ADJOURNMENT Item No: 7C Meeting Date: September 13, 2010 Type of Business: Council Business City Administrator Review: ______ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Mark Beer, Finance Director Item Title/Subject: Resolution 7667 Authorizing Certification of the Proposed General Fund Budget and Property Tax Levy for Fiscal Year 2011 State law requires that the City certify a proposed 2011 General Fund Budget and proposed 2011 property tax levy to Ramsey County by September 15, 2010. This was last discussed at the September 7, 2010 work session. The City Council directed staff to use a preliminary General Fund levy increase of 3% or $122,892, this does not off-set the expected Local Government Aid cuts anticipated of $485,000, but with expenditure reductions and use of fund balance the City can balance the 2011 budget. The base General Fund levy would be $3,402,792 and special levies for Fire Debt Service of $93,885, police personnel referendum of $196,000, PERA rate increase special levy of $39,145 for a total General Fund levy of $3,731,822. The base levy for the Street Improvement fund would be $300,000. The 2004 Improvement Bond Debt Service Fund has a special levy of $190,553. The total of all base and special levies proposed is $4,222,375, an increase of $122,982 or 3% over 2010. Respectfully submitted, ___________________________ Mark Beer RESOLUTION NO. 7667 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA Resolution Authorizing Certification of the Proposed General Fund Budget and Property Tax Levy for Fiscal Year 2011 WHEREAS, current state statute requires cities to certify a proposed budget and tax levy to the county auditor; and, WHEREAS, guidelines established by the Commissioner of Revenue require certification to occur on or before September 15, 2010; and WHEREAS, the Department of Revenue has certified the amount of Local Government Aid payable to the City in 2011. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View that the proposed budget for the General Fund for fiscal year 2011 is $5,565,298. BE IT FURTHER RESOLVED that the proposed 2011 base property tax levy is $3,702,792 (General Fund $3,402,792 and Street Improvement Fund $300,000) and the proposed 2011 special levies are $519,583 for a total net property tax levy of $4,222,375. BE IT FURTHER RESOLVED that the Finance Director shall certify these amounts to the Ramsey County Auditor. Adopted this 13th Day of September 2010. ______________________________ Joe Flaherty, Mayor (ATTEST) ______________________________ Jim Ericson, Administrator (SEAL) Item No: 7D Meeting Date: September 13, 2010 Type of Business: Council Business City Administrator Review: _____ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Mark Beer, Finance Director Item Title/Subject: Resolution 7668 Establishing Public Hearing Dates for the Proposed General Fund Budget and Property Tax Levy for Fiscal Year 2011 The Truth in Taxation laws have changed and there no longer is an exemption from holding the public hearing when the levy increase is less than the “implicit price deflator”. Mounds View has always held a Truth in Taxation hearing regardless of the exemption so the law change does not affect us. The State has reserved Monday, December 6, 2010 and Monday, December 13, 2010 for use by cities. Cities may select other days if they wish, but then must work around dates selected by counties, school districts, and special districts that were given priority for those dates by the State. I recommend that since the Mounds View City Council normally meets on Mondays, that the initial Truth in Taxation public hearing be held on Monday, December 6, 2010 and that the continuation public hearing be held on Monday, December 13, 2010. The continuation public hearing may be part of the regular City Council meeting on Monday, December 13, 2010. Final adoption of the a budget and property tax levy for 2011 may happen at the regular City Council meeting on Monday, December 13, 2010. The attached resolution establishes December 6, 2010 and December 13, 2010 as the dates for the Truth in Taxation public hearings. Respectfully submitted, ___________________________ Mark Beer RESOLUTION NO. 7668 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA Resolution Establishing Public Hearing Dates for the Proposed General Fund Budget and Property Tax Levy for Fiscal Year 2011 WHEREAS, the City is required to hold a truth in taxation hearing under the truth in taxation laws, as part of the budget process to adopt its final General Fund Budget and Property Tax Levy for fiscal year 2011; and, WHEREAS, the City Council would like to provide an opportunity for public comment at a public hearing on the 2011 General Fund Budget and Property Tax Levy; and WHEREAS, the City Council must select dates for an initial public hearing and a continuation public hearing; and WHEREAS, certification of the public hearing dates to the Ramsey County Auditor must occur on or before September 15, 2010. