sodded or lawn areas would be adjacent to the wetland area. There appears not to be a natural buffer strip to prevent yard and driveway runoff from going directly into the wetland. Sincerely, Sherri Ruf On the Western edge there is a Type 6 wetland consisting mainly of Alder. Red-Osier Dogwood and Marsh Marigold are also very prevalent on the wetland side. On the upland side there are Cottonwood and Box-elder trees. Although these trees can be found in wetlands, they are also indicative of disturbed soil conditions which are present in this case. Common Buckthorn, Raspberry, Canada Goldenrod, Honeysuckle and Smooth Brome grass are good upland indicators which are also present on the upland side of the delineated edge. There is a fairly steep slope along this Western edge which helps define the wetland boundary. Soils go from a heavy organic saturated within seven inches, to a silty sand with no saturation found at 18 inches down. The wetland covering the SE portion of the property is a 2/6 consisting of a Reed Canary Grass basin with areas of dense Red-Osier Dogwood. Aspen are also present along the fringe of this wetland. The upland consists of Raspberry, Canada Goldenrod, Smooth Brome Grass and Dandelion. The wetland edge followed the edge of the fill used in the making of the roadway. The middle and lowest area of this wetland did not have standing water within 18 inches of the surface. However, mottling and saturated conditions were present within the first 12 inches. Wetland boundaries were marked in the field with lath and orange wetland boundary flagging. The areas marked as wetland were those just previously described as being along the Western edge and SE corner of the property. Each stake was also numbered. Stakes were marked #1-12 along the western boundary from North to South. The other wetland was marked #1-14 starting in the NW corner of the wetland, working counterclockwise and circling back to the starting point.
