for an Off Sale Intoxicating Liquor License Renewal for
ABC Liquor located at 2840 County Highway 10
In accordance with Section 502.08 of the Mounds View City Code, a public hearing is required
for all liquor license renewals.
502.08: LICENSE HEARING:
No issuance of a new license, transfer of an existing license, renewal of an existing license,
issuance of temporary special event or banquet licenses, or special outdoor consumption
endorsements for the sale of intoxicating liquor on-sale or off-sale, club, Sunday sales or
on-sale wine shall be hereafter granted by the Council until a public hearing has been
conducted by the Council after published notice in the official newspaper at least ten (10)
days in advance of the hearing.
The City of Mounds View issued an intoxicating liquor license for ABC Liquor in June of 2008,
and their renewal is before the Council for consideration. ABC Liquor’s Intoxicating Liquor
License will expire June 30, 2009. The notice of this public hearing was sent out to residences
within a 350 feet radius, and the Notice of Public Hearing was published in the City’s official
newspaper. Property taxes on this property are current.
ABC Liquor has submitted their city liquor license application materials and the applicable fees.
The following investigations and inspections have been conducted to determine whether there is
cause for the City to the above referenced intoxicating liquor license application:
Police Inquiry and Investigations (Mounds View Police Department)
The Mounds View Police Department has issued a satisfactory report for ABC Liquor. ABC
Liquor did pass their yearly liquor compliance check with the police department. Staff has
submitted a background check application on the owner of ABC Liquor to the Minnesota
Department of Criminal Apprehension. Staff has not received yet received the background
check report. The liquor license will be contingent on a satisfactory background check.
Attached are the police calls on this property for your reference.
Utility Billing Inquiry (City of Mounds View)
The Finance Department has issued a satisfactory report for ABC Liquor.
Fire Inspection (City of Mounds View Fire Marshall)
The City’s Fire Marshall has issued a satisfactory report for ABC Liquor.
Recommendation:
Staff recommends that the City Council open the Public Hearing for public input. Staff
recommends approval of this business license contingent on a satisfactory background check.
If this renewal is approved, the time period of this license will be July 1, 2009 to June 30, 2010.

Resolution Approving an Off-Sale Intoxicating Liquor License for ABC Liquor
WHEREAS, ABC Liquor’s Intoxicating Liquor License expires June 30, 2009; and
WHEREAS, all City of Mounds View business licenses must be approved by the
City Council; and
WHEREAS, staff recommends approval of ABC Liquor’s Intoxicating Liquor
License, pending a satisfactory background check with the Minnesota Department of
Criminal Apprehension.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council

Police Inquiry and Investigations (Mounds View Police Department)
Staff has submitted a background check application on the owner of Vino and Stogies to
the Minnesota Department of Criminal Apprehension. Staff has not yet received the
background check report. The liquor license will be contingent on a satisfactory
background check.
Vino & Stogies failed their compliance check, which was conducted by the Mounds
View Police Department. The employee did plead guilty to a Gross Misdemeanor for
selling intoxicating liquor to a minor. The owner of Vino and Stogies will be present at
this meeting to discuss this violation.
Utility Billing Inquiry (City of Mounds View)
The Finance Department has issued a satisfactory report for Vino & Stogies.
Fire Inspection (City of Mounds View Fire Marshal)
The Fire Marshal has issued a satisfactory report for Vino & Stogies.
Recommendation
Staff recommends opening the Public Hearing for Public Comment. If the City Council
does decide to approve this liquor license, then this license will not be issued until a
satisfactory background check is received from the Minnesota Department of Criminal
Apprehension. The time period for this license will be July 1, 2009 to June 30, 2010.

