The Police Civil Service Commission has certified an active eligibility list for the position based on previously conducted testing components, which included written testing, and interviews. The top three candidates on the list are as follows: 1. Kenneth Koss 2. Travis Minke 3. Greggory Neumann The #1 candidate in standing on the eligibility list, Kenneth Koss, has successfully completed all of the required testing procedures, which included written testing, background examination, physical examination, psychological examination and physical agility testing. Staff have personally met and interviewed Mr. Koss and recommends he be hired to the position. Recommendation: Staff seeks council approval to proceed with appointing Kenneth Koss to the Position of Police Officer at the step one rate of pay for the position ($3,587.47 per month) in accordance with the Law Enforcement Labor Services Contract, which governs the compensation for this position. This hire is to be effective on August 3, 2009. Respectfully submitted, Mike Sommer Chief of Police RESOLUTION NO. 7480 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA APPOINTING KENNETH KOSS TO THE POSITION OF POLICE OFFICER WHEREAS, the City Council has approved the hiring of a Police Officer for a current vacancy in the Police Department, and the Police Civil Service Commission has approved the procedures for establishing an eligibility register to fill this vacancy, and; WHEREAS, the approved hiring procedures consist of a competitive written examination, resume scoring, oral interviews, background investigations, physical examination, psychological examination, and physical agility testing, and; WHEREAS, the Police Civil Service Commission has certified the eligibility list for the opening, and Kenneth Koss is the top candidate standing on the eligibility register, and his background investigation, physical, psychological, and physical agility testing have all been successfully completed, and; WHEREAS, staff of the Police Department have met with Mr. Koss, and the Chief of Police recommends he be appointed to the position of Police Officer. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council does hereby appoint Kenneth Koss to the position of Police Officer effective August 3, 2009 at the step one rate of pay as stipulated in the Law Enforcement Labor Services contract for the position. The discovery of a needed code amendment comes about in many ways, such as, something in the community or general practices change, staff discovers that there is a better way to operate, issues or requests from residents or city attorney recommendations. Discussion: Here is a list of code amendments that staff is proposing: • Remove the word “decks” from allowed encroachments (Chapter 1104.01 Subd. 5c) – the code allows certain things to encroach beyond the building setbacks, such as a front door stoop or steps, bay windows, chimneys, eaves, awnings, etc. The code currently has the word decks in this list, but the code also has a specific setback requirement for decks. As such, it should be removed from this section. • Clarify and simplify accessory building height (Chapter 1106.03 Subd. 1b) - The Code currently states that accessory buildings shall not exceed 15 feet in height, which is measured at the midpoint between the eave and highest peak. This is very difficult for staff to verify during an inspection, and confusing for property owners when they are designing the building. Staff would like to change the code for accessory buildings in residential districts - the height shall not exceed 20 feet or that of the principal structure, whichever is less, as measured at the highest peak. • Remove the R-O, Residential-Office zoning district (Chapter 1111)– there has been only one property (2865 Highway 10) that was zoned R-O. The City recently rezoned this property to R-4 for the senior living development. Thus, there are no properties zoned R-O in Mounds View, and staff does not foresee the City using this zoning designation in the future. As such, staff recommends that the City eliminate this zoning designation from the City Code. Code Amendments Staff Report Page 2 • Flammable liquids in Industrial districts (Chapter 1116.02) – the Planning Commission began talking about this matter last year. Currently, the City allows the storage of flammable liquids in industrial districts as a conditional use (above ground storage or over 25,000 gallons below ground). This discussion began after a business contacted the city because they wanted to have a 1,000-gallon tank of propane. City staff thought it was unnecessary for them to go through the CUP process for that size tank but as the code reads, any amount of above ground storage requires a CUP. The Planning Commission