Discussion Resolution 7482 provides for a payout of Mr. Burda’s vacation time. In accordance with the AFSCME Union Contract, Mr. Burda is authorized a vacation time payout totaling $249.91. This is calculated as 8.9 vacation hours times his hourly rate of $28.08. Recommendation Staff recommends severance payment for Don Burda in the amount of $249.91 in accordance with the AFSCME Union Contract. Respectfully submitted, _____________________________ Desaree Crane RESOLUTION NO. 7482 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION APPROVING SEVERANCE FOR DON BURDA, TEMPORARY BUILDING INSPECTOR WHEREAS, Don Burda has resigned from the Mounds View Community Development Department effective July 23, 2009; and WHEREAS, the balance of accrued and unused vacation is 8.9 hours as of July 23, 2009; and WHEREAS, Don Burda’s current rate of pay of $28.08 per hour; and WHEREAS, the maximum potential payout of vacation time will be 8.9 hours x $28.08 = $249.91. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City Council approves a one-time payout of vacation time not to exceed $249.91. Adopted this 10th day of August, 2009. ___________________________________ Joe Flaherty, Mayor ATTEST: ___________________________________ James Ericson, Clerk-Administrator (seal) Item No: 7G Meeting Date: August 10, 2009 Type of Business: Action Administrator Review: ________ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Ken Roberts, Community Development Director Item Title/Subject: Consideration of a Zoning Code Amendment to allow Car Washes in a B-2, Limited Business, Zoning District Planning Case: TX2009-001 Introduction The applicant, Leon Theis, owns the property and fuel station business at 2280 County Road I, known as “The Station.” Mr. Theis would like to add a car wash to his existing fuel station, which is zoned B-2, Limited Business. Currently the city code only allows car washes as a conditional use in B-3, Highway Business, or higher zoning districts. Mr. Theis has applied for a zoning code amendment to add car washes as a conditional use in B-2 zoning districts. Background Prior to 2007, fuel stations were also only allowed in B-3 or higher zoning districts. The Station was built in 1959 as “Gulf” and existed until two years ago as a legal nonconforming use. In 2007, in order to bring the fuel station into compliance, Mr. Theis purchased additional property so that his parcel would meet the minimum fuel station lot size and applied for a zoning code amendment to allow small “neighborhood fuel stations” as a conditional use in B-2 districts. Recognizing that “The Station” is a much smaller, non- chain, neighborhood-based fuel station, both the Planning Commission and City Council preferred to amend the code to allow this type of small fuel station in B-2 districts rather than rezone the property to a more intense use. Discussion For this car wash proposal, Mr. Theis’ options were to either ask the City to rezone the property to B-3, or have the City amend the code to allow car washes in a B-2 zoning district. City staff thought that the best choice would be to have Mr. Theis apply for a zoning code amendment. If the property were rezoned to B-3, this would allow a lot more intense types of businesses to locate here if The Station ever closed. The other properties in the city that are zoned B-2 are: Fedor’s Market - 5491 Adams Street (adjacent to The Station), ABC Liquor/Simon’s Sports - 2840 Highway 10, Western Bank – 2711 Highway 10, Winiecki Insurance - 2704 Highway 10, Office building -2677 Highway 10, Silver View Plaza – 2540 Highway 10, Mounds View Animal Hospital - 2625 Highway 10, Cars Bike Shop/Radio City – 2661 County Road I, and Vino & Stogies – 2345 County Road H2. Zoning Code Amendment staff report August 10, 2009 Page 2 Zoning Code Amendment Staff is proposing that the City Council amend the Zoning Code to allow a car wash in a B-2 zoning district as a conditional use. Staff has drafted the proposed addition to Chapter 1113, using the same language for car washes as stated in the B-3 zoning district. 1113.04: CONDITIONAL USES: The following are conditional uses in a B-2 District (requiring a conditional use permit based upon procedures set forth in and regulated by Section 1125.01 of this Title): Subd. 8. Car washes (drive through, mechanical and self-service); provided, that: a. The architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing buildings or area as to cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot. b. Magazining or stacking space is constructed to accommodate that number of vehicles which can be washed during a maximum thirty (30) minute period and shall be subject to the approval of the Director of Public Works/City Engineer. c. At the boundaries of a residential district, a strip of not less than ten feet (10') shall be landscaped and screened in compliance with subdivisions 1103.08(l) through (5) of this Title. d. Each light standard island and all islands in the parking lot shall be landscaped or covered. e. Parking or car magazine storage space shall be screened from view of abutting residential districts in compliance with subdivisions 1103.08(l) through (5) of this Title. f. The entire area, other than occupied by the building or plantings, shall be surfaced with material which will control dust, drainage and erosion which is subject to the approval of the Director of Public Works/City Engineer. g. The entire area shall have a drainage system which is subject to the approval of the Director of Public Works/City Engineer. h. All lighting shall be hooded and so directed that the light source is not visible from the public right of way or from an abutting residence and shall be in compliance with Section 1103.09 of this Title. i. Vehicular access points shall be limited, shall create a minimum of conflict with through traffic movement and shall be subject to the approval of the Director of Public Works/City Engineer. j. Public Feedback Staff mailed notices regarding this planning case to all property owners within 480 feet of 2280 County Road I informing them of the proposed actions and the Planning Commission meeting date. As of Thursday, August 6 2009, staff has received four comments (by phone and email) regarding the car wash at The Station. Three of the comments