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Mounds View that the initial Truth in Taxation public hearing will be held on Monday, December 6, 2010 at 6:00 p.m. at the Mounds View City Hall. BE IT FURTHER RESOLVED that the continuation Truth in Taxation public hearing, if needed, will be held as part of the regular City Council meeting on Monday, December 13, 2010 at 7:05 p.m. at the Mounds View City Hall. It is in the City’s best interest to have as many of these improvements done during the project to reduce the number of street openings that may have to happen in the future. Each property owner has signed an agreement to waive their right to a public hearing and has agreed to pay the full cost of the private improvement plus interest and the administrative fee. The property owner may pay the amount due by 4:30 P.M. on Monday, September 13, 2010 in order to avoid the $35.00 administrative fee. The owner may prepay the assessment between September 14, 2010 and October 13, 2010 without paying additional interest. After that, interest at the rate of 5.50% will accrue from September 13, 2010 through the payment date. This interest rate and administrative fee were set by the City Council in Resolution 7135. On or after October 14, 2010, we will forward the assessment roll to Ramsey County for collection with the 2011 property taxes. Respectfully submitted, ___________________________ Mark Beer RESOLUTION NO. 7670 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA ADOPTING A SPECIAL ASSESSMENT LEVY FOR PRIVATE IMPROVEMENTS IN AREA B/C OF THE STREET AND UTILITY IMPROVEMENT PROGRAM WHEREAS, the City has received signed petition and waiver agreements from individual property owners agreeing to the proposed assessments in the attached assessment roll for private improvements in conjunction with the Area A Street and Utility Improvement Project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Mounds View that: 1. Such proposed assessment roll, a copy of which is attached hereto and made a part hereof, is accepted and shall constitute a special assessment against the lands named therein, and each tract of land therein is hereby found to be benefited by the private improvement in the amount of the assessment levied against it. 2. The assessments as adopted and confirmed shall be payable in equal annual installments over a period of one (1) year if less than $1,000 and five (5) years if greater than $1,000, the first of the installments to be payable on or before the first Monday in January 2011, and shall bear interest at the rate of five and one half (5.5) percent per annum from September 13, 2010. To the first installment shall be added interest on the entire assessment from September 13, 2010 through December 31, 2011. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may at any time prior to the certification of the assessments to the County Auditor pay the whole of the assessment, with interest accrued to the date of payment, to the City Treasurer, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the City Treasurer the entire amount of the assessment, with interest from the date of adoption of this resolution through the date of payment, such payment must be made before October 14, 2010, or interest will be charged through December of the succeeding year. 4. The City Administrator shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the county, and such assessments shall be collected and paid over in the same manner as other municipal taxes. Adopted this 13th Day of September 2010. ______________________________ Joe Flaherty, Mayor ATTEST: ______________________________ Jim Ericson, City Administrator (seal) Item No: 7F Meeting Date: Sept 13, 2010 Type of Business: Council Business City of Mounds View Staff Report To: Honorable Mayor and City Council From: James Ericson, City Administrator Item Title/Subject: Resolution 7661, Approving the Promotion of Deputy Police Chief Thomas Kinney to the Position of Police Chief Introduction: Deputy Chief Tom Kinney was appointed the interim police chief by action of the City Council on October 26, 2009. The resolution effectuating the appointment, Resolution 7516, provided Deputy Chief Kinney with an interim wage increase of 10% over his then current rate of pay to compensate him for the additional responsibilities. Discussion: Based on City Council direction, no action was taken regarding the vacancy until after the first of the year in 2010. The Council indicated a desire to “promote from within” and as such, the vacant Chief’s position was posted internally, with minimum requirements noted as follows: • Four-year degree in police science, law enforcement, criminal justice, public administration or a related field • Ten years experience in law enforcement, five of which must be in a senior management position • Must have a commitment to the management philosophy of promoting excellence and quality customer service. Two candidates responded to the positing—Deputy Chief Kinney and Sergeant Steve Menard. Both candidates were interviewed by