came to a consensus to change the code to require conditional use permits only for a combined total amount of 800 gallons or more of flammable liquid. • Address 36 inch or less satellite dish antennas (Chapter 1103.18) – the city code currently addresses satellite dishes, but it was written before the small three foot diameter dishes became common. These small dishes must face south without any obstructions which has caused residents to install them anywhere in their yards, including close to the street. The Planning Commission did not want to regulate them very much, but felt that they should not be installed in the right-of-way, on easements or in wetlands. • Daycare centers in churches (Chapter 1106.04 Subd.1) – every church in Mounds View except for Bethlehem Baptist (PUD) is zoned R-1 (churches are allowed as a conditional use in R-1 districts), and at least one of the churches operates a daycare center. The city code allows licensed daycare facilities in R-1 districts as a permitted use but only if there are 12 or fewer persons, otherwise larger daycare centers are only allowed in R-2 or higher districts. The church daycare centers probably have more than 12 children in them, but they do not appear to cause problems for the neighborhoods. Staff recommends adding language to the R-1 zoning district to allow daycare centers to operate in public or semi-public buildings (churches, schools or community centers) as a conditional use. Due to the long length of some of the amendments, staff requests that the City Council see the attached ordinances to review the proposed language changes. The changes are indicated by deleting the stricken language and adding the underlined text. The Planning Commission reviewed and discussed all of these code amendments and recommended approval on June 17, 2009 and July 1, 2009. Building Height. Building height is to be measured from the average established curb level or from the average ground level at the building line, whichever is higher, to the top of the cornice of a flat roof, to the deck line of a mansard roof and to the mean distance of the highest gable on a pitched or hipped roof to the highest roof surface. SECTION 2: Chapter 1104 of the Mounds View Zoning Code is hereby amended with the proposed additions underlined and the deletions stricken as follows: Chapter 1104.02, Subd. 3, Height Limitations: f. The height of any detached accessory building shall not exceed 20 feet or that of the principal structure, whichever is less. Accessory building shall not exceed fifteen twenty feet (20’) or that of the principal structure, whichever is less, in height and shall be five feet (5’) or more from all lot lines of adjoining lots. Accessory buildings 120 square feet or under shall be three feet (3’) or more from any other building or structure on the same lot. COUNCIL BUSINESS 1 A. Business Registration Program. 2 1. Ordinance 821 (First Reading). 3 4 Building Official Osmonson noted the staff report contains the background and recommendations 5 related to the Business Registration Program. Community Development Director Roberts 6 presented the three actions required to implement such a program and requested Council direction 7 on the fee to be charged. Building Official Osmonson advised that staff research of other 8 communities with such a program found fees range from $25 to $100 per year. 9 10 Council Member Mueller asked whether the fees charged by other cities covered costs. Building 11 Official Osmonson stated Fridley’s fee is in the higher range and based on the size of business, 12 Spring Lake Park and St. Paul charge a flat fee. Council Member Mueller noted another city felt 13 the program was vital so the type of business and possible hazards were known in advance of an 14 emergency response. She stated her support to institute this Program and charge a fee to offset the 15 City’s costs with an “early bird” incentive for a lower fee in subsequent years if signed up the first 16 year. 17 18 Council Member Gunn stated her support of this Program and noted it can be considered the same 19 as the liquor license or cigarette license fee. She suggested a $25 annual registration fee. 20 21 Mayor Flaherty agreed with the need to have business contact information on file and that the Fire 22 Department should already know of hazard information. He stated he supports the City becoming 23 more efficient but does not support an annual fee or budget increase in 2009. Rather, he suggested 24 a voluntary registration program. 