were in support of the car wash, and one was from The Alano Society (adjacent business to The Station). They were asking questions about traffic flow on the site, and after speaking with City Staff, appeared to be agreeable with the proposal. Planning Commission Action The Planning Commission held a public hearing on Wednesday, August 5, 2009 and recommended approval (6-0, Meehlhause absent) of the zoning code amendment and the conditional use permit and development review. Deadline for Action The City accepted this planning application on July 16, 2009 and in accordance with MN Statute 15.99, the City shall make a decision within 60 days of application acceptance. The deadline for action for this request is September 14, 2009. Recommendation Staff recommends the City Council review the proposed code amendment. Staff will be presenting the Second Reading of Ordinance 833 along with the Conditional Use Permit and Development Review requests at the August 24, 2009 City Council meeting. BE IT FINALLY RESOLVED that the Mounds View Planning Commission directs staff to forward this resolution to the City Council prior to approval of the minutes. The City Council of the City of Mounds View, pursuant to the recommendation of the City of Mounds View Planning Commission, has hereby determined that Chapter 1113 of the Mounds View Zoning Code be amended to add car washes as a conditional use in a B-2 zoning district by deleting the stricken language and adding the underlined text as follows: Chapter 1113.04: Conditional Uses: Subd. 9. Car washes (drive through, mechanical and self-service); provided, that: a. The architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing buildings or area as to cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot. b. Background Earlier this year, the City Council decided to leave the local Convention and Visitor’s Bureau (CVB), Visit Minneapolis North (VMN). Six other cities also chose to leave VMN. VMN will no longer represent the seven cities listed below, effective December 31, 2009. VMN will continue to represent Maple Grove, Brooklyn Park and Brooklyn Center beyond 2009. 1. Fridley 2. Blaine 3. Coon Rapids 4. Anoka 5. Shoreview 6. Mounds View 7. Ham Lake Discussion At the August 3rd Work Session, the City Council reviewed and discussed the draft Articles of Incorporation and By-Laws for a new CVB. This new CVB would represent the above listed seven cities and potentially the City of New Brighton once their new hotel is completed. The City of Coon Rapids Attorney’s office drafted the proposed Articles of Incorporation and By-laws with input from the seven cities, New Brighton and the respective lodging properties. Both documents have been updated since the Council reviewed them on August 3rd. The latest versions of these documents are attached for the Council’s review. The City Councils for each of the seven cities are currently (or soon will be) considering resolutions to approve the draft Articles of Incorporation and By-Laws. Once all of the cities have passed these resolutions, the City Councils from each City will appoint the first Board of Directors for the new CVB. The purpose of each City Council approving draft Articles of Incorporation and By-Laws is to establish the CVB. The new Board of Directors will finalize the By-Laws. The new CVB will be funded the same way as VMN is now funded. VMN is funded by a 3% lodging tax. Per State Statute, this tax is collected from the respective lodging properties and 95% of those funds are passed onto the CVB. The remaining five percent is used by each City to cover administrative expenses. The Blaine Jaycees discontinued gambling operations at Robert’s Sports Bar and Entertainment due to the decrease in gambling profits. Discussion: All supporting documentation is on file with the City and their non-profit status is on file with the Minnesota State Gambling Control Board. The organization is in compliance with all requirements of the City Code. The Spring Lake Park Lions would be the only charitable organization holding a charitable gambling license at Robert’s Sports Bar and Entertainment. Recommendation: Approve attached Resolution 7485 Respectfully submitted, _____________________________ Desaree Crane RESOLUTION NO. 7485 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION GRANTING A CHARITABLE GAMBLING PERMIT FOR THE SPRING LAKE PARK LIONS TO CONDUCT CHARITABLE GAMBLING AT ROBERT’S SPORTS BAR AND ENTERTAINMENT IN MOUNDS VIEW WHEREAS, the Spring Lake Park Lions have requested that the City Council allow them to conduct charitable gambling at Robert’s Sports Bar and Entertainment; and WHEREAS, the Gambling Control Board requires that the local unit of government pass a resolution specifically approving or denying requests to conduct charitable gambling; and WHEREAS, the Spring Lake Park Lions are in compliance with all requirements of the Mounds View Municipal Code with regard to charitable gambling regulations. NOW, THEREFORE, BE IT RESOLVED, that the Mounds View City Council does hereby authorize the Spring Lake Park Lions to conduct charitable gambling at Robert’s Sports Bar and Entertainment. These survey questions were to be available for residents to answer at the Festival in the Park event, scheduled for Saturday, August 22, 2009. The booth would be open from 2pm to 7pm, and be staffed by members of the City Council. Discussion Below are draft survey questions for your review. Staff added an additional survey question in regard to Town Hall Meeting attendance. Due to the decline in resident participation, Staff felt it would be helpful to seek information from residents on why they were not able to attend the Town Hall Meeting in April. Each question below would be on a separate piece of paper. 1. At the Saturday, April 25, 2009, Town Hall Meeting, the City experienced low resident participation. If you did not attend the Town Hall Meeting, could you tell us why? The City of Mounds View is considering changing the Mounds View City Code to allow homeowners to have 3 dogs per residential property. Currently, the Mounds View City Code only allows 2 dogs per residential property. As stated in the current Mounds View City Code, you would be required to submit for a residential kennel license if you owned more than 2 dogs.