a panel consisting of Administrator Ericson, Assistant Administrator Crane, New Brighton Public Safety Director Bob Jacobsen and Erin Rian from the League of MN Cities. The interview panel forwarded their recommendation to the Police Civil Service Commission who, on June 8, 2010, certified an eligibility list consisting of two names, Tom Kinney and Steve Menard, in that order. Based on the eligibility list, the City Council directed staff to initiate the background check and evaluations on Deputy Chief Kinney. The following background checks and evaluations were conducted, all with positive results: • Background investigation and reference check, conducted by Setter & Associates • Psychological evaluation, conducted by Gary L. Fischler & Associates • Medical evaluation, conducted by Multicare Associates Kinney Appointment Report Sept 13, 2010 Page 2 Proposal: Deputy Chief Kinney is presently at Step 5 of the Deputy Chief pay range ($39.38 per hour), plus, with the interim status, Deputy Chief Kinney is receiving an additional 10% to account for the responsibilities associated with both positions. Thus, with the extra 10%, his current rate of pay is $43.32 per hour. The following lines represent the current steps and rates of pay for the Police Chief position: Step 1 Step 2 Step 3 Step 4 Step 5 $35.81 38.05 $40.28 $42.52 $44.76 While it would be a disincentive to offer a wage less than what Deputy Chief Kinney is presently earning, it would also seem inappropriate to hire Mr. Kinney at Step 5 of the Chief’s range, the next highest rate of pay, inclusive of the interim pay adjustment. Rather than decreasing Mr. Kinney’s salary, an option would be to continue his present wage of $43.32 per hour and forego the typical step increase at 12 months. The step increase to Step 5 would not occur until after 18 months, and only upon a satisfactory performance evaluation. Recommendation: I recommend the City Council approve the attached Resolution 7661 which approves the promotion of Deputy Chief Thomas Kinney to the position of Mounds View Chief of Police, maintaining his present rate of pay of $43.32 per hour for 18 months, after which point Mr. Kinney would be eligible for a wage and step increase to Step 5, presently $44.76 per hour. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council does hereby promote Deputy Chief Tom Kinney to the position of Police Chief, effective September 13, 2010, subject to the provisions and terms of the Personnel Manual, with the following noted compensation, benefits and conditions: W age / Step: $43.32 per hour Step Increases: Step 5 on March 13, 2012, subject to satisfactory evaluation and City Council approval Use of vehicle: In lieu of a car allowance, Mr. Kinney shall have access to a police vehicle which can be taken home. Said vehicle shall not be used for personal trips or vacations. No Contract: Neither this resolution nor the Personnel Manual shall constitute an employment contract. The Police Chief is a non-union, exempt position serving at the will and pleasure of the City Council. The ordinance made numerous changes to both Chapter 502 and 503 regulating liquor sales in the City of Mounds View. Discussion: One of the changes in Ordinance 843 addressed liquor sales on Sundays. The City Council deleted reference to an additional license that could be obtained by establishments to provide for sales of alcohol from 10:00 am to noon on Sundays. It was staff’s understanding that no licensed entity served alcohol during this time, since no establishment had ever requested the additional license. It has since come to our attention that both Mermaid and Moe’s have a history of serving alcohol on Sundays before noon, usually in conjunction with a brunch or some other food service. Neither owner was aware that a separate license in addition to the Sunday license was needed to serve for the two hours before noon on Sundays. (The State of MN allows for the sale and service of alcohol beginning at 10 am Sundays.) While the original language, now deleted, seemed fairly straightforward, clearly it had been interpreted otherwise by two of our licensed establishments. Summary: Based on direction provided by the City Council at their work session on September 7, 2010, the attached ordinance is available for introduction and first reading. Second reading and adoption will be scheduled for September 27, 2010. Respectfully submitted, ________________________ James Ericson City Administrator ORDINANCE NO. 851 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE AMENDING CHAPTERS 502 AND 503 OF THE MOUNDS VIEW CITY CODE REGARDING LIQUOR SALES ON SUNDAYS THE CITY OF MOUNDS VIEW ORDAINS: SECTION 1. The City Council of the City of Mounds View hereby amends Title 500, Chapter 502, Section 502.12 of the Mounds View Municipal Code by adding the underlined language and deleting the stricken language as follows: Subd. 2. Sunday Sales: Notwithstanding the provisions of subdivision 1 of this Section, restaurants, clubs, bowling centers and hotels with