25 26 Council Member Stigney stated if the cost is not borne by the businesses, it would be borne by the 27 residences and this program relates to the business community. He outlined a sliding scale fee 28 schedule to create incentive for businesses to register and penalty if the business does not register 29 by a set date. 30 31 Council Member Hull stated his agreement with Council Member Stigney’s suggestion and 32 charging a penalty if registration is not made by a set date. He noted that after the initial software 33 cost, the City’s only cost is for maintenance. 34 35 Community Development Director Roberts suggested implementation on January 1, 2010, to allow 36 adequate time to inform businesses. 37 38 Council Member Mueller asked about the perceived value for the business owner. Building 39 Official Osmonson stated it is a safety service and noted that Mounds View does not charge for a 40 fire permit. Clerk-Administrator Ericson added that the more efficient City staff can be, the higher 41 level of service can be offered to residents, which benefits all. 42 43 MOTION/SECOND: Mueller/Gunn. He noted that future Councils can determine what 40 an on-going fee should be. 41 42 Clerk-Administrator Ericson stated he believes there would be a better response if there was not a 43 registration fee and a penalty could be charged if not registered by a set date. Resolution 7477, Approving the Preliminary Feasibility Report for Area C of 16 the Street and Utility Improvement Program. 17 18 Joe Rhein, Bonestroo Consulting Engineer, presented the preliminary feasibility report for Area C 19 of the Street and Utility Improvement Program noting it includes resident input and the Streets and 20 Utilities Committee recommendation. He indicated the project is financially feasible at an 21 estimated cost of $3,209,900 and recommended approval. 22 23 Mayor Flaherty stated his support to proceed with Area C. They Mayor likes to maintain parking 24 one side of Edgewood Drive with the off-street trail option (Option C). However, he is not 25 convinced a sidewalk is needed along Woodcrest Drive based on resident input. Mr. Rhein noted 26 that Edgewood Drive Option C is preferred by Edgewood Middle School and staff’s recommended 27 Option. Those 2005 cost estimates were updated, based on a construction inflation 40 cost index at $1,533,000, or an increase of 18.6%. He noted that the Council wanted to consider 41 accelerating Area C and combine it with Area B to take advantage of competitive prices. Resolution 7479, Approving Non-Standard Street Design Recommendations 10 for Areas B and C of the Street and Utility Improvement Program. 11 12 Public Works Director DeBar presented the recommendation of the Streets and Utilities 13 Committee for non-standard street design for Areas B and C, which had been discussed at the 14 Council’s July 6, 2009, Work Session. He explained that Council approval would allow the 15 engineering consultant to proceed with the final design and plan/specification preparation phases 16 of this project. It was noted that the Council would consider Edgewood Drive standards on 17 August 24, 2009. 18 19 Council Member Mueller reviewed the alignment for the proposed sidewalk and stated she thinks 20 the money could be better spent. Public Works Director DeBar stated the Street Task Force 21 recommended that sidewalks be addressed as part of street projects if identified in the 22 Comprehensive Plan. Council Member Mueller stated she normally would go with the Committee 23 recommendation but this sidewalk would also require retaining walls and most residents in that 24 area do not favor the sidewalk so she would like it eliminated from Woodcrest Drive. 25 26 Jim Battin, Streets and Utilities Committee Chair, stated their recommendation is primarily 27 because the easement between Bona Road and the School is heavily used by students to get to 28 Woodcrest. He pointed out that County Road H is a major street with a 45 mph speed limit and 29 visibility for eastbound traffic is limited. Mr. Battin explained the Committee recognizes there are 30 some issues with the north side sidewalk due to retaining walls but was concerned for students that 31 may use the easement. 32 33 Mayor Flaherty stated students use the easement because they do not want to go out of their way 34 one block south. Mr. Battin agreed students prefer the shortest route. Mayor Flaherty noted the 35 trail plan was created in 1992 and not been updated since that date. 36 37 Council Member Gunn recommended the money be used instead to better mark the crosswalks on 38 County Roads H and H2 that are used by students to get to the school. Public Works Director 39 DeBar stated staff intends to pursue a Safe Route to School Grant to provide advanced warning on 40 County Road H. He noted that money is budgeted each year for trailway development and 41 expansion so a sidewalk could be added in the future to Woodcrest Drive, if the Council so 42 decides. 43 44 MOTION/SECOND: Mueller/Gunn.