for Taiko Sushi Bar located at 2394 Highway 10 in
Mounds View
In accordance with Section 502.08 and 503.08 of the Mounds View City Code, a public
hearing is required for all liquor license renewals.
502.08: LICENSE HEARING:
No issuance of a new license, transfer of an existing license, renewal of an existing
license, issuance of temporary special event or banquet licenses, or special
outdoor consumption endorsements for the sale of intoxicating liquor on-sale or off-
sale, club, Sunday sales or on-sale wine shall be hereafter granted by the Council
until a public hearing has been conducted by the Council after published notice in
the official newspaper at least ten (10) days in advance of the hearing.
Pro Association, Inc., (dba Taiko Sushi Bar) has not submitted the city liquor license
application materials and the applicable fees. The owner of Taiko Sushi Bar did leave a
voice mail message to Staff on Friday, May 29, 2009, and stated that he would have
the materials for Staff by Monday, June 1, 2009. Staff contacted the owner directly by
phone the morning of June 1st, to reconfirm his intentions. The owner stated to Staff
that he would have the materials and payment no later that the morning of June 2nd. As
of Thursday, June 4, 2009, at 4:00 p.m., no applications materials were submitted.
The notice of this public hearing was sent out to residences within a 350 feet radius,
and the Notice of Public Hearing was published in the City’s official newspaper.
Recommendation
Staff recommends opening the Public Hearing for Public Comment, and postpone this
item to the next City Council Meeting on Monday, June 22, 2009. Staff will keep the
City Council updated on the status of this license.

Moe’s has submitted their city liquor license application materials (to include an outdoor
liquor endorsement to sell liquor on their outdoor deck), and the applicable fees. The
following investigations and inspections have been conducted to determine whether
there is cause for the City deny the application:
Police Inquiry and Investigations (Mounds View Police Department)
The Mounds View Police Department has issued a satisfactory report for Moe’s. Staff
has submitted a background check application on the owner of Moe’s to the Minnesota
Department of Criminal Apprehension. Staff has yet to receive a background report.
The liquor license will be contingent on a satisfactory background check.
Utility Billing Inquiry (City of Mounds View)
The Finance Department issued a satisfactory report on Moe’s for their utility bill.
However, Ramsey County Property Records show that Moe’s continues to be
delinquent in their property taxes for 2008 and half of 2009. In accordance with
§502.04, subd. 2(b), no intoxicating liquor license shall be granted for operation on any
premises on which taxes, assessments, utility bills or other financial claims of the
Municipality are delinquent or unpaid. Attached is a letter submitted to by the owner,
outlining his plan to pay the county property taxes in full.
Fire Inspection (City of Mounds View Fire Marshal)
The City’s Fire Marshal has issued a satisfactory report on Moe’s.
Recommendation

The Finance Department states that the establishment owes money on their utility bill
($2,028.55). In addition, Ramsey County Property Records show that The Mermaid
continues to be delinquent in their property taxes for 2008 and half of 2009. In accordance
with §502.04, subd. 2(b), no intoxicating liquor license shall be granted for operation on any
premises on which taxes, assessments, utility bills or other financial claims of the Municipality
are delinquent or unpaid.
The City Council may approve this liquor license contingent on payment of their utility bill and
property taxes, or the City Council may deny renewal in accordance with Section 502.04(b).
Please be advised that this is not the first time they have been delinquent with their utility bills
and property taxes. Attached are the Minutes relating to their last liquor license renewal on
June 9, 2008.
Clerk-Administrator Ericson contacted Dan Hall (owner of the Mermaid) to discuss a plan on
making full payment on property taxes and City utility bill. Mr. Hall indicated on June 4, 2009,
that The Mermaid will have everything paid in full when the hotel is bought. According to Mr.
Hall, the closing on the purchase of the hotel transaction take place next week.
Fire Inspection (City of Mounds View Fire Marshall)
The Fire Marshal has not inspected The Mermaid. Please refer to her letter dated May 11,
2009.
Recommendation
Staff recommends opening the Public Hearing for public comment. The City Council could
either approve their liquor license contingent on a satisfactory background check, utility bill,
property tax full payment, receipt of their Certificate Liability Insurance, and a satisfactory fire
inspection or deny renewal in accordance with Section 502.04(b) of the Mounds View City
Code. Staff has a resolution prepared in case the City Council wishes to approve the liquor
license contingent on a satisfactory background check, utility bill, property tax full payment,
receipt of their Certificate of Liability Insurance, and a satisfactory fire inspection. Staff would
further recommend setting a deadline for payments on delinquent property taxes and utility
bill. If approved, the time period for this license will be July 1, 2009 to June 30, 2010.