seating capacities for at least 30 persons and which hold an on-sale intoxicating liquor license may serve intoxicating liquor between the hours of ten twelve o’clock (10:00 12:00) A.M. noon and two o’clock (2:00) A.M. on Sundays in conjunction with the sale of food upon obtaining a Sunday Sales license from the City. SECTION 2. The City Council of the City of Mounds View hereby amends Title 500, Chapter 503, Section 503.10 of the Mounds View Municipal Code by adding the underlined language and deleting the stricken language as follows: 503.10: HOURS OF SALES: No sale of 3.2 percent malt liquor shall be made on any Sunday between the hours of two o’clock (2:00) A.M. and ten twelve o’clock (10:00 12:00) A.M. noon. No sale shall be made between the hours of two o’clock (2:00) A.M. and eight o’clock (8:00) A.M. on any other day. (1988 Code §101.09; Amended, Ord. 717, 7-28-03) SECTION 3. In accordance with Section 3.07 of the City Charter, the following summary shall be printed in the official City newspaper in lieu of the complete ordinance: On May 10, 2010, the City Council adopted Ordinance 843 which amended Chapters 502 and 503 of the Mounds View City Code relating to liquor licensed establishments. One such revision related to hours of sales on Sundays. On September 27, 2010, the City Council adopted Ordinance 851 which reinstated the allowance to sell alcohol between the hours of 10 am and noon on Sundays, consistent with Minnesota Statutes. A printed copy of the ordinance is available for inspection during regular office hours at the office of the City Administrator. SECTION 4. This ordinance shall take effect and be in force 30 days from and after its passage and publication, in accordance with Section 3.09 of the City Charter. Item No: 8B Meeting Date: September 13, 2010 Type of Business: CA Administrator Review : ____ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Thomas Kinney, Deputy Police Chief Item Title/Subject: Resolution 7669 Authorization to Enter into a Grant Agreement with the Minnesota Department of Public Safety, Office of Traffic Safety Safe and Sober Project Discussion: The Mounds View Police Department in partnership with the Ramsey County Sheriff’s Department, the Police Departments of New Brighton, Roseville, Maplewood, St. Anthony, North St. Paul and White Bear Lake applied for and have been awarded a grant from the Department of Public Safety for the Safe and Sober project. The purpose of the grant is to allow agencies to conduct highly publicized, overtime enforcement projects addressing traffic safety issues with an emphasis on impaired driving and passenger protection use. The Safe & Sober Grant Program provides funds to law enforcement agencies to conduct stepped-up traffic enforcement and community outreach. The grant funds are available on a cost reimbursement basis; costs are reimbursed after they are incurred and paid by the grantee agencies. The project year begins on October 1, 2010 and ends on September 30, 2011. The Mounds View Police Department will use the funds from the grant to pay officers to work various traffic enforcement projects. The Mound View Police grant award for 2010-2011 is $30,000.00. Recommendation: Staff recommends the council authorize the acceptance of this grant agreement. Respectfully Submitted, __________________ Thomas Kinney Deputy Police Chief RESOLUTION NO. 7669 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION AUTHORIZING THE MOUNDS VIEW POLICE DEPARTMENT TO ENTER INTO A GRANT AGREEMENT WITH THE MINNESOTA DEPARTMENT OF PUBLIC SAFETY, OFFICE OF TRAFFIC SAFETY FOR THE SAFE AND SOBER PROJECT FROM OCTOBER 1, 2010 THROUGH SEPTEMBER 30, 2011 WHEREAS, the Mounds View Police Department along with the Ramsey County Sheriff’s Department, New Brighton Police Department, White Bear Lake Police Department, Maplewood Police Department, St. Anthony Police Department, North St. Paul Police Department and the Roseville Police Department have applied for and been awarded a grant from the Department of Public Safety Safe and Sober program to conduct highly publicized, overtime enforcement projects addressing traffic safety issues; and, WHEREAS, the grant funds will cover overtime personnel costs incurred through Safe and Sober enforcement efforts which will be reimbursed to the city of Mounds View; and, WHEREAS, all allocated manpower resources will be on a volunteer basis, and will be on an officer’s scheduled time off. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council does hereby authorize the Mounds View Police Department to enter into a grant agreement with the Minnesota Department of Public Safety, Office of Traffic Safety for the project entitled SAFE & SOBER COMMUNITIES during the period from October 1, 2010 through September 30, 2011. NOW, BE IT FURTHER RESOLVED that the Interim Chief of Police of the Mounds View Police Department is hereby authorized to execute such agreements and amendments as are necessary to implement the project on behalf of the Mounds View Police Department.
